I am the new Chapter President for OCRIMS in 2014. It’s a long story, but I actually served as the OCRIMS Past President last year, 2013. I have been involved with OCRIMS and its Board of Directors off and on since 2001, when I arrived in Southern California from Maine. The Reader’s Digest version of my career is I have worked in the insurance and risk management industry since 1976, first as a claims person with a now defunct insurance company (Kemper—I had nothing to do with their failing), then as a risk manager, and during my mid-life crisis I started an insurance agency in Ogunquit, Maine. That’s enough about me. OCRIMS currently has approximately 215 members, and our newsletter reaches out to more than 700 people. We have monthly chapter luncheon meetings at the Orange Hill restaurant in Orange. If you have never been there, you must put this restaurant on your bucket list. It is located high up on a hill (as the name suggests) and offers spectacular views of all Orange County, just breathtaking. Information about our February 2014 luncheon meeting is located on the following pages of the newsletter. Bridgette Castillo with St. Joseph Health System was the OCRIMS President in 2013. She did a fabulous job and worked tirelessly for our Chapter, and this year I am glad she will serve as our Past President. You should have no expectation that I could ever meet or exceed Bridgette’s efforts. President’s Message by Dan Reynolds

Welcome to the January 2014 Orange County RIMS newsletter! I am the new Chapter President for OCRIMS in 2014. It’s a long story, but I actually served as the OCRIMS Past President last year, 2013. I have been involved with OCRIMS and its Board of Directors off and on since 2001,

when I arrived in Southern California from Maine. The Reader’s Digest version of my career is I have worked in the insurance and risk management industry since 1976, first as a claims person with a now defunct insurance company (Kemper—I had nothing to do with their failing), then as a risk manager, and during my mid-life crisis I started an insurance agency in Ogunquit, Maine.

That’s enough about me. OCRIMS currently has approximately 215 members, and our newsletter reaches out to more than 700 people. We have monthly chapter luncheon meetings at the Orange Hill restaurant in Orange. If you have never been there, you must put this restaurant on your bucket list. It is located high up on a hill (as the name suggests) and offers spectacular views of all Orange County, just breathtaking. JANUARY LUNCH MEETING REVIEW by Diana Rich

OCRIMS welcomed in 2014 with its traditional workers’ compensation update. The meeting was

well-attended and featured top-notch presenters.

James Bradley, VP of Strategic Management at Reny Company, shared with us some sobering statistics on the pervasive fraud still occurring in California. For 2011-12 (the latest year data are available) district attorneys statewide reported a total of 819 arrests, prosecuted 1,332 cases, and had 708 convictions with restitution of over

$53 million awarded. The fight against fraud is far from over: It is estimated that, of the $125 million in known or paid fraud, there is another $126 million in hidden or unreported fraud. Experts estimate the total cost in the US of medical fraud across all lines is $90 billion. Employers are encouraged to work with their claims administrators and insurers to understand the scope of fraud-prevention activities and what they can do to join the fight. Judge Ellen Flynn, Associate Chief Justice in charge of the 12 Southern California WCAB offices, graciously stepped in for Katherine Zalewski, Chief Counsel of the California Department of Industrial Relations, who was called away at the last minute. Judge Flynn gave us some highlights of WCAB operations, and what we can look forward to in 2014.

One exciting development is the introduction of a new program for remote appearances from CourtCall. Parties will be able to handle routine matters via conference, saving considerable time and energy. Most WCABs in Southern California are participating in the pilot program, and early feedback is very favorable.

The WCAB has revised its Policies and Procedures manual to reflect the changes in workers’ compensation since the last version was published in 2003. Among the changes: Index 1.155 gives judges the power to “… require that all parties appearing in the courtroom be dressed appropriately and conduct themselves properly for a courtroom setting.” Anyone who has been to the WCAB lately will be watching to see how this turns out. Judge Flynn presented an update from Destie Overpeck, Acting Administrative Director of the Division of Workers’ Compensation, on the progress the Division has made in enacting the regulations required to implement SB 863. Among these are fee schedules for various services, new rules for Qualified Medical Examiners (QMEs), Independent Medical Review (IMR), Independent Bill Review (IBR), benefit notices, and Medical Provider Networks (MPNs). CSUF CENTER FOR INSURANCE STUDIES $30,000 ENDOWMENT by Bridgette Castillo

The mission of OCRIMS is to advance education, communication and professionalism in the risk management community, which is why we started a relationship with Dr. Weili Lu (Director of the Center for Insurance Studies at Cal State Fullerton) 15 years ago. We’ve contributed our time, knowledge, guidance and more than $60,000 in scholarship funds during this long-standing relationship. We are honored to be investing in the Orange County community to develop young risk professionals.

At the OCRIMS lunch meeting on January 7, our Chapter presented the Center for Insurance Studies at California State University, Fullerton with a check for $30,000. The endowment is for the development of risk management coursework, general program support and ultimately, development of a risk management and insurance undergraduate degree. The endowment will provide $1,000 in student scholarship(s) annually to qualified students in perpetuity. The Dean of the Mihalyo College of Business and Economics, Dr. Anil Puril, and the Director of the Center for Insurance Studies, Dr. Weili Lu,

graciously accepted the endowment on behalf of California State University, Fullerton. The endowment was presented by Al Gorski (RIMS Board member), Bridgette Castillo (2013 OCRIMS President), Cristin McAllister (OCRIMS Past President), and Marybeth Hughes (OCRIMS Past President).

