INTRODUCTION

The following set of rules and regulations are intended to develop and maintain a sense of community and safety for all of our owners, residents and property. These are based on common sense and courtesy to help us enjoy a high quality of life at Deer Park II.

In addition to the provisions of the applicable Federal and State Laws, local ordinance and the Deer Park II Condominium Declaration and Bylaws, the following Rules and Regulations shall govern the use of the Common Areas, as well as the conduct of all residents.

Each unit owner shall comply with the rules and regulations and is responsible for the actions of their guests.

ASSESSMENTS (See amendment to collection of assessment)

Payment of Monthly Assessments

• All monthly assessments are due on the 1st of each month.

• Payments must be mailed to the address provided on the coupon booklet or paid electronically by setting up the online payment..

• Payments received after the 10th of each month are subject to a late charge of $50.00.

Delinquent Assessments

• After 30 days, collection procedures will commence. A unit owner under collection will be responsible for all legal and collection costs.

• A $50.00 bank charge will be assessed against the unit owner’s account in the event that a check (NSF) is not honored by the bank for any reason.

• For repeat non-sufficient fund payments, Management is authorized to request payments in the form of a cashier’s check, money order or certified check.

• All initial attempts to remedy delinquencies should be made in writing to the management company. The unit owner may be expected to appear at a hearing before the Board of Directors to address the delinquency.

Collection Process

• This rule also applies to fines and fees assessed to a unit owner for violation of any rule, regulation, by-law or declaration.

COMMON ELEMENT/LIMITED COMMON ELEMENT

To protect the safety of all residents as well as the structural integrity of all common elements, preserve the architectural integrity and value by providing for the continuity of design throughout the community, the following is in place:

Definition

• All green areas including shrub beds.

• Exterior of buildings, roof, foundation, front steps, and porch pillars.

• Patios are part of the common element.

Damages to Common/Limited Common Element

• Unit owners are responsible for all damages to any and all other units and the common elements resulting from the lack of proper maintenance or repairs to their respective units.

• Unit owners are responsible for any damages incurred by their guests or pet, including court costs and attorney fees.

• Each unit owner is responsible to promptly report to the management company any defects or need for repairs, which may be the responsibility of the Association.

Exterior Attachments

• No fixtures of any kind are allowed to be attached to the exterior walls, doors, porch pillars, or windows. This includes but is not limited to antennas, satellite dishes, flower boxes, plant hangers, motion lights, basketball hoops, holiday decorations, awnings, sun shades, canopies, trellises, shutters or window air conditioners.

• No signs, notices, bird feeders or tents will be allowed on porch pillars, walls or landscaping/grass and windows.

• No wall décor may be affixed to any exterior siding porch pillars, brick walls/siding or common element.

• Unit owners and occupants must not erect or have erected any fence, partition, wall, divider or similar structure exterior to their unit other than any such structure erected by the developer; may not make or allow any alterations or replacements to the exterior of the unit, including, but not limited to doors, windows or skylights or to any common elements.

• Malibu lights are permitted along your walkway and around the landscaping, provided connecting wires are buried beneath the rocks. Damage to Malibu lights is the responsibility of the unit owner.

• No carpeting, artificial grass or adhesive surface shall be applied to any patio, porch or driveway.

• Installation of additional phone lines, DSL or any other utility that require wires cannot be affixed to the exterior of the unit. The drilling of holes in the siding or brick resulting from such installation will be repaired at unit owner’s expense. If the wires are at ground level, all wires must be buried.

For Sale Sign

• No unit owners, or any agent of a unit owner may display “For Sale” or other similar signs anywhere in the windows or on the common elements or limited common elements.

• It is also prohibited to place signs on 125th Street, trucking company’s landscaping and/or property.

Restrictions

• Nothing shall be done in any unit or on the common element which may impair the structural integrity of the building or which may change the appearance of the building.

• Nothing shall be altered or constructed in or removed from the common/limited common element. Unit owners may not paint or alter the exterior of their units, including doors, windows, landscaping, patio or porch.

• All repairs and replacements shall be first class quality and as similar to the character of the construction or installation that existed immediately prior to the occasion that necessitated the repairs.

• No parts of the property shall be used for purposes other than housing and related common purposes for which the property was designated or replacements (i.e. garages shall not be used as a living space).

