EXECUTIVE SUMMARY
A. Introduction
1. This is summary of social safeguards due diligence conducted for Construction of Output 2
of P-ARBS Project and for which the collection of data, meetings with local authorities and
field visits have been conducted in November and December 2018.
2. The proposed project is for rehabilitation and upgrading (R&U) of the secondary irrigation
canals, associated intakes and water control infrastructure in irrigation zone in the Panj Amo
River which is geographically spread over the southern part of the Panj-Amu River that flows
through northern Afghanistan. P-ARBSP covers Five provinces namely; Badaqkhshan,
Takhar, Kunduz, Baghlan and Bamyan.
3. The Project components include rehabilitation and improvement of the secondary irrigation
canals, and associated intakes and water control infrastructure.
4. Under MAIL, the Output 2 includes overall 6 NCB Packages as NCB – 002, 003, 004, 005,
006 and 007.
5. This report covers due diligence of the NCB – 003 is awarded on Oct 26 2018, and 004, 005
and 006 have been surveyed and are under procurement process for contract award.
6. Technical parameters: Rehabilitation of existing bed of canals is from 0.5 meters up to 4
meters wide. Existing right of way (ROW) for most of the secondary canals are about 3
meters on average with access roads along these irrigation channels, which shall be
sufficient for equipment to be used for rehabilitation works.
B. Objectives of DDR:
• The main objectives of this due diligence of this project:
• Identify any LAR impacts in accordance with ADB SPS 2009;
• Access capacity of EA in knowledge and understanding of ADB SPS 2009 and good
practices;
• Propose project arrangements for social safeguards in accordance with ADB SPS 2009.
C. Summary of Findings and IR Categorization
7. Social safeguards due diligence of Output 2 packages NCB – 003 to 006 have been
conducted in November and December 2018 confirmed no LAR issues at present stage.
D. Institutional Implementation and Monitoring Arrangements
8. The Executing Agency for the Project is the Ministry of Finance (MOF) and the
Implementation Agency is Ministry of Agriculture, Irrigation and Livestock. MAIL is

responsible to oversee the implementation of Output 2 through the existing Central Program
Management Office (CPMO) in Kabul in the MAIL.
9. This CPMO is part of an overall ADB PMO responsible for all ADB projects and programs
implemented by the Ministry. Also, for implementation of Output 2 a PIO for basin-level
activities in the river basin agency (RBA) in Faizabad, Kunduz and Taloqan, embedded
within the RBA office to avoid setting up a parallel structure and to strengthen government
institutional capacity.
10. To meet ADB safeguard requirements the CPMO had engaged a full time Environmental
and Social Safeguard Team including Social and Environmental Safeguard Senior Manager,
Social Safeguard Manager, Environmental Specialist and Gender Officer who are in charge
for the Project’s environmental and social performance related to construction / rehabilitation activities.
11. The Environmental and social safeguard specialists are responsible to ensure timely
submission of SEMPs and DDR for review and no objection by ADB and conducting social
safeguard monitoring and audit of construction sites. Expected Outcomes • The project will result improvement to the existing in coming future and to carry their products
to the local markets for income generation purposes. • Decrease conflict among the canal between the farmers and all water users. • Prevent irrigation water loses • To enhance the livelihood and security of the villagers by the supporting of agricultural
production. • To recharge and absorb the ground water and as side activity prevents flooding.

A. INTRODUCTION
12. The proposed project is for rehabilitation and upgrading (R&U) of the secondary irrigation
canals, associated intakes and water control infrastructure in Panj Amo River Basin. The P-
ARBSP covers three Provinces namely; Badakhshan, Takhar, Kunduz, Baghlan and
Bamyan. The project locations maps are shown in Figure 1, 2, 3 and 4.
13. The Project components include rehabilitation and improvement of the secondary irrigation
canals, and associated intakes and water control infrastructure in the above mentioned Panj
Amu River;
14. The list below shows the scope of the works under the P-ARBSP

B. Objectives, Methodologies of this Due Diligence Report and Policy Framework
Objectives:

• Propose project arrangements for social safeguards in accordance with ADB SPS 2009.
Methodologies:
15. For preparing this Due diligence report the project documents including detailed design
which provided by Central Program Management office of Ministry of Agriculture, Irrigation
and Livestock has been reviewed.
16. To identify the social impact of construction work and if there is any LAR issue CPMO Social
Safeguard Manager and the PIO Managers including engineering team have conducted
resettlement surveys in (November and December 2018) of the proposed project sites.
17. Meetings with local authorities and villagers conducted.
18. Besides that, Google maps/satellite map and project drawing reviewed to see if there are
any impacts on the construction site.