Insurance industry experts in a panel discussion agreed that while terrorism risks are changing, they believe the Terrorism Risk Insurance Act (TRIA), set to expire Dec. 31, 2014, will be reauthorized by Congress. In fact, a poll taken at the annual Property/Casualty Insurance Joint Industry Forum found that 93% of attendees believe TRIA will be renewed.

“In the U.S., we’re moving away from the risk of catastrophic-scale terrorism. But we are probably more likely to have the Boston Marathon type of terrorism,” said Stephen Flynn, professor of political science and founding director of the Center for Resilience Studies at Northeastern University in Boston.

The reasons are that, “The know-how to carry out these low-end acts is pervasive and the opportunities for this type of terrorism are relatively high. Because they can be conducted on a small scale, they are difficult to plan for in advance and intercept,” he explained, adding, “In my mind there is no question that the feds need to play a backstop role. This isn’t a natural market. It’s not a natural disaster environment. The role an industry can play in educating about risk and engaging mitigation measures is a very useful public policy outcome of the feds playing a role as a backstop.”

The six-member panel was moderated by Julie Rochman, president and CEO of the Insurance Institute for Business & Home Safety.

Robert H. Easton, executive deputy superintendent of the insurance division at the New York Department of Financial Services [pictured above with John Huff, director of the Missouri Department of Insurance] said, “We would like to see TRIA in some form become permanent so we don’t have to have this discussion every few years.”

Easton added, “The political reality is that this is unlikely to occur, but our view is that if anybody should be taking one of the more extreme views it is New York. The program has been critical to insuring that there is sufficient capacity in the marketplace.”

Huff agreed that it needs to be renewed, but noted that TRIA should not be a “big state, small state issue.” Rather it should be supported by states of all sizes. “Missouri has a significant urban, suburban and rural presence,” he said.

Jay Gelb, managing director and senior equity analyst for Barclays believes TRIA will be reauthorized at the last minute. If reauthorization doesn’t happen, “It would be concerning from an investment viewpoint,” however, “Insurers could underwrite the exposure or limit their concentrations in target areas, especially in lines where losses cannot be excluded, such as workers compensation.”

Matthew Mosher, senior vice president and chief rating officer for the A.M. Best Company observed that while insurers can, indeed, manage the risk of terrorism, and even avoid it, “What does that do for the nation as a whole? When you look at the impact of TRIA, it comes down to how much risk you want individuals to absorb. At this point insurers are not able to provide a large amount of coverage without a backstop.”

In terms of adjustments to the program, Easton said, “We would like to see the inclusion of cyber as a risk that TRIA addresses. The cyber world is very different today than even 12 or 13 years ago.”

RIMS COMMENDS THE FIO FOR ISSUING ITS INSURANCE REGULATION MODERNIZATION REPORT

 

In early December 2013, the U.S. Department of the Treasury’s Federal Insurance Office (FIO) released a report on how to modernize the country’s insurance regulation system. While the RIMS External Affairs Committee reviews the report’s findings, the Society is pleased that the FIO has taken this important step toward improving the inconsistent system of laws currently regulating both domestic and international insurance.

“RIMS strongly supported the creation of the Federal Insurance Office as a first step toward needed federal regulation of the insurance market,” said Carolyn Snow, RIMS Board Director. “There is no question that commercial insurers,

producers and policyholders would benefit from more consistency and uniformity in terms and conditions when insurance is purchased from a single insurer.

Opportunities to streamline the insurance purchasing process are a priority for this Society and we’re happy to see the FIO make progress to enhance regulations.”

In December 2011, RIMS filed a comment letter to the FIO with the Society’s recommendations for insurance regulations. Issues in the letter included:

A recommendation to counter the inherent weakness in the state-based system that allows states to legislate variance to national standards or model laws or simply apply or interpret these standards in a manner that diverges from any national standard.

RIMS identified the lack of uniformity in licensing requirements, new product entry, requirements, or terms and conditions, without any sound policy justification for differences as creating significant barriers to entry into the market.

In regards to insurance subsidiaries of groups that are internationally active, RIMS advocated in favor of credit to be given to the capital held at the subsidiary level and that capital requirements should be the same for domestic and international insurers and subsidiaries. The Society noted that disparate regulations could lead to lower credit ratings, higher borrowing costs for international groups, as well as affect capacity and therefore increase cost of insurance to consumers.

CAROLYN SNOW NAMED 2014 PRESIDENT OF RIMS

Society Introduces 2014 Officers & Board of Directors 

NEW YORK — RIMS has announced that Carolyn M. Snow, CPCU will lead the Society as president for the 2014 term, effective January 1.