• No unit owner shall permit anything to be done or kept in the common element which will result in cancellation of the general insurance policy on the building, or contents thereof, or which would be in violation of any law.

• Unit owners are not permitted to perform the following: cutting/watering grass, fertilizing, tree and/or bush trimming, planting sod or seedlings, rock/stone replacements or additions. These tasks are the sole responsibility of the

landscaping company, which is hired by the Board of Directors to perform such actions as authorized.

• Unit owners may not direct landscaping personnel to perform any services. All landscaping is based upon recommendations of the professional landscapers.

• No walls or fences may be erected to enclose any patio or porch.

• No planting or gardening is allowed.

EMERGENCIES

In case of emergencies, contact the Management Company at (708) 532-4600. An answering service operator will record your problem and can refer you to a suitable professional. An “emergency” is any situation that immediately affects the health, safety, or property of the unit, or threatens the common area of the Association.

Unit owners should be aware that any referrals made by the Management Company regarding maintenance or emergency repair work to the interior of the unit are the owner’s sole responsibility. Therefore, the unit owner should be prepared to pay for the expense of the service call. In case of a life-threatening emergency, you should call 911.

FLAG DISPLAY

Statute Pertaining to American Flag

Under Section 18.6 of the Illinois Condominium Property Act, the display of the American flag or a military flag (or both) shall be allowed on or within the limited common elements or in the immediately adjacent exterior of the building where the unit of a unit owner is located, subject to the rules and regulations and resolutions of the Association.

The Board may adopt reasonable rules and regulations regarding the location and size of the flags.

Flag Installation Requirements

Damages caused by the installation or mounting of the post is the sole responsibility of the unit owner, to include but not limited to damages caused by high winds.

• Only one (1) mount is permitted; • Only American and military flags∗ are permitted (both flags may wave on same

mount); • No more than one (1) American flag and one (1) military flag per unit; • No more than 3’ x 5’ in size; • Lofts: Flag mount must be placed on the post farthest from the garage. Place

mount facing the unit opposite your unit; place mount 18 inches from the top and 74 inches from the bottom in the center 5¾ inches from each edge of the post;

• Townhomes: Only end units have a post. Mount the flag with same specifications as the lofts. Middle units do not have posts but may mount a flag on a flag stand.

Note: Improper display of the American or military flag is subject to removal by the Board.

Please refer to the Declaration, Article VIII – Maintenance, Alteration and Decorating – Paragraph C, “Damage caused by a unit owner” before installing your flag mount.

∗ “American flag” means the flag of the United States, made of fabric, cloth, or paper displayed from a staff

or flagpole. The American flag does not include a depiction or emblem of the American flag made of lights, paint, roofing, siding, paving materials, flora, balloons, or any other similar building, landscaping, or decorative component.

“Military flag” means of any branch of the United States Armed Forces or the Illinois National Guard made of fabric, cloth, or paper displayed from a staff or flagpole. The military flag does not include a depiction or emblem of a military flag made of lights, paint, roofing, siding, paving material, flora, balloons, or any other similar, building, landscaping, or decorative component.

GANG ACTIVITY/LOITERING

Although gang activity has not been a problem within our community, we would like to take a proactive stand to keep our community safe.

• If you suspect that there is gang activity in our community, please notify the Alsip Police Department.

• The following list contains some behavior that may be related to gang activity:

the display or use of gang signs and signals

drugs

weapons

vandalism

graffiti

fighting

loitering

reckless or disorderly conduct

• Please keep your eyes and ears open to keep gang activity out of our community.

• Unit owners, members of their family (residing in unit) who participate in gang activity are subject to legal actions and face eviction.

GARAGE SALES

• A permit must be obtained from the Village of Alsip and must be visibly displayed.

• Garage sales should take place during daylight hours.

• Signs shall not be posted to advertise the garage sale on the premises without prior written consent of the Board.

• Merchandise should be displayed within the unit owner’s garage and is limited to the unit owners’ driveway.

• Merchandise is not to be displayed on the common element, i.e. the sidewalks, landscaping, etc.

• Unit owners are responsible for any damages that may result.

• Unit owners are responsible for guest adhering to the parking rule.

