RFP 15.8 – LED Lighting I. Instructions to Respondents

Proposals for the requested products and/or services are detailed in the accompanying Technical Specifications. In Minnesota, the Service Cooperatives, organized pursuant to Minnesota Statute 123A.21, are public, nonprofit cooperatives designed to provide a variety of services to their member organizations including, but not limited to, cooperative purchasing services. The Service Cooperatives currently provide purchasing contracts to more than 1,200 members (schools, cities, counties, other governmental organizations and nonprofit agencies) in Minnesota and South Dakota through the Cooperative Purchasing Connection. The Cooperative Purchasing Connection is a joint powers group of eight (8) Minnesota service cooperatives:

• Lakes Country Service Cooperative (LCSC), Fergus Falls, MN • Metro ECSU (METRO), Arden Hills, MN • Northeast Service Cooperative (NESC), Mt. Iron, MN • Northwest Service Cooperative (NWSC), Thief River Falls, MN • Resource Training and Solutions (RESOURCE), Sartell, MN • South Central Service Cooperative (SCSC), Mankato, MN • Southeast Service Cooperative (SSC), Rochester, MN • Southwest/West Central Service Cooperative (SW/WC), Marshall, MN, also serves members

in South Dakota In addition, the North Dakota Educators Service Cooperative (NDESC) is a joint powers group of North Dakota school districts, multi-district special education units, cities, counties, other governmental agencies, and nonprofits organized under the provisions of Chapter 54-40.3 of the North Dakota Century Code. NDESC holds a joint powers agreement with LCSC to provide purchasing contracts to its members. NDESC currently serves approximately 200 members across the state of North Dakota. Together, these cooperatives operate a joint purchasing program under the name of Cooperative Purchasing Connection. In this Request for Proposal (RFP), the Cooperative Purchasing Connection and the North Dakota Educators Service Cooperative will be referred to as the Cooperative Purchasing Connection (CPC). LCSC provides the administrative functions of CPC. Administrative functions include, but are not limited to: bid and contract research, development, and negotiations; fiscal reporting agent; marketing development; contract promotion and member support services.

II. Bid Procedures

A. Intent of the Request for Proposals Purpose: CPC is seeking to partner with a vendor(s) to develop a program for service cooperative members to have the ability to purchase light-emitting diode (LED) lighting at a consortium discount as described in the accompanying technical specifications at substantial savings.

Objective: To accept a vendor(s) proposal(s) that will provide a broad-line of quality LED lighting products at discounted pricing. CPC strives to bring value to its members through an LED lighting agreement, CPC’s goal is to provide members with an alternative lighting option (LED) that will provide a safer, more efficient, and cost-effective way to illuminate their facilities. CPC believes that

an LED lighting agreement will benefit CPC members by decreasing their energy consumption and lowering their maintenance and disposal costs. Through the combination of purchasing power, CPC’s objective is to achieve cost savings through a single competitive solicitation process. This process eliminates vendor(s) from responding to multiple quotes and proposals allowing for the reduction in administrative and overhead costs through our purchasing procedures. CPC will work closely with the awarded vendor(s) to market this contract not only to CPC members, but also to potential members where the contract would be an advantageous option for growing membership and purchases through the awarded vendor(s).

C. Questions

Questions regarding the RFP need to be submitted electronically via Public Purchase by 2:00 p.m. CDT on Wednesday, June 17, 2015. Questions will be answered via Public Purchase, tracked and logged within the system.

D. Responding Vendor Qualifications

All proposals must contain answers, responses and/or documentation to the information requested. Any respondent failing to provide the required information/documentation may be considered non-responsive. Respondents must demonstrate their ability, capacity and available resources to provide LED lighting products and/or services to CPC members. Respondents are required to communicate and demonstrate within their response that they have extensive knowledge, background, and at least five (5) years of experience with manufacturing, obtaining, delivering, installing, maintaining and/or supporting the product lines of products, equipment, services or software offered. CPC reserves the right to accept or reject respondents failing to demonstrate their abilities or capacity solely based on information provided in the bid response and/or its own investigation of the company.

E. Required Securities Awarded vendor(s) will be required to post a $1,000.00 performance bond at the time of the award(s). The performance bond may be in the form of a bond, certified or cashier’s check, or money order payable to Lakes Country Service Cooperative, Attn: Bid & Contract Facilitator, 1001 E. Mount Faith Ave., Fergus Falls, MN 56537. It may also be a bond naming Lakes Country Service Cooperative as obligee written by a corporate surety, satisfactory to CPC, pledging that the respondent will abide by the terms stated in this RFP and in the vendor’s proposal and pledges the faithful performance of the contract and the payment of all obligations arising thereunder. Failure to comply with the awarded vendor(s) proposal, the performance bond shall be forfeited to CPC as liquidating damages, not as a penalty. Loss of the performance bond may include, but is not limited to: poor customer service, poor quality of product, delivery issues, lack of reporting, and lack of administrative fee payments.

F. Bid Submission Public Purchase: CPC has moved its RFPs to a web-based system called Public Purchase. Public Purchase is an easy-to-use platform that provides respondents/vendors with automatic notification of open solicitations, automatic notification of answered questions and issued addenda, and a way to electronically submit your organizations solicitation response. All changes, updates, uploads, and downloads are time stamped and logged as part of the RFP process. Submission of Proposals: It is the responsibility of the respondent to be certain that the proposal submission has been uploaded to Public Purchase by the due date and time of July 1, 2015 at 2:00 p.m. CDT, as described in the Technical Specifications. All proposals MUST be submitted electronically via Public Purchase. If the proposal has not completed its upload to Public Purchase by the due date and time, the Public Purchase system and CPC will not accept the proposal. If any issues occur during the upload of the proposal, respondents/vendors should contact Public Purchase at [email protected] or utilize the chat function within Public Purchase for immediate technical support. If the data in the submission is password protected, the password must be provided with the proposal. Oral or hardcopy proposals are invalid and will not receive consideration. Interpretations: Requests for additional information, including Instructions to Respondents or Technical Specifications shall be asked via the Public Purchase platform for all participating respondents to see. CPC will respond accordingly via Public Purchase to all questions and/or by issuing an addenda.

