The project consists of Retro-Commissioning the Mechanical Equipment and ATC System. The School District was designated a distressed school district on December 21, 2001 pursuant to the Pennsylvania Public School Code (PSC), 24 P.S. §6-691(c). The School Reform Commission (SRC) has been established pursuant to PSC, 24 P.S. §6-696, and is responsible for the operation, management, and educational program of the School District pursuant to PSC, 24 P.S. §6-696(e)(1). 2.0 Place and Date of Submission One (1) original and three (3) copies each of the Technical Proposal and Fee Proposal shall be submitted in separate sealed envelopes clearly marked: “Retro Commissioning Services for Commodore John Barry Elementary School RFP – TECHNICAL PROPOSAL” and “Retro Commissioning Services RFP for Commodore John Barry Elementary School – FEE PROPOSAL” with the name of the proposing firm and their address. Thisinformationisprovidedsolelytogiveprospectiveproposersa“ballpark”estimateoftheCommissioningServicescostsanddurationofthisprojectanditissubjecttochangeasthedeignsisfinalizedandconstructabilityreviewsarecompleted.

7.0 ProjectScope

TheSchoolDistrictwillengagetheservicesoftheCommissioningAgent(CxA)toprovideprofessionalservicesandfieldoversightandcoordination,andbuildingRetro-CommissioningoftheexistingMechanicalandBuildingAutomationSystems.

TheselectedCxAwillutilizeaRetroCommissioningprogramtobeapprovedbySDP.Theselectedsoftwareprogrammustbecompatiblewiththeexistingsoftwareandshallbenon-proprietary.AllreportstotheSDPshallbeinPDF,WordDocument,Excel,orotheracceptableformat,asthetypeofreportdictates,sothattheSDPisnotrequiredtopurchaseorsubscribetotheselectedprojectmanagementsoftwareprogram.AllprojectfilesanddocumentswillbecomethepropertyoftheSchoolDistrictatprojectcompletion.

COMMISSIONING AGENT TASK

General Requirements. The Owner is committed to Retro-Commissioning this project to ensure that all systems arecompleteand functioningproperly, to theoriginaldesign intent,prior tomaterial completionandthatfacilitystaffhasadequatesystemdocumentationandtraining.The Commissioning process shall oversee and coordinate the traditionally separate functions ofequipment startup, system performance testing and balancing, control system calibration,constructionandsystemdocumentation,andtraining.SpecificrequirementsoftheCommissioningprocessandresponsibilities,duties,andobligationsoftheCommissioningAgent(CxA)teamaredescribedbelow.Toaccomplishthesetasks,theCxAshallberequiredtocoordinatehisorheractivitieswithotherentities.TheCommissioningprocessdoesnottakeawayfromorreducetheresponsibilityoftheprojectdesignersor installingcontractortoprovidea finishedand fully functioningproduct. It isnoted that the servicesof theDesignTeam,Contractor,andvarioussubcontractorsareNOTprovidedforunderthisScopeofWorkandtheCxAisnotresponsibleforprovidingtheirservices.TheprimaryroleoftheCxAshallbeto:1)Identifyallmechanicaldeficienciesthroughtestingeachcomponentineachoftheschool’ssystem;2)Restorationofthemechanicalsystemtoitsoriginaldesignintent;3)Recommendingpreventativemaintenanceprocedurestoprolongthemechanicalequipment life. This can be attained through the development, coordination and execution of aRetro-CommissioningPlan;observinganddocumentingthedesignintentoftheexistingmechanicalequipment and system testing to establish that equipment and systems are functioning inaccordancewiththerequirementsoftheoriginaldesignintentpertheContractDocuments;andtoassist theOwner, EndUser, and SDPMaintenance Personnel in developing correct and completedocumentationoftheaforementionedprimaryroleofthiseffort.TheCxAwillnotberesponsiblefordesignconcept,designcriteria,compliancewithcodes,design,orgeneralconstructionscheduling,cost estimating, construction management, or construction supervision. The CxA may assist theDesignGroupintheOfficeofCapitalProgramswithdesignissues,problemsolving,orthecorrectionofconstructionnon-conformanceordeficiencies,butultimateresponsibilityformeetingtheprojectobjectivesandrequirementsresideswiththecontractedRetroCommissioningTeamlistedbelow.

Design Intent Review Phase

TheCxAshallassistindocumentingtheproject’srequirements,theOwner’sdesignintent,andtheoriginalbasisofdesignandrationaleforaccomplishingtheserequirements.TheCxAshallcompletethefollowingtasks:

• Review Owner’s Project Requirements (OPR) documentation for familiarization of SOWintent.

