1. INTRODUCTION

2. The Objectives of the Project are:

5. ABOUT THE ACT:

The Right to Information Act, 2005 was enacted by the Parliament on

15th June 2005 and came into operation on the 12

th October 2005.

The followings are the objective of the Act: -

(i). To provide for setting out practical regime of right to information for

citizens to secure access to information under the control of public

authorities;

(ii). To promote transparency and accountability in the working of every public

authority;

(iii). To set up Central Information Commission and State Information

Commission and for matters connected therewith;

(iv). To contain corruption and to hold governments and their instrumentalities

accountable to the people: and

(v). To harmonise revelation of information with public interests, including

efficient operations of the governments, optimum use of limited fiscal

resources and the preservation of confidentiality of sensitized information.

INITIATIVES TAKEN BY AT THE STATE GOVERNMENT :

Just after the enactment of the Act, all the Departments of the State

Govt. have already designatied FAAs,PIO’s and APIO’. However, in regard to

Proactive Disclosure as required under Section 4(1) (b) of the Act giving details

of the organization, funding pattern, employees list etc. etc. have not yet been

made by some departments.

The State Govt. constituted the State Information Commission (SIC) on

time as per the requirement of the project Act. The SIC is very good in strength

compared to many other states in the country i.e. 5 Information Commissioners

and one Chief IC. The various judgement given have been trend setter for the

public and transparent governance, The disposal rate of the appeals and

complaints at the SIC level is excellent as is evident from the Tables 1-3, given

below:

EFFORTS AT HIPA LEVEL:

In order to further streamline the training programmes, HIPA is also having

three Divisional Training Centres (DTC) at Punchkula, Hisar and Rohtak. DTC

Panchkula was established in the year 1993-94 while DTCs at Hisar and Rohtak started

functioning in 2007 & 2009 respectively. These DTCs have also been very helpful in

successfully implementing the RTI Project. Being an apex Training Institute, HIPA is

aware of the problems, apprehensions and responsibilities of the Government Officers

working as the functionaries (i.e. FAA, PIO, APIO) under the RTI Act. Even before

being selected as SIA under the project, HIPA has been conducting training

programmes on RTI at HIPA and in its DTCs. These training programmes were being

funded by Haryana Government. The target group in all the training programmes so

conducted have been newly appointed PIOs, APIOs, FAAs, NGOs, Media Persons and

also other social activists. Most of these programmes, except the district level training

programmes, were used to be organized for 2 to 3 days. It had also moved to all the

district headquarters for organizing RTI programmes for the district level officers,

activists and media persons in the year 2006 .

Haryana was selected in the second phase of the CAPACITY BUILDING FOR

ACCESS TO INFORMATION project. Consequently, HIPA as SIA and the two

districts (i.e. Jhajjar and Gurgaon) as the DIAs were selected by DOPT, Government of

India for the implementation of the project. In order to implement the Act in true spirit,

HIPA has been taking up training programmes, mass awareness programmes etc. so that

the same is implemented in true spirit. A large number of the FAAs, PIOs, APIOs and

other officers/officials have been trained. However, during the period of the said project

many PIO’s/APIO’s and other officers/officials could not be covered. Even then, a good

number of Govt. Officials at the level of FAAs/PIO’s/APIO’s and other

officers/officials were covered under the Project. The role of the HIPA in

implementation of the Act is basically giving training to the Govt. employees and

creating Mass awareness to the general public through various means.

Thus imparting training to the Government employees is in one way for

the officers to be well equipped in the contents of the Act so that information seeker

can be helped out when information requests are made. To realize the ultimate objective

of the Act, imparting training to the NGO’s/citizens, media people and also the

commoners is also not less in importance. The general public have been made aware

about the important provisions of the Act so that they could ask for information which

really improves their life in rural and urban areas. It is quite automatic that when the

people are free to get the information from the public authorities, transparency in the

working of the public authorities is the result. This will ultimately achieve of what the

citizens aimed at i.e., good governance for the Govt. as well as for the governed.

When checked up in the Government departments, through the process of

information audit, good response could be seen on implementation of the Act from

many departments except in a few cases. The applications filed by the information

seekers, in some cases are very general in nature which does not involve any long

process of giving information to them. The applications requesting for the third party

information are coming in large numbers.

AT THE DISTRICT LEVEL:

Gurgaon district is divided into four blocks i.e. Gurgaon, Pataudi, Sohna and

Faruknagar while Jhajjar district is divided into five blocks i.e. Jhajjar, Bahadurgarh,

Beri, Matenhail and Salhawas. As far as DIA Gurgaon is concerned, it used the

expertise of Haryana Institute of Rural Development, Nilokheri and Nav Jyoti

Foundation of Dr. Kiran Bedi, IPS (Retd.) to carry out the activities of the project.

