6. NOTING AND CONFIRMATION OF CIRCULATION AGENDA NO. 01 DATED 10.05.2019 :

To note and confirm the Circulation Agenda No. 01 dated 10.05.2019 Cantonment Board, Ajmer regarding time period of Shri Mithlesh Kumar Sharma, Sanitary Inspector (on contract basis) w.e.f. 20.05.2019 for eleven months.

7. APPOINTMENT AGAINST VACANT POST OF JUNIOR ENGINEER (ON CONTRACT BASIS)

To note and confirm the Note sheet of P.C.B. and C.E.O. regarding renewal of term of Shri Ankur Kumawat, Junior Engineer (on contract basis).

RESOLUTION 7 : Considered and resolved that a walk-in-interview be conducted in next 15 days for recruitment of Junior Engineer (contract basis). Further same be published in two local newspapers. Board further resolved that a three member committee comprising of following members is constituted for conducting walk-in-interview.

8. EXTENSION OF THE PERIOD OF DATA ENTRY OPERATORS FOR THREE MONTHS W.R.T. ACCRUAL BASED ACCOUNTING SYSTEM SOFTWARE.

Reference Cantonment Board Res. No. 09 dated 29.02.2019. To note and confirm the Note sheet of P.C.B. and C.E.O. regarding time period for

engagement of Data Entry Operator ended on 31.03.2019 for three months for ABAS system for the financial year 201 7-18 as per minimum wages Act.

RESOLUTION 8 ·: Noted and approved up to 31.05.2019.

9. TO EXTEND APPLICABLE PAY SCALE TO EMPLOYEE OF BOARD DURINC PROBATION PERIOD:

Reference this office letter No. VI/PF-AJ/396 dated 28.01.2019 and subsequen openion dated 08.02.2019 tendered by Sh. Ram Swaroop legal opinion of Board and PCE and C.E.O. office note dated 12.03.2019 regarding extend applicable pay scale to employet of Board.

To consider and note the above legal op1ruon. Employee appointment or substantive basis from Olst January, 2010 arid onwards be paid salary as per service rule~ and as per C.F.S.R., 1937 during their probation period and not by way of separate fi:ll monthly remuneration. Arrear of difference amount be paid to them from date oJ appointment during financial year 2019-20. New Salary be paid to affected to employee: w.e.f. 01April,2019.

11. REVISED THE RA TES OF VARIABLE DEARNESS ALLOWANCE THE BASIS OF THE AVERAGE CONSUMER:

To note Govt. of India, Ministry of Labour & Employment Office of the Chief Labour Commissioner (C), New Delhi letter No. F.No.1/38(3)/2018-LS-II dated 27.03.2019 revised the rates of Variable Dearness Allowance on the basis of the average consumer price index number for the preceding period of six months ending on 30.06.2018. This order shall come into force w.e.f. 01.10.2018.

12. CHANGE OF BRAND NAME OF 10 KV GENERA TORS: Reference Cantonment Board Res. No. 17 dated 19.02.2019.

This office tried to place on order on GEM portal w. r. t. the purchase of 10 KV A Generarnr (Koel Gteen) and placed this on the GEM portal as per procedure laid down GFR 2017.

In this response this office issued a work order issued on 12.03.2019 to Mis. Agarwal arid Company, Ajmer who was L 1 bidder of 10 KV A Generator Brand "Mahindra & Mahindra" but after giving the work order on GEM portal the above said Generator is of " Harison" make with Internal Combuston Engine of "Mahindra and Mahindra" Make.

All relevant paper placed on the table.

ITEM TAKEN WITH THE PERMISSION OF CHAIR

13. PRELIMINARY DRAFT WITH REFERENCE TO BUNGALOW NO. 1 :

Reference Dte. DE, SC, Pune letter No. 10832/AJM/DE dated 01.08.2018 along with report on visit to ~jmer Cantonment by Sh. Ajay Kumar Sharma, Director-I, DE, SC, Pune on 23.07.2018. In response to the above report of para (ix) the advertisement published vide this office letter NO. B.No.1/SyNo.44/331 dated 31.10.2018 in two local news papers for submitting sale deeds, gift deeds and other document which shown the proof/evidence of ownership of property etc. within 15 days from the publishing of this advertisement.

In context to above advertisement, stakeholders have submitted various documents including registered sale deed, gift deed and other document claiming ownership.

The same have been forwarded to Sub-Registrar, Ajmer vide this office letter No. B.No.l/Sy.No.44/529 dated 29.01.2018 along with above documents which have been received from stakeholders for seeking verification but no response received and again, reminder vide this office letter No. B.No.l/Sy.No. 4/574 dated 26.2.2019 forwarded to Sub-Registrar, Ajmer and Sub-Registrar, Sarwar, Ajmer. But no response received from Sub-Registrar, Ajmer.

In between, the copy of documents received from stakeholders were forwarded to Cantonment Board Legal Advisor, Ajmer Cantt. vide this office letter No. B.No.1/18 dated 13.05.2019 and requested him to liaison with Sub Registrar, Ajmer to get physical verification of documents and submit the same at the earliest. Legal Advisor submitted report letter dated 04.06.2019, which is put up before Board for kind consideration.

RESOLUTION 13 : Considered and resolved that a Architect be highered by the Board and a Draft Layout Plan be prepared for Bungalow No. 1 (Sy.No.44), Circular Road, Ajmer in a time bound manner.

14. EXTEND TIME PERIOD OF CONTRACTOR MIS. RATH! CONSTRUCTION, NASIRABAD.

To extend the time period of Term contractor for the year 2018-19 Mis. Rathi Construction, 21, Main Street, Nasirabad Distt. Ajmer.

RESOLUTION 14 : The term of contract be extended up to 31st July, 2019 in public interest.

To extend the time period of Term contractor for the year 2018-19 Mis. LNA Infraprojects Pvt. Ltd. , 1/513 Vidhyadhar Nagar, Jaipur.

RESOLUTION 15: The term of contract be extended up to 31st July, 2019 in public interest.

16. PRINCIPAL OF EQUAL PAY FOR EQUAL WORK FOR CONTRACTUAL WORKERS IN AJMER CANTT. To consider legal advice taken from Cantonment Board Legal Advisor on Supreme Court

order dated 26.10.2016 (State of Punjab & Ors. V/s. Jagjit Singh and others).

In above legal advice given in context of above judgment is clearly highlighted from para 03 to para 05, wherein principle of equal pay for equal work principal is to be followed even in case of contractual employees performing similar duties as permanent employees as laid down in the judgment.

In above context Notification issued by Ministry of Labour and Employment G.S.R. No. 976 (E) dated 07.10.2016 & G.S.R. No. 235 (E) dated 16.03.2018 have also been issued.

RESOLUTION 16 : Resolved that matter be forwarded to higher authorities in this regard to obtain necessary instructions.