• ReviewBasisofDesign(BOD)documenttoensureconsistencywithOPR• DeveloppreliminaryCxplanandprovidedesignteamwithadraft.• Developatargetedpre-functionaltestingchecklist.• IncorporateCxspecificationsintoSDPPMProcedures.• Createcommissioningdeficiencies/issueslogtobeupdatedthroughoutCx• CompletechecklistverifyingthatCxAhasreceivedlatestversionofdesigndocuments

TheCxA,withcooperationfromtheSDPDesignGroupinCapitalPrograms,shallprovideadequatewritten OPR, Basis of Design, and full sequences of operations, complete with points lists andcontrolschematics,forallequipmentandsystemsforinclusionintheSDPO&MmanualsandfortheCxAtouseinwritingfunctionaltests.

Occupancy and Warranty Phase The Retro Commissioning at this period of post occupancy is intended to assist the Owner andfacilityoperatingstaffinidentifyinganydefectsintheinstalledequipmentorsystemoperation.TheCxAshallcompletethefollowingtasksduringthewarrantyphase:

• CompletefinalCxissueslogthatincludesresolvedandunresolvedissues• Addressconcernswithoperatingfacilityandstaff• TheCxAshouldverifytheinstallationandperformanceofallcommissionedsystemsnolater

than10monthsaftermaterialcompletionoftheproject• Completefinalcommissioningreport• Assist owner with a 12-month measurement and verification of energy performance

(optional)• Coordinateorwitnessdeferredandseasonaltestingandbalancing

Test Equipment Theinstallingcontractorsshallprovidealltoolsortheuseoftoolsrequiredtostart,checkout,andfunctionally test equipment and systems, except for specified testingwith supplemental portabledataloggers,whichshallbesuppliedandinstalledbytheCxA.To expedite air-water balance testing, and tominimize additional cost to the contractor, the CxAshall verify the Test and Balance (TAB) contractor’s air-water balance values by witnessing thetesting and verifying the results while on site. All testing shall be performed after school hours,weekendsorduringsummer/winterrecesssessions.Data loggingequipment,monitoringdevices, specializedequipment,andsoftwarenot required tobe provided by the installing contractor in the Contract Documents, and provided by the CxA tomonitor,confirm,orverifythecontractor’stestingprocedures,shallremainthepropertyoftheCxA.Equipment provided shall meet the minimum accuracy, calibration, and performance standardsrequiredbytheperformancetest.

8.0 ProposalRequirements

Technicalproposalsshallprovidethefollowingrequiredinformation.Technicalproposalsshallprovideacomprehensive,butconcisesummaryofqualificationandcapabilitiestosatisfytherequirementsoftheRFP.

9.0 FeeProposalATTACHMENT“H”

FirmsrespondingtotheRFPshallcompleteandreturnaseparatefeeproposalinaseparatesealedenvelopeatthesametimeastheirtechnicalproposalshowever,theproposer’sfeeproposalwillnotbeopenedunlessanduntilthatfirmhasbeenselectedforfeenegotiation.SeeAttachmentH.

Thefeeproposalshallmeetthefollowingrequirements:

9.1 BaseServices9.1.1 StaffingPlan

Note:FeeproposalsshallfollowthesameformatasthepersonneltablelistedinAttachment“H”,Pages1and2ofthisproposal.Thehourlyratesmustbefully-loaded(includingbenefits,overhead,andprofit),all-inclusivewageratesforallpositionsincludedinTheBaseServicesStaffingPlan.Thesehourlyrateswillalsobeusedforalladditionalservices.Onlyonehourlyrateforthedurationofthecontractforeachpositionwillbeaccepted.

9.1.4 SupportServicesHomeofficemanagementandsupportservicesaredeemedtobeoverheadcostsandwillnotbeseparatelycompensated.

9.1.5 ReimbursableExpensesTheonlyreimbursementsthatwillbepaidtotheconsultantsshallbeforactualcostofincidentalmaterialsandservicesauthorizedbytheSchoolDistrict.Thiswouldincludereproductionofbiddingdocumentsandspecialpresentationdocumentsrequiredforpublicmeetings.NormalprintingofdocumentsforSDPapprovalsorconsultant’suse,travelexpenses,andmealsshallnotbereimbursable.

