3 The Sum of Rs.2,14,000/- paid vide FDR.No.0582312 dt 02.07.2013 issued by Oriental bank of Commerce, Arundelpet, Guntur as Earnest Money Deposit has been adjusted as part amount of Security Deposit. Balance Security Deposit Rs.6,44,539/- will be recovered from the running bills at 10% to make full security deposit Rs.8,58,539/- recovered.

4 Performance Guarantee (PG) for Rs.8,58,539/- has to be submitted within 30 (thirty) days from the date of issue of acceptance letter valid up to the stipulated date of completion plus 60 days beyond. A penal interest of 15% per annum shall be charged for the delay beyond 30 (thirty) days i.e., from 31st day after the date of issue of LOA. removing the excess weld metal with weld trimmer and finally grinding the welded joint to the required profile with profile grinder as elucidated in the welding manual of 1998 with all contractor's labour except a qualified welder of railways, tools such as welding tank along with vaporizer, crucible, dry mould, mould shoes, clamps will be supplied free of cost by railways at SSE/stores. Consumables like kerosene oil, petrol, welding portion, asbestos powder etc., required will be supplied by free of cost by railways as per the direction of the engineer - in - charge at site , including fixing the rails to sleepers immediately after welding to allow trains. Note : 1. Weld trimmer and profile grinder will be supplied at SSE/stores/depot. Required consumables will also be supplied by railways at free of cost.

2. Contractor to arrange trained staff for using the machines.

3. All materials required for welding work will be supplied by railways free of cost.

4. Sleepers spacing to be corrected after welding. 5. Disturbed parameters of the track to be made good after welding.

6. Disturbed ballast section to be made good. 7. After welding, the weld joint to be painted, supplied by railways to the extent of 100 mm on both the sides of the weld including bottom surface of the flange of the rail.

Note :- Only RDSO/LKO approved rail cutting machine and abrasive discs should be used. The work should be carried out anywhere in this SSE/P.way section. No extra will be paid for transportation of machinery/ man power. In case if the work is stopped due to any reason, no compensation shall be paid to the contractor. The contractor should depute at least 1 skilled labour and 2 semi – skilled labour per one machine every day.

Wooden blocks shall be issued at SE/P.way stores. The same has to be transported to site by contractor at his own cost

In case the contractor fails to arrange a minimum of 40-men mazdoor required with tools for unloading on short notice, de murrage charges will be recovered from the contractor. In case the rails are damaged while unloading/handling the cost of such rails will be recovered from the contractor. ( This item will be operated for unloading of rails from Railway BFR’s only. In case of road transportation, SSR item no. 18010201 only will be paid for unloading .)

SPECIAL CONDITIONS

1 Documents (duly updated and corrected up to the date of tender opening) which are deemed to have been part of this tender document are: a General Conditions of Contract. b. 2 If there arises any discrepancy between the printed Indian Railway unified standard schedule of rates (works & materials)-2010 (and corrected and amended up to date of tender opening) and the schedule attached to the Tender pertaining to this work, the former shall be treated as authentic and binding for all purposes.

3 The special conditions supplemented to the conditions of Tender and contract the General

Conditions of contract and the notes appearing Indian Railway unified standard schedule of rates (works & materials)-2010 should be considered as part of the Contract papers. Where the provisions of these conditions are at variance with the General Conditions of Contract, these special conditions shall prevail.

4 SECURITY DEPOSIT:

a) Security Deposit shall be 5% of the contract value. b) EMD paid along with tender shall form part of the SD. c) Balance SD shall be recovered from contractor’s bills. d) The rate of recovery shall be at the rate of 10% of the bill amount from every bill till the full

security deposit is recovered. e) Security Deposits will be recovered only from the running bills or final bill of the contract

and no other mode of collecting SD such as SD in the form of instruments like BG, FD etc. shall be accepted.

f) Security Deposit shall be released to the contractor after expiry of the maintenance period and after passing the final bill based on “No Claim Certificate” given by contractor.

g) After work is physically completed, Security Deposit can be returned to contractor if he so desires in lieu of FDR/ irrevocable bank guarantee for equivalent amount to be submitted by the contractor.