Ms. Snow is the Director of Risk Management for Humana Inc. She has been a member of RIMS for 14 years and on its Board of Directors for seven years. Previously, Ms. Snow served as the society’s Treasurer, Secretary and Director of External Affairs. She is a member of RIMS Kentuckiana/Bluegrass Chapter.

“Risk management has arrived,” said Ms. Snow. “Business leaders around the world realize that this business function can do more than just protect assets. Risk practitioners are being called on to identify and create value for their organizations and, now, have a tremendous opportunity to contribute to their companies’ strategic direction.”

Snow continued, “But, it’s not enough to just acknowledge the evolution of risk management. With an emphasis on resources that support tomorrow’s

leaders, the Society’s global initiatives and that draw from our membership’s vast knowledge and expertise, RIMS will provide our global network of risk practitioners with a clear vision of the future of the profession to better equip them to advance their risk programs through 2020 and beyond.”

MANAGER, SAFETY & LOSS CONTROL—BJ’s Restaurants, Inc. Restaurant Support Center in Huntington Beach is looking to hire a Safety & Loss Control Manager, who will report to the Senior Director of Risk Management. The Safety Manager is responsible for developing, implementing, and managing all aspects of safety for a multi-state restaurant operation, brewery operation and Restaurant Support Center.

Areas of Responsibility: Analysis of reported incidents to identify root cause and ensure proper corrective

recommendations have been generated to reduce or eliminate hazards. Perform on-site Property/Liability inspections of restaurant and brewery operations to identify

and evaluate hazardous conditions and make recommendations for corrective measures to minimize risk.

Oversee the development, coordination and implementation of comprehensive employee-training programs, including safety education and programs designed to support operational efficiency.

Develop and oversee safety-incentive programs. Communicate with management on issues related to safety guidelines, policies, procedures and

compliance. Oversee the coordination and implementation of OSHA-required training. Communicate and coach restaurant and support center management teams regarding safety-

related issues and recommend appropriate actions. Monitor accident investigations and follow up to verify effectiveness of resolution, remedy

and/or repair. Ensure compliance to Company safety programs and procedures. Overall management of Company Safety Matters binder, updating as necessary. Maintain and update Company Injury and Illness Prevention Plan (IIPP). Promote and support a strong safety culture across the organization.

Key Skills and Requirements: Working knowledge of Federal and California OSHA standards. Working knowledge of basic restaurant fire safety and emergency-response requirements. Bachelor’s degree or equivalent combination of education and experience. ARM Professional designation preferred. Minimum of five years related experience in safety with an emphasis on workers’

compensation and general liability. Fluent in Spanish is a plus. Working knowledge of MS Word, Excel, PowerPoint, and relational databases. Willingness to travel.

NEW YORK — Registration is now open for RIMS 2014 Annual Conference & Exhibition. ANTARCTICA FACTS Since winter has yet to make an appearance in Southern California, think about Antarctica while you are baking in the current heat wave.

Antarctica is the highest, driest, windiest, emptiest, coldest place on earth.

An ice sheet covers all but 2.4 percent of Antarctica’s 14 million square kilometers.

At its thickest point the ice sheet is 4,776 meters deep and averages 2, 160 meters thick. This is 90 percent of all the world’s ice.

There are lots of penguins, whales, seals, and fish in Antarctica’s waters, but there are no land mammals and, as far as scientists know, no native peoples.

Eskimos and polar bears are found in the ARCTIC, not the Antarctic.

The mean annual temperature at the South Pole is minus 56 degrees F.

The continent is roughly 14 million square kilometers (5.4 million square miles). The USA is only 9.36 million square kilometers (3.6 million square miles).

Scientists work on all kinds of unique projects in Antarctica, including climatology, glaciology, astronomy, UV radiation, and more. Scientists also study humans in Antarctica, doing research on how the human body adapts to cold and how the human mind and heart react to extreme isolation.

The Antarctic continent wasn’t even actually seen until 1820. No man set foot in Antarctica until 1895. The first human landing there is claimed by Henryk Bull, with a party from a whaling ship.

Most tourists who visit Antarctica visit the Antarctic Peninsula, which is accessible from Chile. There the climate is mild in comparison with the rest of the continent, and is teaming with wildlife. This part of Antarctica is sometimes called the “Banana Belt.”

All warm-blooded animals living on and around Antarctica--whales, seals, sea birds, penguins--rely on thick layers of blubber to insulate them from the cold. The layer of blubber on a Weddell seal can be up to 4 inches thick.

Plants grow in Antarctica in ice-free regions (only about 2 percent of the continent is ice-free). Lichens and moss grow in any favorable niche, including in sand, soil, rock and on the weathered bones and feathers of dead animals. Algae also grows in Antarctica.

Fifty million years ago Antarctica had a temperate climate, evergreen forests and many more kinds of animals than it has today. As the icecap slowly formed, most of the animals that lived there in ancient times were obliterated. Evidence of this once warm climate is in the fossils of plants, including fossil ferns, found by scientists.

There are many different species of penguins in Antarctica, including the gentoo, the chinstrap, the rockhopper, the king, the macaroni and more. In all there are 21 species of penguin scattered throughout the southern hemisphere.
