1.0 INTRODUCTION

1.1 Background

Bursa Malaysia Berhad’s (“Bursa”) building was officially opened in September 1997 and Bursa’s

trained auxiliary policemen were entrusted to take care of security for all Bursa Assets and Properties.

Due to increasing responsibilities over the years and with tenants occupying the building, the

management of Bursa had decided in the year 2006 to partially outsource security guards to take care of

its senior management residences, perimeter guarding , basement car parks and annex building.

The purpose of this exercise is to source for a qualified security vendor to provide uniformed security

guards with a good track record to handle daily security duties and security threats.

1.2 Purpose of the Document Bursa is seeking proposals from participating vendors for Security Guard Services at its main building

located at Exchange Square, Wisma Chase Perdana, Chairman and CEO’s Residence.

This Request for Proposal (RFP) is made available STRICTLY for the purpose of the preparation of

the proposal only and is to be returned with your RFP or notification of no bid. The information in this

document is CONFIDENTIAL and all information contained should not be divulged to third parties

without the written consent of Bursa.

Vendors who intend to participate in the RFP are required to address all requirements stated in this

document with regards to the outsourcing of Security Guards including articulating the alternatives to the

requirements that cannot fully be met.

2.0 STANDARDS AND INSTRUCTIONS This section covers the standards and instructions that should be followed by the vendors in response to

this RFP.

Please read this RFP specification carefully. Vendors are advised to read the whole of this document.

2.1 Instructions to Prospective Vendors 2.1.1 Vendors are invited to submit their proposals to address the requirements contained in this RFP

document.

2.1.2 Vendors must submit the proposal in two (2) parts:

2.1.3 The proposals must be enclosed in a SEALED envelope, drop to the Tender Box and must be

addressed to:-

2.1.4 The proposal must reach Bursa not later than 5.00pm, Monday, 9 September 2013. Late

responses will not be entertained.

2.1.5 The top left-hand corner of the envelope must be marked “RFP For Security Guard Services”.

The same title must be used for any subsequent written correspondence including electronic

communication (e-mail).

2.1.6 The proposal and all accompanying letters and documents must be submitted in Five (5) copies

and provide one (1) softcopy in CD (please provide financial in Microsoft Excel Format).

2.1.7 English and/or Bahasa Malaysia is to be employed in any correspondence and technical

literature. Vendors must explain how the proposed solution meets every technical requirement

specified and how the proposed components fit into the entire solution.

2.1.8 Vendors assume the risk of the method of dispatch chosen. Bursa assumes no responsibility for

delays caused by any delivery service. Postmarking by the due date will not substitute for actual

proposal receipt. Do not deliver proposals by facsimile transmission or other telecommunication

or electronic means.

2.1.9 Suggestions for additional features or alternatives, within the general framework of this

specification, are welcomed.

2.1.10 Prices must be quoted in Ringgit Malaysia (RM) on a per item basis. The schedule of prices must

be quoted on the basis of outright purchase.

2.1.11 Bursa reserves the right to accept or reject any proposal submitted. Bidders must be duly licensed

in accordance with all governing authorities and to the satisfaction of those authorities.

2.1.12 Proposals must be signed by an official who is authorised to act on behalf of the organisation

submitting this proposal.

2.1.13 Vendors are required to sign a non-disclosure agreement with Bursa. There shall not be any

breach of information and the vendor is expected to keep all dealings with Bursa strictly

confidential. All information and records compiled by the vendor shall be for the use of this

project only and for no other purpose and must not be reproduced elsewhere.

2.2 Tender Deposit 2.2.1 A refundable tender Deposit of RM10,000 by way of banker’s cheque drawn in favor of Bursa

Malaysia Berhad is required on submission of tender documents. 2.2.2 The Tender Deposit of unsuccessful vendors will be refunded while intimating the rejection of

the tender. The Tender Deposit of the successful vendor will be adjusted towards Performance

Bond.

3.0 VENDOR RESPONSE REQUIREMENTS

Vendors must address the following Tender Response Requirements:

3.1 Eligible Criteria for Evaluation Vendors must provide and describe the following specific criteria to be evaluated which include:

3.1.1 Company Profile and Organisation - provide brief statement of the company’s capabilities, a

brief company history, mission statement and organisational summary including personnel who

would be directly responsible for the management of this project.

3.1.2 Management Approach - Details of how your company will organise this project and title of the

person who will have overall responsibility. Include organisation chart depicting the structure of

your company operations.

3.1.3 Personnel Selection Process – Describe how recruitment and selection of security guards are

accomplished. All personnel under this RFP must be thoroughly trained, experienced and

qualified to perform the work which they are assigned.

