A.1 Background and Impacts Assessment
1. The Changting Tingzhou sub-project entails the construction of hydropower scheme with the installed power of 20 MW at Guangkan Village, Niuguo Township in Changting County of Longyan Municipality. This Resettlement Plan (RP) has been prepared on the basis preliminary design, a socio-economic assessment (see Appendix 1). The main stakeholder (Tingzhou Hydropower Development Co. Ltd.) together with the affected township, Niuguo Township Government, had undertaken a consultation with the affected households and village leaders in May 2006. In June 2006 Changting County PMO designated one staff to coordinate the preparation of RP and to monitor land acquisition and compensation. Then a joint verification of affected land and assets (a detailed measurement survey) had been conducted by Niuguo Township Government, Changting County PMO staff and local affected households starting from 15th to 30th in July 2006. In August 2006 local compensation rates and entitlements had been checked by the staff from the Land and Resource Administrative Bureau/Office at Changting County and Niuguo Township level and monitoring staff from Changting County PMO. It was confirmed that they were in compliance with the Resettlement Framework agreed upon with ADB. The scheme will start the construction after the approval of the RP by ADB and full payment of land compensation and resettlement subsidy to the affected households starting from December 2006.
2. The sub-project will acquire 8mu of forest land for its planned power station, while the construction of main dam (with a height of 9.75m), auxiliary dam, tunnels and power station including step-up substation will temporarily affect another 25mu of paddy land and 3mu of forest land for 25 months. Meanwhile, the reservoir (with a surface area of 2,650 mu) will submerge 121mu various lands including 3.9mu paddy land, 3.1mu dry-crop land, 88.6mu forest land and 25.4mu unused floodplain. In addition, a 2.35km access road will also be submerged and should be rebuilt at higher location where unused waste land will be acquired. Upgrading of existing access road and installation of power transmission line will have no impacts on the current land uses. A 30km 35kV transmission line will be built to connect with the county grid, but no land acquisition or resettlement impacts will occur. The total number of APs is 77, including 34 persons (8 households) affected by the reservoir submergence, and 43 persons (10 households) affected by temporary land occupation. According to the detailed measurement survey there are no residential houses or other structures that will be demolished by the scheme, so no house resettlement will be needed for the affected 18 households. The submerged farmland on average accounts for less 15% of the total farmland holdings of the 8 households (household land holdings: i.e., 4 to 5 mu paddy land and about 4 mu dry-crop land per household). The impacts to the affected houses are shown in Table 1.

A.2 Policy Framework and Entitlements
3. The RP policy is based on the PRC Land Administration Law 1998, Implementation Measures of the PRC Land Administration Law in Fujian Province 1999, Regulations on Compensation for Land Acquisition and Resettlement of Large and Medium Water Conservancy and Hydropower Schemes issued by the State Council of PRC in July 2006, Temporary Regulations on Land Compensation in Changting County 2005, Implementation Suggestions on the Compensation of Land Acquisition in Fujian Province issued by the People’s Government of Fujian Province in January 2006 and the ADB’s Involuntary Resettlement Policy. The main policy principles are: i) negative impacts will be minimized as much as possible; ii) resettlement/compensation will be carried out so as to improve or at least restore the APs pre-project living standards; iii) APs will be thoroughly informed/consulted on compensation options and RP design; iv) affected assets will be compensated at replacement cost; and v) compensation and subsidies will be fully provided prior to ground leveling/demolition.
4. The RP sets eligibility and entitlement provisions establishing compensation mode and rates in accordance to ranges compatible with the 1998 Land Administration Law. Since land losses are minor, cash compensation will be used. In practice the affected households will receive the land compensation and resettlement subsidies at the rate of 16 times the Average Annual Output Value (AAOV) from the project proponent Tingzhou Hydropower Development Co. Fujain (THDC). Temporary paddy land losses will be compensated directly to the APs at a rate equal to 3.5 times the AAOV, while temporary forest land losses will be compensated directly to the affected village at a rate equal to 3 times of the AAOV, and THDC will responsible for the restoration of land to its previous or better quality acceptable to the affected households. Green crop losses and losses of trees, fruit trees and bamboos will be compensated to the APs or affected villages in cash based on the current market value determined by Forestry Bureau of Changting County in consultation with the affected households. The compensation rates for various types of losses are detailed in Table 2.

5. The affected households will receive their entitlement in accordance to the type of impact, their eligibility and compensation standards set out in Table 3.

