Dissemination and Consultation And Entitlement Matrix

The meeting disseminated the NNP1 policies to three villages, upper reservoir (2UR), Thathom district,

Xaysomboon that will affected from the inundated.

1 April 2014 held at Pou village.

2 April 2014 held at Hatsamkhone village.

3 April 2014 held at Piengta village.

On behalf of the NNP1, the community relation and development team mentioned four purposes such as:

1. Disseminate and consult how to calculate the affected compensation unit rate from the NNP1.

2. Disseminate and entitlement matrix the affected compensation unit rate from the NNP1.

3. Disseminate and consult the grievance process.

4. To collect data to add in document on social safeguard, livelihood development plan and

vulnerable information.

A meeting chairman, Thathom district governor opened and had opinion mentioned the agreement

statement on movement plan of the NNP1 PAP. The compensation policies are advised to the villagers

how to compensate, resettle and all of that is strategic plan to develop economic of the Lao PDR. The

chairman mentioned the NNP1 will be natural resource and will gain revenue to the villagers, particularly,

there are five places in Thathom such as: Namsan 1, Namsan 2 but dam development can be negative and

positive on livelihood and agriculture production area. The NNP1 is the priority that Lao Gov. gave. The

other projects also had affected and compensated to the people and had policies, but the projects had

benefit for people and resettlement to other areas. The chairman mentioned the NNP1 had the

transparency and higher rate than the other projects. If the severely affected people, as known from

concession agreement (CA), the project will have better policies twice. The government defined new

relocations for the NNP1 if the PAP do not go with the project plan, the project will have condition,

appropriate and the project team, will explain calculations for discussion and agreed unity. Chairman

compared compensation to many projects. This project calculated like this, another one calculated like

that. So the rate is different, but the NNP1 will explain details to people know how to calculate.

1. Four ways of calculations.

Compensation rate that paid by other projects are under other conditions similarly

up dating based on inflation.

At current, Market study is proceeded free or research institute or NGO.

Information on statistic market rate of state informed each month.

Truth rate observation in the affected villages.

From four resources will define the actual price for the affected people, this way, authority village with

people agree and said that it was fair transparent to people. Explanation policies, entities that the affected

got from compensation of the NNP1 is people have unity and agree to the policies, additionally, the

project presented the NNP1 grievance principles on grievance mechanism, conflict solution procedure

and people understand.

After explanation, discussed with village authorities and people they understood, realized that the NNP1

has policies that are fair and correct to the affected people.

Comment from Pou villagers

After listening from the morning till afternoon, villagers would like to ask how to compensate. As

remembered, it will be better than the previous one. After comparing to the NNP2, a little known from its

compensation. If the NNP1 is over the previous one, it will be happy. The second issue would like to

propose whether any compensation if not moved? We live in the house if we would like to change this

area. Agriculture job would like to changed, feeding animals for living:

1. Comments of Mr Thidpheng, village Front Line: would like to ask this agreement.

- Heritage law, three households in a house go to the bank, will money be divided into three parts?

- Compensated land, during dried period can the people go to do farming?

2. Mr Nouyengxiong: proposed dad grave (Chertongxiong) in the reservoir area to check the flooding

or not?

3. Mr Boungyung: Proposed

a. Some are not moved but wanted to stay in the same, not to leave Pou land but the result loss, the

project will compensate?

b. Compensation is the project and state conduct rightly supposed Mr. A has 1ha will calculate how

many meters, people wants to know the calculation is understand but some people do not understand.

c. Would like the project compensation appropriately, balance, satisfied the affected loss would like

the project takes a minute of the meeting.

4. Mr Touxiong proposed the company to intall electrical post and pull electrical cable for village

households of Pou village that not have electrical use.

Comments from Hatsamkhone villagers

1. Mr Jomphet, head of Hatsamkhone village proposed after explanation document the villagers

agreed on unit rate way but the village would like the project to assist:

a. Assist in repairmen primary school as model of ministry of education.

b. To build the Ou bridge to cross Namngiep.

c. Would like the project to make road with 2 kms within Hatsamkhone and make electrical network.

d. Expand village office bigger and make bus station and market.

e. Would like the project to make GRS water supply at Houaypakhae. GRS water supply is not

enough.

f. Weaving house 50 m x 8 m.

g. New job development for men and women and to be labours for construction projects.

h. Loss compensation from the project.

i. Propose the project to assist policies research six affected houses, at current have four houses

moved before the construction project. How will it be compensated?

Comments from Piengta villagers

Agreed to calculation of the project.

After questionnaire with the villagers agrees calculating tables. At present, people have not any issues if

yes, the village will propose to the NNP1.