G. RFP Particulars Addenda: Addenda are written instruments issued by CPC which modify or interpret the RFP documents by additions, deletions, clarification, or corrections. All addenda issued by CPC shall become a part of the specifications and will be made part of the contract. Addenda will be sent automatically upon CPC’s response via the Public Purchase platform. Addenda are logged and tracked within the Public Purchase system. If such confirmation is not received, the respondent may be deemed non-responsive. Interpretations, corrections, or changes made in any other manner will not be binding, and respondents shall not rely upon such interpretations, corrections and changes. No answers to questions or addenda will be issued later than seven (7) business days prior to the due date and time of the proposal, except an addendum withdrawing the proposal or one which includes postponement of the date of receipt of proposals. Correction of RFP Documents: Upon examination of the RFP documents, respondents shall promptly notify the RFP Facilitator of any ambiguity, inconsistency or error, which they may discover. Any notification of ambiguity, corrections and/or requests for interpretation must be submitted, via the Public Purchase platform, no later than ten (10) business days prior to the RFP opening. Interpretations, corrections, and changes to the documents will be made either by answers or an addendum. Such addenda will be sent to respondents via the Public Purchase platform. All changes are logged and tracked automatically by the Public Purchase system. If such confirmation is not received, the respondent may be deemed non-responsive. Interpretations, corrections, or changes made in any other manner will not be binding, and respondents shall not rely upon such interpretations, corrections and changes. Late Submissions: Proposals will not be allowed to be submitted and/or uploaded after the RFP due date and time set by CPC (see Technical Specifications). It is the respondent’s responsibility to ensure that RFP responses are received by the due date and time listed. Modifications or Withdrawal of a Proposal: A proposal may not be modified, withdrawn or cancelled by the respondent for a period of one hundred-twenty (120) days following the due date

and time of the proposal, as each responder so agrees in submitting a proposal. Prior to the due date and time of the proposals, any proposal submitted may be modified or withdrawn within the Public Purchase system. Withdrawn proposals may be resubmitted online via Public Purchase up to the due date and time designated for the proposal provided that they are fully in conformance with these Instructions to Respondents. Opening of Proposals: The properly identified proposals which have been submitted on time will be opened after the RFP due date and time. A summary of the proposals will be made available for public inspection during normal business hours in the RFP Facilitator’s office (Fergus Falls, MN) free of charge during normal business hours. For those requesting a copy (electronic or hard copy) of the RFP responses will need to pay a twenty-five ($25.00) service fee for that compilation.

H. Bid Evaluation Conditions Precedent to Award: CPC shall have the right to waive any informality or irregularity in any proposal or proposals received; to accept the proposal or proposals which, in their judgment, is in the best interest of CPC members; and to advertise for new proposals where the acceptance, rejection, waiving, or re-advertising is determined to be in the best interest of the CPC members. Within these categories, specific criteria considered are included (but are not necessarily limited to) the following: 1. Award(s) will be based on, but not necessarily limited to, the following:

a. Adherence to all conditions and requirements of the bid specifications b. Proposed pricing c. Services and support to members d. Qualifications and experience; reputation with current and past users e. “Value Added” services offered f. Needs and requirements of CPC members g. Evaluation of bidder’s ability to service CPC h. Ease and efficiency of the bidder’s order process i. Respondent’s ability to meet RFP requirements j. Geographic service capability k. Nature and extent of company data furnished upon request of CPC l. Ability of vendor to develop partnership with CPC

CPC reserves the right to award the entire contract to one vendor, to award multiple contracts, or to reject any or all proposals. A response to this solicitation is an offer to contract with CPC based upon the terms, conditions, scope of work, and specifications contained in this request. The awarded vendor(s) acknowledges that the contract offer and award (Form G – Contract Offer & Award) binds the awarded vendor(s) to all terms and conditions stated in the proposal until a contract has been signed by both parties. CPC will conduct a cost evaluation analysis of the lowest responsible vendor(s) by creating a market basket (from Form C – Pricing Schedule) and/or by creating a core list of products from multiple categories defined in this proposal to measure proposed pricing between vendors. Proposal responses will be reviewed, analyzed, and evaluated based on the evaluation criteria stipulated within this RFP document. All proposals shall be evaluated using the same criteria and scoring process of 250 points. The following criteria shall be used by CPC to evaluate proposals:

The evaluation points listed within the evaluation table above are the maximum number of points that a respondent can receive for their proposal. CPC may grant partial point for each category. Forms found in Form C – Pricing Schedule that are labeled as “Optional” are considered as “Value Added Attributes” along with other services and support that can be evaluated and scored to receive a maximum of fifty (50) points per the evaluation table.

I. Contract Award Contract Development: Following the final evaluations, CPC will develop a contract with the most highly qualified respondent(s). If a satisfactory contract cannot be developed with the most highly qualified respondent(s) the second most qualified respondent(s) may then be approached to develop a contract.

III. General Terms & Specifications

Assignment: Any contract awarded under the conditions of this RFP shall be for the use of organizations eligible for membership in the Cooperative Purchasing Connection Consortium. In addition, any eligible agency outside of the tri-state area may participate (piggyback) with this contract at their discretion, with the consent of the awarded vendor(s). All requirements of this RFP will apply to all participating eligible agencies. Agencies outside of the tri-state area participating in this RFP contract shall be responsible for obtaining approval from their approving body of authority when necessary and shall hold the agencies of the Cooperative Purchasing Connection harmless from any disputes, disagreement, or actions which may arise as a result of using this RFP contract. Audit: In accordance with applicable law, the awarded vendor will agree that a member(s) of CPC’s purchasing team may audit their records to establish that total compliance of the agreement is met. CPC will give at least three days’ notice of an audit. The audit will be conducted at a reasonable place and time. Collusion: Collusion between respondents is cause for rejection of those respondents involved. Confidential Information: CPC is a public entity; the information contained in the proposals shall be considered public information under the Minnesota Government Data Practices Act, Minnesota Statutes Chapter 13 et. seq. No part of a proposal shall be treated as confidential unless so designated, by the vendor submitting the proposal, as trade secret information having met the criteria under Minnesota Statutes § 13.37 Subd. 1(b) and other applicable laws. Any data claimed by the vendor submitting the proposal to be trade secret data must be clearly marked "proprietary and confidential." Should a challenge occur to said vendor’s designation of data as "proprietary and confidential," the vendor shall indemnify and hold CPC harmless for any attorney's fees, costs, penalties, or losses associated with such designation. CPC make no representations to any vendor regarding their designation of data as “proprietary and confidential.” Defects: All products must be 100% guaranteed. Any product which is received damaged, found to be defective, or does not perform to the end users’ expectations must be replaced at the vendor's expense including all shipping/delivery charges. If a member receives product(s) that appear to be damaged, they reserve the right to refuse delivery. Participating members will not be charged for items that are refused.

