The Crysttl COurt Allht ()5 Tower.

IDS Center 80 South 8th Street 333-6656 Because of its central location and architect Philip Johnson's dramatic design, th is multi-purpose complex is the hub of downtown activity. The Center includes a 57-story office tower-Minneapolis' tallest building­an imposing hotel and three levels of retail stores encircling the "Crystal Court" atrium. All of which is inter­connected by an elaborate skyway system.

Minneapolis got its start in skyways back in the early Sixties when sev­eral buildings in the financial district were joined for businessmen's con­

·' venience. It was a good idea, and it caught on quickly.

Soon skyways were popping up all over-between major department stores, joining apartment complexes and office buildings, connecting park­ing garages with shopping routes. Currently, more than 20 central city blocks are linked by skyways. Planning and construction of more pedestrian bridges is under way.

With the 1973 addition of IDS Cen­ter skyways, the system gained its crown jewel.

I know Phoebe's father was George, but I don't know his wife or his father . Phoebe had George B., Cyrus, Darwin & sisters. One was Mary. George B. born 1831. Citicorp, shared the word on why visitors should trade In their tackle boxes for theater boxes.

"Arthur Frommer is in love with the Twin Cities because of the marvelous cultural offerings now available," Bachmann said. " The Twin Cities are no longer merely regarded as a sportsmen's paradise, but now have the distinction or being cultural capitals of the nation ranking second only to New York City."

94, died suddenly at her Sand­wich home Aug. 20. She was the widow of Harold Eugene Ragle, a U.S. Navy physician, who died inl981.

Mrs. Ragle was a native of Summerfield, Marshall County, Kansas and had graduated from the University of Kansas, class of 1914. She made her home in Palo Alto, California, for many years before moving to Sand­wich one and a half years ago.

Mrs. Ragle was a member of the P.E.O. Sisterhood, the Sand­wich Woman's Club and several local societies.

Survivors include two daughters, .Elizabeth Soule of ~~ and Emily Gene Eilertsen of Spokane Washington. Also surviving ar~ six grandchildren, John G. Born in Schenectady, New York, Dr . Sou l e was a graduate of Glen Ridge High School and of Dartmouth College, c l ass of 1936 . He received his medical degree from New York Univer s ity in 1939 and in terned at Mountainside Hospita l in Montclair, New Jersey . He later

Pennsylvania in Philadelphia . He was a Fellow of the American College of Physicians, a Diplomate of the American Board of Internal Medicine, and a member of the American Medical Association and the Massachusetts Medical Society.

For 24 years, Dr. Soule served on active ·duty in the Navy Medical Corps, retiring with the rank of Captain. He was at Pearl Harbor when the Japanese attacked. He was Senior Medical Offi c er aboard the USS Missouri <BB63) during the Korean War. In the late 1950's and early 1960's he was Senior Medical Officer at the U. S. Naval Base, Subic

·Bay, Philippines. During his last tour of duty, he was Chief of Clinical Services, National Naval Medical Center, Bethesda, Maryland.

Following retirement from the Navy in 1965, Dr. Soule settled with his family in Andover, Massachusetts, becoming director of medical education at the Beverly Hospital. He later assumed this position at the Lahey Clinic in Boston. For nine years he served medical director at Phillips Academy, Andover.

In 1979, Dr. Soule retired from the practice of medicine and moved to Sandwich on Cape Cod where he became active in community affairs . He served as Chairman of the Library Building Committee the School Building Committee, and also as a member of the Town Finance Committee.

In addition to his wife, Dr. Soule is survived by three sons, John Gordon Soule of Austin, Texas, Richard Mansfield Soule of Sturbridge, Massachusetts, and Robert Ragle Soule of Alexandria, Virginia; three grandchildren; one niece and two nephews; and several cousins.

A memorial service w~s held at St . John 's Episcopal Church in Sandwich on Sunday 5 January 1986 . Burial was at Arlington National Cemetery in Virginia on Friday 10 January 1986 .

1910 in Milburn and passed away Oct. 30, in Monahans, Texas, at the age of 74 years, 10 months and 11 days.