5 Performance Guarantee (PG)

a. The successful bidder shall have to submit Performance Guarantee (PG) within 30 (thirty) days from the date of issue of Letter of Acceptance (LOA). Extension of time for submission of PG beyond 30 (thirty) days and up to 60 days from the date of issue of LOA may be given by the authority who is competent to sign the contract agreement. However, a penal interest of 15% per annum shall be charged for the delay beyond 30 (thirty) days i.e., from 31st day after the date of issue of LOA. In case the contractor fails to submit the requisite PG even after 60 days from the issue of LOA, the contract shall be terminated duly forfeiting EMD and other dues, if any payable against that contract. The failed contractor shall be debarred from participating in re-tender for that work.

b. Performance Guarantee shall be submitted by the successful bidder after the Letter of

Acceptance (LOA) has been issued, but before signing of the contract agreement. This P.G. shall be initially valid up to the stipulated date of completion plus 60 days beyond that. In

case, the time for completion of work gets extended, the contractor shall get the validity of P.G. extended to cover such extended time for completion of work plus 60 days.

c. The value of P.G. to be submitted by the contractor will not change for variation up to 25%

(either increase or decrease). In case during the course of execution, value of the contract increases by more than 25% of the original contract value, an additional Performance Guarantee amounting to 5% (five percent) for the excess value over the original contract value should be deposited by the contractor.

d) Wherever the contract is rescinded, the security deposit shall be forfeited and the

performance guarantee shall be encashed. The balance work shall be got done independently without Risk and Cost of the failed contractor. The failed contractor shall be debarred from participating in the tender for executing the balance work. If the failed contractor is a JV or a Partnership firm, then every member/partner of such a firm shall be debarred from participating in the tender for the balance work in his/her individual capacity or as a partner of any other JV/partnership firm.

e) The Engineer shall not make a claim under the Performance Guarantee except for amounts

to which the President of India is entitled under the contract (not withstanding and /or without prejudice to any other provisions in the contract agreement) in the event of:

(i) Failure by the contractor to extend the validity of the Performance Guarantee as described herein above, in which event the Engineer may claim the full amount of the Performance Guarantee.

(ii) Failure by the contractor to pay President of India any amount due, either as agreed by the contractor or determined under any of the Clauses/Conditions of the Agreement, within 30 days of the service of notice to this effect by Engineer.

(iii)The contract being determined or rescinded under provision of the GCC, the Performance Guarantee shall be forfeited in full and shall be absolutely at the disposal of the President of India.

6 Deductions that shall be made from Contractor’s bills: a) VAT i Royalties and Octroi duties if any, that may be payable under any Provincial Government

Sales Tax Act or Local Bodies Act or Rules on any of the materials that may be used or supplied by the contractor will be payable by the contractor. The Railway will neither pay the taxes or duties nor be bound to compensate the contractor for any amounts paid by him by way of these taxes or duties.

ii As labour and material component are not easily identifiable in the work, VAT shall be deducted at 2.8% of total value of each bill.

iii For earth work contracts, VAT shall be recovered at source at 1.4% iv As per the A.P.VAT Act 2005 section 4 and sub-section 7(b) "Any dealer executing any works

contract for the Government or local authority may opt to pay tax by way of composition at the rate of 4% on the total value of the contract executed for the Government or local authority and in such cases the tax at 4% shall be collected at source.

b) Income Tax Deduction at source:

i In terms of the new section 194-C inserted by the Finance Act 1972, in the income Tax Act 1961 the Railway shall at the time of arranging payments to the contractor, for carrying out the work (including supply of labour) under the contract be entitled to deduct income tax at source on income comprised in the sum of such payments.

ii The deduction towards income tax to be made at source from the payments due to non-residents shall continue to be governed by Section 195 of the income Tax Act 1961.

iii Where amount of labour charges is not separately indicated, Income Tax at the rate of 2% will be recovered on the entire value of the contract. However, where labour portion is separately indicated, the Income Tax will be recovered at 2% on the value of the labour portion only.

iv No Income Tax will be deducted on payments made for supply of material when such value is distinct and ascertainable.

c) Seigniorage Charges Seigniorage charges for supply of earth, moorum, sand and other minerals as fixed by State Government and payable to them as revised from time to time during the currency of contract will be recovered by Railway from the contractors on account and final bills and remitted to the State Government. The rates quoted by the tenderer shall be inclusive of these charges. Claims regarding revision of seigniorage charges and consequent enhancement of the accepted rate will not be entertained.

d) Conservancy charges: As applicable from time to time shall be recovered from the contractor’s bills.

e) Water: Water required for executing the work should be arranged by contractor himself at his own cost. However, Railway may also supply water for the work depending on feasibility and availability on specific request from contractor. A charge of one percent will be recovered by the Railway for the supply by Railway piped water from existing pipe line and calculated on the amount of all items of work appearing in the bills payable to the contractor in respect of which work such water has been used by the contractor and such charges shall be deducted from sums due or payable by the railway to the contractor from time to time. In the event of water having to be brought by the Railway to the site of the work in traveling tanks, the actual freight at public tariff rate and all other charges incurred therein including any demurrage that may be levied shall also be payable by the contractor and deducted from sums due or payable by the Railways to the contractor from time to time. In addition to these charges, if additional pipe lines to those already existing are called for by the contractor, the cost of the same and all charges incurred by the Railway in their laying including supervision charges will be paid by the contractor or the contractor provides and lays his own pipe line at the discretion of the Divisional Engineer.

