Amendment

Chapter 0080-09-02 Restricted Use Pesticides

Rule 0080-09-02-. 13 Dicamba is amended by deleting the rule in its entirety and substituting the following language so that, as amended, the rule shall read :

0080-09-02-.13 Dicamba.

(1) Definition . Dicamba is any pesticide containing 3, 6-Dich loro-2-methoxybenzoic acid or 3, 6-Dichloro-o­anisic acid.

(2) Application . If a pesticide is labeled to have a dicamba concentration of at least 6.5% weight/weight and is not labeled for over the top use, a person shall not apply the pesticide between May 15 and October 1 of the same year for production of cotton or soybeans.

(3) Records. Any person who applies a pesticide labeled to have a dicamba concentration of at least 6.5% weight/weight shall keep records of the application as required under 0080-09-02-.07.

(4) Violations.

(a) Where dicamba of any concentration is applied in violation of the Act, its corresponding regulations, or this rule, each acre of the application shall constitute a separate violation.

(b) A person is responsible for violations when committed by either the person or his agent.

(c) Each violation is grounds for denial or revocation of any certificate, license, or charter issued under the Act; actions for injunction; assessment of civil penalties up to $1500 per violation; and imposition of criminal charges against the violator.

Public Hearing Comments

The department of agriculture held a public hearing on May 14, 2019. Haley Todd served as the hearing officer for the rulemaking hearing regarding Chapter 0080-09-02 Restricted Use Pesticides. There were no oral comments at the hearing. Written comments from constituents are summarized below along with the department's response.

Comment:

Erica Bell Vick on behalf of Helena Agri-Enterprises, LLC ("Helena") made a comment regarding 0080-09-02-.13(2)(b) suggesting additional language limiting the section to dicamba tolerant cotton and soybeans.

Response:

The department appreciates the comments of Helena. The intent of section (2)(b) is to prohibit the use of outdated, burn-down dicamba technology being applied for the production of cotton and soybeans between May and October. The desired language from Helena would be redundant since the section is already limited to soybeans and cotton and adding another caveat to when the rules apply would make the rule harder to understand.

Comment:

Helena further commented that it seeks clarity on the record keeping requirements of 0080-09-02-.13(3).

Response:

The rule as written extends to any applicator using 6.5% dicamba or greater regardless of the target, not just soybeans and cotton.

Regulatory Flexibility Addendum

Pursuant to T.C.A. §§ 4-5-401 through 4-5-404, prior to initiating the rule making process, all agencies shall conduct a review of whether a proposed rule or rule affects small business.

(1) Type or types of small business subject to the proposed rule that would bear the cost of, and/or directly benefit from the proposed rule:

Pesticide applicators who serve producers of cotton and soybeans are subject to this rule.

(2) Identification and estimate of the number of small businesses subject to the proposed rule:

Approximately 5,500 private applicators and 250 commercial applicators of pesticides are expected to be subject to this rule.

(3) Projected reporting, recordkeeping and other administrative costs required for compliance with the proposed rule, including the type of professional skills necessary for preparation of the report or record:

The proposed rule change is not expected to increase administrative costs of affected firms.

(4) Statement of the probable effect on impacted small businesses and consumers:

The rule implements time of year restrictions for application of certain dicamba pesticide concentrations in commercial production of cotton and soybeans. It is anticipated that affected firms will require greater planning and diligence during portions of the year to apply adequate quantities as applied in previous harvests. The department expects that these limits are reasonable and will minimally affect production, if at all.

(5) Description of any less burdensome, less intrusive or less costly alternative methods of achieving the purpose and/or objectives of the proposed rule tl:lat may exist, and to what extent, such alternative means might be less burdensome to small business:

No less burdensome methods for controlling off target drift are effective.

(6) Comparison of the proposed rule with any federal or state counterparts:

These rules are consistent with the EPA approved label for the product as well as EPA's recommended use of the product.

(7) Analysis of the effect of the possible exemption of small businesses from all or any part of the requirements contained in the proposed rule.

Exception of small businesses from this rule may expose the state to greater risks associated with dicamba products

Impact on Local Governments

Pursuant to T.C.A. §§ 4-5-220 and 4-5-228 "any rule proposed to be promulgated shall state in a simple declarative sentence, without add itional comments on the merits of the policy of the rules or regulation, whether the rule or regulation may have a projected impact on local governments." (See Public Chapter Number 1070 (http://publications.tnsosfi les.com/acts/106/pu b/pc1070. pdf) of the 2010 Session of the General Assembly)

Additional Information Required by Joint Government Operations Committee

All agencies, upon filing a rule, must also submit the following pursuant to T.C.A. § 4-5-226(i)(1 ).

(A) A brief summary of the rule and a description of all relevant changes in previous regulations effectuated by such rule;

This rule places time of year restrictions on application of certain dicamba pesticide concentrations in the commercial roduction of cotton and so beans.

(B) A citation to and brief description of any federal law or regulation or any state law or regulation mandating promulgation of such rule or establishing guidelines relevant thereto;

Dicamba products are registered and labeled in accordance with the Federal Insecticide, Fungicide and Rodenticide Act. Under T.C.A. 62-21 -116 dicamba ma be a lied consistent with its labelin .

(C) Identification of persons, organizations, corporations or governmental entities most directly affected by this rule, and whether those persons, organizations, corporations or governmental entities urge adoption or rejection of this rule;

Chapter 0080-09-02 Restricted Use Pesticides

Rule 0080-09-02-.13 Dicamba is amended by deleting the rule in its entirety and substituting the following language so that, as amended, the rule shall read:

0080-09-02-. 13 Dicamba.

( 1) Scope. This rule applies to any person who makes or causes a row crop application of dicamba. Provisions of the rule are made in addition to all other definitions and requirements for the sale and application of pesticides under the Act, its corresponding regulations, and associated product labels.

t-,;(2'+)--Definitions. When used in this rule, unless the context requires otherwise:

!-i:,(ai+)--Dicamba means is any pesticide containing 3, 6-Dichloro-2-methoxybenzoic acid~_Q[ 3-i 6-Dichloro-o-anisic acid ; or any pesticide containing either substance in a concentration greater than or equal to 6.5%; and,

(b) Row crop application means for production of cotton or soybeans in commerce.

~ ill Application . If a pesticide is labeled to have a dicamba concentration of at least 6.5% weight/weight and is not labeled for over the top use, a person shall not apply the pesticide between May 15 and October 1 of the same year for production of cotton or soybeans.

A person shall not make a row crop application of dicamba before 7:30 a.m. or after 5:30 p.m. local time for the application site.

Between May 15 and October 1, a person shall not make a row crop application of dicamba un less the dicamba product is labeled for in crop use.