Funeral services were held Saturday, Nov. 2 at 2 p.m. at the Govier Brothers Ch,apel with the Rev. Gary Aten officiating. Music for the service was provided by Edna Anderson and Wanda

Cooksley. Pallbearers included Lee Strayer, Tom Christy, Walt Daily, Alan Daily, Paul Daily and Don Daily. Burial was in the New ~elena Cemetery. Govier Brothers Mortuary was in charge of arrangements.

Survivors include his wife, Faye, of Monahans, Texas; two sons, Richard of Topeka, Kan., and Marion of Midland, Texas; two

daughters, Rose Marie McLennon of Nowota, Okla., and Susan Leisk of Denver, Colo. ; one sister, Irene Christy of Anselmo; seven brothers, Merle of Elkhorn, Mick of Anselmo, Verne of Milburn, Walter of Broken Bow, Ted of Truth or Consquences, N. Bernardine was born December 29, 1912, Boston, Massachusetts, the first child of Dr. William A. Cooney and Maude (Brown) Cooney. She has one sister, Ann (Cooney) Link.

Bernardine was married july 21, 1947, in Northampton, Mass., to Walter H. Uhlig. They have one son, Walter joseph Uhlig, born March 24, 1951, a music supervisor a t Wilmington, Del., friends School.

She attended public schools in Northampton, Mass. Her teaching experience excended from 1934 - 1973 in Arizona, Northampton, Mass., Worcester, Mass., and Philadelphia, Pa. Previous to this, she graduated from Smith College and earned a M.S. from the University of Mass., Amherst, Mass.

Soule Kindred needs information, especially on families since 1800. We'd like to suggest that you begin with your 6th generation ancestor from George Soule Cor your earliest Soule ancestor, if you haven't made the connection to George-1). Fill out a form for that ancestor, and then submit forms for each of your ancestors down to yourself. This is especially important if you descend through a female line; Soule women who marry tend to become lost Soules.

We have been asked to explain how to fill out the form. To help in see.ing just ~1ow it's done, I've completed a form for m:i. 6th generation ancestor, on page 63 and 64. Let's take a look at how it's done:

T he office looks as if Andy Warhol was the interior decorator: Eng41e parts, industrial equipment

crates and photographs of mangled cars adorn the walls and floors.

Such items are not objects de art, bu,t trophies of courtroom battl~ought bY, Bowman &

Brooke .. One of ihe Twin Cities' newest law firms, it is the only local finn that does nearly all of its work in product liability defense . .

The. Minneapolis firm's specialization serves as testimony to th~owing litigation in this field. 'The number of ~!:_oduct

liability suits agaiMt manufacturers has swelled to 11,000 in 1984 from 1,500 only a decade earlier, according to the administrative office of U.S. . Courts. .. . . : ,

The firm was 'formed iii ·: .: · · February 1985 when H a~torneys, lead by Richard Bowman, split away from Gray PJant Mooty Mooty &_~nnett, a large . · Minnea~ finn. Bowman had

been a product liability attorney for Gray Plant since 1965 and had developed much of the firm's business in that area, said George Soule, one of Bowman & Brooke's seven partners. Soule left Gray . Plant with Bowman, who at 44 is the finn's oldest and most experienced attorney.

The split was as friendly as such things go ~ause the departiJJ.{· attorneys took only product ~; ?

liability clients with them, Soule said. Other law work, including other types of litigation, estate planning and real estate law, stayed with Gray Plant.

"We were a little island among ourselves" at the Gray Plant finn, said John McShane, a Bowman & Brooke partner. "It was an amiable departw:e! but I left 'ft .

behind some good fdends." Bowman & Brooke already has ·

grown to 20 attorneys and has an unusually large support staff of 25 employees. That includes a staff of three in Phoenix, where founding partner J effrey Brooke represents the state of Arizona against suits . · claiming that car accidents are the rt!Sult of poor road design by state highway engineers.