HOLIDAY DECORATIONS

• Decorations may be placed on the common/limited common elements in the following locations:

trees and shrubbery and the rocky area only, no decorations are allowed in the grass

only lights are allowed in the trees/shrubbery; no garland, tinsel or ornaments of any kind is allowed

no inflatable displays are allowed on the common element

defacing of exterior unit with holiday spray paint is not permitted

• Holiday lights should not be affixed to the exterior without the proper hardware:

Plastic gutter hooks/clasps are recommended. Any hardware (such as nails, staples, tape, glue or tacks) that causes damage or defacement is not allowed.

Decorations that create a safety hazard will not be permitted.

• Unit owners will have thirty days to repair any damages caused by their decorations. If the unit owner fails to repair damages to previous condition, the Board will have the repairs made to mitigate damages, and the unit owner will be responsible for the expense.

• Seasonal decorations may be installed no earlier than one (1) month prior to the holiday and must be removed no later than thirty (30) days after the holiday. All Christmas decorations must be removed by January 31st.

• Electrical cords and attachments cannot be exposed if decorating trees.

Any damages to the exterior will be the owner’s responsibility.

INSURANCE

Deer Park II Condominium Association, pursuant to the requirements of the Illinois Condominium Act and our Bylaws, maintains a “Master” insurance policy. The master policy covers each building, including the unit structure, against fire and property damage. The coverage is “all risk” and is in an amount equal to the full replacement cost of the building (except for items not normally insured).

Per Section 12(h) of the Illinois Condominium Property Act, mandatory insurance coverage is required by unit owners. Unit owners are required to obtain insurance covering their personal liability and compensatory damages to another unit caused by the negligence of the owner or his or her guests, residences or invitees or regardless of any negligence originating from the unit. The personal liability of a unit owner or association member must include the deductible of the owner whose unit was damaged, any damage not covered by insurance required by this subsection, as well as the decorating, painting, wall and floor covering, trim, appliances, equipment and other furnishings.

• In the event of negligence, unit owners will be held responsible for damages that are caused to another unit and/or property.

• The Associations’ property insurance policy only covers the common elements, the limited common elements, the bare walls, floors and ceilings of the units, and those fixtures located within the units which were originally installed by the developer of the condominium property. The Association’s property insurance policy does not cover improvements and betterments installed by unit owners.

• Betterments and improvements mean, generally, those items which are fixed in nature such as wall finishes, fixtures, floor coverings, cabinets which were installed following the original sale from PD Hartz Construction Company.

• Upon request, unit owners may be required to provide proof of homeowner’s/liability insurance. Failure to submit proof upon request could result in a violation hearing and fines.

• Unit owners are not allowed to file insurance claims under the Association’s policy without approval from the Board. Unit owner will have deductible assessed back to them for failure to contact Board.

LEASING/RENTING OF UNITS

General

• Leasing of Units is prohibited pursuant to the amendment to the Declaration voted upon by the members of the Association on November 15, 2003. However, certain hardships may be determined based on a case by case review. Board’s decision is final.

MAINTENANCE OF UNITS

Repairs and maintenance of the property within the walls of the unit are the owner’s responsibility. The unit owner is responsible for anything that services their individual unit, which also include items housed outside of the unit. Unit owners should refer to Article VIII of the Declaration regarding maintenance of the unit.

Homeowners’ Responsibility – Maintain and/or Replace

• Fire or smoke alarms – unit owners and occupants must keep operational any fire or smoke alarm systems in their unit and not obstruct their operation

• All appliances should have yearly maintenance checkup and cleaning (air conditioner, furnace, dishwasher, washer and dryers, garbage disposal, refrigerator, stove, and water heater)

• Electrical problems • Fire sprinkler system in garage • Automatic garage door openers • Interior walls • All plumbing problems, including supply lines, sewer lines, exterior spigots,

faucets and fixtures • Storm doors, if applicable • Garage doors – interior structure (springs, rollers, keypad/openers) • Patio and porch (cleaning only) • Coach light (bulb replacement only) • Window maintenance, includes window locks, window clips, and screens • Door maintenance, including patio door locks and screens (repairs and cleaning

only) • All plumbing, natural gas, and cable systems • Bird nests, interior rodents and insects • Dryer vents cleaned yearly • Gutter extensions (white only)