At the end, the president stress and some points to the villagers three affected villages:

Dam construction is in need of general vision of the state-government and 8th and 9th main meeting of the

Obiectives:

Consultation on Compensation Unit Rate for PAPs' Possession

:

l. Land type rate

- The rate of common field and clear a rice field was so much different rate 7,000 Kip/m2and 3,500 Kip/m2. ln fact, a new clear rice field use a machine currently. There was not muchstump wood (Tree root). Condition and quality were different. So it should be considered moreto be closed to each other. For the common field rate was suitable 7,000 Kip/ m2.

- Building either closed to the road or not closed to the road. There was so much differentrate between 20,000 Kip and 10,000 Kip/m2

- Question: What was the compensation of Road land (Road) which the villagers sharedand constructed? lt was necessary to be considered owing to its investment.

- Fish pond land saw its compensation based on construction value; the proposed ratewas 15,OOO Kip/m3. For the villagers made fish pond far from the road (no facility to use amachine). lf the compensation rate used, it was still low and required to propose to themanagement team.

The garden land rate 1,500 Kip/m2 was low, proposed to be more such as corn could be plantedtwo seasons.

The villagers still had no comments in the meeting.

2. New clear paddy field rate 3,500 Kip/m2.3. The building land between the land near road 1 D and outside of the road required the

similar rate as it looked like so much ditferent.4. Moreover, it was seen the other land types request more.

Xaysomboun province, the consultation meeting was held at Pou villagers to discuss the

Objectives:

Consultation on Compensation Unit Rate for PAPs’ Possession Main questions/opinions by PAPs and Main answers:

I. Land type rate

The villagers had not got any comments so proposed to the villagers thinking more and

sending it to the team to during working in Thathom in two days.

II. Building Unit price

Noticed that everybody agreed with the unit rate proposed in the meeting, but the

villagers had a question on the risky accommodation because it was flooded in the previous

year. The house was out of the marking, flooding zone or the nature or due to the project

affected and listed the name (the risky house) for the project for study more.

III. The rate of industrious Tree – Fruit tree

The coconut tree rate was proposed more as a result of the low rate

IV. Seasonal plant

The villagers commented that seven (7) sugarcanes per pile requesting more because of the

fact. The large pile had fifteen (15) sugarcanes. The middle pile had six (6) sugarcanes.

The banana was proposed more consideration.

V. Custom and tradition

Proposed the village to list the graves that would be flooding and its performance of religious

rites, then sending to the project.

VI. Addition comments

- Adding more rate of paddy field land from 7,000 Kip / m2 to 10,000 Kip / m2.

- Proposed to add more compensation of fish pond because of the low rate in truth. It cost

two million kip if compensated as the proposed rate over one million; it seemed a low rate and

considered more. (There was no information of the size of the pond in line with their request)

- Requested to separate personal grass land type and the village’s one because of around

forty (40) hectares grass lands. If there was policy, it would like to be considered for the village’s

land.

- This issue would be land type if fixed one made a fence around some points would not

get compensation. For support from the project would have many types such as: Public health

work, education and others based on the grass land policy which would be consulted more if

possible, it would define a new area.

The meeting ended at 11:10 am; some issues were not consulted, proposed in this

occasion was handed over to the village’s consultation immediately and proposed more.

Therefore, this meeting minutes is created as reference for the implementation in the

future.

Weekly meeting with board of village development commissioners

In the morning of 15th September 2015, the NNP1-Thathom district team organized the weekly meeting

with board of village development commissioners at Phiengta village. The participants are from 3 affected

villages by the Project include: B. Pou, Hardsamkhone and Phiengta.

The meeting attend by Mr. Vongphanh DABOUTHDEE; village part ’ se retariat of Thaviengxay village

group, 3 board of village development commissioners and the NNP1-Thathom district team such as:

Representative from Government 1;

NNP1-Thathom district team 5;

- Clarified the pensions rate to involve local authorizations and other involve parts to deeply

acknowledge of the pensions rate.

Minute of Meeting


In the morning of 22th September 2015, the NNP1-Thathom district team organized the weekly meeting

with board of village development commissioners at Phiengta village. The participants are from 3 affected

- Mr. Bounmy show the map that will be increased flooding in 3 affected villages.

2. Activities implementing within this week

- Rice and mushroom planting monitoring;

- Data collection of final year of high school(year 7) for screening who will be met scholarship

condition by Education Team;

- Fisheries data collection workshop for village representative such as: B. Pou 10, B. Hardsamkhone

4 and B. Phiengta 6 by Fisheries team. The NNP1 will support budget and equipment as follow:

scale, book, monitoring form, and salary 70,000 kip per month per person.