Although more than half the firm's business derives from suits filed in Minnesota, Soule said a growing propo!;iion of comes from outside the state. Its list of clients includes General Motors; Navistar, formerly International Harvester; Clark Equipment and Toyota. Bow­man & Brooke often works with the client corporation's legal staff as well as with local law firms when the trial is outside Minneso-ta. '

New disputes Soule said his firm has found it­

self increasingly involved in two new areas of product liability disputes: a utomobile airbags and all-terrain vehicles. ·

Bowman & Brooke represents Toyota in aU of its airbag cases in the United States. Last year, for fu: stance, Jan Wickstrom sued Toyo­ta for failing to install airbags: Wickstrom, a Twin Cities physi- · cian, was severely injured in a head-Qn collision with a bank robber who was driving the Wl'ong way on I-94 in an attempt to elude a pursuing police car. She contends that her injuries would have beeli less severe had her car been equipped with an airbag.

Similar cases are being brought against car manufacturers throughout the country.

Test driving and crash testing ·

are only a minor part of Bowman

& Brooke's defense strategy. ·

"Groups that are devoted to the airbag are starting to fight their battles in court, having lost it in Congress," Soule said.

The popularity of all-terrain ve­hicles, such as three-wheelers, dirt bikes and other off-road vehicles, also has resulted in a spate of law­suits.

Bowman & Brooke has been in-

valved in enough of these suits so that some of its attorneys have test driven three-wheelers so they could have a worpng knowledge of the product. In one 'Ill-terrain vehi· cle suit, Bowman was able to ra ise doubts about the cre_dibility of a plaintiff's expert witness by get­ting him to admit he'd never driv-en one of the vehicles. ·

Other vehicles Bowman & Brooke attorneys have taken for test drives include helicopters, air­planes, 18-wheelers, oil tankers and bulldozers. The firm also occa­sionally arranges to have crash tests performed on its client's .products.

But test driving and crash test­ing are only a minor part of Bow­man & Brooke's defense strategy. Other defense tactics include:

• Convincing the jury to give fair treatment to its defendant. Large corporations often are at a disadvantage when viewed next to an Injured or grieving individual, Soule said.

"Our biggest obstacle is sympa­thy for ' the plaintiff," Soule said. "We .talk to the jury about the re- · sponsibility to be objective. We don't dispute that the injuries of the plaintiff are horrible. But we advise them that they are responsi­ble under law to treat every liti­gant equally."

Also working against defendants is the fact that they often are viewed as having deep pockets. Jurors sometimes tend to feel that since the corporation has ample re­sources to pay damage awards, it should do so even if it's not legally justified, Soule said.

"It takes real gu~ not to award damages," McShane said.

· law firm's investigators attempt to establish the physical and mental state of the ·plaintiff. Sometimes the plaintiff had been drinking al· cobol or was asleep at the time of the incident, according to Soule.

"Usually in car accidents you have some time to avert or brake," McShane said. "But not when you're drunk, and you hit ·going 65 to 70 mph."

McShane often represents Gen· era! Motors in local accidents in· volving automobile gas tanks and airplane engines made by its Alii· son gas turbine subsidiary.

nany hired witnesses, the expert may have testified on such· a broad range of products that his ex· pertise could be put to question. AI the very least, such research help~ the defense anticipate the expert'~ testimony, Soule said.

Bowman & Brooke also lines UJ: its own expert witnesses, firs1 checking their backgrounds tc make sure their expertise or credi· bility is not vulnerable to attack.

• Researching the development and design of the product. In fact Soule says that many product lia bility suits hinge on the design o·

· the product. In researching the product'!

background, the firm attempts tc re-create how the product was de veloped. They also examine techni cal journals and competitors' prod uct manuals to assess the state o: the art a t the time. The fir m em _ploys a full-time librarian to aid ir such research.

· on a steep grade and injured it: driver. T~e driver is suing Clarl

for not having install~ a roll-proof . cab that be contends would have protected him from injury.

"The loader was built in 1959, and roll-proof cabs were not a state-of-the-art back then," Soule said.

Soule will attempt to show that Clark was not negligent in failing to install a roll-proof cab because while such cabs are standard fea­tures . today, they were not when the front-end loader was built.

Tort refonn strategy . A longer range defense strategy

is to convince the state Legislature to reform some of its tort laws to reduce client liability and enable them to better present the client's case.

Lawyers Association, the op~ing ' counterpart of the Minnesota Trial Lawyers Association. The defense lawyers proposed and supported a tort reform package that waS un­successful at the state Legislature in the 1986 session.