Association’s Responsibility

• Windows and entry door, not including storm doors (normal wear and tear) • Walks, driveways, lawn and landscaped areas • Exterior walls, including brick, siding, tuck pointing and painting • Patio and porch (normal wear and tear) • Gutters and downspouts (not including extensions) • Lawn care and snow removal • Post and pillars (normal wear and tear) • Roofs • Sidewalks • Skylights • Coach lights

MOTOR VEHICLES

To preserve and protect the residential nature of the community, to safeguard against unsightly vehicles in the community and to protect the safety of all residents, the following is in place:

Vehicle Repair

• Vehicle repair is not permitted on common or limited comment element, except for emergency repairs minimally necessary to render vehicle operable for removal to a service facility.

• Oil changes are not permitted except in unit owner’s garage.

• Unit owners are not permitted to run a vehicle service repair operation in the garage. Only the repair of unit owner’s own vehicle(s) is permitted.

Vehicle Washing

• Not permitted from November 1st through April 1st, or if temperature drops to below freezing.

• Vehicles may be washed in driveways but not on the common elements. ∗

NOISE/DISTURBANCES

To preserve and protect the residential nature of the Association, to safeguard and to protect, the following is in place:

• No resident or persons in his or her unit shall make any disturbing noise in the common areas or on a patio that would interfere with the rights, comfort, or convenience of other residents.

• Under certain circumstances, the Association will grant reasonable accommodations for medical equipment.

• At no time are musical instruments, radios, stereos, or televisions to be so loud as to create a nuisance to other unit owners.

• Music can be played in the common elements until 11:00 p.m. as long as it is not disturbing other residents or creating a nuisance.

• All vehicles shall be equipped and operated in a manner not to disturb residents.

• Behaviors found to be offensive to unit owners and reported to the Board of Directors will result in a hearing at which time suitable measures will be taken regarding the complaint.

• While waiting for buses or any other methods of transportation, littering, throwing rocks, or causing a disturbance shall not be permitted. All such offenders will be reported to the Alsip Police Department.

• Use of illegal fireworks and blasting devices is strictly prohibited. All such offenders will be reported to the Alsip Police Department. Offenders will be subject to a hearing, which could result in a fine.

• The discharge of any type of firearm within the Association is strictly prohibited. All such offenders will be reported to the Alsip Police Department and are subject to a hearing and a fine.

OUTDOOR COOKING∗

• No cooking of any kind is allowed on driveways or in garages. All outdoor cooking is restricted to the patio only.

• Cooking must be contained. No open fires are permitted. A barbecue grill or proper cookware must be utilized.

• Extreme caution should be used with turkey fryers.

• A patio fire pit is not allowed due to health concerns and consideration of your neighbors.

PARKING

Commercial Vehicles

Pick-up trucks, vans, trucks, tractors, trailers, wagons, or any oversized motor vehicles having commercial license plates or used for commercial purposes or which have advertisements of one or more businesses permanently affixed to same and which cover an aggregate of more than 30 square inches shall not be parked on the common or limited common elements but may be kept inside garages.

Common and Limited Common Elements

• No trucks, vans, recreation vehicles, boats, motorcycles, or similar vehicles shall not be stored or parked in the common or limited common elements, but may be kept inside garages.

• Vehicles that cannot fit in a closed garage is prohibited from parking on the driveway.

• Parking across driveways or sidewalks is prohibited.

• Parking in front of mailbox is prohibited.

• Parking motor vehicles of any kind on the sidewalk is prohibited.

• Double parking vehicles on one car apron is prohibited.

• After a two-inch snowfall or when substantial drifting occurs, vehicles are not permitted in the visitor parking spaces until snow removal has been completed.

• All vehicles must be in operational condition, legally registered and insured.

• Vehicles may not be stored on common or limited common elements.

• No vehicle shall be used as living quarters.

• The Association reserves the right to limit parking in “Visitor” parking spaces and to have improperly parked vehicles towed at unit owner’s expense.

Recreational Vehicles

Oversized vehicles, such as campers, house trailers, motor homes, trucks, vans or van campers, motorcycles, ATVs (all-terrain vehicles), etc. shall not be stored or parked in the common or limited common elements.