ADB SPS 2009
19. The objectives of ADB’s safeguard policy on involuntary resettlement are: to avoid
involuntary resettlement wherever possible; to minimize involuntary resettlement by
exploring project and design alternatives; to enhance, or at least restore, the livelihoods of
all displaced persons in real terms relative to pre-project levels; and to improve the
standards of living of the displaced poor and other vulnerable groups.
20. The three important elements of ADB’s involuntary resettlement policy are: (i) compensation to replace lost assets, livelihood, and income; (ii) assistance for relocation, including
provision of relocation sites with appropriate facilities and services; and (iii) assistance for
rehabilitation to achieve at least the same level of well-being with the project as without it.
21. The policy principles for involuntary resettlement are:
(i) Screen the project early on to identify past, present, and future involuntary resettlement
impacts and risks. Determine the scope of resettlement planning through a survey and/or
census of displaced persons, including a gender analysis, specifically related to resettlement
impacts and risks.
(ii) Carry out meaningful consultations with displaced persons, host communities, and
concerned nongovernment organizations. Inform all displaced persons of their entitlements
and resettlement options. Ensure their participation in planning, implementation, and
monitoring and evaluation of resettlement programs. Pay particular attention to the needs of
vulnerable groups, especially those below the poverty line, the landless, the elderly, women
and children, and Indigenous Peoples, and those without legal title to land, and ensure their
participation in consultations. Establish a grievance redress mechanism to receive and
facilitate resolution of the displaced persons’ concerns. Support the social and cultural
institutions of displaced persons and their host population. Where involuntary resettlement
impacts and risks are highly complex and sensitive, compensation and resettlement
decisions should be preceded by a social preparation phase.
(iii) Improve, or at least restore, the livelihoods of all displaced persons through (a) land-based
resettlement strategies when affected livelihoods are land based where possible or cash
compensation at replacement value for land when the loss of land does not undermine
livelihoods, (b) prompt replacement of assets with access to assets of equal or higher value,
(c) prompt compensation at full replacement cost for assets that cannot be restored, and (d)
additional revenues and services through benefit sharing schemes where possible.
(iv) Provide physically and economically displaced persons with needed assistance, including
the following: (a) if there is relocation, secured tenure to relocation land, better housing at
resettlement sites with comparable access to employment and production opportunities,
integration of resettled persons economically and socially into their host communities, and
extension of project benefits to host communities; (b) transitional support and development
assistance, such as land development, credit facilities, training, or employment
opportunities; and (c) civic infrastructure and community services, as required.
(v) Improve the standards of living of the displaced poor and other vulnerable groups, including
women, to at least national minimum standards. In rural areas provide them with legal and
affordable access to land and resources, and in urban areas provide them with appropriate
income sources and legal and affordable access to adequate housing.