6. Under the scheme, no house and other structures will be demolished according to the survey of affected land and assets carried out from 15th to 30th July 2006 by Niuguo Township Government, the two affected village committees and local farmer representative.
A.3 Rehabilitation and Income Restoration
7. The option for land adjustment to replace losses is possible because the losses are a negligible amount of the village farmland. However, cash compensation was the preference of all APs. The payment for the compensations based on the original standard (10 times AAOV) has

been made to the affected households in December 2006, while the additional payment of the compensations based on the new standard will be made right after the ADB approval of the RP. The township will provide support and training to affected households so they can invest compensation to restore and improve their income. Directly associating with the project construction, 40 persons in the 18 affected households are anticipated to work as temporary workers on the construction site with the daily salary of RMB 25 per person. Provision of the priority to hire construction workers from the affected households has been incorporated into the construction contracts. Also, THDC will provide 3 permanent employment opportunities to be operation workers at the power station for the three households in which part of their paddy land will be submerged by the reservoir (one for each household). For this purpose, THDC will provide free trainings for two laborers from each of the affected households. The annual salary of the worker in THDC will be over CNY 12,000 each. The operation of the project will also promote the development of local agro-processing with the secure power supply at cheaper power tariff, such as bamboo processing, wood processing and edible fungus processing. The planned agro-processing projects will provide at least 800 jobs, and the township will prioritize to assist these affected households accessing these off-farm employment opportunities. Many of these jobs will employ women. Therefore, it is certain that the livelihood of the affected persons will be improved.
8. There are no residential lands and houses that will be affected or demolished under the scheme. No vulnerable households will be involved by the land acquisition according to the Socio-economic Assessment (see Appendix 1).
A.4 Institutional Arrangements
9. The Changting County PMO will be responsible for monitoring RP implementation. The Land and Resources Administrative Bureau/Office at Changting County and Niuguo Township level will administer land compensation measurement and payments. The village leaders will monitor the process and assist affected households. The land acquisition has been approved by Land & Resource Departments and Forestry Departments in 2005 by issuing the Documents No. 91 [2005] and No. 242 [2005]. Since the project was not implemented until now, THDC has agreed to pay the higher compensation in accordance with the new national policies, as a preferential treatment to the APs.
A.5 Public Consultation and Disclosure
10. During project preparation, affected households have been informed and consulted on the impacts, compensation policies and individual entitlements. Affected households will meet with the project proponent to consider temporary and permanent employment opportunities and other enhancement measures related to the project. In December 2006, all affected households have received a Resettlement Information Booklet clarifying the policies and entitlements, prior to notification of land requisition. This RP will be provided to the affected households at two villages of Guangkan village and Dianxia village at Niuguo Townships once it is approved by ADB.
A.6 Complaints and Grievances
11. In case of grievance, APs will submit an oral or written complaint first to Guangkan and Dianxia villages at Niuguo Township resettlement offices according to administrative area of their location. If the grievance is not settled within two weeks, they can seek redress at the district resettlement office, within one month. If still unresolved within two weeks, a case can be further

moved up to the Changting County PMO. Final appeal is available in the civil courts in Changting County.
A.7 Monitoring and Reporting
12. RP implementation will be monitored regularly by the Changting County PMO and reported monthly to the Fujian PMO. The Fujian PMO will collect the county report and provide a summary of the progress of land acquisition, compensation and rehabilitation activities in the Semi-annual Progress Reports to be submitted to ADB.
13. An Independent Agency, Resettlement Administration Bureau of Longyan Municipality, has been engaged by Changtin County Government in accordance with the government regulation and requirement of Fujian PMO. The Agency was involved in the initial activities of the resettlement plan implementation and will carry out external monitoring once a year and annual reports will be sent to ADB until 2 years after resettlement is completed. Table 4 provides a list of indicators to be monitored.

A.8 Cost and Funding
14. RP budget is estimated at CNY 2,446,384, including CNY 64,000 for the permanent acquisition of forest land from Guangkan village, CNY 1,065,120 for the compensation of the lands to be submerged by the reservoir, CNY 135,750 for the compensation of the land temporarily affected, CNY 50,420 for the compensation of green crops including trees, fruit trees and bamboo, CNY 752,000 for the restoration of 2.35km access road, CNY 60,000 for resettlement monitoring and evaluation, CNY 106,365 for administration costs, and CNY 212,729 for contingency. The cost of resettlement is fully funded by the Tingzhou Hydropower Development Co., Ltd, Fujian, which will be responsible for the construction and operation of the scheme. A breakdown of the resettlement estimate is shown in Table 5. All the RP costs will be funded entirely by the company. Payments will be made indirectly to the affected households through the two affected village committees, jointly monitored by the Land and Resource Office at Changting County, Niuguo Township level and staff from Changting County PMO.