RFP 15.8 – LED Lighting 8 Due: Wednesday, July 1, 2015, 2:00 p.m. CDT

Delivery: All prices submitted are to be F.O.B. Destination, Freight Pre-Paid and Allowed. Unless clearly stated otherwise by the respondent, prices submitted shall include all charges for transportation, packaging, etc., necessary to complete delivery on an F.O.B. Destination basis. Express Online Marketplace: CPC provides members with an online purchasing platform called Express. Through Express, members are able to search for and purchase items. Essentially, Express is a one-stop shop for many of CPC’s commodity based contracts. Awarded vendor(s) do not have to have an e-commerce site to be included in Express. Over the span of a year, members have purchased over $815,000 in commodity type goods through Express. As Express offers integration into two of the main school financial systems in Minnesota, CPC expects members utilizing the marketplace and sales to grow significantly. A demonstration of Express will be available to all respondents who participate in the non-required conference call. CPC will work with the awarded vendor(s) to determine if the LED Lighting contract is suitable for the online platform.

Force Majeure: Except for payments of sums due, neither party shall be liable to the other, nor deemed in default under this contract, if and to the extent that such party’s performance of this contract is prevented by reason of force majeure. The term “force majeure” means an occurrence that is beyond the control of either party affected and occurs without fault or negligence, including, but not limited to, the following: acts of nature; acts of the public enemy; war; riots; strikes; mobilization; labor disputes; civil disorders; fire; flood; earthquakes; famine; volcanic eruptions; meteor strikes; lockouts; injunctions-interventions-acts or failures; or refusals to act by government authority; and other similar occurrences beyond the control of the party declaring force majeure which such party is unable to prevent by exercising reasonable diligence. The force majeure shall be deemed to commence when the party declaring force majeure notifies the other party of the existence of the force majeure, and shall be deemed to continue as long as the results or effects of the force majeure prevent the party from resuming performance in accordance with this agreement. Force majeure shall not include late deliveries of software or materials caused by congestion at a manufacturer’s plant or elsewhere, an over-sold condition of the market, inefficiencies and poor management practices, or similar occurrences. If either party is delayed at any time by force majeure, then the delayed party shall notify the other party in writing of such delay within 48 hours. Insurance: The awarded vendor(s) shall purchase, maintain and provide certification from insurer(s) for minimal coverage during the life of an awarded contract, to include, but not limited to comprehensive public and/or commercial liability, errors and omissions, workman’s compensation, unemployment, and other insurance coverage required by and applicable to each of CPC’s individual state’s statutes and federal laws which proposed products and services will be offered and provided. Leasing: Members may intend to purchase products and/or equipment from the awarded vendor(s) through a leasing program. The awarded vendor(s) should attempt to work with CPC’s current leasing vendor. The current leasing vendor may require a minimum purchase amount to begin the leasing process. Should the awarded vendor(s) be required to utilize their own financial leasing company, this should be noted/requested as an exception in Form B – Questionnaire. New Member Notification: CPC will email the current membership list to the awarded vendor(s) each quarter. Those members not renewing membership should not receive member pricing/discounts. Ordering: All orders will be executed by CPC members, directly, with the awarded vendor(s). The awarded vendor(s) will provide products and/or service(s) directly to the specified member and invoice that member directly. The awarded vendor(s) may offer a variety of options for members to place orders.

RFP 15.8 – LED Lighting 9 Due: Wednesday, July 1, 2015, 2:00 p.m. CDT

Patents: The awarded vendor(s) shall hold and save CPC and CPC members and their officers, agents, servants, and employees, harmless from liability of any nature or kind, including cost and expense for, or on account of, any patented or non-patented invention, process, article or appliance manufactured or used in the performance of this contract, including its use by the owner, unless specifically stipulated in the contract document. Quarter: As used herein, quarters are defined as the periods from July 1 through September 30, October 1 through December 31, January 1 through March 31, and April 1 through June 30. Recalls: The awarded vendor(s) shall notify CPC and their participating members immediately of any product recalls. The awarded vendor(s) will issue a credit or comparable substitute for any delivered, recalled product at the member’s discretion. All costs associated with voluntary and involuntary product recalls shall be borne by the awarded vendor(s). Service Cooperative Member: A service cooperative member shall be defined in accordance with the, Minnesota Statutes M.S. 471.59, and M.S. 123A.21, Sub. 11, North Dakota Century Code Chapter 54-40.3, and South Dakota Statutes 5-18A-37. An eligible member includes any school, city, county, other governmental agency, or nonprofit organization that has been deemed eligible for participation. Sales Representation and Marketing: The awarded vendor(s) agree(s) to provide identified sales/marketing representatives whom CPC can contact for sales and product information.

Sales Tax: Sales tax shall not be included in the prices quoted on the proposal form. Substitutions: The materials, products or equipment described in these documents establish a standard of type, function and quality to be met by any proposed substitution. Unless the particular specification prohibits substitution, respondents are encouraged to propose materials, products or equipment of comparable type, function and quality. Proposals for substitute items shall be stated in the appropriate blank on the proposal form, or if the form does not contain blanks for substitution, on the respondent’s letterhead attached to the pricing form. Respondents shall attach to the form a statement of the manufacturer and brand name of each proposed substitution plus a complete description of the item, including descriptive literature, illustrations, performance and test data and any other information necessary for an evaluation. The burden of proof is upon the respondent for the merit of the proposed substitution. Value Added Attributes: Attributes that a vendor can provide that assist in educating or providing additional service to CPC members. This would include, but is not limited to products/services, such as promotional items, participation in vendor shows, demonstration of products, training seminars, and ability to integrate with CPC’s Express online marketplace (if applicable). CPC also considers any “optional” forms listed within Form C- Pricing Schedule to be value added attributes.

G. Vendor Presentations: Vendors submitting proposals may be asked to make a formal presentation

of their proposal to CPC, if necessary, on Wednesday, July 8, 2015. Exact presentation location, time, and details will follow.

H. Notification of Intent to Award: RFP award notification will be made by Wednesday, July 15, 2015. The actual award is subject to approval by CPC’s Board of Directors.

I. Contract Term: The term of the contract resulting from this RFP will be from August 1, 2015 through September 30, 2016. There will be an optional yearly renewal for a period lasting no longer than three (3) additional years, based on successful performance. All renewals and performance criteria will be mutually agreed upon between CPC and the awarded vendor(s).

J. Administrative Fee: The awarded vendor(s) will be required to pay a two (2.0%) percent

administrative fee on the total gross sales to CPC members. This fee is used to cover CPC’s program costs, including the cost of conducting the RFP, continuing support of the contract, and marketing the contract to current and potential members through direct mail, email notifications, and personal on-site visits. Administrative fees shall be paid to Lakes Country Service Cooperative on a quarterly basis.

K. Reports Required of the Awarded Vendor(s): The awarded vendor(s) will provide CPC with quarterly reports listing the sales volume showing the total gross dollar volume of all purchases made by members within that quarter and the correlating administrative fee calculations. CPC may also request reports on commonly purchased items or top selling items to create or update a market basket. All reports must be submitted in MS Excel.

