United Nations Convention on the Law of the Sea 1982, Article 234

Marine transportation on the NSR is regulated by the Russianlegislation based on the principles of the UN Convention onthe Law of the Sea, 1982, in particular article 234 “Ice-covered Areas”.

• Non-discrimination basis for all states• Preventing environment pollution• Ensuring safe navigation

Article 234«Coastal States have the right to adopt and enforce non-discriminatory laws and regulations for the prevention, reductionand control of marine pollution from vessels in ice-covered areaswithin the limits of the exclusive economic zone, whereparticularly severe climatic conditions and the presence of icecovering such areas for most of the year create obstructions orexceptional hazards to navigation, and pollution of the marineenvironment could cause major harm to or irreversibledisturbance of the ecological balance. Such laws and regulationsshall have due regard to navigation and the protection andpreservation of the marine environment based on the bestavailable scientific evidence.»