HIPA also organized one different stakeholders workshop and three training

programmes on the behalf of the DIA Gurgaon. Resource persons trained by HIPA were

also used to organize the training programmes in the villages. Banners, hoardings,

pamphlets, brochures and RTI calendars have been other means of awareness

generations.

DIA Jhajjar used the services of the resource persons trained by HIPA to organize

training-cum awareness programmes at the district, block and village levels. Banners,

generations.

Both the DIAs have prepared the RTI directories of the district level functionaries

of the RTI Act. Information fairs, audit of proactive disclosures and the impact of RTI

act on the working has been other important work done by the DIAs.

KEY ISSUES TO BE TAKEN CARE OFF AT STATE LEVEL:

The State Information Commission is still to have its own building and is housed

in a rented building at Chandigarh. The State Government seems to be very sincere in

implementing the project that is why it has decided in principle to establish a call centre

with 6 seats and about 1159 common service Centers in the rural areas and 114 centres

in the urban area in the State. It will take some more time by the time these start

working. Proper record management of all the Departments needs to be thrust upon. In

addition, proactive disclosure of all departments could be made compulsory as there are

few departments and public authorities who are yet to put their details as per the

requirement of the Section4(1) b. Moreover, Public authorities are not updating the

information. All the departments and public authorities need to prepare the details of

applications received, applications disposed of properly at the PIOs levels itself, number

of first appeals and reasons thereto and also appeals to the IC. Penalty prescribed

against the officials if they do not adhere to these time limits. This would certainly make

the monitoring over the departments more effective.

The objective of the Act could be achieved only when the general public

are made to understand about the Act in detail. In such scenario, the role of the Mass

Media for effective implementation of the Act is very important.

2. Activates Undertaken by the SIA and DIAs

(A). Training and Capacity Building

(I) Training and capacity building are the main components of this project.

As there are the only means to improve one’s knowledge and skill etc. on a particular

subject. During the project period 2007-09 HIPA and its Divisional Training Centers

conducted 59 training programmes. A total of about 2055 trainees participated of the

total participants attended the training programmes. About 95% of the total participants

attended these training programmes were FAA, PIO, APIO and other officers/officials

while the rest 5% were from NGOs Media and other civil society organizations and

some times very active members of general public. The detail about number of training

programmes along with the date and no. of participants is given below as Table 4-14.

In many cases, training module was of 1-2 days duration. At the DTC levels

mainly the training programmes were organized just for a day. In the one day training

programmes the salient features of the RTI Act and how effectively the information

could be provided, were use to be covered. In the 3 to 5 days training programmes role

play group, work case law discussions and even basics of computer use to be covered.

Many training programmes used to be organized for 3-5 days also. (Schedules of 1-5

days training programmes are given at Table 15-17.

HIPA being very close to Delhi has that extra advantage of getting excellent

speakers may be from CIC, CHRI and other organizations working in the area of RTI

Act. The Chief Information Commissioner and Information Commissioners of the State

Information Commissioner. Haryana were also kind enough to interact and address the

trainees very frequently.

(II) The main objectives of the training programmes used to be :-

- To help the participants to understand the significance of Right to Information

Act;

- To enable the participants to understand the different provisions of RTI Act.

- To enable the participants to learn techniques to disclose information promptly

and at the lowest reasonable cost.

- To motivate the participants to the extent that they carry the message of

transparency under the act to their colleagues and juniors about their obligations

and responsibility under the Act,

- To enable the participants to act as agent for bringing the attitudinal change

among the other Officers/Officials for effective implementation of the Act.

(III) Methodologies adopted in the training programmes :

(IV) The two DIAs imparted training to 5372 number of trainees during the year 2007-2010. However initially during the first year of the project both the DIAs were slow but

got the momentum after the third quarter of the first year. At the district level also the

participants used to be a mixed batch of trainees. Both the DIAs first organized district

level training programmes. In these programmes where district level officers of almost

all the departments including the FAA, PIO and APIOs participated . DIA Gurgaon

itself imparted training to 1255 participants, while Jhajjar district gave training to 4117

participants.

(V) The methodology in the district level programmes used to be:

- Lecture Method

- Interaction with the speakers

- audio visual Aids

Haryana Institute of Rural Development, Nilokheri and Nov Jyoti Foundation

under the leadership of Dr. Kiran Bedi also organized the training programme on the

behalf of DIA, Gurgaon.

