Here is what we need you to say:

You oppose the proposed RESIDENTIAL RESALE INSPECTION PROGRAM and urge the City Council to reject the recommendation in the DRAFT HOUSING ELEMENT that the program be adopted. To remedy dangerous living conditions caused by the construction of illegal rooms and additions, the City Council should require ALL residents to comply. Requiring this at the point of sale places the burden on a small group of buyers and sellers, instead of the entire community. Requiring an inspection and resale permit will add to the cost of buying and selling a home in Daly City. Homeowners who have completed legal renovations could be forced to pay hundreds of dollars for an inspection to verify permitted work. Imposing energy and water efficiency upgrades at the point of sale affects the affordability of homes and places a burden upon homeowners who may need to quickly sell their property. Strict State disclosure laws already protect buyers of residential properties.

We are thrilled that Alex has joined SAMCAR. He brings a wealth of experience and education that will ensure his success as our Coordinator. Most recently, Alex graduated from Johns Hopkins University, having earned a Masters degree in Government. He completed his undergraduate studies at UC Davis. Alex worked in the Governor’s office for close to 3 years, working in both Constituent Services and Legislative Affairs.

Alex KhalfinRecently, the proposed plan for the Cargill site in Redwood City came

before the City Council. Up for consideration was whether the City should approve studying and processing the 50/50 Balanced Plan, proposed by

DMB, the development company charged with planning the site’s future.

Ultimately, the Council voted 7-0 to move forward and begin studying the Plan.

Many of our past and present leadership, as well as a great number of our REALTOR members attended the City Council meeting. Thank you to each Realtor who stayed well into the night, to demonstrate SAMCAR’s support!

This is to advise that the Town of Hillsborough has recently begun heightened enforcement of sign violations. This is occurring with more frequency around the Black Mountain Road exit off of Highway 280. Previously, this

was County land, but it was recently annexed into Hillsborough.

Signs are allowed only on private property in Hillsborough. Here is the existing ordinance for your reference:

Section 17.48.040No permit required. Limit to one sign per property. Signs are only allowed on private property with permission of the private property owner or occupant, as appropriate. Sign must consist only of black letters, symbols or artwork on a white background setting for the name, address, phone number and logo of person or firm, and words “for sale.” Sign must not exceed 12 inches by 15 inches. Sign may be posted once the owner had decided to offer the property for sale and must be removed no later than 1 week after such transaction has been completed or the effort abandoned or the listing expired. Hillsborough Municipal Code, see 17.48.040 Real Estate and Contractors’ Signs.

Assessment AppealsInformationThere is important information now available about property

tax reassessments in San Mateo County. Please be aware

AB 985 (De La Torre)would create an expensive program to eliminate ancient illegal and unenforceable racial restrictions from the public re-cord of property ownership, even though they are of no legal effect. The bill will surcharge every recorded document an ad-ditional $3 to fund a program to process requests to eliminate what is already illegal and unenforceable language. It will al-low any person to submit a correction to property records to remove an illegal restriction. C.A.R. OppOSES because it too, is a tax disguised as a fee. AB 985 will generate about $60,000,000 during its first three years of operation, far in excess of actual costs, even though there are only a miniscule number of re-cord correction requests.

Member Appreciation BBQ

Thank you to all 300+ SAMCAR members who came out to the Annual Member Appreciation BBQ at the San Mateo Central Park on August 6th. Although the day started with some surprise rain, it turned into a great day for some softball, music, food and fun.

The SAMCAR Board of Directors happily served a full buffet of hamburgers, hot dogs, hot links, ribs, green and fruit salad, chips, cookies and brownies. The attendees were treated to music by the Ron Borelli Band. To enliven the crowd, SAMCAR raffled off REALTOR® and Affiliate memberships, advertising, iboxes and sign riders.

There was fun for everyone! If softball was not the preferred game, guests also played chess, checkers, Chinese checkers and dominoes.

Thanks to the Special Events Committee members who helped plan the day and to the SAMCAR Board of Directors who made sure our members knew how much we appreciated them!

The first meeting was held on August 27th at SAMCAR to explain the goals of the group and to listen to feedback from those interested in meeting on a monthly basis to hear from a speaker who will share valuable information about succeeding in real estate, hearing about upcoming seminars, conferences and educational offerings, a chance to network and share information with other members about the market and the industry and more.

There are dozens of YPN Groups being formed all over the country and NAR has a blog and resource links specifically for members of this growing group.

MLSLISTINGS INC. UPDATES

Court Confirmation DisclosureWhat it says 7.15.1 Estate Sale, Probate and Bankruptcy ListingsAll listings that require or may require court confirmation must be so identified.

What it means Listings that are being sold under the oversight of a court must at least use the “Additional Listing Information” checkbox for their listing that either require or may require court confirmation.

