1. Mystery Giftbox redemption commences on 19 December 2018 and ends on 31 December 2018,

23:59pm (or which stocks last) (“Promotion Period”).

2. Applicable to all new and existing Samsung Pay users with enough Reward points.

3. Users can only redeem ONE Mystery gift box consisting ONE item as stated as table below with 500

Rewards points during the Promotion Period.

4. The redemption of the selected items listed below is based on a random computerized calculation

system and decision of Samsung shall be final. No correspondence, queries, appeals or protests will

be entertained.

a result of fraud, or if Samsung believes that user’s transactions and/or reward points has been

manipulated in any way by machines or computers.

10. Samsung reserves the rights to change the products/offers of similar value in the event of out of

stocks or circumstances that is outside its control.

11. Samsung reserves the right to request for a screenshot of the Samsung Pay transaction history page

and/or other supporting documentation for verification purposes.

12. By redeeming the gift, Samsung Pay user agrees to release and hold Samsung and its employees,

officers, directors, shareholders, agents, representatives, parent companies affiliates, subsidiaries,

licensees, advertising, promotion, and fulfilment agencies, and legal advisors, harmless from any and

all losses, damages, rights, claims and actions of any kind in connection with the gift redemption or

resulting from acceptance, possession, use or misuse of the gift or from any gift-related activity,

including without limitation, personal injury, death, and property damage, and claims based on

publicity rights, defamation, or invasion of privacy.

13. Samsung will not assume any responsibility or liability for the product/merchandise/gift/e-voucher

and Samsung expressly excludes and disclaims any representations, warranties or endorsement,

implied or express, written or oral, of the product/merchandise/gift/e-voucher offered under this

Promotion, including but not limited to any warranty of quality, merchantability, fitness for a

particular purpose or use, health and safety. The product/merchandise/gift/e-voucher is offered

solely by the merchant under such terms and conditions as may be determined by the merchant.

Any dispute arising from or in connection with the product/merchandise/gift/e-voucher offered by

the merchant shall be resolved by the users directly with the merchant.

14. In the event of a conflict between these Terms and Conditions and the Individual T&Cs, the parties

shall give the provisions their broadest interpretation so as to reconcile the conflict. If such an

and such provision shall govern.

the exclusive jurisdiction of courts of Malaysia.

Bhd (“SME”), his/her redemption request cannot be revoked, cancelled or be exchanged. Once you

have redeemed your Rewards Points, they will be considered extinguish and strictly cannot be

reinstated.

2. Delivery information must be entered within the redemption period. Users who failed to do so shall

be deemed as disqualified. Information cannot be changed once submitted. SME shall not be

responsible for any inaccurate name or postal address information provided by the User which

3. SME reserves the right to appoint a third party (3rd) party vendor or service provider to handle the

fulfilment or making available of the item and delivery of the item to you. By providing your

personal information including name, delivery address, contact numbers, email address and other

information to SME, SME can use and/or disclose to such third party (3rd) party vendor or service

provider for the purposes of delivery service.

4. The fulfilment and delivery of the redemption item is handled by Nardell Sdn Bhd (Co. No.757489-D)

with its registered address and place of business at No. 10-03, Jalan Bangsar Utama 9, Wisma

Bangsar Utama, 59000 Bangsar, Kuala Lumpur (“Nardell”).

5. Nardell will contact the user to verify the user’s address for purposes of delivering theredemption

item. For any queries pertaining to the delivery of the redemption item, the user may contact

Nardell at 03-22012289.

6. In the event there is any change of address, the User is required to contact Nardell at 03-22012289

within 14 days from the date of redemption, the request of change of address may subject to any

additional charges and the approval from Nardell.

7. To accept the redemption item, the user or the authorised representative or the recipient are

required present identification, i.e. NRIC or Passport to the delivery personnel, failing which the

delivery personnel have the right to refuse delivery and will return the redemption item to SME as

“unclaimed”.

8. If any of the redemption item(s) are return to SME or Nardell “unclaimed”, the user may request

SME or Nardell to redeliver the unclaimed redemption item to the user, but the user will be

responsible to bear all costs of redelivery of the unclaimed redemption item.

9. The proof of delivery of redemption item must be in the form of written acknowledgement of

receipt of the redemption by the user, the authorised representative or the recipient. If the delivery

address is an office address, an acknowledgement by any office staff will be treated as good

acknowledgement of the redemption item.

10. Samsung Gear VR (SM-R325) will be delivered to users within 60 working days after the redemption

period ends.

11. If the user does not receive the redemption item upon the expiry of 60 working days after the

redemption period ends (“Rewards Receipt Expiry”), it will be the responsibility of the user to inform

SME no later than seven (7) working days from the Rewards Receipt Expiry and SME will arrange for

the delivery of the redemption item to the user upon receipt of proof of non-delivery from Nardell

or appointed third party (3rd) party vendor or service provider. The user will not have any recourse

against SME if the user allows the expiry of the said 7 working days and the user will be considered

to have had received and accepted the redemption item in good order.

12. When the user has in receipt of the redemption item, he or she should examine the redemption

item. If the redemption item arrive damaged or faulty, the user should contact Nardell within 24

hours upon receipt and provided the damaged or faulty redemption item is return to SME or Nardell

in its original state and packaging at your own cost and expenses within five (5) working days (as or

any other period stipulated by SME or Nardell from time to time) from receipt date. A replacement

redemption item will be delivered within 30 working days of the return or damaged or faulty

redemption item. If the user fails to return the damaged or faulty redemption item within 5 working

days, the damaged or faulty redemption item will not be given a replacement item.

13. Delivery will be made within Malaysia only, Samsung reserve the right to refuse or disqualify or

reject users who key in other countries addresses.

14. Images of the items are for illustration purposes only, the actual redemption item colour may differ

from actual product. Redemption item cannot be refund or exchange for cash or any other

redemption item.



16. The decision of SME shall be final and no further correspondences shall be entertained.