3.1.4 Development and Retention of Personnel – Describe methods and initiatives designed to

promote employee retention.

3.1.5 Total Quality Management – Outline administrative controls, plans and process to monitor and

assure contract compliance of security services including methods of quality control,

administration audits, job inspections /performance programs, corrective action planning and

follow up reporting.

3.1.6 Cost proposal and Invoicing – Provide billing rates for the following ;

• Security Guard

Include overtime, Public Holiday policies and rates. Propose Invoicing frequency and procedures

and applicable discounts.

3.1.7 Training Programs – Describe the pre-training programs in place to support this project and

formal continuous training to be provided. Please include trainer’s profile.

3.1.8 Value Added Features – Indicate features or programs not covered elsewhere in the response

which are offered to enhance your company’s ability to manage this project.

3.1.9 Insurance – The successful vendor shall carry and maintain with respect to any work or service

to be performed at Bursa’s facility within ……….days of commencement of services to Bursa,

insurance written by a responsible insurance company to provide the following:

• Worker’s Compensation as required by applicable statuette and employers liability

insurance

• Commercial General Liability

• Excess – umbrella Insurance, including terrorism coverage

Please include a sample certificate of insurance.

3.1.10 Transition Plan – Submit a projected Transition plan from implementation if awarded the

contract to include tasks and time frame. Include a list of all individuals assigned to your

transition team with current information, telephone numbers and email addresses.

3.1.11 References – provide at least three (3) client references whose facilities are comparable in size,

profile and security service hours. Include company name, address, contact person and contact

number.(Appendix III)

3.2.2 Required Services – provide uniformed guards for a variety of services, implementation and

security objectives according to policies and procedures of Bursa which may include but is not

limited to the following general tasks :

• Entry and egress access control

• Roving patrols of interior and exterior of building perimeter areas and residential

perimeter at Senior Management residential security stations

• Visitor and staff identification verification

• Log in daily operating and incident reports

• Monitoring and responding to building intrusion detection systems and alarms and fire

detection equipment

• Responding as necessary to other life safety duties as identified by Bursa’s security

procedures

• To follow and adhere to all scope of duties describe by Bursa in the agreement which

will be enforced on the commencement of services (Appendix V)

3.2.3 Valid Documents - Vendor to ensure all security guards provided must have valid documents

such as NRD Identification cards for locals and valid work permits for foreigners (who are

allowed by law to perform security guard services).

3.2.4 Security Orders & Procedures – Vendor shall develop a comprehensive set of general

security procedures and site specific responsibilities prior to the commencement of the contract

and must be reviewed and approved by Bursa’s management within thirty (30) days from

commencement of services to Bursa.

3.2.4 Uniform – Vendor shall provide uniforms and other protective clothing necessary to support

continuous performance of contract requirements. Vendor is also responsible for the daily

appearance of security personnel engaged.

3.2.5 Additional Duties – Vendor shall respond if necessary to accommodate additional duty hours as

may be requested by Bursa.

4.0 Terms of Contract and Conditions 4.1 The term of this contract if awarded shall be for a two (2) year period with an option to renew

for another one (1) year unless terminated by either party with a thirty (30) days written notice.

4.2 Deployment of security guards is to be completed within a period of one (1) month commencing

from the date of acceptance of the offer by Bursa.

4.3 Any delay in deployment over the stipulated period will attract a penalty of the monthly contract

payment per day subject to maximum of the monthly contract payment per month.

4.4 Daily late deployment of guards: Penalty will be based on no of hours of delay within the

particular shift.

5.0 Format of the Tender Proposal for Submission The written proposal must be in the following format;

6.0 Schedule of Prices

6.1 Vendors are to submit their schedule of prices for the solution in the format provided. This

submission must be separated from the Vendor Response Requirements.

6.2 The proposal must include the detailed costing for the following areas:

6.2.1 Security Guard Services Fee

6.3 Bursa reserves the right to decide whether to proceed with the project or not and shall not be

liable to pay any other amount in respect of the project.

6.4 The schedule of prices must be separated from the tender proposal. Vendors who fail to complete

their submissions clearly or as required, or which are found misleading to Bursa, whether

intentionally or otherwise, may be disqualified from the tender process.

7.0 FINAL AGREEMENT This VENDOR RESPONSE REQUIREMENTS will be part of the final agreement. Vendor must not

include any items in their proposal which they are not prepared to include in the contract.

We, the undersigned, having read the instructions to prospective vendors relevant to this proposal, make our

proposal in accordance and compliance herewith in the following terms, that is to say:

1. We have examined the RFP for the requirement of Security Guards Services, and we hereby offer to

address the requirements as per this RFP to deliver and provide guards in accordance with the associated

RFP.