(vi) Develop procedures in a transparent, consistent, and equitable manner if land acquisition is
through negotiated settlement to ensure that those people who enter into negotiated
settlements will maintain the same or better income and livelihood status.
(vii) Ensure that displaced persons without titles to land or any recognizable legal rights to land
are eligible for resettlement assistance and compensation for loss of non-land assets.
(viii) Prepare a resettlement plan elaborating on displaced persons’ entitlements, the income and livelihood restoration strategy, institutional arrangements, monitoring and reporting
framework, budget, and time-bound implementation schedule.
(ix) Disclose a draft resettlement plan, including documentation of the consultation process in a
timely manner, before project appraisal, in an accessible place and a form and language(s)
understandable to displaced persons and other stakeholders. Disclose the final resettlement
plan and its updates to displaced persons and other stakeholders.
(x) Conceive and execute involuntary resettlement as part of a development project or program.
Include the full costs of resettlement in the presentation of project’s costs and benefits. For a project with significant involuntary resettlement impacts, consider implementing the
involuntary resettlement component of the project as a stand-alone operation.
(xi) Pay compensation and provide other resettlement entitlements before physical or economic
displacement. Implement the resettlement plan under close supervision throughout project
implementation.
(xii) Monitor and assess resettlement outcomes, their impacts on the standards of living of
displaced persons, and whether the objectives of the resettlement plan have been achieved
by taking into account the baseline conditions and the results of resettlement monitoring.
Disclose monitoring reports.
22. The ADB SPS 2009 distinguishes three categories of affected persons (APs) or displaced
persons, with variable compensation needs: (i) APs with formal rights: APs with formal
legal rights to land lost in its entirety or in part; (ii) APs with semi-formal rights: APs without
formal legal rights to land lost in its entirety or in part but who have claims to such lands that
are recognized or are recognizable under national law, and; (iii) APs with non-formal rights:
APs who have neither formal legal rights nor recognized/recognizable claims to land lost in
its entirety or in part.
23. For categories (i) and (ii) above, borrowers are expected to provide compensation at full
replacement cost for lost land, structures, land improvements and relocation assistance. For
APs in category (iii) (informal settlers), the borrower/client is expected to compensate all
assets other than land (i.e. buildings, trees, cops, businesses) at full replacement cost. The
risk of opportunistic encroachment on land designated for acquisition by the project is
managed through a cut-off date.
24. Compensation for lost land may be in the form of replacement land (preferable if feasible) or
in cash. When “land for land” compensation is not feasible cash compensation can be valued based on market rates or, in absence of land markets, through other methods (i.e.
land productivity or reproduction costs). Independently from the valuation method used,
compensation is to be provided at “full replacement cost” including: (i) transaction costs; (ii) interest accrued; (iii) transitional and restoration costs; and (iv) other applicable payments, if
any. Compensation for all other assets is to be provided in cash at replacement cost without
deductions for amortization, salvaged materials and transaction costs.

C. SOCIOECONOMIC INFORMATION
25. Agriculture is the major economic activitiy in the project area and providing about 65% to
76% of all employment for their income earning. Traditionally, men are involved in bulk of
the income earning activities. Especially, in almost all cases of agricultural activities men are
involved. However, significant women involvement was visible in livestock rearing. It has
been understood that women in most cases are involved in cattle feeding and watering.
Livestock is another significant income earning source for the households. Some of the APs
in the AHs were found to be engaged in more than one profession.
26. Average income of the households was found to be around 21,353 Afn per month. People
spend relatively higher amount on food items, monthly average 7,575 Afn, followed by 4,912
Afn on non food items. As it has been mentioned earlier that the average family size for the
AHs is 10.5, which means, per personper day income in the affected area is around 70.20
AFN, which is equivalent to USD 1.24. It has been mentioned earlier that the poverty line for
Afghanistan is USD 1 per person per day. Hence, the affected people are living above the
poverty line of Afghanistan.
27. The educational qualification of the household heads is similar to the educational level of the
entire population. Majority of the household heads ranging from 74% to 76% are illiterate,
while a significant number have middle school education as the highest level of educational
attainment.
28. Most of the households have no electricity supply (99%). No household has access to solar
panel or to piped water supply. The other point should be noted that two important rivers
flow through the project area, feeding into the canals – the Kokcha River in the east and
Punj-Amu River in the north-east. All the AHs were found to have the year round access to
road.
29. Majority of the households (81%) live in single storied houses, which are actually mud
houses. Most of them have less than 4 rooms in the households. The floor area for more
than 50% of the families was found to be between 101 and 500 m2. Majority of the houses
are built with earthen floor (75%), earthen wall (80%) and earthen roof (75%).
D. CONSULTATION, PARTICIPATION, AND DISCLOSURE
30. According to ADB SPS (2009), the affected people must be meaningfully consulted and
provided with opportunities to participate in the planning and implementation of LAR. Under
the same principles, affected people have to be informed in an appropriate and timely
manner of the LAR planning process and outcomes, as well as the schedules and
procedures for the preparation and implementation of the LAR activities, including
entitlements, payment procedure, and relocation, if any.
31. Public consultation conducted on two phases, first from July- August and the second round
from 1st to 10th December 2018. The following methodology was adopted for seeking public
concerns on minimizing the impact on project on vegetation (along the canal line) and other
environmental and social issues:

• Because of the security concerns, local professionals (8) were trained in Kabul as
enumerators and sent to project site specially along the canal line with structured
questionnaires;
• All concerned people with particular focus on people owning the vegetation were consulted
together with representative of the water users’ association, irrigation association, local bodies and others
• Consultation meetings were organized in 22 villages along the canal line of Package 2
section one, Package 1 and 3 intakes, to collect concerns and suggestions.
E. Summary of Public Consultation:
• Due to so many number of secondary canals under Output 2 NCB packages, the CPMO
Social Safeguard Manager could only visited the site once yet the PIO teams based in the
project implementation areas had site visits and conducted community consultations on the
proposed works;
• People pledged that they will extend their support for the timely completion of the project;
• Based on site visit and discussion with villagers there has not been any private trees and
building in NCB packages 003 to 006 that to be affected during the project implementation.
• Maximum precaution from the contractors need to avoid damage to crops along the
construction line and if damaged the contractor should compensate the farmers;
• Water in canals is also used by some residents as drinking water and farmers have
observed that change in color of canal water and water quality is very poor for drinking
purposes, and therefore there should be some water access point along the canal line as
well as preventive and control measures to maintain the water quality for drinking. Also,
during the lining works along the secondary canals, upon the need of the community and
nearby settlements, the project may construct women access points/water collection points.
• There should also be the provisions for training to farmers to the semi-skilled jobs. Also,
contractors should give priority to local vehicle owners in hiring vehicles for transportation of
materials.
F. DUE DILLIGENCE FINDINGS
a. NCB – 003
32. This report presents the findings of the resettlement survey of the secondary canals of the
NCB – 003 Secondary Canal Irrigation Subproject located in the Bahark district of
Badakhshan Province and Taloqan District of Takhar Province. Design of its secondary
canals has been completed and this report represents the findings of the resettlement
survey. This NCB Irrigation Subproject has a long list of secondary canals and these are
proposed structures to be rehabilitated under PARB-Project. As per this report’s findings, it can be said that the proposed works has no LAR impact and in regards there is no need for
land acquisition and for the LARP.

34. This report presents the findings of the resettlement survey of the secondary canals of the
NCB - 006 Irrigation Subproject located in the Kunduz Province. Design of NCB - 006
Irrigation Subproject has been completed and these secondary canals namely Qala e Zal,

Objectives of DDR:
• The main objectives of this due diligence of this project:
• Identify any LAR impacts in accordance with ADB SPS 2009;
• Access capacity of EA in knowledge and understanding of ADB SPS 2009 and good
practices;
• Propose project arrangements for social safeguards in accordance with ADB SPS 2009.
Institutional Implementation and Monitoring Arrangements
35. The Executing Agency for the Project is the Ministry of Finance (MOF) and the
Implementation Agency is Ministry of Energy and Water. MAIL is responsible to oversee the
implementation of Output 2 and Output 3 through the newly established CPMO in Kabul in
MAIL.
36. This CPMO serves all ADB projects and programs implemented by the Ministry. Also, for
implementation of Output 2 and Output 3 a PIO for basin-level activities in the river basin
agency (RBA) in Kunduz, Takhar and Badakhshan, embedded within the DAIL offices to
avoid setting up a parallel structure and to strengthen government institutional capacity.
37. With respect to the Project Management, PMO and PIOs of MAIL have been established and
staffed.
38. To meet ADB safeguard requirements the CPMO had engaged a full time Environmental and
Social Safeguard Team who is in charge for the Project’s environmental and social performance related to construction/rehabilitation activities.
39. The Environmental and social safeguard team is responsible to ensure timely submission of
SEMPs for review and no objection by ADB and conducting social safeguard monitoring and
audit of construction sites.