HIPA being located at Gurgaon and Jhajjar being the neighboring district of

Gurgaon district both DIAs requested HIPA to organize training programmes on their

behalf during the year 2009-10. Therefore, on behalf of the DIA, Gurgaon, HIPA

organized 4 training programme while 6 training programmes were organized on behalf

of DIA Jhajjar.

(B). Research and Documentation

For the proper capacity building, training and awareness generation excellent

training material and manuals, guides are a must. In the beginning of the project period

mostly material on RTI was available in English and the cliental in the state prefers

material in Hindi. Therefore, first of all HIPA translated the RTI Act and other useful

RTI material in Hindi. Keeping in view the requirement of the project and the people,

HIPA prepared and published the following RTI material.

• User Guide in English.

• Handbook in Hindi.

• Directory of FAAs, PIOs and SPIOs of Haryana Government covering 178

public authorities.

• HIPA also conducted the audit of Pro-active Disclosure under 4(1)b of 157

public authorities given in Table-18.

By the end of the project period, it has been noticed that most of Public

Authorities have proactively put many information on their websites. However,

these public authorities are not very active in updating these information.

• We also audited the impact of RTI on the improvement in service deliveries of

32 public authorities, see Table – 19.

• During audit of service delivery and RTI it was observed that there is

tremendous improvement in the service delivery and redressal of the public

grievances.

Though, we have not compiled the best practices and case studies in the form of

documents but we have circulated many important cases of the State Information

Commission and news appeared in the local newspapers. The scanned new paper clips

are given in end of the report.

• The DIA Jhajjar and Gurgaon both translated the RTI act in simple Hindi so that

it could be well understood by the common people.

• HIRD Nilokheri, Karnal published Suchna Ka Adhikar Adhiniyam, 2005

(Suchna Pustika) of 32 pages and also a crispy brief booklet on RTI Suchna Ka

Adhikar Adhiniyam, 2005 of 10 pages .

• Nov Jyoti Foundation circulated and published Suchna Ka Adhikar as

Loktantra Ka Adhikar.

• The DIA , Gurgaon also distributed Suchna Ka Adhikar Adhiniyam, 2005 ( Ek

Vivechana) by Dr. A.K.Yadav ( Former Secretary, SIC, Haryana) among the

district & block level officers.

• The DIA Jhajjar also translated the RTI Act in simple Hindi and published and

distributed user guide in Hindi.

• Both the DIAs published and distributed the diary of PIOs & APIOs. The

Directory prepared and published by DIA Gurgaon covers 82 public authorities

while the directory prepared by DIA Jhajjar covers 297 public authorities.

• DIA Gurgaon audited 136 public authorizes to find out the pro-active disclose

under section 4(1)b.

• The DIA Gurgaon specifically keeping in view the effect of RTI Act on services

delivery audited 8 public authorities. These public authorities are mainly related

providing services directly to the people viz HUDA, Public Health, Education,

PWD, B&R, Panchayats.

(C). Mass Awareness Campaign

When we look at the real objective of the Act and also in order to implement the

Act in true spirit creating Mass Awareness in the general public is to be given priority of

course at the same time, training of the Government official/public authorities is also a

must. While speaking about the Act, much importance is to be given to the public by

making them understand the important provisions of the Act rather than giving them

training like the Government functionaries so that they could well understood the

reasons being provisions of the procedures how to get information from the public

authorities.

The role of the Mass Media in making the people’s awareness is very

important.

Therefore, keeping the above background in mind as per the mandate of the

project, the following activities were performed by SIA and DIAs:

� The SIA published and distributed about 13545 brochures & pamphlets .

� DIA Gurgaon has distributed about 172110 Pemphlets, Broachers, Posters

during the project period while DIA Jhajjar prepared & distributed 53195

number of pemphlets, Broachers, Posters during the period 2007-10. (Scanned

Copy of of Pemphlets, Broachers, Posters are given at Table 16).

� DIA Jhajjar many times published about the provision of RTI act in the

different newspapers.

� A Drama group was constituted at HIPA to enact Nukkad Natak/street plays

on RTI at various places, particularly at the local level. The group has been

trained by the noted theatre personality Shri. M.K. Raina. This group also

performed at HIPA in different training programmes and also at District &

Block levels. The total number of these shows by Drama Groups were 7 in

number during the period 2007-09. The Drama has been able to educate

people about the mission of RTI Act and about their rights for seeking

information so that administration could be held more accountable to the

people even in the remotest areas in the state. The CDs of The Drama Groups

were also prepared and distributed to the different departments and public

authorities.