3. Next activity plan

- The board of 3 village development commissioners should create their own work schedule;

- NNP1 will prepare schedule in Lao version;

- If organize next meeting, request for Education and Fishery Team to join to addition explain more

about their activities;

- Should inform meeting date earlier, in case head of village group is not available so he/she has

more time to delegate other to join;

- Request for sport equipment for each village of 3 and some other areas;

- Request for necessary materials for 3 villages office;

- Request for computer and internet (email) workshop to focus village staff, due to easier in

coordination.

In the morning of 23rd September 2015, the NNP1-Thathom district team organized the weekly meeting

with board of village development commissioners at Pou village. The participants are from 3 affected


The meeting attend Mr. Vo gpha h DABOUTHDEE; village part ’ se retariat of Thavie g a village group, 3 board of village development commissioners and the NNP1-Thathom district team such as:

some do not know NNP1. So, Mr. Luangthip brief again about this case.


- Request NNP1 disseminate traffic road law to local people and affected from drug abuse;

- Request NNP1 to support sport materials to youth of 3 villages, in case it helps them to avoid drug

abuse;

- Request NNP1 to disseminate about sanitation to community as: how to protect malayria and

others;

- Should inform meeting date earlier, in case head of village group is not available so he/she has

more time to delegate other to join;

- Request for NNP1 to rebuild the temple because NNP1 use the temple to be workplace with local

people;

- The focus villages request for camera to use for taking photo when running activities;

- Request for fish species to the village public pond;

- Request to urgent implement about livelihood program to improve life living of people;

- Improve 3 villages infrastructure;

- Request for doctor specific in disability as soon as possible;

The Quarter III Consultation Meeting

On 12 Jan 2016 from 08:30 to 12:00, in Thathom district Military Hall, Xaysomboon province, the

consultation meeting was held Thathom district Military Hall to discuss the following issue:

In the meeting, the representative of the NNP1, Thathom team, education, health, infrastructure,

vunerable and asset registration team summarized annual report and plan next three - month activities

in the upper reservoir in Thathom district, Xaysomboon province.

1. District coordinator agreed, informed in a detail.

2. The NNP1 coordinator has defined the period and made the meeting schedule quartly for

village and district coordinators.

3. All activity report must be the same as village and district coordinators to acknowledge

which complete or incomplete and when complete.

4. For shrot and quick period of asset compensation.

5. HHs Selection of Mushroom plantation aimed at training and can make production.

6. Where will 15 PAP HHs resettle?

The resolution of the new proposal of 137 graves at Ban Pou.

On January 13rd 2016 by 9:00 to 11:30 at Pou village, Thathom District, Xaysomboun Province. The

consultation meeting on the resolution of the new proposal of 137 graves at Ban Pou and Participants as

:

Total number of Participants: 16 Persons

Number of Woman: 02 Persons

Government staff: 05 Persons

Representative of NNP1 : 03 Persons

Number of Villager: 08 Persons

The meeting was chaired by Madam Phonesy THIPHANTHAVONG, President of LFNC of Thathom

District, She explained all issues and inquired the elders and tribe heads as: the number of 195 old

graves became 137 graves. These buried in one place or many places, the village authorities certified

that 137 graves had selected and had the real data. After that, the Thathom District authorities and

Secretariat of Xaysomboun Province studied, considered and agreed unanimously in the meeting as : It

agreed the project to continue surveying and collecting data in this number, After the completion of

data collection, the meeting will be organized once more during the compensation and ritual.

Therefore the meeting was closed by 11:30, it made this MoM as evidence to implement further.

Grave Mediation of the NNP1

On 13 Jan 2016 at 8:30, at Pou village, Thathom district, Bolikhamxay province, the consultation

meeting was to discuss the following issue:

Mediation Subject as follows:

1. Propose new 195 graves from the villagers

After the meeting considered as follows:

1. Mediation committees checked document that villagers proposed 195 graves and Pou

village committee consideration actually seen 137 graves.

2. The village mediation committees saw collect graves that our mediation opened the

meeting besides there is no evidence and true data.

Monthly Meeting with village Coordination Committee (Piengta, Hatsamkhone and

Piengta)

On 27 Jan 2016, at Pou village, Thathom district, Bolikhamxay province, the consultation meeting

was to discuss the following issue:

1. Development Part

- Village Coordinator in the meeting on 30/12/2015( Mr Bounmy and Mr Somneuk)

- Open the 3rd meeting with district coordination on 12/1/2016

- The team collect the grave data based on the proposal.