9.2 AdditionalServicesCostforadditionalserviceswillbebasedonsubmittedhourlyratesforbaseservices.

9.3 CompensationandPaymentTheSDPintendstoenterintoalumpsumcontractforallrequiredserviceswiththeselectedfirm.Thatlumpsumwillnotbeadjustedfordelaystosubstantialcompletionofninety(90)

daysorless.Forpurposesofthisrequirement,substantialcompletionmeanscompletionofallareaorphasessothattheyaresuitableforfulloperationasintended,withonlyminorpunchlistsremaininguncompleted.Delaystosubstantialcompletionwillnotincreasethecompensationforpost-constructionphaseservices.Thepercentageofthetotalfeetobepaidmonthlyforcompletionofeachphase(preconstruction,construction,post-construction,andwarrantyinspection)shallbebasedonthepercentageofestimatedman-hourstobeexpendedduringthatphase.

10.0 EvaluationCriteria

TheselectioncommitteewillreviewallRFPsubmittalsandassignatechnicalscorebasedontheevaluationcriterialandtheweightingforeachsectiondescribed.

11.0 SelectionProcedure

TheSDPisfollowingatwo-stagequalifications-based-selection(QBS)processforthissolicitation(sometimesreferredtoastheBrooksActprocess).TheSchoolDistrictmayatanytimeterminatetheRFPprocessprovidedforhereinforanyreasonornoreasoninthesolediscretionoftheSchoolDistrict.ThereceiptofproposalsorotherdocumentsbyproposersduringanystateoftheRFPprocesswillinnowayobligatetheSchoolDistricttoenterintoanyagreementwithanyproposerormaketheSchoolDistrictliableforanyproposercosts.

Stage1:

Step1:Technicalproposalsoffirmswillbeevaluatedbytheselectioncommitteeandrankedonthebasisoftheirtechnicalqualificationsandsuitabilityforthisassignment.

Step2:Alimitednumberoffirms(tobedeterminedbytheSDP)withthehighestratedtechnicalproposalswillbeinvitedtointerviewsandoralpresentationswiththeselectioncommittee.

Stage2:

Inthesecondstage,thefeeproposalofthehighestratedfirmwillbeopenedandtheSDPwillenterintofeenegotiations.(Feeproposalsfortheotherfirmswillnotbeopeneduntilsuchtimeasthefirminquestionhasbeenselectedforfeenegotiation.)

IftheSDPcannotreachanagreementonfeewiththatfirm,negotiationswiththatfirmshallbeterminated.Thefeeproposalofthenexthighestratedfirmwillbeopenedandfeenegotiationswiththatfirmcommenced.

TheprocesswillberepeatedasnecessaryuntilagreementisreachedortheSDPelectstoterminatethissolicitation.

Eachtechnicalproposalwillbereviewedbyaselectioncommitteetodetermineresponsiveness.Proposalsdeemednon-responsivewillberejectedwithoutevaluation.TheSDPreservestherighttorejectanyorallproposalswhensuchrejectionisinthebestinterestoftheSDP.AresponsibleproposaliscompleteandaddressesallrequirementsoftheRFP.TheSDPreservestherighttowaiveanyinformalitiesandtechnicalitiesintheRFPprocessoranynon-materialdefectsinproposals.

Ifforanyreasonwhatsoever,theSDPrejectstheproposer’sproposal,theproposeragreesthatitwillnotseektorecoverlostprofitsonworknotperformednorwillitseektorecoveritsproposalpreparationcosts.Bysubmittingitsproposal,theproposerexpresslystatesthatitintendstobelegallyboundandacceptsthelimitationofremediessetforthinthisparagraph.Bysubmittingitsproposal,theproposerfurtherexpresslystatesthatshoulditfile,initiate,orpersuadeanothertofile,initiateorinanyothermannerpursueorencourageanylawsuitorthatsuchfiling,initiating,orotherpursuitconstitutesabreachofitsagreementwiththeSDPandthatitwillbeliablefordamagesincurredbytheSDParisingfromthebreachofthisagreementincluding,butnotlimitedto,theSDP’sattorneys’feesandcostsofdefendingsuchaction.

TheSchoolDistrictmayatanytimeterminatetheRFPprocessprovidedforhereinforanyreasonornoreasoninthesolediscretionoftheSchoolDistrict.ThereceiptofproposalsorotherdocumentsbyproposersduringanystateoftheRFPprocesswillinnowayobligatetheSchoolDistricttoenterintoanyagreementwithanyproposerormaketheSchoolDistrictliableforanyproposercosts.TheSchoolDistrictmayaltertheseananyotherproceduresasitdeemsnecessaryandappropriate.TheSchoolDistrictwillevaluateallproposalsbasedonanumberoffactorstodeterminewhatisinthebestinterestsoftheSchoolDistrict.