� A CDs of one of the street plays have been prepared. This play is in local

Haryanivi dialect and it shows in RTI awareness programmes at the local

level. The CDs prepared have been shown in the local TV Channels to create

awareness about the Act in the general public. The CDs of the Drama Group

and of the street Plays have already been sent to DOPT, CGG and

YASHADA.

� The DIA Gurgaon with the help of Nav Jyoti Foundation of Dr. Kiran Bedi

also prepared Haryanvi Ragni, Plays and Folk songs for creating RTI

awareness. These Ragni and Folk songs groups have visited the block

headquarters and also many villages for conveying the message of RTI act.

The Ragnis in particular have been applauded very well in the villages and

Ragni Group has performed in almost all the village and Block level

programmes .

� Apart form this two numbers of AV (Documetary Films) were also got

prepared and distributed to the General public for awareness by DIA Gurgaon.

� Banners were also displayed at the important sites at the Block & District level

headquarters for making the people aware of about the different provisions of

the RTI act. Banners were also installed at the public places like Bus Stands

and Schools.

� The scanned copies of the brochures , pamplets, handbuilt posters and

calenders are given below.

D. Dissemination & Advocacy and Clearing House

For sensitizing the different stake holders, the copies of RTI Act and User Guide

both in Hindi and English were prepared and distributed by the SIA and DIAs. The

following RTI material was distributed by SIA & DIAs:

• SIA, DIA Gurgaon & DIA Jhajjar distributed 2233, 5019 & 2390 copies of the

RTI Act both in English & Hindi respectively during the project period.

• SIA distributed 3000 copies of the User Guideline in English & 3000 copies of

Handbook in Hindi to the different stakeholders.

• HIRD Nilokheri, Karnal published Suchna Ka Adhikar Adhiniyam, 2005

(Suchna Pustika) of 32 pages and also a very brief booklet on RTI Suchna Ka

Adhikar Adhiniyam, 2005 of 10 pages.

• The DIA Gurgaon distributed 8960 copies of the above guides and manuals

while DIA Jhajjar distributed 9301 copies of such guides and manuals.

• The district implementing agency also distributed Suchna Ka Adhikar

Adhiniyam, 2005 (Ek Vivechana) by Dr. A.K.Yadav among the district & block

level officers.

• 1000 Copies of the Directory of FAAs, PIOs and SPIOs of Haryana Government

covering 181 public authorities was also prepared and distributed by SIA. Both

the DIAs distributed 1000 copies each of the directories of the Public

Authorities.

As a clearing House SIA has been sending utilization certificates to DOPT

online in the form of quarterly reports. The directory of PIOs, APIOs and FAAs as well

as the details of activities undertaken for mass awareness has been sent to national

Implementing Agency during the National Review Workshop organized at Jaipur from

22-23 January, 2009 and during the closer workshop of the project held at Hydrabad on

21.12.2009.

E. Multistakeholder Workshop and Information Audit

• A total of 170 seminars/talkshows and multi-stakeholders workshops were

organized by the SIA and DIAs. Of the total, the State Implementing Agency

organized 14 Seminars & Workshops, DIA Gurgaon organized 133 workshop/

seminars/talk shows while DIA Jhajjar organized 23 seminars and workshops

during the period 2007-09.

• In the multi-stakeholders workshops people from different walks of life,

PIOs/APIOs/FFAs of the public authorities, NGOs, Media People and even

academicians took part. In these seminars/workshops, the RTI material

published in SIAs & DIAs were distributed. A lot of interaction took place in

these seminars and workshops. In the seminars organized at the Block levels by

the DIAs, SHGs women, NGOs. Self Help Group Federations, local level PIOs

and general public mainly participated. These participants raised a lot of issues

relating to them at the village level and of course about their rights regarding the

basic facilities to be provided by the PRIs and how all these information could

be accessed under the Act.

• Due to the popularity and success of these seminars and talk shows at the village

level, Central Information Commission selected Gurgaon district villages for the

visit of Bangladeshi delegation to study the usage and implementation of RTI

Act at the panchayat level. This delegation was lead by Ms. Shaheen Khan

Executive Director, Manusher Janno Foudation, Dhaka; Joint Secretary, Human

Resources Bangladesh, National Parliament Secretary; Director General,

Bangladesh Press Institute; Deputy Secretary, Ministary of Information, Dhaka;

Vice Chairman, Censor Board Bangladesh; Deputy Secretary, Ministary of Law,

Justice & Parliamentary Affairs, and Joint District Judge Gazipur. Sh. Pankaj

Sehrasehkar, Joint Register and Deputy Secretary, CIC, New Delhi was also

with the delegation. The team visited two villages viz. Abheypur and Kherala of

Sohna Block on 14.08.2009. the delegation interacted with both the Sarpanches,

Panchayat Members and villagers of both the villages and they were impressed

with the awareness of RTI at the Panchayat and Village level.