f) Electrical energy that may be required for operating contractor’s plants for carrying out work will

be supplied by the Railway wherever feasible at the discretion of the Railway on specific request from contractor and on payment of the charges as required by the Electrical Department of Railways.

g) The Building and Other Construction Workers Welfare Cess:

The Contractor for carrying out any construction work in Andhra Pradesh must get themselves registered from the Registering Officer under Section-7 of the Building and Other Construction Workers Act, 1996 and rules made thereto by the Andhra Pradesh Govt. and submit certificate of Registration issued from the Registering Officer of the Andhra Pradesh Government (Labour Dept). For enactment of this Act, the contractor shall be required to pay cess @ 1% of cost of construction work to be deducted from each bill. Cost of material shall be outside the purview of cess, When supplied under a separate schedule item.

7 Variation in the Quantities:

1) The Railway reserves the right to alter the designs and drawings. If due to change of drawing or any other reasons, there be variations, either increase or decrease in quantities, payment will be made only for the actual quantities executed at the accepted rates. If there be sufficient cause the Railway may grant extension of the date of completion suitably. Such circumstances shall in no way affect or vitiate the contract or alter the character thereof, or entitle the contractor to damages or compensation thereof except as provided for in this contract.

2) The quantities of each item of work furnished in the Schedule are approximate and are intended for the guidance of Tenderer/Contractor. In actual execution of work there may be some increase in the quantities specified. Such variation up to 25% shall in no degree affect the validity of the contract and it shall be performed by the contractor as provided therein and be subjected to the same conditions, stipulations and obligations originally and expressly included and provided for in specifications and drawings and the amount to be paid thereof shall be calculated in accordance with accepted schedule of rates.

3) Individual NS items in contracts shall be operated with variation of plus or minus 25% and payment would be made as per the agreement rate. For this, no finance concurrence would be required.

4) In case an increase in quantity of an individual item by more than 25% of the agreement quantity is considered unavoidable, the same shall be got executed by floating a fresh tender. If floating a fresh

tender for operating that item is considered not practicable, quantity of that item may be operated in excess of 125% of the agreement quantity subject to the following conditions

a) Operation of an item by more than 125% of the agreement quantity needs the approval of an officer of the rank not less than S.A. Grade:

i) Quantities operated in excess of 125% but up to 140% of the agreement quantity of the concerned item, shall be paid at 98% of the rate awarded for that item in that particular tender;

ii) Quantities operated in excess of 140% but up to 150% of the agreement quantity of the concerned item shall be paid at 96% of the rate awarded for that item in that particular tender;

iii) Variation in quantities of individual items beyond 150% will be prohibited and would be permitted only in exceptional unavoidable circumstances with the concurrence of associate finance and shall be paid at 96% of the rate awarded for that item in that particular tender.

b) The variation in quantities as per the above formula will apply only to the individual items of the contract and not on the overall contract value.

c) Execution of quantities beyond 150% of the overall agreemental value should not be permitted and, if found necessary, should be only through fresh tenders or by negotiating with existing contractor with personal concurrence of FA&CAO/FA&CAO(C) and approval of General Manager.

5. In cases where decrease is involved during execution of contract: a) The contract signing authority can decrease the items up to 25% of individual item without finance

concurrence. b) For decrease beyond 25% for individual items or 25% of contract agreement value, the approval of

an officer not less than rank of S.A. Grade may be taken, after obtaining ‘No Claim Certificate’ from the contractor and with Finance concurrence, giving detailed reasons for each such decrease in the quantities.

c) It should be certified that the work proposed to be reduced will not be required in the same work. 6. The limit for varying quantities for minor value items shall be 100% (as against 25% prescribed for

other items). A minor value item for this purpose is defined as an item whose original agreement value is less than 1% of the total original agreement value.

7. No such quantity variation limit shall apply for foundation items. 8. As far as SOR items are concerned, the limit of 25% would apply to the value of SOR schedule as a

whole and not an individual SOR items. However, in case of NS items, the limit of 25% would apply on the individual items irrespective of the manner of quoting the rate (Single percentage rate or individual item rate).

9. For the tenders accepted at Zonal Railways level, variations in the quantities will be approved by the authority in whose powers revised value of the agreement lies.