Visitors

Due to the limited availability of parking spaces and the residential density of the Association, the design includes only parking in garages and driveways as assigned parking. The Board reserves the right to limit parking in the visitor parking spaces and to have improperly parked vehicles towed at owner’s expense.

• Visitor parking spaces are reserved for visiting guests of unit owners only. Unit owners are prohibited from parking in the visitors parking spaces at any time.

• This rule will be strictly enforced. The violator’s car will be towed at owner’s expense and fines may also be assessed after a violation hearing.

PETS

State and Local Laws

• Residents are required to comply with State and the Village of Alsip Ordinances.

• These Ordinances prohibit keeping vicious, wild, or exotic animals as pets. They also require that pets be leashed at all times when outside the unit, prohibit animals from running loose on common property, and prohibit animals from trespassing or damaging another’s property or creating a nuisance.

• These Ordinances and Rules also authorize Animal Control to enter the condominium property to investigate complaints and to enforce said Ordinances. Any unit owner may report violations to Animal Control by calling the Alsip Police Department’s non-emergency number.

Pet Types, Generally

• No animal, reptiles, rabbits, livestock, fowl, or poultry of any kind, other than one (1) common household dog, cat or other usual household pets, shall be kept or maintained in any unit.

• No animal(s) will be kept, bred, or maintained for commercial purposes in any unit.

• No attack dogs, or dogs of a vicious nature or temperament, are permitted.

Pet Size and Number

• Each unit owner is limited to one (1) dog or cat, not both. Unit owners may keep birds and aquariums, without limitation as to number and weight, provided that these creatures are not kept for commercial purposes.

• The maximum weight of any dog in any individual unit shall not exceed thirty-five (35) pounds at full growth.

An owner of a dog “who has not yet reached full growth” (also referred to as “puppies”) shall no later than one (1) week after the puppy taking up residence at Deer Park II, furnish the Board with a statement by a certified Veterinarian (DVM) stating: (1) the animal’s age and current weight, (2) the breed of the animal, and (3) a professional estimate of the animal’s expected weight upon reaching full growth. Service and assistance dogs are exempt from the weight restriction provision.

The Board will then determine if it is reasonably expected that the puppy, upon reaching full growth, will conform to the Rules and Regulations requirement as to size. If so, the puppy may continue to reside at Deer Park II and a written record of such determination will be included and

maintained in the registration records for future reference. If the dog, when grown, exceeds the weight limitation, it will be subject to removal upon notice and hearing.

Registration

• All owners must complete a pet registration form.

• All pets must be registered with the Association within one (1) week of taking up residence. Registration includes a current picture of the pet, as well as proof of required licenses, vaccinations and a current rabies vaccination certificate.

• It is the responsibility of the pet’s owner to provide vaccination updates annually.

• Unit owners who are found to have an unregistered pet residing at their unit shall be subject to a fine upon notice and hearing.

Conduct

• No pet is allowed to roam unleashed at any time on the common elements. A person capable of controlling the pet must walk the pet on a leash not to exceed six (6) feet in length

• Owners walking pet(s) shall carry a scooper and/or baggie to immediately clean up and properly dispose of any droppings.

• Owners must pick up after their pet at all times no matter the location.

• No pet may be tied to any part of the exterior of a unit or common element.

• Any household pet causing a disturbance on a repeated basis shall be subject to removal from the Association upon notice and hearing.

• The cost of any repair to the common element caused by a pet shall be assessed to the unit owner.

Pet Sitting

Please refer to the rules regarding pets when pet sitting. Pet sitters should have a copy of the Veterinarian’s Report that includes the pet’s vaccination record and tags. This rule will be strictly enforced.

Visiting Pets

No pets exceeding the 35-pound weight restriction will be permitted as visiting pets, meaning no guests may bring these pets onto the property.

SATELLITE DISHES

Antenna Installation

• Definition

For the purposes of these satellite dish/antenna rules, the term “fixed wireless signals” shall mean any commercial, non-broadcast communications signals transmitted via wireless technology to and/or from a fixed customer location. Examples include wireless signals used to provide telephone service or high-speed internet access to a fixed location. This definition does not include, among other things, AM/FM radio, amateur (“HAM”) radio, Citizens Band (“CB”) radio, and Digital Audio Radio Services (“DARS”) signals.