The Greater Bay Area Market Report for July 2009 reports that the median single-family home price is up 6.6% in July over June of 2009, while the number of sales slipped to 2,431.

Some additional Quick Facts for July of 2009 are:The median price of existing single-family homes increased to $522,500 up 6.6% from June 2009.Existing single-family home sales decreased -5.4% from June 2009 for a July total of 2,431.Condos remained at $340,000 ─ a 0% change from June 2009.Existing condo sales decreased -4.3% in July over June 2009 for a total of 582.

Greater Bay AreaMarket Reportfor July 2009

Change to MLS RulesNOW EffectiveThe following rules went into effect August 15th.

LockboxesWhat the Rule Says 13.12 Lockbox Accessibility. If a lockbox is present on a property that is located in the MLSListings service area and is listed for sale in the MLSListings system, there must be an electronic lockbox that is accessible by a key issued by one of the lockbox Authorized Providers listed in Appendix B. More than one lockbox may be used on a property.

What the Rule means If one or more lockboxes are placed on a property one of them must be electronic and accessible by a key issued by an MLSListings authorized provider. However, it is not required to place a lockbox on a property, and more than one lockbox on a property is permitted.

Photograph RequirementsWhat it says 7.11.2 All residential listings with existing buildings that are entered into the MLS for sale must include a photograph of the front of the building within 72 hours after entry. Listings designated as “Seller Prefers No Photo” must have written authorization from the seller to exclude a primary image, which must be provided to the service upon request. On new construction, a realistic artistic rendering of the intended appearance of the front of the building will suffice until the building is completed, at which time an appropriate photograph must be submitted. Photographs are optional on vacant land, commercial/industrial, business opportunity and rental listings.

What it means Listings in property classes 1-4 must include at least one photo of the front of the building (condo structures included). You will have 72 hours from publication to meet this requirement. The primary photo does not need to be of the front of the building. The MLS has available for subscriber use a “Seller Prefers No Photo” image to download and then upload to identify listings for which the seller is requesting no photo of the property be published. The listing agent must also download and use the “Seller’s Instruction to Omit Photo” form, executed by the seller and held by the agent, as evidence the seller has instructed the agent not to publish a photo of the property. You do not have to submit this to the MLS, unless requested.

This photo requirement rule is NOT retroactive to all listings andapplies only to listings entered after August 15th 2009.

News from BROkER/MANAGER MEETINGS

Broker Manager MeetingHighlights the Statement:“Disclose, Disclose, Disclose”Contributed by Julie Ziemelis

What is the most feared statement in real estate? “I’m taking you to court!” That’s closely followed by “I’m suing you” and “I hope you have a good lawyer.” Avoiding these dreaded words was the topic of the Broker/Manager meeting on August 20th at the Sheraton Hotel in Burlingame. Attorneys Thomas P. O’Toole, a partner in the law firm of Cannata, Ching & O’Toole, and Mailana Mavromatis, Legal Counsel for Property I.D., both gave plenty of information and case studies about the perils of not disclosing information to clients in a real estate transaction.

Mr. O’Toole started the session with the latest laws from the Federal, state and local levels. He pointed out the following information that was pertinent to REALTORS®:

1. Make sure your DRE number is on ALL of your solicitation materialincluding your business cards, stationery and fliers. The font size hasto be as big as the smallest font size on the material.

2. A foreclosing owner has to give 90 days notice to terminatea bona fide tenant.

3. Don’t text or use your cell phone while you are driving.4. Regarding HvCC: You ARE permitted to have direct contact with

the appraiser and can offer to them comps in the area and speak tothem directly. You CANNOT coerce them into a value that is not justified.

He further discussed HVCC and mentioned that NAR is trying to get a moratorium on this bill.

Mr. O’Toole then discussed disclosures and asked the members in the room to use the general rule about if to disclose or not, “Trust your gut”. If you feel something is in a gray area, disclose it. He suggested over disclosing and keeping in mind that neighbors and tenants always talk, so most defects or history about the property eventually comes up to the buyer.

“I have never heard of anyone getting sued for disclosing too much information,” Ms. Mavromatis told the crowd as she led the second half of the discussion. Ms. Mavromatis focuses on land use laws and

discussed the natural hazard disclosure statements. It is important to sit down with your client and read the report together. If your client has questions, direct them to call the company with their questions as experts in the field of geography, soils, local endangered species, etc. have prepared those reports and they are in a legal position to provide clarification. “If you try and interpret the reports, you are opening yourself to liability,” she told the crowd.

Based on a law established July 1, 2009 that states

licensees must disclose their individual DRE numbers publicly

when soliciting business, MLSListings is developing a solution to

accommodate teams to comply with this ruling. Further information

regarding these details will be coming soon.