2. The technical team

- Asset Registration and compensation team will inform asset items in Feb.

- Public health Piengta village will get maintenance and medical kit support from the NNP1.

- Vulnerable team will interview and recollect two villagers as required ear aids, vulnerable

person from the NNP1 and the household from livelihood re-habitation

Infrasture team:

- Water supply at Pou.

- Update three villages under proceeding step.

- Update the area where 320 m and post on 27/01/2016.

3. Livelihood

- The village trust fund- Tikkham

- The progress of the market-Mr Davone

- The progress of activities development on crop plantation /Mr Vangmua

After that, the NNP1 Mr Bounmy Chitpanya mentioned the infrastructure.

1. Village office Pou, in the budget plan.

2. Piengta village public health will repair and support medical kit.

3. Ou Bridge cross Namngiep 1 will ensure tractors passing conveniently and the project

will maintain within 10 years after electricity sale.

4. Where will the PAPs resettle? Coordinate with above state.

5. Road to the cemetery is not in the budget plan but it is not much in the budget, proposal

can be made.

6. Complete water supply (GFS) at Pou village, permanent GFS of three villages complete in

2016.

Comment-Village Coordination committee

1. Agriculture land determination where not inundated, Hatsamkhone village is reserved

forest at Hatsaykhao

2. Agriculture land determination where not inundated, Pou village proposed district

agriculture, environment and natural office, zone 1 is Namche zone to road D1 (Animal

and paddy field rotate) and zone 2 is Pou water.

3. Agriculture land determination where not inundated, Piengta village, zone D1,

Hatsamkhone, Houayou and Houaydou.

4. Paddy field at Kao, can change to the new land type? To repay village labour.

5. Propose the project fertilizer and pesticide ( in the dry production such as water melon)

as appropriate policies.

6. How will fish pond land get compensated? Not seen in the compensate policy.

7. Tamlee paddy field at Piengta before there is no asset registration not inundated area

but now, there will be inundated at 320 m marking.

8. The NNP1 project assist soil to cover at Pou temple.

Summary

It is agreeable and understandable to each issue in the discussion and chairperson

steered the project coordination committee and village coordination if any questions,

come and discuss with the issue and find solution. For agriculture arranged land, should

arrange the PAPs only.

Therefore, the meeting is closed at 12:00 and as reference for the implementation in the

future.

- Agreed on date to start survey for road and bridge;

The ritual of each ethnic group is as below:

1. Lao Loum ritual:

4 sweet and sour food types

5 pairs and 8 pairs of candle

One pig

one shaman of the village

6 elders of the village

2. Hmong ritual:

11 prophesiers will be prophesied, who will be relocated spirit. 1 prophesier can relocate

spirit of 1 grave per day.

Materials for the ritual based on the selected prophesier as:

-candle

-big animal

-small animal

On March 10th 2016, by 09:00 tc 12:50, at Hatsamkhone village, Thathorn District, XaysombounProvince. lt was organized the consultation meeting on ihe new agriculture zone and determination ofsuspension bridge crossing the Namngiep River vuith 3 villages authoritres( Hatsamkhrone, Pou andPiengta villages), eiders , PAPs of 3 villages, Mr.Phonexay TANOVAN, head of RMU of XaysombounProvince and ihe representative of NNPl PC , The chairrnan of the meeting was Mr. KheunthongXAOVENEKHATV, Districi Pariy comrniitee, President of Par-iy audit of Thathom District, the participantstotalized 173 Persons (As the list of participants attached herewith).

At the meeting, it proposed the bridge construction plan, in the past time, the villagers proposedto construct 2 bridges and besides this, it proposecl the result of the agriculture area survey io preparefor the livelihood restoration of PAPs.

Through the consultation meeting and voteforthe suspension bridge construction crossingNamNgiep River and new agriculture zone with PAPs of 3 villages as:

Agriculture and construction of 15 House hold (HHs) (Pou, Hatsamkhone and Piengta)

On 23 Mar 2016, 08:30 at Pou village, the meeting is open the grave registration of the NNP1 PAPs.

The meeting attends by Mr.Kinthong Veokham; deputy district Party secretariat of Thathom district Party-

State inspector, district Front line, district Women Union and also three districts and RMU as well as the

NNP1.

Document dissemination as follows:

1. Disseminated Close grave registration document – 355/Thathom. On 21/03/2016.

2. Discussed on grave registration of Lao Loum ( Village grave )

3. Declared on grave compensation as the project planned.

After documentation dissemination and Summary:

1. The Mediation committee and villagers that grave agrees to conduct as governor ref.no

1003/Gov.XB 21/08/2015. 3.000.0000 Kip/Grave.