No further taxes and levies are required to be paid for all the compensation payments, as these were paid in 2005.
A.9 Implementation Schedule
15. In line with the project implementation schedule, the implementation schedule of resettlement plan has tentatively been set as specified in Table 6.

Appendix-1
Summary of Social Assessment on the Villages and Households Affected by Changting Tingzhou Hydropower Scheme
A. General Introduction
1 Changting Tingzhou Hydropower Scheme is located on the Tingjian River, a tributary of the Hengjiang River, which flows through Shantou, Guangdong Province, to the sea, at southeast part of Changting County in Longyan Municipality. The dam, water diversion system, powerhouse and other structures lie at Guangkan village of Niuguo Township. The total investment cost of the scheme will amount to CNY 115.03million with the total installed capacity of 20 MW. It would take 25 months to complete the following proposed construction:
- construction of a main dam and a auxiliary dam & spillway; - construction of two water diversion tunnels with the diameter of 7.7m and the total
length of 1,016.5m + 997m and a forebay with the total capacity of 60,000m3; - construction of a riverbed type powerhouse equipped with 2 units of
turbine-generators at the designed capacity of 2 X 10 MW; - construction of a associated step-up substation; - construction of a 35kv transmission line 30km in length to connect the power station to
the county grid; - other necessary accessory facilities; and - upgrading 3000m long access road.
2 The scheme will affect some land in the respective villages. In order to prepare the Resettlement Plan in line with the Resettlement Policy Framework of Fujian Soil Conservation and Rural Development II Project, in July 2006, jointly with the project proponent, Tingzhou Hydropower Development Co. Fujiang, Changting County PMO invited the staffs from the relevant county government authorities including Land and Resources Administrative Bureau, Forestry Bureau, and the representatives from Niuguo Township Government and two affected villages including Guangkan village and Dianxia village to carry out the detailed survey on losses and social economic status of the affected households.
B. Socio-Economic Profile on the Affected Villages and Households
3 There are two villages in the Niuguo Township that will be affected by the scheme. The total population of these two villages is 1,515, among which 703 of Guangkan Village and 812 of Dianxia Village. Each household has about an average of 4.5mu of paddy land for cultivating rice and vegetables, and over 3 mu dry slope land for cropping sweet potato and fruit trees. Crop income from rice growing, fruit trees and bamboo remained the main source of earning for villagers, accounting for about 60% of their income and another 40% is contributed by non-farm work out of the village. The per capita income was CNY 2,550 to 2,685 in 2005. About 32% (489 persons) of the population was below the poverty line, with the 10% below CNY1,100 per capita and 22% between CNY1,100 and CNY 1,500. A summary profile of the affected villages is shown in Table 1.

4 There are 18 households in two villages affected by the scheme. The average income per capita in 2005 was CNY 2,621 in the affected households, more than CNY1,000 above the relative poverty line. However, their educational level is relatively low, with only 16.7% completing high school in all 18 householders with the ages ranging from 34 to 67 years. The majority had elementary (44.4%) and middle school (38.9%) education. If we make the statistics for all family members including women in the affected households, the educational level will be lower due to the sex preferential tradition in local area. There are no vulnerable households (absolute poor, single parent, elderly, disabled, or ethnic minorities) affected under the scheme according to the table-2 filled in during the investigation, which was carried out in June 2006. Fore more detail, please see table-2.
5 Results from the household survey, including and additional opinion survey among females and small village group discussions indicated that most villagers were quite positive about the proposed project. There are three benefits derived from the scheme. First one is creating job opportunities during the construction and operation. 40 persons in the 18 affected households are anticipated to work as temporary workers on the construction site with the daily salary of RMB 25 per person. Second is to promote the development of local agro-processing with the increasing power supply at cheaper tariff rate, such as bamboo processing, wood processing and edible fungus processing. The planned agro-processing projects will provide at least 800 jobs, accounting for 10% of total population of the nearby 20 villages in the adjacent 3 townships, and enabling 2,500 persons (75% of the total population under poverty line) to get out of the poverty.
C. RP Budget and Compensation Plan
6 The total affected land will be 157mu that locate in Guangkan and Dianxia villages. The reservoir of the scheme will inundate 121 mu lands including 3.9mu paddy land, 1.7mu dry-crop land, 20.7mu forest land and 7.9mu floodplains in Guangkan village, 1.4mu dry-crop land, 67.9mu forest land and 17.5mu floodplain in Dianxia village. The power station and auxiliary houses will occupy 8 mu of forest land belonging to Guangkan Village. In addition, during the construction of dam, powerhouse and other structures, another 25mu paddy land and 3mu forest land will be affected temporarily for a period of about 25 months. In average, the permanent affected lands per household account for less 15% of total land holdings of the household contract from the village. There are no dwelling houses and other structures in the future reservoir area and planned power station area.
7 The total 32mu affected paddy and dry land belongs to two villages and is contracted to the above-mentioned 18 households with the paddy land use right of 30 years and other land use right of 50 years starting from 1998. According to Implementation Measures of the PRC Land Administration Law in Fujian Province 1999, Regulations on Compensation for Land Acquisition and Resettlement of Water Conservancy and Hydropower Schemes issued by the State Council of PRC in July 2006, Temporary Regulations on Land Compensation in Changting County 2005,

