seconded by LaCroix to approve the resolution authorizing designation of personnel with authority

to request for suppression assistance. Vote: Unanimous.

PENNINGTON COUNTY COMMISSION RESOLUTION - AUTHORIZING

DESIGNATION OF PERSONNEL WITH AUTHORITY TO REQUEST FIRE

SUPPRESSION ASSISTANCE

WHEREAS, South Dakota State Law 41-20A-11 states, “Assistance in suppression of

range fire within county--Reimbursement of expenses: At the request of a board of county

commissioners or a person designated by a board of county commissioners for such purpose, the

state wildland fire coordinator may assist in the suppression of any range fire within the county. If

any assistance provided by the coordinator includes the use of more than six state employees and

more than two vehicles, the county to which the assistance is given shall reimburse the coordinator

for the reasonable expenses incurred.” and;

WHEREAS, pursuant to SDCL § 41-20A-11 the South Dakota Wildland Fire Coordinator

may assist in the suppression of rangeland fires within the county upon request of a Board of

County Commissioners or its designee, and;

WHEREAS, at the time of a fire emergency there is insufficient time to convene the Board

of Pennington County Commissioners to make such requests, and;

WHEREAS, the South Dakota Wildland Fire Coordinator has requested that a person(s)

be officially designated by the Pennington County Commission to make such requests, and;

WHEREAS, Pennington County is responsible for the reasonable expenses incurred by

the South Dakota Wildland Fire Coordinator for the assistance that Pennington County requests as

set forth above.

NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Pennington County Board of

Commissioners in and for the County of Pennington, State of South Dakota, the Pennington

County Fire Administrator is hereby designated and authorized to request, on behalf of Pennington

County, fire suppression assistance from the state wildland fire coordinator as deemed necessary

within Pennington County. The Pennington County Fire Administrator is also authorized to

designate additional individual(s) who shall also have full authority to request assistance as

provided herein. If the County Fire Administrator designates additional individual(s), the

Pennington County Fire Administrator shall separately list the name(s) of said individuals(s) and

promptly provide the list to the State Wildland Fire Coordinator.

This authority shall continue in full force and effect until terminated by Resolution of the Board.

purchase one new 2022 114SD Freightliner tandem axle truck from Floyd’s Truck Center, Rapid

City, SD, in the amount of $108,692, off of the Pennington County 2020 contract for one new

2021 tandem axle truck. Vote: Unanimous.

MOVED by Lasseter and seconded by LaCroix to authorize the Highway Department to purchase

six new 2021 Trail King TKBD22-433 trailers from Butler Machinery, Rapid City, SD, for a total

cost of $337,356 utilizing their Sourcewell cooperative purchasing contract #121918-TKI. Vote:

Unanimous.

REQUEST TO ESTABLISH A SPEED LIMIT PINE GROVE ROAD DISTRICT: MOVED

by Hadcock and seconded by Lasseter to direct the Highway Department to prepare the resolution

MYSTIC ROAD/MAG WATER POLICY: MOVED by Rossknecht and seconded by Lasseter

to postpone indefinitely proposed revisions to the mag water policy and to direct the Road

Advisory Committee to conduct a review of the current policy. Vote: Unanimous.

EXECUTIVE SESSION – SDCL 1-25-2

A. Personnel Issue per SDCL 1-25-2(1)

MOVED by Hadcock and seconded by Rossknecht to go into Executive Session pursuant to SDCL

1-25-2(1) for the purpose of discussing personnel matters. Vote: Unanimous. The Board remained

in Executive Session from 9:57 a.m. until 10:30 a.m. MOVED by LaCroix and seconded by

Hadcock to come out of Executive Session. Vote: Unanimous.

MOVED by LaCroix and seconded by Lasseter to place Jason Enders at Grade B31/Step 15 for an

hourly rate of $28.97, effective January 10, 2021. Vote: Unanimous.

ITEMS FROM PLANNING & ZONING

BOARD OF ADJUSTMENT: MOVED by Hadcock and seconded by LaCroix to convene as the

Board of Adjustment. Vote: Unanimous.

A. VARIANCE / VA 20-22: William and Stacy Hayford. To reduce the side yard setback from

25 feet to 6 feet in a Low Density Residential Zoning District, in order to construct a garage, in

accordance with Sections 207 and 509 of the Pennington County Zoning Ordinance.

S1/2 Lot G of N1/2NW1/4 and 40 feet adjoining Lot G of NW1/4NW1/4, Section 28,

T2N, R5E, BHM, Pennington County, South Dakota.

MOVED by LaCroix and seconded by Lasseter to approve Variance / VA 20-22 with one (1)

condition because (1) granting the variance doesn’t run counter to the public interest based on

Staff’s findings; and (2) special conditions exist, to wit: topography and narrowness of the lot

that excuse literal enforcement of the ordinance in that enforcement causes “unnecessary

hardship,” to wit: buildable area and (b) granting the variance not only observes the ordinance’s

spirit but also ensures substantial justice is done. Vote: Unanimous.

1. That the Variance only applies for the proposed garage and the side yard setback be to

reduced to 6 feet for the proposed garage. All other structures must meet the minimum

setback requirements or obtain separate Variance(s).

B. VARIANCE / SV 20-06: David Spear; Fisk Land Surveying - Agent. To waive submittal of

percolation tests and soil profile information, the dedication and improvement of undeveloped

Section Line Right-of-Way, and to reduce the pavement width from 32 feet to 24 feet for Old

hole information for proposed Lot 1 or obtain an approved Subdivision Regulations Variance

to waive these requirements;

4. That at the time of Minor Plat submittal, the plat meets the requirements of Section 400.3 of

the Pennington County Subdivision Regulations, or an approved Subdivision Regulations

Variance be obtained waiving any of these requirements that are not met;

5. That at the time of Minor Plat submittal, eight (8) foot Minor Drainage and Utility Easements

be dedicated on the interior sides of all lot lines, or an approved Subdivision Regulations

AN ORDINANCE ESTABLISHING TEMPORARY ZONING REGULATIONS

THAT RESTRICT REZONING IN PENNINGTON COUNTY (SIX MONTH

MORATORIUM). BE IT ORDAINED BY PENNINGTON COUNTY, THE

FOLLOWING ORDINANCE BE ENACTED AS FOLLOWS:

WHEREAS, the Pennington County Board of Commissioners has concluded there is a

present need to study the impact of rezoning in Pennington County to determine whether current

zoning regulations adequately protect the public health, safety and general welfare; and

WHEREAS, SDCL § 11-2-10 authorizes a Board of County Commissioners, in the

interest of public health, safety and general welfare, to adopt emergency temporary zoning controls

for a reasonable period of time to study regulated land uses and related matters; and

WHEREAS, a moratorium on the approval of rezoning in Pennington County is necessary

for the immediate preservation of the public health, safety and general welfare; and

NOW, THEREFORE, BE IT ORDAINED that the Pennington County Board of

Commissioners hereby approves a six month moratorium on the approval of rezoning requests in

Pennington County; and

IT IS FURTHER ORDAINED that the moratorium will end when the amendments to

Section 200 of the Pennington County Zoning Ordinance that are currently pending take effect;

and

IT IS FURTHER ORDAINED that the Pennington County Board of Commissioners

hereby declared an emergency to exists under SDCL 7-18A-8 and 11-2-10 and, therefore, that this

Ordinance shall take effect immediately upon approval.