L. Specific Terms and Conditions: 1. To accept a vendor(s) proposal(s) that will provide a broad line of quality LED lighting products

at discounted pricing. As CPC strives to bring value to its members, CPC’s goal is to provide members with an alternative lighting option (LED) that will provide a safer, more efficient, and cost-effective way to illuminate their facilities. CPC believes that an LED lighting agreement will benefit CPC members by decreasing their energy consumption and lowering their maintenance and disposal costs.

2. Standard terms and conditions: a. The awarded vendor(s) agrees to:

i. Have access to a full inventory of the awarded product line(s). ii. Provide sales and marketing representation that is able to educate, introduce and

demonstrate products and/or services to CPC members. iii. Demonstrate that it possesses the necessary resources to, and agrees to, provide a

comprehensive training and support program on the operation and use of the LED lighting agreement. Services offered must be appropriate and adequate to ensure a successful partnership.

iv. Supply quoted pricing to CPC’s members upon their request. Quoted pricing should reflect the pricing found in Form C – Pricing Schedule.

v. Maintain a minimum monthly average fill rate of 95% or above. Items that are reordered, backordered, or partially filled are not considered filled items when calculating this service level.

vi. Invoice and ship all items directly to CPC’s participating members. vii. Provide packing slips with all deliveries including the members’ purchase order

number. viii. Orders not filled and partial shipments shall be indicated on the packing list. CPC

members shall be notified of an anticipated availability date. ix. Deliver goods during normal hours of operation on weekdays, unless at the

convenience of the member and through mutual agreement with the awarded vendor(s).

x. Pay return shipping and give full credit on any defective product. All products must be 100% guaranteed.

xi. Warranty the products and supplies purchased by members against any defects in design, workmanship and as suitable use intended for a period equal to the original manufacturer’s warranty period.

xii. Assist members in reaching a resolution in a dispute with the manufacturer over warranty terms. Equipment warranties must be clearly and visibly stated.

xiii. Provide an electronic online catalog for order entry use by and suitable for the members’ needs. The online catalog will note product discounts and, if applicable, the differing discounts for catalog categories awarded.

xiv. Verify that all items conform to applicable federal and state safety requirements. xv. Provide proper Safety Data Sheets (SDS) as required by law for all products sold. The

SDS literature must be delivered to the member with each shipment of goods. xvi. Include delivery in all pricing, although the awarded vendor(s) may require a

minimum order for no delivery charge to be assessed. If the member’s order is below the minimum order, a delivery charge may be assessed. The minimum order is based upon the member’s order. No delivery surcharge may be assessed if the order meets or exceeds the minimum, even though the actual delivery may be below the minimum due to “out of stock” or backordered items.

xvii. CPC reserves the right to request samples of products for evaluation. The awarded vendor must provide the requested samples, at no charge, within five (5) business days of the request.

3. Product and/or category terms and conditions: a. The awarded vendor(s) agrees to:

i. Provide pricing in the form of a discount percentage off catalog or the manufacturer’s suggested retail price (MSRP). Discount pricing shall remain intact for the duration of the contract term.

ii. Offer LED lighting products that will serve educational, city, county, and other governmental, and nonprofit organizations.

iii. On Form C – Pricing Schedule, C.1 – Column Definitions: 1. Read the provided column definitions and clarifying requests as they pertain to

sheet C.2 – LED Lighting. iv. On Form C – Pricing Schedule, C.2 – LED Lighting (Required Form):

1. Offer LED lighting products such as, but is not limited to: decorative lighting, exterior lighting, high/low bay lighting, bulbs, lamps, linear lighting, interior lighting, and retrofit kits.

2. Offer LED lighting products that meet the following specifications: a. A full five (5) year replacement warranty. b. Maintain at least seventy (70%) of their initial light output when they reach

their rated life hours (L70) c. A rated life ≥ 25,000 (bulbs) hours and ≥ 50,000 hours (all others).

kits that meet the following specifications: a. Are UL 924-Listed and ETL-Listed. b. Meet current National Fire Protection Association (NFPA) 101 Life Safety

Code, NFPA 70 Electrical Standards, National Electric Code, and Occupational Safety and Health Administration illumination standards.

c. Retrofit kits not to exceed five (5) watts and include a five (5) year minimum warranty.

d. Individual exit sign lamps not to exceed two (2) watts and include a five (5) year minimum warranty.

can offer to CPC members. Services can include, but are not limited to energy audits and walk-throughs, energy savings planning, installation services, etc.

1. As you envision it, what is your company’s role in this partnership? Please include sales and marketing strategies.

We’re a distributor with the majority of the major LED manufacturers available to us, and strictly a lighting distributor which provides us expertise in the lighting area that other distributors may lack as lighting is not their entire business model. Additionally we have 15+ years of rebate management experience at Xcel Energy so can assist and maximize any available rebate opportunities. In short, more of a consultative role than a strictly sales relationship.

2. Does your company have a dedicated marketing department in which CPC can communicate with and obtain marketing materials, images, etc.?

We do, headed up by Scott Gaston out of our CO headquarters.

3. Does your company have the capability to provide product/service demonstrations at shows and training seminars? If so, please explain what training options would be available to CPC members.

Yes, we can gladly perform on site trainings, product demonstrations, financial analysis examples, etc…and of course always available by phone for interactions.

4. How many staff members are dedicated to in-house customer service? How many staff members will be working directly with CPC members if your company is awarded the contract?

2 strictly on customer service, however all employees manage their customers directly. Currently able to offer 3 staff members, but can source 10+ from other locations, and additional hiring is possible in the future.

5. Using the map provided in the RFP (pg. 10), please identify the regions and/or states that your company is able to service.

All - national distributor, on site presentations most applicable to MN.

6. Inventory: where are your company’s distribution hubs located? What is the service/fill rate of inventory from those locations?

7. Describe your company’s ordering process and what methods can be used by members to place or create orders?

Directly with their account managers as well as online ordering being forthcoming within 60 days with direct logins/ordering for customers.

8. Does your company have retail locations that members would be able to access to make purchases? If so, please describe how our members would receive their discount(s) at your retail locations.

No.

9. Does your company offer online ordering? How many staff members are dedicated to your online ordering help desk?

Within 90 days, our Ecommerce site will be up an running with backend login’s for customers to input purchase orders. 3-5 staff, including account managers available for support.

10. State your company’s process for introducing new products to participating members.

We're consistently rolling out new products, nearly weekly. Typically with existing customers we simply email the relevant details, specifications, applications, etc….if there is a large group of folks signed up we have mass email functionality to provide similar info to those signed up for the newsletter.

11. Describe the sales process that your company would take with an educational member (i.e. school)? Will this process differ from a city, county or nonprofit member? If so, please describe both processes.