G. GRM/GRC and Institutional Setup
41. Field level grievances will be addressed through a local grievance redress committee (GRC)
that will be formally constituted by CPMO MAIL under each subproject such as NCB and ICB
contracts. The GRC, headed by a Program/Project Director, will consist of CPMO Social
Safeguard Officer who will lead the GRC on its first level, a representative from the APs/DPs,
local representative NGO/CS and/or Shora Head, the CPMO Environment and Social Team
(EST) and concerned staff from the line departments. The GRC will be formally notified and
established at the project sites. The GRCs’ will function as a forum for hearing complaints
and exploring quick resolutions to resolving conflicts in the project concern area. Each GRC
will record its discussions and inform the concerned parties of a resolution within 2 weeks of
time of its findings and recommendations. If the GRC cannot resolve the grievance, the
APs/DPs have the right to directly communicate with the CPMO for the resolution and it will
be called as the second level. And at any point in time the APs/DPs can directly appeal to the
courts of law. Communities will be informed about the GRC through the CPMO EST site visits
and consultation process. Grievance may also be addressed to ADB Office of Special
Projects Facilitator in case of non-resolution at project level.
42. To ensure women have access to the grievance mechanism, an elder and influential female
would be assigned to look after the issues faced by women in the project vicinity. She will be
responsible to communicate issues faced by the female and provide them with the solution
after following the GRM.
Institutional Setup
43. In regard to institutional set up, the CPMO EST has established a well-coordinated
mechanism with their engineering team for site works such as collecting primary data on
social and resettlement and REA checklists. As the scope of the implementable work is so
widen and is scattered amongst Badakhshan, Takhar and Kunduz provinces, the EST
capacity to cover all the provinces in order to ensure establishment of institutional set up was
not feasible and the CPMO social safeguard manager was only able to visit Badakhshan
province for NCB – 003 for this purpose. With the expansion of the personnel to CPMO EST
will make them enable to plan proper and manageable site visits to field and bring efficiency
into project works and provide accurate, relevant and reliable and timely data for reporting
and future actions.
GRIEVANCE REDRESS MECHANISM
44. Complaints consideration procedures aim to provide an effective and systematic mechanism
for the Project in responding to queries, feedbacks and complaints from affected persons,
other key stakeholders and the general public.
Levels and Procedure for Grievance Redress
45. The Grievance Redress Mechanism (GRM) is available to people living or working in the
areas impacted by the project activities. Any person impacted by or concerned about the

project activities has the right to participate in the GRM, should have the easy access to it,
and be encouraged to use it. The proposed GRM does not replace the public mechanisms of
complaint and conflict resolution envisaged by the legal system of the Afghanistan but
attempts to minimize use of it to the extent possible.
46. A Grievance Redress Committee (GRC) will receive and facilitate the resolution of affected
peoples’ concerns, complaints, and grievances about the project’s LAR performance. As already mentioned GRC does not possess any legal mandate or authority to resolve LAR
issues, rather acts as an advisory body or facilitate to try to resolve issues, for example,
relating to value of compensation for affected properties.
47. A 6-member GRC is proposed to be formed at the project area. In case of the absence of any
of the members during the decision-making process, an appropriate candidate will be
nominated by the original representative. However, at least five members should execute a
session for grievance resolution. GRC is proposed to be composed of the following members:

Proposed Measures to Address Grievance
Grievances will be addressed through the following steps:
48. Grievance registration: Any aggrieved AP will first produce his/her complain/grievance in
writing to the Convener of the GRC. Upon receipt of complaint(s), the Convener will organize
a GRC hearing session in his/her office within 15 days for resolution of the grievance(s), and
preserve all related records, proceedings, decision and recommendations. With assistance
from the INGO, the verdicts will be conveyed to the concerned AP through the respective PIO
office in the province.
49. Grievance processing: Queries and complaints that are clarified and resolved at the intake
point are closed immediately. If grievances are not resolved at the local level GRC, then
complaints can be lodged at the District Committee at the district level. The District