10. For tenders accepted by General Manager, variations up to 125% of the original agreement value may be accepted by General Manager.

11. For tenders accepted by Board Members and Railway Minister, variations up to 110% of the original agreement value may be accepted by General Manager.

12. The aspect of vitiation of tender with respect to variation in quantities should be checked and avoided. In case of vitiation of the tender (both for increase as well as decrease of value of contract agreement), sanction of the competent authority as per single tender should be obtained.

8 Employment of Civil Engineering Graduate or Diploma Holders:

a) It is mandatory that contractors should employ the following technical staff during the execution of the work

b) One graduate engineer when the value of agreement is Rs 15.00 lakhs and above c) One qualified diploma holder when the agreement value is more than Rs 5.00 lakhs but less than

Rs.15.00 lakhs. d) Educational qualification certificates, bio-data with a passport size photograph of technical

supervisor should be available with the concerned JE/SE/ADEN. e) Technical staff should be available at site whenever required by the Engineer-in-charge to take

instructions. f) In case, the contractor fails to employ technical staff as aforesaid, he shall be liable to pay reasonable

amount not exceeding a sum of Rs.5000/- (Rupees Five Thousand only) for each month of default in case of graduate engineer and Rs.3,000/- (Rupees Three Thousand only) for each month of default in case of Diploma Holder.

g) The decision of the Engineer-in-charge as to the period for which the required technical staff was not employed by the contractor and as to the reasonableness of the amount to be deducted on this amount shall be final and binding on the contractor.

h) For welding of rail joints contracts where RDSO’s certified welder of the contractor is engaged, this clause is not applicable.

9 Labour License:

a) Contractor has to abide by the contract labour (Regulations and abolition Act, 1970) and rules, regulations and amendments thereto that may be followed from time to time.

b) The work should not be executed without a valid labour license. c) The contractor shall comply with the provisions of EPF & MP Act, 1952 and obtain code number

from the concerned authorities whenever workmen employed by him are 20 or more. d) He shall also indemnity Railways from and against any claim, penalties, recoveries under the above

Act and Rules. e) Contractor has to get the code number under EPF so as to enable the PF commissioners to extend the

social security benefits to the workmen engaged by them. 10 Modification to Clause 63 & 64 of GCC: a) The provision of clause 63 and 64 of the General Conditions of Contract will be applicable only for

settlement of claims, disputes, for values less than or equal to 20% of the original value (excluding the cost of materials supplied free by Railway) of the contract or 20% of the actual value of the work done (excluding the value of the work rejected) under the contact, whichever is less.

b) When claims / disputes are of value more than 20% of the value of the original contact or 20% of the value of the actual work done under the contract, whichever is less, the contractor will not be entitled to seek such disputes/claims for reference to arbitration and the provisions of clause No.63 & 64 of the General Conditions of Contract will not be applicable for referring the disputes to be settled through arbitration.

c) The contractor shall furnish his monthly statement of claims as per clause 43 (1) of General conditions of contract.

d) The contractor can seek reference to arbitration to settle the disputes only once. 11 Price Variation Clause (Applicable for Advertised Tender Value exceeding Rs 50 Lakhs):

a) The rates agreed upon shall hold good till the completion of the work and no additional individual claim will be admissible on account of fluctuation in market rates, increase in taxes, levies, etc. However extra payment/recovery shall be made from bills payable to contractor as per overall market situations as specified below.

d) The above percentages are on the concerned on account / final bill amount excluding

f) Mc component in the bill will be worked out based on the bill made for cement supply. For the portion of cement included in any work item itself (SSR or NS), the quantity of cement as per actual consumption at the rate accepted for Schedule A-I shall be considered as Mc component. In case no SSR cement item is available in the agreement (Schedule

A-I) and cement is only a part of other NS or SSR items, cement component shall be worked out based on SSR rate (At Par) for cement supply.

g) Month under consideration referred in para 11(b) above shall be the month in which the

measurements are recorded for the bill.

h) Base month is month in which tender is opened. For quantities beyond scope of the original agreement [i.e., in case of variations], month in which negotiations are conducted is taken as base month.

i) SAIL’s ex works price referred in Para 11(b) above shall be circulated by Railway Board

for every month. The same are final and binding on both parties of the contract.

l) Items excluded from the scope of Price Adjustment:

The following shall be excluded form the value of the work done for the purpose of price adjustment. The value of the materials if any, supplied by the Railway at fixed prices or free of cost. Specific payments if any made by the contractor to the consultants engaged by him where such

payments are indicated in the accepted offer. Value of items of work in excess of 25% for major value NS items, 100% for minor value NS

items and 25% for schedule value for SSR items for which separate rates may be negotiated.

m) Price variation shall be worked out and effected as and when final RBI indices are published and as and when SAIL prices are circulated by Board.

n) PRICE ADJUSTMENT DURING EXTENDED PERIODS OF COMPLETION:

The price variation is payable/recoverable for the extended periods [i.e., when the month under consideration falls beyond the original due date of completion] shall be worked out as following: Extension Granted on Price Variation Modalities Force Majeure clause (clause 17) of GCC

Price Variation shall be same as specified in above paras.