All customers treated equally in regards to process, evaluation, specification, rebate determination, etc….always inquire as to customer needs/goals prior to suggesting solutions.

12. Does your company offer and/or conduct energy audits, savings calculations, or an energy plan? If so, please describe the offerings and describe the associated charges. The charges can also be defined in Form C – Pricing Schedule, C.4 – Services.

Our Regional Manager, Tony Beman was previously the manager of the commercial energy efficiency team at Xcel Energy serving the MN/CO/NM markets for the last 10yrs. That position entailed exactly what is listed here, via his team of 20+ reps, inclusive of energy savings calculations, audits, energy management plans (prioritized planning), this is all standard offerings at no fee, additionally rebate determination/maximization, tax benefits, financing, and detailed financial analysis to support internal budget requirements.

13. Does your company employ or directly work with electricians that will be able to assist with the installation or retrofitting of LED lighting for a CPC member? If so, please describe the process and note any applicable charges in Form C – Pricing Schedule, C.4 – Services.

We do not directly employ electricians, but work with many throughout the state of MN so have a broad offering to support customers.

14. Does your company work with purchasing members to submit lighting rebates? If so, please explain the process you would take with the member.

We will absolutely handle this part of the process 100% as it is very much within our value proposition e.g. #12. Essentially we’ll determine the maximum rebates, complete the applications, invoicing, specification sheets, preapprovals, etc….essentially the only thing we can’t take care of in regards to rebates for customers is signing the documents for them.

15. Does your company require a minimum order? If so, what are your minimum order requirements? If the minimum is not met, what surcharge would you assess?

Various manufacturers do have minimum orders in order to attain free freight, ranging from $1000-20000. LED Supply CO has no minimum purchase order requirements.

16. Briefly explain your delivery policy and the lead time required from a member placing an order to receipt of delivery.

If product in stock in CO warehouse, ships same or following business day. Some manufacturers provide backend websites to us to allow visibility into inventory availability. Also, consistently reaching out to the manufacturers to vet lead times and associated customer expectations.

17. At times there are issues with service and/or deliveries. Please describe your process for addressing issues with participating members.

Customer service is our background, via Xcel Energy and we will always do everything in the best interest of the customers.

18. Please describe any other “value adds” your company can bring to the members of CPC.

More major manufacturer availability than most (e.g. Cree, Cooper, Philips, GE, Lithonia, etc…), years of energy efficiency/rebate/utility experience and customer service, consultative approach to give customers the best visibility into their facility opportunities rather than strictly selling product SKU’s. All services available w/o fees.

19. What are your payment terms? CC payments upon shipment, or 1% net 30.

20. Does your company accept payment by procurement card? If so, is a member assessed a fee for purchasing with a procurement card?

<$10,000 no CC fees, 5% over $10,000.

21. Does your company offer any prompt payment discounts? If so, please describe.

1% if paid within 15 days.

22. State your company’s process for handling returns and/or credits.

If LED Supply CO error, we take back returns/credit accordingly. If not, typical 20% restocking fee, however that is negotiable depending upon details.

23. Does your organization currently have another other contracts in place with purchasing consortiums similar to CPC? If so, please list your current contracts and the contract maturity date with that consortium.

If your organization currently has contracts with other consortiums in Minnesota, North Dakota, and South Dakota, please describe how your company will position this contract to CPC members, if awarded.

The number of years the product is covered under the manufacturer's warranty. For

this RFP, all products submitted must include a full 5-year replacement warranty.

The estimated time for the product's light output to decrease light by 30%. This RFP

requires that all products submitted maintain 70% of their initial light output when

they reach their rated life hours. For this RFP, all products submitted shall have a

rated life of ≥ 25,000 hours (bulbs), and ≥ 50,000 hours (all others).

The electrical power needed for the product to operate.

A unit of measure of the luminous flux or quantity of light emitted by a source; more

lumens = more light.

The measure of color quality and representatation of the degree of color shift objects

undergo when illuminated by the light source as compared with the color of those

same objects when illuminated by a reference source of comparable color

temperature. The higher the CRI (max. 100), the better appearance. This RFP

requires all products submitted to have a CRI ≥ 80.

commercial sector lighting solutions through collaboration among its federal,

regional, state, utility, and energy efficiency programs members. Energy Star

certification is an internationsal standard for energy efficient consumer products

originated in the United States. This RFP requires respondents to note if the product

is DLC qualified or Energy Star certified; all LED products must be DLC qualified or

Energy Star certified.

company’s role in this partnership? Please include sales and marketing strategies.

We envision ourselves as not just a supplier but as a resource for education, audits, financing, rebates for existing projects as well as for future budgetary considerations. We supply these services at no additional costs or obligations.

2. Does your company have a dedicated marketing department in which CPC can communicate with and obtain marketing materials, images, etc.?

Our primary manufacture does have a dedicated marketing staff where we obtain all the above information. Solus has a full time staff person who just works on School, Govt. and non-profit projects. All images, marketing material and specifications can be obtained through him.

3. Does your company have the capability to provide product/service demonstrations at shows and training seminars? If so, please explain what training options would be available to CPC members.

We currently are members of the School Facility Managers group, MASMS. Minnesota League of Cities, and the Minnesota Chief Engineer Guild and do demonstrations at all of their conferences. We also regularly do in-house demonstrations at sites for staff and administrators. This would be available to any of your members. We regularly attend most conferences and meetings.

4. How many staff members are dedicated to in-house customer service? How many staff members will be working directly with CPC members if your company is awarded the contract?

We currently have one full time staff for government, school and non profit entities. We have 2 additional staff who regularly work with these groups, primarily with audits and conferences. One of these staff are in our Aberdeen office. Currently we are looking for one additional staff for Govt. projects and may add another depending upon sales.

5. Using the map provided in the RFP (pg. 10), please identify the regions and/or states that your company is able to service.

We currently have representatives in the Twin Cities, Northern Minnesota, and South Dakota and working on representatives in North Dakota with anticipated fall 2015 staffing. We currently serve all regions on map and will be able to serve all regions on the map.

6. Inventory: where are your company’s distribution hubs located? What is the service/fill rate of inventory from those locations?

The National warehouse for our primary supplier is located at the same site as our office in Maple Grove MN. Our monthly service/fill rate for our products that are on our current MN state contract is above 95%.

7. Describe your company’s ordering process and what methods can be used by members to place or create orders?

We are very flexible primarily using purchase orders. We also take verbal, email, phone orders and Credit card orders.

8. Does your company have retail locations that members would be able to access to make purchases? If so, please describe how our members would receive their discount(s) at your retail locations.

We currently do not have retail locations but members are welcome to stop at the office/warehouse in Maple Grove and pick up an order.

