Required Personal Documents for H-1B/TN/E-3 Petitions Individuals not yet at VT in H-1B/TN/E-3 status
Please note that if any of your original documents are in any language other than English, a word for word translation must be included. USCIS does not require translations to be created by a translation agency.
All translations must contain the following statement: “I certify that I am fluent in both English and [foreign language] and that the attached translation in English of [name of applicant]’s [name(s) of document(s)] is a true and accurate translation of the original document(s) in [foreign language].” And, the translation should be signed and dated by the translator.

Dependents: your spouse and unmarried, minor children (under age 21) are eligible for H-4 status as a dependent of someone in H-1B status. If your dependents are currently outside of the US, no paperwork is required; your family can apply for their H-4 visas on the basis of your H-1B Approval Notice. If they are in the US and need a change of status to H-4, or an extension of their current H-4, a Form I-539 must be filed for the first dependent and Form I539A for each additional dependent. ISS can include the H-4 application with the H-1B petition, but the form must be completed by the beneficiary, i.e. your family members. See www.uscis.gov/i-539 to download the form and instructions on how to complete the form. Together with the signed I-539 for the first H-4 dependent and the signed I-539A for each additional H-4 dependent, you will need to provide copies of the following support documents:
Biographic page of passport
Marriage certificate + translation, if applicable (for spouse)
Birth certificate + translation, if applicable (for children included in the application; do not needthis for spouse)
Current and previous immigration status documents
I-94 record
US visa stamp from passport
Check for USCIS filing fee: $370. The $370 fee is for all dependents. However, each dependentmust also include $85 for the biometrics processing fee, regardless of age (example: if only oneH-4 dependent, then $370 + 85; if two H-4 dependents, then $370 + $85 + $85)
o Checks should be made payable to “US Department of Homeland Security”
o Can include one check with the $370 fee plus all $85 biometrics processing fees, or issuea separate check with the biometrics fee(s)
USCIS will schedule all H4 applicants for a biometrics appointment at a USCIS ApplicationSupport Center near the address the H4 applicants listed as their home address. You shouldreceive this notice at the address listed in the H4 soon after USCIS receives the H-4 application.For more information on the H4 biometrics requirement, please see this USCIS announcement:

We will need the original I-539, with original signatures (not a scan). Form I-539 is not used for H-1B status. Do not include the H-1B beneficiary on this form.
ISS may need several other documents, depending on your individual situation. If so, we will request these documents.