and The Implementation Suggests of the Land Acquisition in Fujian Province 2006, the affected households not obtaining the replacement land will receive the land compensation rate and resettlement subsidies of 16 times the Average Annual Output Value (AAOV). Temporary paddy land losses will be compensated directly to the APs at a rate equal to 3.5 times the AAOV, while temporary forest land losses will be compensated directly to the affected at a rate equal to 3 times the AAOV. The output of these lands is detailed in Table 3. The AAOV of paddy land in local area is CNY 1,500/mu per annum, while the AAOV of floodplain currently growing small bamboo and forest land is determined to be CNY 500/mu per year, and the AAOV of dry crop land is CNY 1,200/mu per annum. In addition, 60 forest trees, 87 fruit trees and 352 bamboo will be cut and they are needed to compensate. Base on the current value of these trees and bamboo determined by the Forestry Bureau of Changting County in consultation with the affected villagers, the compensation of the forest trees, fruit trees and bamboos is set at CNY 200/tree, CNY 300/tree and CNY35/bamboo, respectively, and they will be paid to the affected households. The details of the budget for compensation are shown in Table 3.
8 According to the land and assets survey conducted in 15th to 30th July 2006, there are no resident houses and greenhouses affected by the scheme, but 2.35km access road will be inundated by the reservoir. The access road will be rebuilt at the higher location where unused waste land will be acquired. The upgrading of the access road and installation of power transmission line will have no impacts on the current land uses.
9 The consultation to determine the compensation rate and the quantities to be compensated held among Niuguo Township Government, Guangkan Village Committee, Dianxia Village Committee and local affected households in August 2006. The payment of all the compensation and subsidy will be made starting from December 2006 (prior to the construction) to the affected households through the affected villages by Tingzhou Hydropower Development Co Ltd. Fujiang, Changting County, The Land and Resource Administrative Bureau/Office at Changting County and Niuguo Township level joined with the staff from Changting County PMO will monitor the process to confirm the compliance with the RP and guarantee the interests of affected households. The compensation plan is detailed in Table 4.

Appendix -2 Tingzhou Hydropower Subproject

I. Summary Description on the Project
Changting Tingzhou Hydropower Scheme is located on the Tingjian River, a tributary of the Hengjiang River, which flows through Shantou, Guangdong Province, to the sea, at southeast part of Changting County in Longyan Municipality. The dam, water diversion system, powerhouse and other structures lie at Guangkan village of Niuguo Township. The total investment cost of the scheme will amount to CNY 115.03million with the total installed capacity of 20 MW. It would take 25 months to complete the following proposed construction:
i. construction of a main dam and a auxiliary dam & spillway; ii. construction of two water diversion tunnels with the diameter of
7.7m and the total length of 1,016.5m + 997m and a forebay with the total capacity of 60,000m3;
iii. construction of a riverbed type powerhouse equipped with 2 units of turbine-generators at the designed capacity of 2 X 10 MW;
iv. construction of a associated step-up substation; v. construction of a 35kv transmission line 30km in length to
connect the power station to the county grid; vi. other necessary accessory facilities; and vii. upgrading 3000m long access road.

IV. Affected Person Entitlements
A LOSS OF LAND USE 1 Permanently Affected Agricultural Land
100% of the cash compensation will be paid to the APs based on subsidy of 6 times AAOV and land compensation of 10 times AAOV.
2 Temporarily Affected Agricultural Land Cash compensation for loss of income potential (3.5 times AAOV for paddy land and 3 times AAOV for forest land) and compensation for green crops and trees will be made to the APs. Restoration of land to its previous or better quality will be made.
B. LOSS OF CROPS AND TREES 1 Trees The affected village will receive the compensation at current market value of the trees 2 Fruit trees and bamboo
APs will be compensated for the loss of the fruit trees and bamboo at their current market value.
C. REHABILITATION MEASURES Two members of the affected households will be provided training to develop alternative livelihood sources. Labours from the affected households will be hired as temporary workers on the construction site with the daily salary of RMB 25 per person. One member of each household will be recruited by THDC as the operator of the power station with the annual salary of over RMB 12,000.