Administrative Grounds [under clause 17A (i), (ii) and (iii) of GCC Contractor’s Account [under clause 17(B) of GCC]

Lesser of: a) Price variation same as specified in above

paras. b) Price variation worked out taking month under

consideration as the month in which the original due date of completion falls.

12 Period of completion:

a) Work under this contract shall be completed in all respects within 08 months from date of issue of letter of acceptance.

b) Extension of time of completion will be granted by Railways on specific request from contractor under clause 17 of General Conditions of Contract.

c) However, while granting extension of time under clause 17(B) of GCC, a token penalty as deemed fit based on the circumstances of the case can be imposed on the contractor by the Railways without prejudice to other rights of Railway and as provided under GCC.

13 Maintenance Period: The work shall be maintained after completion, for a period of Nil months by the contractor and he shall make good any defects, imperfections at his own cost.

14 Safety precautions to be taken at work site:

a) The contractor shall not allow any road vehicle belonging to his or his suppliers etc. to ply in railway land next to the running line. If for execution of certain works near railway line, road vehicle’s are necessary to be used in railway land next to the railway line, the contractor shall apply to the Engineer-in-charge for permission giving the type and number of individual vehicles, names and license particulars of the drivers, location, duration and timings for such work/movement. The Engineer-in-charge or his authorized representative will personally counsel, examine and certify the road vehicle drivers, contractor’s flagmen and supervisor and will give written permission giving names of road vehicle drivers, contractors flagmen and supervisor to be deployed on the work location, period and timing to the work. This permission will be subject to the following obligatory conditions.

(i) Road vehicles can ply along the track after suitable cordoning of track with minimum distance of 6m from the center of the nearest track. For plying of road vehicles during night hours, adequate measures are to be communicated by contractor in writing along with a site sketch to the contractor (s) representative and controlling engineer/supervisors in charge of the work .

(ii) Nominated vehicles and drivers will be utilized for work in the presence of at least one contractor’s flagman and one contractor’s supervisor certified for such work.

b) The vehicles shall ply 6m clear of track. Any movement/work at less than 6m and up to minimum 3.5m clear of track center, shall be done only in the presence of railway employee authorized by the Engineer-in-charge. Cost of such railway employee shall be borne by the Railway.

c) In case any work needs to be done at less than 3.5m from the centre line of track, such work should be done under a traffic block and/or speed restriction as decided by Engineer-in-charge. Contractor shall submit detailed planning of the work to the Engineer-in-charge to plan the speed restrictions and traffic blocks.

d) The Railway administration will not be responsible for the safety of contractor’s labour engaged for this work by the contractor. Contractor should not make any claim from the Railway for any compensation to be paid for loss of human life or injury sustained by his labour. Contractor should make his own arrangements to make his labour conversant with Railway Working rules. While working in vicinity of running track, all necessary safety precautions should be followed by his workmen.

e) The work may have to be carried out under traffic conditions. It is the responsibility of the contractor to see that there is no detention and/or interruption to the movement of trains. No claim will be admissible towards loss of time, wastage of labour employed etc. that may be incurred by the contractor due to movement of trains.

f) In case of accident/natural calamities involving human lives, the railway administration can draft the equipments and vehicles of the contractor for restoration of normalcy. However, for payment purpose the item will be operated as an additional NS item in the contract agreement duly negotiating the rate

g) Liability of Contractor’s any damage sustained by Railways during Accidents etc., caused due to Contractor’s Failures, Fault or Negligence: In the event of any accident occurring at the work spot and it is established during the departmental enquiry by the Railway or by statutory enquiry of CRS, that the accident occurred wholly or partly due to any act tantamounting to negligence on the part of the contractor or his labour in not adhering to the instructions of the Engineer-in-charge, the contractor shall render himself liable for damages and also legal prosecution if loss of life is involved.