Committee under chairmanship of the respective District Governor will resolve the case within
15 days and inform the APs.
50. Feedback provision: Receipt of grievances lodged in person or via phone will be
acknowledged immediately. Receipt of grievances received through a letter or e-mail or
acknowledged through a letter / e-mail / fax within 3 working days upon receipt by GRC
coordinator at local level. In case the grievance is not related to project activities or impacts
generated due to the project implementation and cannot be considered, the feedback will be
provided to the complaining party specifying to which entity (community or department as
relevant) it has been forwarded.
51. If the District Committee decision is unacceptable to the APs, they can register the complaint
directly to the PMO at Kabul within 1 month of receiving the response from the District
Committee with documents supporting their claim.
GRM: Central Level
52. Following unsuccessful consideration of grievance by GRC at the district level complaint
resolution will be attempted at a central level through following steps.
i. Grievance processing: If the District Committee decision is unacceptable to the APs, they can
register the complaint directly to the PMO at Kabul within 1 month of receiving the response
from the District Committee with documents supporting their claim. The PMO will then
attempt to resolve the grievance within 15 days and inform the APs.
ii. Feedback provision: If the grievance was resolved, the complaining party will be informed on
the outcome of grievance resolution. If grievance was not resolved by the GRC at central
level, appropriate information will be provided to the complaining party, including details why
the case was not resolved.
iii. Should all the above three levels of grievance redress system fail to satisfy the AP, he/she
may approach the appropriate court of law for its resolution. The AP will be facilitated in this
process by the INGO and SST.

stakeholders.

57. To meet ADB safeguard requirements the CPMO has engaged full time Team of
Environmental and social Safeguard specialists who are in charge for the Project’s environmental and social performance related to construction / rehabilitation activities.
58. Safeguard specialists are responsible to ensure timely submission of semi-annual (covering
January-June of each year and due by end of July the same year) or annual (covering
January – December each year and due in January of the following year) social safeguards
monitoring reports for acceptance and further disclosure.
Social Safeguards Mitigation Measures:
59. Safeguard measures including the following should be undertaken during rehabilitation
works:
i. Measures should be taken during construction works to not affect the crops and or livestock of people in areas used for such purposes;
ii. Minimize the land areas to be used temporary for rehabilitation works, storage of machines and other equipment, clear marks should be installed to inform public about rehabilitation zones, with no access to unauthorized people, with proper safety fencing especially in certain areas where there is safety risk for people children and livestock;
iii. Nature and timing of the works to, wherever possible, to be communicated to farmers and public; farmers allowed time to irrigate and/or harvest crops before commencing any works;
iv. The owners of the land plots will have free and safe access to their lands; roads and foot bridges shall be provided at different location to cross the canals to ensure mobility of farmers, community members and their livestock: locations of roads and bridges should be consulted with farmers, public and relevant authorities to meet best the needs of local people.
Safeguards provisions in civil works contracts: 60. The EA will ensure that the contractors will follow ADB’s SPS (2009) safeguards
requirements and applicable laws of Afghanistan during rehabilitation works. The EA will address safeguards measures and requirements through appropriate conditions in the civil works contract.
61. Shall the contractor need land temporary for rehabilitation works, equipment or machine storage, written ease agreement shall be signed based on the free will between the Contractor and land owners/users, following the laws of Afghanistan and principles of ADB’s

SPS (2009). The EA shall review the agreement and ensure that all appropriate provisions comply with the ADB’s SPS (2009) safeguards requirements, and laws of Afghanistan. Though this shall be a mutually agreed process between the Contractor and land owners/users, the EA shall monitor the situation and act as a mediator if any dispute emerges.
62. Upon the completion of works, the land that was temporarily used must be restored at least to its pre-project condition and returned to the owner/user with mutual settlements of all relevant losses. One of the conditions for final payment to the civil works Contractor is the submission of proof that all temporarily used lands have been fully restored to their pre-project conditions and that there are no pending compensation issues related to the temporary use of land.
63. The Contractor shall have a Social Safeguards/Community and Grievance Coordinator who will carry out safeguards monitoring, register the received grievances and facilitate resolution, and prepare semi-annual monitoring reports on social and resettlement safeguards performance, any unanticipated land impact. She/he shall facilitate to continued information disclosure and meaningful consultation with affected communities throughout construction period.
I. Conclusion 65. Based on currently available information on the project area and project activities, it may be
concluded that the canal rehabilitation works involves no IR or IP issues. 66. Data has been collected on all the secondary canals through the ADB resettlement checklist.
The community has been consulted and have been informed about the project intervention and the benefits the intervention would bring to the community. The data gathered on the checklist indicate that there is no LAR impact and there is no need for LARP as there is no major impact associated with social safeguard, land acquisition nor resettlement.
67. If, there any impact emerges during implementation of the sub-project in regards to social and resettlement safeguard, ADB will be notified promptly and a corrective action plan will be prepared and implemented following ADB SPS 2009 requirements.