• Antenna Types

The following types of antennas shall be permitted, subject to these satellite dish/antenna rules:

◦ “Dish” antennas that are one meter (approximately 39.37 inches) or less in diameter and designed to receive direct broadcast satellite service, including direct-to-home satellite service, or to receive or transmit fixed wireless signals via satellite;

◦ Antennas that are one meter or less in diameter or diagonal measurement and designed to receive video programming services via broadband radio service (wireless cable) or to receive or transmit fixed wireless signals other than via satellite; and

◦ Antennas designed to receive local television broadcast signals.

All antennas not covered by the Federal Communications Commission (“FCC”) regulations are prohibited without the prior written consent of the Association.

No more than one antenna may be installed by unit owner.

• Location

Unit Owners may install antennas upon common element rock beds adjacent to patios with the prior written consent of the Association. Such antennas may only be installed on the same side of the patio upon which the air conditioning condenser is located in accordance with the diagram below. Wiring for such antennas must be buried in the rock beds so that landscapers can trim bushes without obstruction, and such wiring shall not be attached to exterior portions of walls. Masts for such antennas shall not exceed 8 feet in height. The installation, maintenance, inspection, repair,

replacement, painting and removal of such antennas located on the common elements shall be carried out strictly in accordance with any and all terms and conditions which may be established by the Board from time to time (including, without limitation, terms and conditions which may be contained in license agreements prescribed by the Association).

Except as otherwise provided in the preceding Section A(3)(a), antennas may only be installed on exclusive-use areas (patios serving units), and antennas shall not be placed on roofs, exterior walls, soffits, walkways, landscaped areas or other portions of the common elements, even if an acceptable quality signal cannot be received from an exclusive-use area.

Except as otherwise provided in these satellite dish/antenna rules, antennas must not extend beyond the unit owner’s exclusive-use area or encroach upon any common elements or another unit owner’s limited common elements.

Installation of antennas on common elements or limited common elements does not convert the common elements or limited common elements to individual-owned property.

• Installation

All installations shall be completed so they do not damage the common elements, the limited common elements or the individual units. No installation shall be permitted which would void or impair any warranties provided to the Association or in any way impair the integrity of a building.

Improper installation can cause damage to structures, posing a potential safety hazard to Association residents, guests and personnel. To ensure that antennas are installed in a manner that complies with applicable building and safety codes and manufacturer’s instructions, any installer other than the unit owner shall provide the Association with evidence of insurance coverage deemed satisfactory by the Association in the Board’s sole discretion.

Antennas must be secured so that they do not jeopardize the soundness or safety of any structure or the safety of any person at or near the antennas, including damage from wind velocity. Each unit owner shall indemnify, hold harmless and defend the Association, the Board, the Association’s community management firm and each of their employees and agents and assume any and all liability for loss, damage or injury to any person or property arising in connection with the installation, placement, maintenance, inspection, repair, replacement, painting, use, operation and/or removal of an antenna serving the unit owner’s unit, including,

without limitation, attorneys’ fees, court costs and other expenses incurred by the indemnified parties in defending any claims.

There shall be no penetrations of exterior building components, including, without limitation, the exterior walls of a building or patio surfaces, without the prior written consent of the Association. The purpose of this restriction is to prevent structural damage and moisture infiltration.

• Maintenance

Unit owners who install or maintain antennas are responsible for all associated costs, including, but not limited to, costs to undertake the following:

◦ Place, maintain, inspect, repair, replace and remove antennas;

◦ Repair damage to any property caused by antenna installation, maintenance, inspection, repair, replacement, removal or use;

◦ Pay medical expenses incurred by persons injured by antenna installation, maintenance, inspection, repair, replacement, removal or use;

◦ Reimburse residents or the Association for any and all property damage caused by antenna installation, maintenance, inspection, repair, replacement, removal or use; and

◦ Restore antenna installation sites to their previously existing condition.

Unit owners shall not permit their antennas to fall into disrepair or to become a safety hazard. Unit owners shall be responsible for antenna maintenance, inspection, repair and replacement and the correction of any safety hazard.