2. We submit herewith literature, which is fully descriptive of the expertise we are offering together with

the completed Schedule of Prices. We understand and agree that the statements made in this costs

summary are subject to verification under the provisions of the RFP or the proposal process.

3. Whereas it is understood that Bursa Malaysia reserves the right to accept or to refuse this proposal,

whether it be lower or higher than any other proposals or of the same amount, the undersigned agrees that

this proposal shall remain valid and shall not be withdrawn one hundred and twenty (120) days from the

final date fixed for the submission of proposals and Bursa Malaysia may have the price validity extended

for another sixty (60) days if required provided always that Bursa Malaysia has the benefit of the lower

price. It is agreed that no other term, conditions or stipulation shall be imposed by us after the said date.

Appendix V

Sample of Agreement and Scope of Duties

AN AGREEMENT made the day of 2013

a company incorporated in Malaysia and having its Head Office at

(hereinafter called “the Company”) of the other part and of BURSA MALAYSIA BERHAD

15th Floor, Exchange Square, Bukit Kewangan, 50200 Kuala Lumpur. , Bukit

(hereinafter called “the Customer”) of the other part. WHEREAS:

(i) The Customer has requested the Company to provide it with the services specified in part (II) of the Schedule 1 hereof (hereinafter referred as “the said Services”)

(ii) The Company has agreed to accept the Customer’s request upon the terms and

conditions hereinafter contained.

NOW IT IS HEREBY AGREED as follows:- 1. The Company shall on and from the day of 2013

provide the Customer with the said services in respect of the premises known as per part (II) of Schedule I (hereinafter called “the said Premises”).

2. Subject always to clause 9(i), this Agreement shall remain in force for a minimum

period of twenty four (24) months from __ __ of 2013 and thereafter from month to month until determined by either party giving the other ONE month’s notice in writing (by registered post) term.

3. General provision as to service chargers and terms of payment

(i) The Customer shall pay to the Company the said Services the agreed charges specified in the Part (I) of Schedule 1 of Services of this agreement on a monthly basis “Fees”. Such Fees shall be made within thirty days (30) from the date of receipt of invoice.

(ii) All invoices submitted by Company to the Customer shall be deemed to be correct and shall not be disputed after fourteen (14) days of the date of the receipt of the said invoices.

4. General provision as to liability of Company

(i) The Company in providing the said Services and in acting for the purposes of the Agreement herein will be responsible for the selection or employment of the personnel and be in charge of such said Services;

(ii) Keys for which a written receipt shall have been issued by the Company, and for which keys

shall have been taken into the custody of the Company’s employees the provision of this Agreement shall apply.

5. General provision as to notification of claims.

(i) In the event if any occurrence which may give rise to a claim against the Company, the

Customer shall within twenty-four (24) hours of such occurrence lodge a police report and shall inform the Head Office of the Company in writing by registered post within three (3) days of such an occurrence, furnishing the Company a copy of the police report and all particulars relevant to the said occurrence in particular of any loss or damage.

(ii) Any claim by the Customer against the Company must in any event be made in writing by registered post against the Company within fourteen (14) days of such occurrence-giving rise to the claim.

6. General provision as to amount of liability.

If pursuant to the provision set out herein, any liability on the part of the Company shall arise (whether under the express or implied terms of this Agreement, or at Common Law or at any other way) to the Customer for any loss or damage of whatever nature arising out of or connection with the provision of, or purported of, or failure in provision of the Services, such liability shall be limited to the total fees herein for a term of (2) two years (i.e total Fees x 2) in respect of any and all incident arising during the term of this agreement.

7. The Customer undertakes that it will not during the period of subsistence of the Agreement or

within one (1) year next after the termination thereof (however the same may be determined ) knowingly offer employment in any security capacity to any person who shall be or shall have been an officer or servant to the Company during such period.

8. Any variation to this Agreement shall only be effective if in writing and signed by the duly authorised representatives of the Parties.

9. (i) This Agreement shall continue in force for the duration and may be terminated at any Party

giving (1) month notice in writing to the other without assigning any reason whatsoever.

(ii) Either party may terminate this Agreement where one party is in breach of any material provision of this Agreement at any time by giving twenty four (24) hours notice to the defaulting party specifying the nature of the alleged breach.

(iii) The Agreement, may be determined by either party forthwith if the other party commit any breach of its obligation hereunder or (being an individual) shall commit an act of bankruptcy, or (being a corporation) go into liquidation other than for the purposes of reconstruction or amalgamation or shall suffer the appointment of a Receiver of any of his or its property or income or make any deed or arrangement with or composition for the benefit of any of his or its creditors.

