HISTORICAL NOTE
The first authority to regulate public health in Nebraska wasgiven to individual municipalities in the state in 1869. A newcriminal code of 1873 related in part to offenses against publichealth. The second effort to regulate the practice of medicine wasin 1881 when an act passed by the Legislature required physicians toregister their qualifications with county officials. Similarrequirements were made for the practice of dentistry in 1887.
The original law forming the State Board of Health was enactedin 1891. This law was amended in 1903 to provide for a State HealthInspector. The Board of Health was composed of the governor,attorney general and supt of public instruction. The board wasempowered to grant and revoke licenses for the practice of medicineand surgery, dentistry, and nursing; to supervise all mattersrelating to the protection of people from contagious, infectious andepidemic diseases; to license maternity homes; to appoint boards ofexaminers for professional medical persons; and to operate abacteriological laboratory
The Department of Public Welfare gained supervision and controlover matters relating to public health by the Civil AdministrationCode of 1919. This new organization created the Bureau of ExaminingBoards under the authority of the Department of Public Welfare. Allmembers of the different boards of the Bureau were appointed by thatdepartment. Prior to 1927 there were ten groups of examiners eachof which had a separate practice act. After control of these boardswas transferred to the Department of Public Welfare, the ten groupswere recodified in the Uniform Licensure Law of 1927 to be regulatedby one act. That act also provided for the annual renewal of alllicenses in Nebraska.
The Board of Pharmacy was created in 1887 to examine applicantsfor pharmacists' licenses and register. Members were the attorneygeneral, secretary of state, auditor, treasurer, and commissioner of

In 1899 the Board of Embalmers was established to examine andcertify embalmers. This board was appointed by the state board ofhealth. The legislature of 1931 required all funeral directors andundertakers in Nebraska to register.
The Legislature of 1901 provided for the certification ofosteopaths by the state board of health. In 1909 the state board ofosteopathy was formed consisting of the governor and five examinersappointed by the governor to examine and certify persons desiring topractice osteopathy.
An act approved April 3, 1903 required the state board ofhealth to examine all applicants for certification as physicians.Prior to this time physicians were required to hold a diploma forregistration in Nebraska. The legislature of 1917 passed a lawreorganizing the health department and created an advisory board toconduct examinations for licenses to practice medicine.
The Board of Dental Secretaries was created by the legislaturein 1905. It consisted of five dentists appointed by the state boardof health for terms of five years. Their duty is to examine,certify and register all dentists in Nebraska.
Another Board created in 1905 was the Board of Veterinarians,later of the Board of Veterinarian Medicine and Surgery.
The Board of Optometry was created by the legislature of 1907.It consists of three examiners appointed by the governor for termsof three years.
The Board of Examiners of nurses was created by the 1909legislature and members were appointed by the state board of health.The legislature of 1935 eliminated the nursing profession from theUniform Licensure Act and set up a Bureau of Education andRegistration of Nurses within the Department of Education under thesupervision of the Superintendent of Public Instruction.
The Board of Chiropractic was created by the legislature of1915.
The 1919 legislature established the Board of Chiropody.

The Basic Sciences Act was passed in 1927 requiring candidatesapplying for a license to practice the healing arts to be certifiedby a Basic Science Board before taking a license examination. Thecertificate related to Chiropractic, Osteopathy, and Medicine andSurgery, and covered the subjects of anatomy, physiology, chemistry,bacteriology, pathology, and hygiene.

The Board of Barber Examiners was also created by the 1927legislature under the supervision of the Department of PublicWelfare. The law was amended in 1929 to include all those who cuthair to hold haircutters licenses.
The Board of Cosmetology Examiners was created January 1, 1930.
The Board of Examiners for Architects and Engineers wasestablished in 1937. See RG081 for records.
From 1953 to 1981, the Department of Health was governed by aBoard of Health appointed by the governor. The 1981 Legislaturepassed a law defining the role of the 15 member Board of Health asthe Bureau of Examining Boards.
From 1981 to the present time. The sole role of the Board ofHealth has been to govern the Bureau of Examining Boards. TheDepartment of Health is no longer governed by a board and is headedby a Director.

NOTE: The following volumes are minutes of the NebraskaState Board of Health and include actions taken by theBoard regarding licenses to practice medicine inNebraska, 1903-1935. By a legislative act April 3,1903, the state board of health was required to examineall applicants for certification as physicians. By alegislative act in 1905, maternity homes and boarding homesfor infants came under the jurisdiction of the board.The board was known as the Secretaries to the State Boardof Health until July 23, 1917. It then became the AdvisoryBoard to the Nebraska State Board of Health and wasorganized as such July 24, 1917. It was again reorganizedas the Board of Medical Examiners in November 1918 andbecame a part of the Department of Public Welfare. Thisboard held its 1st meeting November 13, 1919 and continuesthrough the period of these minutes, January 8, 1935.