9. Does your company offer online ordering? How many staff members are dedicated to your online ordering help desk?

We offer an order blank and a one time credit card authorization form or they can use a credit card. We typically set up an account with their first order and have all their shipping and billing information at that point. Customers have the option of using main office or dedicated customer representatives to order.

10. State your company’s process for introducing new products to participating members.

We have a pdf flyer called “Watts New!” That we email out on our mailing list and have on the dedicated link on our web site. We also hand them out at the many meetings and conferences we attend as well as site visits.

11. Describe the sales process that your company would take with an educational member (i.e. school)? Will this process differ from a city, county or nonprofit member? If so, please describe both processes.

For smaller school districts we usually contact the Superindentant first and introduce ourselves. In larger school districts we usually contact the facilities manager. We typically end up starting with a demonstration as we carry mosto of the products used in schools with us for that purpose. It is really all about establishing a relationship with the decisionmakers and end users. Not really to much different with other Govt. or nonprofits we work with.

12. Does your company offer and/or conduct energy audits, savings calculations, or an energy plan? If so,

13. Does your company employ or directly work with electricians that will be able to assist with the installation or retrofitting of LED lighting for a CPC member? If so, please describe the process and note any applicable charges in Form C – Pricing Schedule, C.4 – Services.

We do on occasion hire an electrician to complete the work but this is the exception and not the rule although we are looking seriously on having in house electrician. We offer and regularly offer verbal assistance on many projects for electricians if it is their first time using one of our products. We do not anticipate applying for this on this contract. We do work with the clients to find, review, write specifications for projects using our products at no additional cost.

14. Does your company work with purchasing members to submit lighting rebates? If so, please explain the process you would take with the member.

Yes, First we identify power company and calculate rebates and/or contact power company reps (ex. CEE for Excel or Energy Insight for Minnesota Power) We typically assist client with filling out forms and submitting rebates. We also follow up to make sure the get the correct rebate amount.

15. Does your company require a minimum order? If so, what are your minimum order requirements? If the minimum is not met, what surcharge would you assess?

No minimum order, no surcharges

16. Briefly explain your delivery policy and the lead time required from a member placing an order to receipt of delivery.

Our strategy is to limit the number of sku’s that we submit on the contract to the primary equipment that is used by the schools, govt. and non profits and still meet the minimum qualifications. We have m0st of these items on stock in Maple and can get these shipped typically the same day they are ordered. We also have a full line of LED’s that are not on the contract that vary in their shipping time that will be available at Govt. pricing.

17. At times there are issues with service and/or deliveries. Please describe your process for addressing issues with participating members.

We do everything possible to make the client satisfied up to and including personally delivering product or picking up returns. Typical warranty procedure has been to either pick up or send shipping label and send or hand deliver replacement products. No receipts needed as we have record of all transactions. We use shipping date as warranty date as this is a date we can verify.

18. Please describe any other “value adds” your company can bring to the members of CPC.

Assessments, training, installation overview, follow-up on installation, rebate processing at no additional cost or obligation. We also offer financing on larger projects. We offer all of the products we sell at wholesale pricing to CPC Members and 15% off MSRP (less than wholesale) on items in same family as products in same family. Example if they wanted to order a wall pack on list with a photocell or a color of bulb not on list. Example is a specialty 2700 K tube light we use in Special Education rooms.

19. What are your payment terms? Typical is 30 days from shipping date (and invoice) but are flexible. Example being we have worked with customer for portion of payment for rebate or grant funding.

We would like to offer our whole RVLT catalog at reduced price in addition to the contract offers. The reason most of these are not proposed on contract is that we do not stock them in our warehouse or they have a efficiency <90% or CRI < 80. (see #23 above)

For this RFP, all products submitted shall have a rated life of ≥ 25,000 hours (bulbs), and ≥ 50,000 hours (all others).

Question Response 1. As you envision it, what is

your company’s role in this partnership? Please include sales and marketing strategies.

We envision ourselves as not just a supplier but as a resource for education, audits, financing, rebates for existing projects as well as for future budgetary considerations. We supply these services at no additional costs or obligations.

We’re a distributor with the majority of the major LED manufacturers available to us, and strictly a lighting distributor which provides us expertise in the lighting area that other distributors may lack as lighting is not their entire business model. Additionally we have 15+ years of rebate management experience at Xcel Energy so can assist and maximize any available rebate opportunities. In short, more of a consultative role than a strictly sales relationship.

2. Does your company have a dedicated marketing department in which CPC can communicate with and obtain marketing materials, images, etc.?

Our primary manufacture does have a dedicated marketing staff where we obtain all the above information. Solus has a full time staff person who just works on School, Govt. and non-profit projects. All images, marketing material and specifications can be obtained through him.

We do, headed up by Scott Gaston out of our CO headquarters.

3. Does your company have the capability to provide product/service demonstrations at shows and training seminars? If so, please explain what training options would be available to CPC members.

We currently are members of the School Facility Managers group, MASMS. Minnesota League of Cities, and the Minnesota Chief Engineer Guild and do demonstrations at all of their conferences. We also regularly do in-house demonstrations at sites for staff and administrators. This would be available to any of your members. We regularly attend most conferences and meetings.

Yes, we can gladly perform on site trainings, product demonstrations, financial analysis examples, etc…and of course always available by phone for interactions.

4. How many staff members are dedicated to in-house customer service? How many staff members will be working directly with CPC members if your company is awarded the contract?

We currently have one full time staff for government, school and non profit entities. We have 2 additional staff who regularly work with these groups, primarily with audits and conferences. One of these staff are in our Aberdeen office. Currently we are looking for one additional staff for Govt. projects and may add another depending upon sales.

The National warehouse for our primary supplier is located at the same site as our office in Maple Grove MN. Our monthly service/fill rate for our products that are on our current MN state contract is above 95%.

We are very flexible primarily using purchase orders. We also take verbal, email, phone orders and Credit card orders.

We offer an order blank and a one time credit card authorization form or they can use a credit card. We typically set up an account with their first order and have all their shipping and billing information at that point. Customers have the option of using main office or dedicated customer representatives to order.

Within 90 days, our Ecommerce site will be up an running with backend login’s for customers to input purchase orders. 3-5 staff, including account managers available for support.

10. State your company’s process for introducing new products to participating members.

We have a pdf flyer called “Watts New!” That we email out on our mailing list and have on the dedicated link on our web site. We also hand them out at the many meetings and conferences we attend as well as site visits.

We're consistently rolling out new products, nearly weekly. Typically with existing customers we simply email the relevant details, specifications, applications, etc….if there is a large group of folks signed up we have mass email functionality to provide similar info to those signed up for the newsletter.