15 Security: It is the responsibility of the contractor to arrange for watchmen to guard against theft etc., till that

time the Railway materials (if any) are handed over to Engineer-in-charge. It shall be the responsibility of the contractor to keep in safe custody any Railway materials, plant or equipment issued for the work. The contractor shall at his own expenses provide suitable temporary shed/sheds for storing his material etc on the Railway land if available and sparable free of rent and shall remove the shed/sheds when no longer required in terms of Clause-30 of General Conditions of Contract. If due to any reason, the Railway is not in a position to make available the railway land, the Railway Engineer-in-charge of the work may permit the contractor to erect at his own cost shed/sheds or secure private --accommodation outside the Railway premises. In such a case contractor may be permitted to take the Railway material required for the work outside the Railway premises and to store in the shed so erected on private accommodation so secured. It shall be the responsibility of the contractor to keep the railways materials in safe custody and the same should be kept entirely separately from the contractor(s) materials and the Railway shall have liberty to inspect the same from time to time.

16. TRANSPORTATION CONDITIONS: 1 Materials shall be handed with proper care and the contractor will be responsible for its safe

custody from the time of its taken over for conveyance till it is handed over after stacking as destination.

2 The Railway shall not be liable for any loss or damage caused to the materials while in the custody of the contractor. The contractor will be liable to make good any loss or damage to material during loading, transit unloading or stacking.

3 It must be ensured that no work is carried out by the contractor without the knowledge of authorised Railway staff.

4 The lead shall be determined along the shortest practical route and not on the route actually taken.

5 The contractor or his authorised representative shall take over/handover the materials duly giving/taking the acknowledgement at each stage from/to the authorised Railway staff in charge. The acknowledgement should indicate description of the materials, quantities actually received/handed over by him from/to the authorised railway staff clearly indicating damage if any.

6 Damage to contractors transport vehicles if any will on contractors account. 7 Accident if any to contractors vehicle or to persons would be the responsibility of the

contractor and Railway will not be responsible for any damages or compensation thereof. 8 Idling of the contractor labour and vehicles if any account of delay in loading/unloading will

not be considered and contractor will have no claim whatsoever in this regard. 9 The contractor shall carryout the work in such a manner as to avoid any inconvenience and

disturbance to Railway working and the public using the Railway premises and he will adjust his programme of work accordingly in consultation with the authorised Railway staff.

10 The contractor should transport the Railway materials in trucks vehicles which are covered by motor vehicles insurance.

11 The materials should be stacked at the nominated stations/depts etc as required by the Engineer-in-charge.

12 In case the permanent way materials are to be picked up from the other side of the track, the Railway staff in-charge should be present and safe guard the movements of the trains. There should be no to the safety of the track while trucking out the materials.

13 The contractor is responsible to lay and maintain the service approach roads at his own cost for the easy passage of his vehicles.

14 The contractor or his agents labour and drivers of vehicles shall not cause any damage to the Railway administration premises or property. In the event of any damage caused to the Railway property. In the event of any damage caused to the Railway property the contractor shall a once make good the same to the satisfaction of the administration.

15 While working close to or along side the existing Railway track the contractor shall be responsible for ensuring the there is no obstruction or interference to sage running of trains, signaling electrical installations structures are caused at any time. In cause any damage to the Railway property the contractor is responsible to make good of the loss at his cost.

16 The Central/State Government laws in force on labour contracts and transportation etc, would apply to the recent contract.

28 17 The contractor should accommodate in lorry/trucks/trailors free of charge one or two railway

employees as escorts in drivers cabin in the railway choose to sent an escort with materials. 18 In case of any dispute regarding carrying out the work the decision of Sr.Divisional

Engineer/Divisional Engineer in final end. 19 While transporting Railway material no other outside materials should be transported along

with Railway material. Any illegal article/materials found any time in the vehicle will result in termination of contract and forfeiture of Security Deposit.

20 In case of any accident/mishap the same should be immediately informed to the Divisional Engineer duly taking care to safeguard the Railway materials.

21 All taxes/toll gate fees should be paid by the contractor. He should not claim the same from Railways.

22 Willful pilferage of Railway materials shall be taken up under relevant act.

23 The contractor should visit the site of work to have a clear idea of nature of work involved so that he can quote the rates accordingly. For transporting of material, it may become necessary to collect and lead the material from stacks/deep areas and from wild growth in some occasions. The contractor should be aware of this. No extra will be paid in this aspect.

24 The contractor should take all precautionary measures while transporting materials. They should be fastened firmly so as not to cause any damage to other road users.

17. Track Works Conditions:

17.1 The sleeper/rails and fastenings will be supplied by the Railways for carrying out the work. 17.2 All the released materials (as per the inventory taken by the ADEN/PWI concerned) has to be trucked and

the materials are to be handed over at the nominated locations by the contractor, if any lesser, damages occurred for the released materials the cost of the same will be recovered from the contractors bills as per the extent rules and certificate in the bill has to be furnished by the ADEN/PWI stating that all the released materials are returned and accounted in the relevant register duly giving page number and date.