2. Request grave risk from inundated from water to the grave 1 meter will be

compensated due to next erosion.

3. Propose on grave, complete collection as GPS and explain to people for understand

compensation.

Monthly Meeting with village Coordination Committee (Piengta, Hatsamkhone and

Piengta)

On 27 Jan 2016, at Pou village, Thathom district, Bolikhamxay province, the consultation meeting

was to discuss the following issue:

1. Development Part

- Village Coordinator in the meeting on 30/12/2015( Mr Bounmy and Mr Somneuk)

indicatethe understanding village coordination)

- Open the 3rd meeting with district coordination on 12/1/2016

- The team collect the grave data based on the proposal.


- Asset Registration and compensation team will inform asset items in Feb.

- Public health Piengta village will get maintenance and medical kit support from the NNP1.

- Vulnerable team will interview and recollect two villagers as required ear aids, vulnerable

person from the NNP1 and the household from livelihood re-habitation

Infrasture team:

- Water supply at Pou.

- Update three villages under proceeding step.

- Update the area where 320 m and post on 27/01/2016.

3. Livelihood

- The village trust fund- Tikkham



After that, the NNP1 Mr Bounmy Chitpanya mentioned the infrastructure.

1. Village office Pou, in the budget plan.

2. Piengta village public health will repair and support medical kit.

3. Ou Bridge cross Namngiep 1 will ensure tractors passing conveniently and the project

will maintain within 10 years after electricity sale.

4. Where will the PAPs resettle? Coordinate with above state.

5. Road to the cemetery is not in the budget plan but it is not much in the budget, proposal

can be made.

6. Complete water supply (GFS) at Pou village, permanent GFS of three villages complete in

2016.


1. Agriculture land determination where not inundated, Hatsamkhone village is reserved

forest at Hatsaykhao

2. Agriculture land determination where not inundated, Pou village proposed district

agriculture, environment and natural office, zone 1 is Namche zone to road D1 (Animal

and paddy field rotate) and zone 2 is Pou water.

3. Agriculture land determination where not inundated, Piengta village, zone D1,

Hatsamkhone, Houayou and Houaydou.

4. Paddy field at Kao, can change to the new land type? To repay village labour.

5. Propose the project fertilizer and pesticide ( in the dry production such as water melon)

as appropriate policies.

6. How will fish pond land get compensated? Not seen in the compensate policy.

7. Tamlee paddy field at Piengta before there is no asset registration not inundated area

but now, there will be inundated at 320 m marking.

8. The NNP1 project assist soil to cover at Pou temple.

Summary

It is agreeable and understandable to each issue in the discussion and chairperson

steered the project coordination committee and village coordination if any questions,

come and discuss with the issue and find solution. For agriculture arranged land, should

arrange the PAPs only.

Minute of Meeting

Review activity implement May 2016 of the NNP1

With reference to plan and true result in the implementation of the project in the previous month.

On 26 May 2016, 01:30 at Pou village, Thathom district held the activity implementation review meeting,

of three villages, Thathom district of the NNP1. Under Mr.Bounthone Panhkeo; deputy district Party

secretariat and deputy governor of Thathom district and RMU as well as the NNP1.

NNP1 PC: : 4 people

Number of PAPs: 12 people

The meeting context as follows:

1. The meeting gets report implementation result in the previous month(5/2016) by explanation,

indication from each responsible team which contributed as follows:

1.1 Infrastructure construction work.

1.2 Livelihood work

1.3 Land asset work

1.4 Education work

1.5 Health work

2. The meeting is contributed openly and agree unity for implementation as follows:

Infrastructure work:

1. Road work: The Company agreed road survey proposal to the agriculture area and affected

area as requested from Piengta.

- For the affected land, the villagers proposed loss policies compensation from the NNP1.

2. GFS: GFS maintenance construction at Pou village, agree the company plan and the district

will have arranged, habitation and reserved tank again.

In the future, GFS of the village, construction technique such as: survey-design, insufficient water

or other issues as the villagers’ suspect, the NNP1 solves the issues as truth.

Land asset work:

1. The village land: Handover to RMU as central integrated with the related section, company,

village authority and land owners managed to discuss, review and if not clear, requires to

recollect data and solve correctly as law and regulation.

- For four families that not registered the asset they have to wait for the answer.

2. Agriculture land: At first, three points are seen that areas aren’t reserved forest, the district

define development land.

3. For eight HHs received compensation: RMU as central integrated with the company team.

Livelihood updating work

- Handicraft activities: supported from the district and the project. Consider the low unit rate.

Therefore, this is as reference for the implementation in the future.
