ORDER

This matter comes before the court on charges of possession of drug paraphernalia, interferencewith official acts and disorderly conduct. The state appears by county attorney Ben Smith and thedefendant appears pro se. Testifying on behalf of the state was officer Stacy Carlson of the Sac Citypolice department. The state offered into evidence its exhibit 1 consisting of various items of drugparaphernalia which were taken from the defendant when he was booked. Officer Carlson testifiedthat he responded to a complaint of excessive noise from the defendant's apartment from loud musicand also from defendant banging on the walls. He testified that he could hear the music from thestreet as he got out of his car. He testified that he first asked defendant to turn down his music and

defendant was initially compliant but then turned it back up even louder when officer Carlson was atthe next door apartment. The officer then went to defendant's apartment where he placed him underarrest. Defendant resisted the officer's attempts to handcuff him and later spit through the window atthe jai.

Based on the evidence presented the court finds that the state has proven the defendant's guiltbeyond a reasonable doubt on each charge and finds him guilty of each charge. It imposes fines of$65.00 on each charge; surcharges of $22.75 on each and $60.00 court costs for a total of $323.25.
