The Wildwood City Board of Education invites applications from interested school board

attorneys to provide legal services as per the following:

School District Legal Services

The Wildwood City School District is comprised of two schools housing students in grades 1

through 12 and an annex in a leased facility for grades Pre-K and K. The District currently

serves approximately 870 students, including high school students received from Wildwood

Crest, North Wildwood and West Wildwood. The district has comprehensive programs for

special education and English language learner students.

I. Scope of Services

For planning and illustrative purposes for the response to this RFP, the following

represent services that will be required on an as needed basis. This list is in no way

inclusive of all tasks that may be required, but is intended to alert the bidder to the areas

deemed particularly relevant to the duties of the position with special attention to New

Jersey Law.

To provide legal counsel and advice to the Board and approved representatives of

the school district.

Timely advice and counsel on emergent matters. Counsel is expected to respond,

at least verbally and to be followed in writing, within a maximum of twenty-four

hours when an inquiry is made by the Board or the Administration.

Written legal opinions upon request.

Initiate and/or defend lawsuits as necessary and at the direction of the Board.

Prepare all necessary legal documents.

Attend all regular meetings for the Board, and attend its meetings with

committees or third parties upon request. Provide alternate coverage when

necessary for meetings.

Work cooperatively with legal counsels of insurance companies, consortiums, or

other collective with whom the Board may be affiliated.

Represent the school district in all judicial and/or administrative proceedings in

which the district or any of its board members, administrators, or agents may be a

party or have an interest.

Provide written, timely notification to the Board of changes in school law or state

regulations including court and administrative decisions that might impact upon

the operation of the school district.

Advice, consultation and opinions with respect to issues relating to the Open

Public Meetings Act and Open Public Records Act.

Conduct in-service programs on specified legal issues for appropriate staff

members upon request.

Fulfill other legal duties as are commonly accepted and assigned.

II. Interview

The Board of Education reserves the right to interview any or all of the applicants

submitting a proposal. Although interviews may take place, the proposal should be

comprehensive and complete on its face. The Board reserves the right to request

clarifying information subsequent to submission of the proposal.

III. Selection Criteria

The Board of Education will evaluate proposals using the following criteria:

Experience with New Jersey public school districts.

Availability of staff to meet the legal services needs of the district.

Interview, if conducted.

Fee proposal.

IV. Minimum Qualifications

Experience in public school law, public school litigation and familiarity with

N.J.S.A. and N.J.A.C.

Experience as a public school attorney in the State of New Jersey.

Be licensed to practice law in the State of New Jersey and be a member of the Bar

in good standing.

Include a list of any other professional qualifications, experience and/or

credentials you feel are relevant to this RFP.

V. Proposal

Each attorney is required to submit the following information in its proposal:

Form 1 - Recommendations from at least three clients.

Form 2 - Proposed fee structure.

Form 3 - Affirmative Action Statement.

Form 4 - Political Contribution Disclosure Form.

Form 5 - Stockholder Disclosure Certification.

Form 6 - Other services or proposals your firm would offer.

Board of Education.

Business Registration Certificate

o N.J.S.A. 52:31-44 requires that each vendor awarded a contract submit

proof of business registration with the submission. Proof of registration

shall be a copy of the respondents Business Registration Certificate

(BRC).

Information beyond the minimum requirements may also be submitted.

All proposals are to be submitted in writing in a sealed envelope and must be clearly

marked “School District Legal Services”. Proposals must be received no later than May

21, 2019 at 2:00 PM prevailing time. Proposals are to be submitted to:

The Board of Education intends to appoint the successful firm at the June 19, 2019

meeting. Services of the selected firm will commence July 1, 2019.

Fee Structure – Legal Services

The Board of Education would prefer an annual flat fee structure for routine district

business, including attendance at monthly Board of Education meetings. Meetings are

tentatively scheduled for the third Wednesday of each month, beginning at 5:30 p.m. for

a thirty-minute work session followed by a regular meeting at 6:00 p.m. Meetings

average about one hour, including the work session. Litigation and special education

issues would be billed hourly, as necessary. An alternate fee structure would be to

provide an hourly billing for all services including attendance at meetings.
