2.1 Good Design

Good design responds in a practical and creative way to both the functionand identity of a place. It puts land, water, drainage, energy, community, economic, infrastructure and other such resources to the best possible use for people – over the long as well as the short term.

3.1 Design in the planning system

The government attaches great importance to the design of the built environment. Good design is a key aspect of sustainable development, is indivisible from good planning, and should contribute positively to making places better for people.(National Planning Policy Framework, paragraph 56)

4.2 Making decisions

Every decision can change a place dramatically for the better or worse over only a few years when the proposed plans are delivered.

Decisions on planning applications should clearly support the design objectives in the Local Plan or area/site specific documents.

4.3 Design checklist

• do plans and proposals take account of the site context? Do they provide sufficient visual information to assess the scheme’s impacts?

• is the scheme aligned with the Council’s vision and policies for the area?

• has the public consultation and engagement been diligently carried out and applicants responded to the comments?

• review the design and access statement if there is one• what aspects of the schemes are being determined and what elements

are illustrative? outline or detailed application? e.g. photo montages are illustrative

4.4 Engaging with the communityLocal communities play a vital part in good design. Those who live and work in an area often best understand the way in which places operate and its strengths and weaknesses.Any major development or plan should aim to• involve the community early and

widely in the plan making process• understand their priorities and

concerns about a development at the pre-application stage to inform the emerging design

4.5 Using planning conditionsThe design process continues after the granting of permission and it is important to ensure that the high quality design is delivered on site. Paragraph 206 of the National Planning Policy Framework (NPPF) states “Planning conditions should only be imposed where they are:

• necessary• relevant to planning and;• to the development to be permitted• enforceable• precise and;• reasonable in all other respects.”Planning conditions are typically used to request further details about the issues that are central to the design quality, for example, building materials, landscape design to manage impact on the sensitive context.

4.5 Example: completed building

Completed development, Beaufort Court, West London – this is a successful example of preparing comprehensive design drawings and details that were realised in the completed scheme with the exception of the wider landscaping. Well proportioned elevations, high quality finishes and innovative method of construction contributed to the project success.

4.6 Top tips for Councillors

• work with officers to set clear priorities for the site or area at the outset

• not all glossy applications are good designs and don’t be afraid to ask for more information

• consider drawings based on what will happen in real life• density, either higher or lower can not be used alone to assess

design quality, consider all aspects of the development as set out in the design and access statement

• design can be objective and there are tested principles and policy frameworks in place in assessing design

• if supported with evidence and policies, development can be refused on design grounds

5.3 Championing qualityCouncillors have an important role to play in ensuring that their local authority has in place the right level of design skills to secure an informed and proactive planning process. Good practice includes:

• an in-house team with design skills that can advise the council and develop the local knowledge base.

• preparing a design quality charter• running design initiatives, including design awards, reviews, competitions• including the design criteria in the council’s public procurement on

development projects and lead by example• regular visits to completed projects to help everyone reflect on the

decisions they took and the impact made by officers in negotiating changes to the initial scheme

5.4 Design ReviewsThe purpose of Design Review is to improve the design quality of new development.

In assessing applications, local planning authorities and councillors should have regard to the recommendations from the Design Review panel.

The local planning authority should consider offering design review when appropriate, preferably at the pre-application stage or as part of the assessing the planning application.

The cost for this can be covered as part of their pre-application service

7.2 Glossary

• Inclusive Design: Designing the built environment, including buildings and theirsurrounding spaces, to ensure that they can be accessed and used by everyone.

• Local Development Order: An Order made by a local planning authority (under the Town and Country Planning Act 1990) that grants planning permission for a specific development proposal or classes of development.

• Local Plan: The plan for the future development of the local area, drawn up by the local planning authority in consultation with the community. In law this is described as the development plan documents adopted under the Planning and Compulsory Purchase Act 2004. Current core strategies or other planning policies, which under the regulations would be considered to be development plan documents, form part of the Local Plan. The term includes old policies which have been saved under the 2004 Act.

• Neighbourhood Plans: A plan prepared by a Parish Council or Neighbourhood Forum for a particular neighbourhood area (made under the Planning and Compulsory Purchase Act 2004).