11. Describe the sales process that your company would take with an educational member (i.e. school)? Will this process differ from a city, county or nonprofit member? If so, please describe both processes.

For smaller school districts we usually contact the Superindentant first and introduce ourselves. In larger school districts we usually contact the facilities manager. We typically end up starting with a demonstration as we carry mosto of the products used in schools with us for that purpose. It is really all about establishing a relationship with the decisionmakers and end users. Not really to much different with other Govt. or nonprofits we work with.

All customers treated equally in regards to process, evaluation, specification, rebate determination, etc….always inquire as to customer needs/goals prior to suggesting solutions.

12. Does your company offer and/or conduct energy audits, savings calculations, or an energy plan? If so, please describe the offerings and describe the associated charges. The charges can also be defined in Form C – Pricing Schedule, C.4 – Services.

We provide all the services mentioned and also internal marketing (ie school board meetings), financing assistance, rebate assistance, installation oversite and training , follow up to verify energy savings all at no additional cost or obligation. Solus is committed to this business model and base our growth and business success on satisfied customers.

Our Regional Manager, Tony Beman was previously the manager of the commercial energy efficiency team at Xcel Energy serving the MN/CO/NM markets for the last 10yrs. That position entailed exactly what is listed here, via his team of 20+ reps, inclusive of energy savings calculations, audits, energy management plans (prioritized planning), this is all standard offerings at no fee, additionally rebate determination/maximization, tax benefits, financing, and detailed financial analysis to support internal budget requirements.

13. Does your company employ or directly work with electricians that will be able to assist with the installation or retrofitting of LED lighting for a CPC member? If so, please describe the process and note any applicable charges in Form C – Pricing Schedule, C.4 – Services.

We do on occasion hire an electrician to complete the work but this is the exception and not the rule although we are looking seriously on having in house electrician. We offer and regularly offer verbal assistance on many projects for electricians if it is their first time using one of our products. We do not anticipate applying for this on this contract. We do work with the clients to find, review, write specifications for projects using our products at no additional cost.

We do not directly employ electricians, but work with many throughout the state of MN so have a broad offering to support customers.

14. Does your company work with purchasing members to submit lighting rebates? If so, please explain the

16. Briefly explain your delivery policy and the lead time required from a member placing an order to receipt of delivery.

Our strategy is to limit the number of sku’s that we submit on the contract to the primary equipment that is used by the schools, govt. and non profits and still meet the minimum qualifications. We have m0st of these items on stock in Maple and can get these shipped typically the same day they are ordered. We also have a full line of LED’s that are not on the contract that vary in their shipping time that will be available at Govt. pricing.

If product in stock in CO warehouse, ships same or following business day. Some manufacturers provide backend websites to us to allow visibility into inventory availability. Also, consistently reaching out to the manufacturers to vet lead times and associated customer expectations.

17. At times there are issues with service and/or deliveries. Please describe your process for addressing issues with participating members.

We do everything possible to make the client satisfied up to and including personally delivering product or picking up returns. Typical warranty procedure has been to either pick up or send shipping label and send or hand deliver replacement products. No receipts needed as we have record of all transactions. We use shipping date as warranty date as this is a date we can verify.

Customer service is our background, via Xcel Energy and we will always do everything in the best interest of the customers.

18. Please describe any other “value adds” your company can bring to the members of CPC.

Assessments, training, installation overview, follow-up on installation, rebate processing at no additional cost or obligation. We also offer financing on larger projects. We offer all of the products we sell at wholesale pricing to CPC Members and 15% off MSRP (less than wholesale) on items in same family as products in same family. Example if they wanted to order a wall pack on list with a photocell or a color of bulb not on list. Example is a specialty 2700 K tube light we use in Special Education rooms.

More major manufacturer availability than most (e.g. Cree, Cooper, Philips, GE, Lithonia, etc…), years of energy efficiency/rebate/utility experience and customer service, consultative approach to give customers the best visibility into their facility opportunities rather than strictly selling product SKU’s. All services available w/o fees.

19. What are your payment terms?

Typical is 30 days from shipping date (and invoice) but are flexible. Example being we have worked with customer for portion of payment for rebate or grant funding.

20. Does your company accept payment by procurement card? If so, is a member assessed a fee for purchasing with a procurement card?

Current Minnesota State contract L290 (5) for LED lamps and fixtures.

This expires at end of year with 2 years additional renewal options. This contact has some of our newer products and thus will be more desirable to use for most schools. We are offering 2 additional lines of LED Tube Lights on this contract that are less expensive and more efficient. We offer on this contract higher discounts on our most supplied bulbs, (LED tube lights) 38% discount vs 15% discount on the state contract. (same MSRP) The State contract is ending at end of year with no guarantee of extension. We offer products in the same “family’ of products with the same discounts as products submitted on contract and offer all of our other products at our regular wholesale rate. 90% of MSRP with volume discounts available on large projects in this category.

The Designlight Consortium (DLC) prompts quality, performance and energy efficient commercial sector lighting solutions through collaboration among its federal, regional, state, utility, and energy efficiency programs members. Energy Star certification is an internationsal standard for energy efficient consumer products originated in the United States. This RFP requires respondents to note if the product is DLC qualified or Energy Star certified; all LED products must be DLC qualified or Energy Star certified.

Executive Summary Respondents were asked to submit discounts on a market basket of products meeting the minimum specifications that would most commonly be purchased by schools, cities, counties, and nonprofit agencies. Respondents had the ability to respond with various types of LED lighting such as, but not limited to: lamps, bulbs, fixtures, troffers, wall-mounts, etc. Respondents also had the option to include emergency LED exit signs and additional services. LED Supply Co. LLC From their website: LED Supply Co. is a wholesale distributor based in Denver, Colorado, that focuses on energy efficiency. As a medium-sized distributor, LED Supply Co. prides themselves on product knowledge, application, and the ability to stay up to date with the most advanced LED fixtures available in the industry. Based on LED Supply Co.’s response to the RFP, it seems their goal is to provide the best lighting products on the market and while they are not locked into a specific manufacturer, it gives LED Supply Co. the ability to recommend the most appropriate lighting for the project. Additionally, LED Supply Co. offers fifteen plus years of rebate management experience, taking on a consultative role versus strictly a sales role. Below are some highlights from LED Supply Co.’s response to RFP 15.8:

1. They are able to perform on-site trainings, product demonstrations, financial analysis examples, etc. 2. They currently are able to provide service to all three states as a national distributor, however, on-

site presentations are most applicable to Minnesota. 3. All inventory is based in Lakewood, Colorado. 4. Able to connect with members weekly via mass email functionality. 5. Currently working to develop their own eCommerce site that will be up and running in 90 days with

back-end logins for customers to input their orders; this will be staffed by 3-5 personnel for support. 6. Relationship based sales process: all CPC members would receive the same service in regards to

process, evaluation, specifications, and rebate determination. They pride themselves on inquiring the goals/needs prior to suggesting solutions.