• A total of 23 Information Fares were organized. Of these, DIA Gurgaon

organized 21, while DIA Jhajjar Organized 2 Information Fares. The Fares

organized by the SIA & DIA Gurgaon at Saras Mela, Gurgaon have been very

popular as people from almost all States take part in this mela which is

organized every year in the months of September-October.

• The State Implementing Agency audited 20 departments of the State

Government to find out the way of disposal of requests and handling the RTI

applications. The findings were very interesting as the police department which

is known for its rude behaviour has been one of the few departments where the

disposal rate of the RTI applications has been very good. On the contrary,

Haryana Urban Development Authority (HUDA) is very poor in the

implementation of the Act, as a result of which , many RTI appeals against the

HUDA officers/officials are pending before the State Information Commission,

Haryana.

4. Key Achievements under the Project

The main emphasis of SIA and DIAs have been on the Training Capacity

Building for access to information. 40 resource persons at SIA were trained by

YASHADA.

� 56 resource persons of the State were trained by YASHADA.

� 187 resources persons were trained by the SIA.

� 1739 FAA, PIOs/ APIOs and other officers/officials were trained by the

SIA.

� 89 NGOs people, Media Persons and other Social Activists were trained by

the SIA.

� SIA conducted 59 training Programmes and 14 workshops and seminars.

� The main highlight of the project have been in three state level multi stake

holders workshops. In these workshops, all the time more than 100 FAA,

PIOs/APIOs, media persons and social activists participated and took keen

interest in raising their concern. The speakers in the multi stakeholders

workshops have been the torch bearers for the effective implementation of

the RIT viz. Sh. Wazahatt Habibullah, Central Chief Information

Commissioner; Sh. G. Madhavan, State Chief Information Commissioner

� The Gurgaon and Jhajjar DIAs have also trained 1040 and 4033 PIOs/

APIOs , FAAs and other officers/officials respectively.

� The Gurgaon and Jhajjar DIAs have also trained 215 and 84 people from

NGOs, Media Persons, Social Activists and General Public respectively.

� DIA Gurgaon organized 53 workshops and Seminars/ Talkshows while

DIA Jhajjar organized 23 workshops, seminars and talkshows.

� Both the DIAs conducted just three training programmes of 3-5 days

duration otherwise all the programmes were just for one day.

� This project helped a lot in conducting training programmes and more than

that it built and improved the capacity of PIOs, APIOs and also it changed

their mindset on supply side. On the first day of training, trainees used to

be quite apprehensive about the implications of the Act, but after the

training all their doubts were used to be over. Before attending the training,

the trainees were keen to know the ways and means not to disclose the

public documents, however, after attending the training, their mindset and

attitude towards the public was changed and so towards the discloser of

the document.

� The project to a large extent has improved the record management of the

Public Authorities. Public Authorities are using the standard formats that

facilitate easy access of public information to citizens. Previously the

number of PIOs designated by the public authorities were less compared to

their requirements. After undergoing the training Public Authorities have

increased their number. Reasonably large in keeping the size and functions

of the Public Authority. One of the main departments i.e. School Education

in Haryana after almost three and half years have designated school

principals and headmasters as PIOs, otherwise earlier only DEO at the

district level used to be the PIO.

� The Training and Capacity Building helped the trainees especially the

PIOs to know how to provide access to Information in the form in which it

is sought by the information seekers without any delay. Followings are the

main learning experiences for the trainees:

• How and in how many days the RTI application will have to be processed?

• How to publish information voluntarily under section 4(1) b ?

• How to bring about necessary changes in existing systems of maintenance,

management and destruction of records ?

• How to create awareness among subordinates and others in their officers?

• Prompt reply to the information seekers?

• Non-Governmental organizations, Self Help Groups, Media Persons, Heads of

the RWAs and people in general etc. were trained by SIA and both the DIAs

under this project on demand side. After attending the training, they know

� Where and how to file application in order to obtain information?

� They know, where and when to approach the FAA and IC for relief?

� They also know, how to get the compensation for any loss ?

The participants of the demand side are more benefited through this

training by knowing how to secure access to requested information and

knowledge about the government schemes and performance, policy formulation

and implementation of the projects particularly public service delivery system.

This project highly helped in strengthening the capacities of information

procedures and i.e. PIOs, APIOs, Appellate Authorities and other officers,

NGOs, SHGs, Media persons etc.