3. ContractingRequirementsa. Bids,RequestforProposals,andPublicSolicitations

1. Non-DiscriminationinHiring

TheRespondentagreesthatitwillcomplywithprovisionsofthePhiladelphiaFairPracticesOrdinanceadministeredbytheHumanRelationsCommissionoftheCityofPhiladelphia,thePennsylvaniaHumanRelationsAct.No.222,October27,1955,asamended,43P.S.Section951etseq;Title7oftheCivilRightsActof1964,42U.S.C.Section2000etseq.,andallpertinentregulationsadoptedpursuanttotheforegoinginprovidingequalemploymentopportunitiesinconnectionwithallworkperformedbyitpursuanttoanycontractawardedtoRespondent,(the"Contract").TheRespondentthereforeagrees:

(v) TheRespondentwillmaintainaworkenvironmentfreeofharassment,intimidationand

coercion,andwillensurethatallon-sitesupervisorypersonnelareawareofandcarryoutRespondent'sobligationtomaintainsuchaworkingenvironment.

(b) ThatitwillidentifyoneachcertifiedpayrollformsubmittedtotheSchoolDistrictthoseofits

employeeswhoareminoritygroupmembersandthosewhoarefemale.Asusedhere,"minority"meansAfricanAmerican,Hispanic,Asian,orNativeAmerican.TheSchoolDistrictshallatalltimeshaveaccesstoworksiteandtotheRespondent'semploymentrecordstoassurecompliancewiththissubsection.

(c) ThatitwillmaintainonformstobesuppliedbytheSchoolDistrict,thename,race,sex,nationalorigin,skillorcraft,address,telephonenumber,andsourceofreferralofeachapplicantforemployment,whichrecordshallshowwhichapplicantswerehired.

Non-DiscriminationinContractingItisthepolicyoftheSchoolDistrictofPhiladelphia,thatbusinessconcernsownedandcontrolledbyminoritygroupmembersandwomenshallhavefullandfairopportunitytoparticipateinperformanceofcontractsletbytheSchoolDistrict.ARespondent'splantojointventurewithorsubcontracttominorityandwoman-ownedfirms(M/WBEs)and/ortoutilizeM/WBEsassourcesofsupplies,equipment,orserviceswillbeasignificantpartoftheevaluationoftheRespondent'sresponsibility.

(a) TheRespondentwillconsiderallproposalsfrompotentialM/WBEfirmsanddocumentontheformssuppliedbytheSchoolDistrict,thereasonsfornotenteringintoajointventureorsubcontractwithaM/WBE.

(b) RespondenttothisRFPshallemploytheservicesofSub-consultant(s),asnecessary,toachievecombinedMinorityOwnedBusinessEnterprise(MBE)andWomanOwnedBusinessEnterprise(WBE)participationgoalsinarangeof15%-20%ofthetotalamountofservicesprovided.IftheFirmisaMBEorWBEfirm,thentheFirmwillhaveachievedthegoalforthatcategory.Anon-MBEorWBEfirmshallemployaMBEorWBEfirmtoachievethesegoals.

(c) TheRespondent'sagreementtomeettherequirementsoftheSectionisamaterial

representationoffactuponwhichreliancewillbeplacedifacontractisawarded.IfitislaterdeterminedthattheRespondenthasnotmadeagoodfaithefforttocomply,withintheSchoolDistrict'ssolejudgment,theSchoolDistrictmaypursueavailableremedies,includingsuspensionordebarmentoftheRespondentfromfutureSchoolDistrictworkasnon-responsible.

3. LiabilityofSubcontractors

AnysubcontractoroftheRespondentshallhavethesameresponsibilitiesandobligationsastheRespondenttocomplywiththeprovisionsofthisSectionandshallbesubjecttothesamepenaltiesforfailuretocomplyassetforthbelow.

4. Method of Compensation The method of compensation for this project shall be based on the Lump Sum Fee payable at 50% and 100% completion, see the “Professional Services Sample Contract.” Project Design Team Personnel List with Hourly Rates (page 2) The listing must include the hourly billable, all-inclusive wage rates for all people listed as design team personnel. These wage rates will be used to invoice for additional services performed. These hourly rates shall be fully loaded including benefits, overhead and profit. Please provide only one wage rate per position; do not use ranges. If ranges are used, the lower rate will be used for evaluation and if selected, will become the contract rate. Do not add positions.