17.3 No plant and or machinery will be supplied by the Railway for this work. It is the contractor’s responsibility to supply at his own cost, any materials, and plant, machinery required for this work.

17.4 For any items of work in the event of their being any conflict in the working or drawing referred to in the Schedule and Specifications of work, the former shall prevail. The decision of Engineer-in-charge will be final in all such matters.

17.5 Use of Raw materials secured with Government assistance where any raw materials for the executing of the contract and procured with the assistance of Government either by issue from Government stocks or purchased under arrangements made on permits of license issued by the Government, the contractor shall hold the said materials as trustee for Government and use such materials economically and solely for the purpose of the contract against which they are issued and at disposed them without the permission of Government and returned if required by the purchases all surplus of unserviceable materials that may be left with him after completion of the contract as Government may fixed the due regard to the condition of the materials. The freight charges for the return if the materials according to the direction charges for the return of the materials according to the direction of the purchased shall be borned by the contractor, in the event of the decision of Government shall be final and conclusive.

17.6 In the event of any breach of the aforesaid conditions the contractor shall in addition to the owing himself open to action for contravention of terms of the licenses, the permit and for any reason whatsoever on his being paid such price or for criminal breach of trust be liable for account to Government for all money advantages or profit resulting of which is in the usual course and would have resulted him by reason of breach.

17.7 If due to any reason the railway is not in a position to make available the Railway land, the Railway Engineer-in-charge of the work may permit the contractor to erect at his own cost shed/sheds or secure private accommodation out side the Railway premises and to store in the sheds erected or private accommodation so secured. It shall be the responsibility of the contractor to keep entirely separate from the contractors materials and the Railway shall be at liberty to inspect the same time to time.

17.8 Speed Restrictions a. Speed Restrictions as required for safety of traffic will be arranged by the Engineer-in-charge. No

work on the track shall be completed until the permanent way inspector of the Railways has imposed the speed restrictions and erected speed indicators.

b. After a speed restriction is imposed, the contractor shall progress with the work in a systematic manner.

c. Long length of track under speed restrictions should be avoided.

d. If the contractor fails to employ adequate labour for alteration to the track so as to permit the train to go at restricted speed, the Railway will take action to employ such labour as is necessary at the Risk and cost of the contractor to attend to track and make it fit for passage of trains at restricted speed.

e. Caution watchman as necessary during day and night would be arranged for free by the Railways 17.9 Contractors supervision

a. The contractor shall employ and post at site a technical supervisor who should be adequately qualified and well experienced in execution of Permanent Way works. The name, details of technical qualification and record of experience of the supervisor employed should be advised to the Engineer-in-charge. If in the opinion of the Engineer-in-charge, the Supervisor is not fit to be in charge of the work, should be forthwith replaced. In this matter, the opinion of the Engineer-in-charge will be final and binding the contractor

b. No work on the track should be done unless and until the PWI contractor’s technical supervisor is present at site

17.10 The minimum progress for the complete track renewals and through sleeper renewals and the penalties for the slow progress should be as follows

a. For CTR and TSR works 4 (Four) Kms per month b. For TRR and Deep Screening work 4 (four) Kms. Per month

For every linear metre of shortage, recovery of the following rates should be made from the contractors bills. a. Complete track renewals : Rs.10/- per metre of shortage b. Through sleeper renewals : Rs.8/- per metre of shortage c. Deep screening : Rs.10/- per metre of shortage

d. Through rail renewals : Rs.4/- per metre of shortage 17.11 This existing rails, sleepers and fastenings from the track should be recovered including excavation etc.,

with utmost care to avoid any damage to the rails, sleepers and fastenings etc., shall be neatly removed re-laid and balance released materials handed over to the PWI concerned at his depot

17.12 The contractor shall carry out the work in such a manner to avoid any inconvenience and disturbances to Railway working and to the public using the Railway premises and will adjust the program of work accordingly in consultation with the Engineer-in-charge

17.13 The work must be supervised by PWI. No work is carried out by the contractor unless PWI in charge of the work is at site. It is necessary that safety of the track is ensured by the PWI in charge supervising the work.

17.14 At any stage during the execution of work, if contractor fails to employ adequate labour to complete the works in traffic blocks to raise the speed by rear packing and restore traffic etc., as decided by the Engineer-in-charge, such work will be carried out by deploying departmental labour at the cost of contractor, without prejudice to action as per G.C.C., in clause 62 and recovery of cost of such labour shall be made from contractors bill as per extent rules.