If antennas become detached from their original points of installation, unit owners shall remove or repair such detachment within five days of the detachment. If the detachment threatens safety, the Association may, with or without notice, remove or repair antennas at the sole cost and expense of the unit owner.

Unit owners shall be responsible for antenna repainting or replacement if the exterior surface of antennas deteriorates, provided that any repainting does not interfere with reception of an acceptable quality signal.

• Safety

Antennas shall be installed and secured in a manner that complies with all applicable state and municipal laws, ordinances and regulations and manufacturer’s instructions. Unit owners, prior to installation, shall provide the Association with a copy of any applicable governmental permit if required for safety reasons.

Unless the above-cited laws, ordinances and regulations require a greater separation, antennas shall not be placed within five feet of power lines. The purpose of this requirement is to prevent injury or damage resulting from contact with power lines. The unit owner installing the antenna shall be responsible for contacting the utility companies, as applicable, prior to any installation.

Antennas shall not obstruct ingress to or egress from any unit, building entrance, walkway, parking space, electrical service equipment, safety equipment, electrical panel, water shut-off valve, or any other area or equipment necessary for the safe and proper operation of the condominium property. The purpose of this requirement is to ensure the safety of Association residents, guests and personnel and safe and easy access to the condominium’s physical plant.

Installations must take aesthetic considerations into account and minimize the impact to the exterior and structure of the buildings. All wiring shall be buried as required by these satellite dish/antenna rules and otherwise installed so as to be minimally visible.

To prevent electrical and fire damage, antennas shall be permanently grounded.

Antenna Removal

• Antenna removal requires restoration of the installation location to its previously-existing condition. Unit owners shall be responsible for all costs relating to restoration of this location.

Association Maintenance of Locations Upon Which Antennas are Located

• If antennas are installed on property components that are maintained by the Association, the unit owners retain responsibility for antenna maintenance. Antennas shall not be installed in a manner that results in increased maintenance costs for the Association or for other residents. If increased maintenance costs or damage occurs, the responsible unit owner shall be liable for all such costs, and such costs shall be charged to the assessment account of the unit owner, constitute a lien against the unit owner’s unit and be collectible in the same manner as any regular or special assessment or other common expense.

• If maintenance requires the temporary removal of antennas, the Association shall provide unit owners with a 10-day written notice, provided that there is no emergency requiring earlier removal. Unit owners shall be responsible for removal or relocation of their antennas before maintenance begins and replacement of their antennas afterward. If an antenna is not removed within the required time, then the Association may do so, at the unit owner’s expense, and such costs may be charged to the assessment account of the unit owner, constitute a lien against the unit owner’s unit and be collectible in the same manner as any regular or special assessment or other common expense. The Association is not liable for any damage to antennas caused by Association removal or storage.

Enforcement

• If a unit owner violates these satellite dish/antenna rules, the Association may begin action for declaratory relief with the FCC or any court of competent jurisdiction. The Association also may initiate rule enforcement proceedings and, in the event a violation is determined to have occurred, to the extent permitted by law, all appropriate sanctions may be imposed, including, but not limited to, a daily fine for violations of a continuing nature. In addition to any other available remedy, the Association may seek injunctive relief to prohibit the installation of an antenna or to seek removal of an installation. The remedies hereunder are not exclusive. In the event of any violation of these satellite dish/antenna rules, the Association reserves the right to utilize any and all remedies, both legal and equitable, to prevent violations or to compel enforcement. Any election of a particular remedy by the Association shall not preclude the Association from seeking any other remedy. To the extent permitted by law, the Association shall be entitled to recovery of attorneys’ fees, court costs and all other expenses incurred in the enforcement of these satellite dish/antenna rules, including, but not limited to, attorneys’ fees, court costs and expenses incurred in connection with the Association’s seeking of injunctive relief. Such fees, costs and expenses shall be charged to the assessment account of the unit owner, constitute a lien against the unit owner’s unit and be collectible in the same manner as any regular or special assessment or other common expense.

• One dish per unit, no larger than 18” in diameter on an 8 ft. mast can be installed within the provided parameters and stats and must be placed in the designated location. See diagram below:

SELLING UNIT

To make this a smooth transaction, please review the following requirements of Deer Park II prior to accepting a signed contract:

Sellers Responsibilities

• Seller must notify the Management Company of their intent to sell their unit when the unit is put on the market.