7. Currently do not employ electricians, but work with many throughout the states. 8. Shipping: LED Supply Co. incurs shipping/freight charges from manufactures, however, LED Supply

Co. has no minimum purchase order requirements for CPC members. 9. Purchases made by procurement card over $10,000 are subject to a 5% surcharge fee. 10. Offering full credit returns if LED Supply Co. error. If not, a 20% restocking fee is standard, but

negotiable depending on details. 11. Currently on the State of Minnesota contract.

Solus LED, LLC From their website: Solus is headquartered in Maple Grove, Minnesota, and is a supplier of interior and exterior LED lighting products. Solus was founded on the basis of educating every sort of individual and business imaginable about lighting efficiencies through use of higher quality, American designed and manufactured LED product. After months of researching the LED industry on an international level, Solus chose to offer solutions through reputable American manufacturers which specialize solely on LED product development. Based on Solus’ response to the RFP, Solus envisions themselves around not just being a product supplier, but a resource for CPC members for education, audits, financing, and rebates pertaining to LED lighting not only for existing projects but also for future budgetary project considerations. Below are some highlights from Solus’ response to RFP 15.8:

1. They currently participate in two conferences that CPC typically attends (MASMS and Minnesota League of Cities).

2. They currently provide representation in the metro area, northern Minnesota, and South Dakota, but are currently working on finding representation in North Dakota (anticipated Fall 2015) staffing. Currently are able to serve all three states and will be able to do so.

3. 95% fill rate on contract items through their Maple Grove office/warehouse; typically has next or same day shipping.

4. Currently run promotions via their “Watts New!” newsletter; ability to email newsletters to members.

5. Relationship based sales process: introduction to the correct personnel at the agency (decision maker and end-user), provide product demonstrations, conduct an energy audit of current lighting infrastructure/products, ability to create internal marketing campaigns (school boards), assist in obtaining financing, assist with applying and receiving energy rebates, and provide the agency with an energy savings report.

6. Considering having an in-house electrician to work solely with the installation process for purchasing members.

7. Shipping: no minimum order and no surcharges for CPC members. 8. Offering government discounts on all products not listed on the pricing form for products. 9. Pricing: Offering all products Solus sells at wholesale pricing to CPC members and 15% off MSRP

on items in the same family of products that are not on the contract list. 10. Offering a 45 day return policy at full credit, no questions asked. 11. Current State of Minnesota contract holder; however, expressed there is no guarantee of renewal.

The products offered to CPC include newer efficient, less expensive lighting products that will be more desirable to members. The CPC offering also is host to a larger discount (38%) or most bulbs rather than the state contract discount (15%) with the same MSRP.

12. Requesting Exceptions: Solus would like to offer their whole RVLT catalog at reduced pricing in addition to the contract offers. The reason is most of these that are not proposed are not stocked in Maple Grove, or they do not have an efficacy of <90% or CRI < 80.

Pricing Schedule Pricing will be reviewed and discussed after the presentations on July 8. Recommendation Based on their responses, both companies operate differently (wholesaler vs. supplier). LED Supply Co. takes the wholesaler role in providing thousands of LED SKU’s and options for CPC members. They provide the support necessary to bring value to all CPC members (K12 and CCOGA’s), but may have minimal on-site, in-person support outside of Minnesota. Solus LED is a supplier looking to provide a LED lighting solution to CPC members. They may provide a fraction of the number of SKU’s, but they have a wider breadth of on-site, in-person support according to their response. After review of the pricing submitted, the value-adds that each respondent could bring to members of the Cooperative Purchasing Connect, it is my recommendation to CPC to invite both respondents in for a formal presentation. This formal presentation will showcase more detail about the company and their products, customer service, and value-adds than what is implied through the details of their response. From the respondents’ presentations, I would recommend an intent to award no later than Wednesday, July 15, 2015.

Pricing Schedule Respondents were asked to submit a market basket of items that met the minimum specifications stated within the RFP (i.e. warranty, hours, efficacy, color rendering index, qualification, etc.). Due to the respondents being two different companies, one a wholesaler (LED Supply Co) and the other a supplier of a lighting solution (Solus) there are not a lot of items that can be compared like for like so we filtered by common categories (efficacy, lumens, CRI). When reviewing the market basket, the LED Supply Co. is offering a 10% discount off of MSRP while Solus LED’s discount averages to be 20%. Below are four broad categories when comparing pricing:

Other optional forms include services and volume discounts. Neither company is offering volume discounts, however, in regards to services, neither company will be charging for energy audits, and any on-site training. Both LED Supply Co. and Solus LED will assist with rebate assistance and management. Solus LED offers a 45 day free product trial.

Dear Jim Azure: Congratulations on becoming an awarded vendor with the Cooperative Purchasing Connection (CPC). We’re looking forward to working with you and you’ll soon be receiving a contract for review. In addition, as you may know, CPC requires awarded vendors to post a $1,000.00 performance bond at the time an agreement is met and the contract is signed by the awarded vendor. The performance bond may be in the form of a bond, certified or cashier’s check, or money order payable to Lakes Country Service Cooperative. It may also be a bond naming Lakes Country Service Cooperative as obligee written by a corporate surety, satisfactory to CPC, pledging that the awarded vendor will abide by the terms stated in the RFP and in the vendor’s proposal and pledges the faithful performance of the contract and the payment of all obligations arising thereunder. With any partnership, some are not successful. Failure from an awarded vendor to comply with the proposal and contract agreement, the performance bond shall be forfeited to CPC as liquidated damages, not as a penalty. The loss of the performance bond may include, but is not limited to:

• Poor communication; multiple documented failures to correspond with CPC. • Poor customer service; failure to respond on multiple occasions to CPC members within a timely manner. • Poor quality of product and failure to replace/refund member purchase when appropriate. • Delivery issues; consistent and documented failures to deliver product on time or in proper condition. • Lack of on-time reporting and inaccurate quarterly reports. • Lack of quarterly administrative fee payments.

Performance bonds will be returned in their full amount upon the successful completion of a bid cycle. Please let me know if you have any questions.

The cooperative purchasing team, using the weighted criteria outlined in the Request for Proposal (RFP), have completed their review of the proposals received. Evaluation criteria included qualifications and experience, quality and variety of product selection, pricing, services and support, and ease of ordering. However, the cooperative purchasing team has decided to reject your proposal based on LED Supply Co.’s ability to service members in both North Dakota and South Dakota. We want to thank you for your proposal, taking the time to present in-person to our purchasing team and the interest in this RFP.