10. Unless otherwise specifically provided for herein, the failure or delay of any Party to enforce at

any time any of the provisions of this Agreement, or the grant of any time or indulgence, shall not be deemed either a waiver of such provision or of the right of that Party thereafter to enforce each and every provision of this Agreement.

11. The stamp duty for this Agreement shall be paid by the Company. 12 This Agreement shall :-

(i) supersede the provisions of any other previous Agreement, warranty or representation

made or given relating the said services as described. (ii) constitute the entire Agreement between the Customer and the Company and shall not

incorporate or be deemed to incorporate the provision of any extraneous document.

(iii) Be governed by the laws of Malaysia and parties submit to the exclusive jurisdiction of the courts of Malaysia.

13. The rates charged in this Agreement may not be varied unilaterally by the Company at any time

during the subsistence of this agreement. IN WITNESS WHEREOF the parties hereto have hereunto set their hands the day and year first above written.

2. Security Coverage / Duty Hours / Manpower 2.1 Security coverage at the building / residence or area of responsibility is 24 hours. 2.2 Duty hours for guards on duty at the building /residence / area of responsibility are as follows:

2.3 Guard(s) on duty are not allowed to leave the area of responsibility at any time during duty hours

or at the end of their duty if there is no replacement. They should call their supervisor and wait for a replacement to be sent.

3. Scope of Duties and Responsibilities

3.1 Guards on duty must ensure proper handing over of duties and must log and record all details into the station book.

3.2 During handling over of duties guard(s) must ensure the building /residence / area of responsibility

are secured and the Guard House is neat and clean. 3.3 Guard(s) must ensure and report any loss or damage of equipment to the Company Supervisor. 3.4 To ensure all vehicles accessing the building /residence / area of responsibility are authorised. 3.5 Guards are responsible whilst on duty for the safety of the occupants, and workers at the

building/residence / area of responsibility. 3.6 To open/close the main entrance gates during entry and exit of vehicles at the residence and area

of responsibility. 3.7 To log movements of vehicles in / out of the building /residence / area of responsibility into the

station book including that of visitors and contractors. 3.8 To ensure maids employed at the residence do not bring in their friends or relatives. 3.9 Ensure proper surveillance if there are contract workers doing work at the building /residence /

area of responsibility and make sure all equipment and other items is properly checked and given permission to be taken out.

3.10 Always be alert and ready to act if confronted by any threat from outsider.

3.11 Always alert and careful on any suspicious movement by characters lingering outside the

perimeters of the building /residence / area of responsibility. 3.12 To verify and obtain permission before allowing any visitor/s to the building / residence or area of

responsibility. If prior information has been given on visits verify before allowing them in. Log in such visits in the station book for reference.

4. Patrolling

4.1 Guard (s) must conduct patrolling around the building / residence / area of responsibility perimeters every (1) hour. Patrolling hours should be staggered to avoid any detection of patrolling time by suspicious elements.

4.2 During patrolling guard (s) must check and ensure perimeters are secured and to report any

damage found on the perimeter fencing to the Aux Police Sergeant / Company Supervisor for follow up action.

5. Keys Control

5.1 All keys related to the Building / Residence / area of responsibility’s gates and doors must be kept safely in the guard house and logged in the station book.

5.2 During handing over of duties guard (s) must ensure the details of keys are recorded in the station

book and handed over properly. 5.3 Daily usage of keys must be recorded at all times in the station book. 5.4 Guards are strictly prohibited to duplicate or take any of the building / residence or area of

responsibility’s keys out of the premise. 5.5 Key (s) damaged or lost should be reported immediately to Bursa Malaysia’s Security Unit for

follow up action. In the event if damage or lost of key (s) is due to the negligence of guard (s) on duty the security company concerned should bear all cost of replacing the key (s).

6. Action During Emergencies 6.1 During Fire Outbreak

6.1.1 To ensure any small fire is extinguished by using fire extinguisher or water.

6.1.2 Report to the supervisor for assistance and call the Fire and Rescue Services if fire becomes uncontrollable. Emergency telephone numbers will be provided at each of responsibility.

6.1.3 To immediately evacuate occupants to a safer place. 6.2 Threat or Burglary Attempt

6.2.1 Raise alarm (blow whistle) and warn occupants if you see any theft or burglary in progress. Immediately contact the Police. Emergency telephone numbers will be provided at each area of responsibility.

6.2.2 If you see any suspicious characters loitering around the perimeters immediately call the

police and provide the necessary information. Alert the occupant. 6.2.3 Ensure safety of occupants. 6.2.4 Report all incidents to the Bursa Security and your immediate superior for further action.

Bursa Malaysia reserves the right to review, amend and change any instruction written above from time to time.