17.15 Deep screening i. Deep screening of ballast below the bottom of the sleepers up to formation level and putting back the

screened ballast, lifting of track to provide the specified cushion, initial, alignment, lifting and levelling the track to proper longitudinal profile, initial packing and additional packing of track as directed by the Engineer or his representative complete with disposal of muck/spoils within a lead of 100m including all lifts/descents. Spreading and boxing of ballast to standard profile. Bringing the cess to the correct level to relation to the final rail level as directed by Engineer-in-charge

ii The work of deep screening should be carried out in accordance with the provisions given under para 238 ( c) to (g) of Indian Railway Permanent Way Manual, 1986 and para 6.3.1 of manual of instructions of long Welded Rails, 1996 with up to date correction slips.

iii. The screening should be taken up to cover full width of ballast section. The ballast above the formation should be taken up for screening. Any deficiency in ballast cushion should be made good by lifting of track to the longitudinal levels decided after proper survey. No extra payment will be paid for such subsequent lift involved to achieve the required clean cushion.

iv Before deep screening work is started, longitudinal profile of track will be taken and final profile marked at 30m interval on pegs, duly taking into account formation/cess level and the required ballast cushion. This will be done by the Railways Engineer-in-charge. The contractor shall maintain the rail level after deep screening to the level as indicated on the pegs or as directed by the Engineer-in-charge

v The work of deep screening will include removing ballast including the core below the sleeper and excavating below the bottom of sleeper up to the formation level as directed by the Engineer-in-charge. The ballast so removed should be screened by using portable inclined ballast screened with 20mm openings. The use of wire baskets for screening is not permissible. Muck/spoils should be disposed off as directed by the Engineer-in-charge

vi. Deep screening work must be organized with independent screening reclaiming and finishing partial each of adequate strength.

vii. Use of wooden blocks is a must as soon as the crib ballast is opened out. Full use must be made of regular wooden blocks as well as tapered wedges

viii In embankments for screening of ballast inclined screens should be positioned at the edge of the formation with the inclined leg resting on the slope so that the muck is thrown on the slopes and the screened ballast is collected on the cess. In cuttings muck from the screened ballast should be collected in cane baskets properly gunny lined and disposed beyond reach of the cutting. Care should be taken that the muck does not mixed with the cleaned ballast. The muck should not be dumped on slopes of cuttings inside of drains and catch watered drains.

ix Proper drainage of deep screened formation should be ensured by sloping the formation toward from the center of the formation to a slope of 1 in 40

x No ballast is to be wasted in slopes and in cuttings while carrying out the above operations. xi. The contractor should carry out digging, screening, levelling the track and rough packing underneath with

the screened ballast adequately so as to pass the trains at 20kmph. These works shall be completed on the first day for the length taken up for screening.

xii. The rate for deep screening will include shifting and squaring of sleepers to the correct spacing as marked by the Engineer-in-charge. This will also include removal/renewal of fitting and re-fixing of fittings and also re-packing.

xiii. After the speed restriction is imposed the contractor shall commence the work immediately and progress with the work in a systematic manner. Long length of track under speed restriction should be avoided

xiv For all works on the running track or adjacent to the running track, the protection of work site shall be ensured by the Railway at its own cost. However, the contractor, in addition will provide the necessary look out means to ensure safety of his workmen/workwomen.

xv The track parameters which shall be attended after deep screening and final packing should be within the following tolerances

xvi At intermediate stages of speed relaxation the above standards may be attained to the extent feasible. The

decision in this regard Engineer-in-charge shall be final. xvii The following essential tools and equipment required for the execution of the work will have to be

arranged for by the contractor at his own cost 1. Screens with 20mm size openings 2. Gauge cum level 3. Wooden squares 4. Cane baskets properly gunny lined 5. Wooden blocks and tapered wedges 6. Mallets/hammers 7. Crow bars 8. Beaters 9. Shovels and wire claws

17.16 Distressing work

i. Contractor shall adhere to the provisions of para 5.7 and Annexure VIII of Manual of instructions on long welded rails.

ii. Destressing operation should be done at destressing temperature range only iii. Track gauge shall be ensured by the contractor/representative of the contractor before passing the train. Iv Whenever weld collars are obstructing the movement of rails at the time of destressing necessary respacing

of adjacent sleepers should be done by the Contractor v Cuttings, drilling of holes should be done by the contractor for which payment will be made extra.

Welding portions, equipment and other consumables along with welder will be supplied by the Railway free of cost. Unskilled labour required for welding should be supplied by the contractor.

vi Whenever LC gates exists, check rails should be removed and proper clearance of ballast is to be made by the contractor for free movement of rails during destressing and refix the check rails and close the LC after distressing