• Seller must provide the name, address, and telephone number of their real estate agent and/or attorney.

• Any exterior damage to the unit that is not caused by normal wear and tear is the financial responsibility of the Seller. Outstanding balances resulting from the inspection may delay the closing. Contact the Management Company regarding this matter prior to your closing date.

New Unit Owners Responsibilities

• New unit owners are required to meet with the Board. Failure to meet with the Board will result in a violation hearing and possible fines.

• Within 30 days of moving into Deer Park II, new unit owners must submit to the Board the following forms: questionnaire, agreement and vehicle registration. Failure to submit these forms within the specified time period will result in a violation hearing and possible fines.

Moving In or Out

• Moving into or out of the unit is only permitted between the hours of 8:00 a.m. and 10:00 p.m., unless the Board has approved of other arrangements in advance.

• The unit owner(s) moving into or out of the unit shall be responsible for any damage to the common elements, if any, incurred during the move. Failure on the part of any unit owner to reimburse the Association will be considered as an unpaid assessment against the unit and will be subject to collection procedures adopted by the Board.

• Moving trucks or other vehicles used for the purpose of moving may be parked on the driveway, at the garage door for loading and unloading purposes only. Moving trucks are not permitted to park in the Visitors’ Parking, landscaping, or grassy areas. Please do not block neighbors’ driveways or common driving areas. Moving trucks are not permitted on common or limited common element overnight.

STORM DOORS

• Deer Park II does not require storm doors.

• Unit owners who wish to purchase a storm door must purchase one that has a full view and is white for uniformity.

• Unit owners will be solely responsible for any damages, which may occur due to the installation of the door, as well as any subsequent damage or maintenance to the door or frame.

• If there are any questions regarding door type, please contact the Board.

TRASH DISPOSAL

Trash Container

• All trash containers must have an attached lid and display the address of the unit owner.

• No trash containers or waste shall be left on the common and limited common elements at any time. All trash containers are to be stored in each unit owner’s garage.

• Boxes and large non-food items must be broken down and neatly stacked beside cans.

• Kitty litter and dog droppings should be securely wrapped in plastic bags so that the bag does not break open.

• All plastic bags must be placed inside of trash container.

• Plastic bags cannot be left at the curb. This is to prevent rodent and pest infestation.

• No dumpsters are not allowed on the common element.

• Recycle bins are permitted for recycling purposes only (subject to Village of Alsip and Allied Waste recycling rules).

Trash Pick Up Schedule

• Scheduled service pick up is on Friday. Time and holiday schedule may vary.*

• Trash container may be placed at the curb on Thursday at or after 6:00 p.m. Trash containers placed at curbs prior to 6:00 p.m. are subject to ticketing by the Alsip Police Department and Association fines.

• Trash containers must be removed from the curb no later than the same evening of that same day of service pick up.

• Unit owners are responsible for scavenger services to pick up large items.

* Note: Pickup day is Saturday after holiday ─ New Year’s, Memorial Day, 4th of July, Labor Day,

Thanksgiving and Christmas.

• The common element shall be kept clear of rubbish, and all other unsightly materials.

• No hanging of clotheslines is permitted on the patio, porch, or any parts of the common element.

• Chalk drawings should be removed the same day.

• Inflatable swimming pools:

should be emptied and put away on the same day

should not be stored on the common and limited common element at any time

adult supervision is required at all times

should not be left unattended

• No storage or storage units (sheds, chest, etc.) of any kind are allowed on the common element. Barbecue grills and patio furniture are the only items that can remain on the patio.

WINDOW TREATMENTS

The beauty of a condominium association lies in its ability to retain uniformity of appearance. In order to keep each owner’s interest in mind, it is imperative that no unit appearance infringe on the appearance of another unit or on the condominium association as a whole. In this regard, uniformity is the rule.

• All draperies, blinds, curtains or other window coverings must be installed by each unit owner on all windows. All window treatments must show an exterior (side facing outward) color that is either white or off-white.

• Window treatments installed in all windows of a unit must be maintained in good condition.

• At no time should bed sheets, newspapers or blankets be used in lieu of curtains, draperies, or blinds.

• For new unit owners, white paper may be used during the ninety-day grace period.
