Effective July 1, 2017
NEW HTA subsection 1(1) definition:
“road-building machine” means a self-propelled
vehicle of a design commonly used in the
construction or maintenance of highways that,
(a) Belongs to a class of vehicle prescribed in
the regulations
(b) Has the features or equipment prescribed
in the regulations, or
(c) Is being used as prescribed in the
regulations

10. Off-road excavators*
11. Low-speed street sweepers*

Following classes of vehicles are “prescribed” as road-building machines:

Off-road mobile cranes
mobile cranes that are not capable of travelling at a speed greater than 60 km/h and
are not operated on a highway other than for purposes of crossing the highway or in the immediate vicinity of the construction site at which the crane is being used
Off-road excavators
excavators that are not capable of travelling at a speed greater than 60 km/h and
are not operated on a highway other than for purposes of crossing the highway or in the immediate vicinity of the construction site at which the excavator is being used
Low-speed street sweepers
street sweepers that are not capable of travelling at a speed greater than 60 km/h

Effective July 1, 2017Following classes of vehicles are not road-building
machines:
1. Mobile equipment vehicles
• Mobile cranes (other than off-road mobile cranes)
• Excavators (other than off-road excavators)
• Street sweepers (other than low-speed street sweepers)
2. Vehicles constructed on a truck chassis
3. Vehicles identified as a truck, multi-purpose passenger
vehicle or an incomplete vehicle by a
compliance/manufacturer label issued under MVSA
4. Vehicles from outside Canada with comparable label
described in #3

• Driver and operator of concrete pumper or mobile crane –
exempt from the requirement to take 10 hours of off-duty time
in a day
• Driver and operator of a large crane – exempt from HTA s.
190 and O. Reg 555/06 if the crane is operated by a large
crane operator
• Large crane – capable of raising, lowering or moving more
than 13 607kg
• Crane operator – hoisting engineer-Mobile Crane
Operator 1 or an apprentice working toward qualification

Effective July 1, 2017Weights and Dimensions
• Hydrovacs, sewer cleaners and street sweepers
manufactured prior to January 1, 2017 will be
eligible for a time-limited permit
• Permit will allow for higher than HTA weights but
within MGVWR and MAWR
• Grandfathering period: 3-15 years based on
model year of vehicle

Safety Inspections
• Minor modifications to NSC 11b for mobile equipment
vehicles (mobile cranes, excavators and street sweepers)
• ABS – if equipped it must function as intended
• Exempt from certain lamp requirements (centre high
mount stop lamp and day-time running lamps) and
certain requirements for lamp location and lens
markings required by Canadian Federal Standards
• Allowance for alternate safety marks on the windshield
and other windows

• Mobile equipment vehicle exempt from automatic
slack adjusters if originally equipped with manual slack
adjusters

Vehicle Inspections
• Minor modifications for mobile equipment vehicles to
allow for alternate safety marks on the windshield and
other windows

Slow Moving Vehicles (HTA Section 76)
A slow moving vehicle is as follows:
a) Farm tractor;
b) Self-propelled implement of husbandry;
c) A motor vehicle towing an implement of husbandry; or
d) A vehicle that is not capable of attaining and sustaining a
speed greater than 40 km/h.

Slow Moving Vehicle Sign (HTA Section 76(6.1))
A slow moving vehicle sign must be displayed on the rear of any
slow moving vehicle or rearmost vehicle in the combination.
A farm tractor, self-propelled implement of husbandry or motor
vehicle towing an implement of husbandry is prohibited from
exceeding 40 km/h.
If any other vehicle (backhoe, grader,
vacuum truck, etc.) is travelling at a speed
greater than 40 km/h, and is displaying a
SMV sign, the vehicle would not meet the
definition of a SMV, a violation for displaying
the sign, a charge could be laid and the
the sign must be removed.
