REPORT NARRATIVE Synopsis: Skipp Jackson was arrested for 647 (F) PC, being drunk in public. Jackson exhibited assaultive behavior towards deputies on scene and a Taser was deployed while effecting the arrest. Jackson was additionally charged with 148(A) (1) PC, for resisting arrest. Jackson sustained a contusion on the back of his head as the result of a fall after the Taser deployment. No deputies were injured during the incident. Jackson was transported to Palomar Hospital by Ramona Fire Department #7890, where he was admitted for further treatment. Jackson was cited for 647 (F) PC and 148 (A)(1)PC Cite # 595802 and released on his promise to appear in court. Origin: On 06/24/14, at about 2125 hours, I was dispatched to a report of a male subject, running into the street and lunging at cars that were driving down the street. (CAD#E1753272). There were multiple reporting parties and they described the subject as a white male adult, 30 years of age, shaved head, wearing blue jeans, and a white t-shirt. The reporting party said he was stumbling and appeared to be under the influence of possibly drugs or alcohol. Investigation: While en route to the scene, Deputy Meyer #7585, broadcast over the radio that the subject description resembled a subject named Skipp Jackson that he had seen in the area earlier and that on prior contacts, force had been needed to take him into custody. Deputy Meyer arrived on scene at approximately 2127 hours and contacted the subject, later identified by his California Driver's License as Skipp Jackson. I arrived approximately one minute later at 2128 hours and observed Deputy Meyer, standing in the middle of the intersection of H Street and 11th Street talking to Jackson who matched the description given by the reporting parties. Meyer was attempting to

talk to Jackson, but Jackson appeared to be physically agitated, had his fists clinched, and had his right hand in his right front pants pocket. I pulled my patrol car up behind Jackson in an attempt to keep him from fleeing the area. I exited my patrol car, and observed he still had his right hand in his front pants pocket and had something small and black in his left hand. I shined my flashlight on Jackson and observed in his left hand was a small black flashlight. Jackson was approximately 8 feet from me and I could smell the strong odor of an alcoholic beverage emitting from his body or breath. I believed Jackson to be drunk in public and in violation of 647(f) PC. I verbally instructed him to slowly take his right hand out of his pocket. Jackson turned quickly towards me, and became verbally aggressive with me stating, "Why you come walkin' up on me?" I told Jackson that I just wanted to talk to him, and to take his hand out of his pocket. Jackson replied, "Fuck you!" Jackson stopped moving backwards, took his hand out of his pocket, and clenched his fists. Jackson then stood with his legs wider apart, consistent with someone stabilizing himself to fight. I withdrew my department issued Taser X26 from my holster and verbally announced to Deputy Meyer I had my Taser out. I turned on the activation switch, readying my Taser if deployment was needed. I kept my Taser down by the side of my right leg out of sight, in an attempt to not agitate Jackson any more than he already was. Jackson yelled, "You're gonna have to fuckin' shoot me!" Deputy Meyer withdrew his department issued Oleoresin Capsicum (OC) spray dispenser from his duty belt, and deployed an approximate 5 second spray into the face of Jackson in an attempt to gain compliance and avoid a physical confrontation. Jackson turned away from Deputy Meyer and became enraged, shouting profanities. Jackson then turned very quickly and lunged two feet towards Deputy Meyer in what appeared to be an attempt to charge him. I quickly brought my Taser on target in the mid torso of Jackson and deployed my Taser, striking him in his right ribcage and right hand. Jackson immediately became incapacitated and fell backwards onto the street surface. I allowed the Taser to activate for the entire 5 second discharge in order to give Deputy Meyer time to effect the arrest without further physical altercation with Jackson. When Jackson struck the ground, he struck the back of his head on the street surface, rendering him unconscious for approximately 8 seconds. Deputy Meyer immediately engaged Jackson, rolled him onto his right side, and placed him into handcuffs without further incident. Had the force not been used, Jackson may have fought with deputies on scene resulting in possible injuries to deputies and or himself. It was unknown if Jackson was armed at the time of contact, and may have retrieved a weapon from the pocket he was reaching into, causing serious injury or death to deputies on scene. As a result of me deploying my Taser, Jackson was taken into custody without any injuries to deputies on scene. I immediately notified Sergeant Strong #1997 at 2130 hours via the radio of the Taser deployment/Use of Force. Ramona Fire Department #7890 arrived on scene at approximately 2135 hours and transported

Jackson to Palomar Hospital for treatment. Jackson was admitted into the hospital for further medical treatment. Deputy Martinez #1472 took two digital photographs of Jackson at the hospital post admittance. (See copies in URL file.) Due to the fact that the charge of 148(A)(1)PC is not a bookable charge, and Jackson was admitted to the hospital for treatment, I determined he would no longer be in violation of 647 (F) PC upon release from the hospital. Therefore, Jackson was cited for 647 (F) PC and 148 (A)(1)PC Cite # 595802 and released on his promise to appear in court. Sergeant Strong notified the Division of Inspectional Services (DIS) at 2214 hours, due to the fact Jackson had sustained a head injury during the Taser deployment. DIS declined responding to the scene at this time. Investigation (cont.) I contacted one of the reporting parties, , that had remained on scene and witnessed the entire incident. made the following statement. Statements: Statement of (Witness):

stated he was driving eastbound on H Street, and as he was approaching 11th Street, observed a male subject lunge into the street towards his car as if he was going to punch or kick the side of it.

swerved to avoid striking him and drove further down the street and pulled over to telephone authorities. While was parked and talking to the Sheriff's 911 dispatcher, he saw the same male subject continuing down the street in his direction. saw him pick up multiple large rocks and was throwing them into random yards. said that is when he saw deputies arrive and begin talking to the subject. stated he couldn't hear what was being said, but saw that the subject appeared to be "Angry and not following deputies instructions."

stated he saw the subject lunge towards Deputy Meyer, and didn't see me draw my Taser weapon until he heard "The pop" and saw him fall to the ground. stated they subject was "acting crazy" and people in the area were afraid of him. Investigation (cont.) Upon arrival at the Ramona Sheriff's Station, I downloaded my Taser X26 into the Evidence Sync program. I printed a copy of the deployment activation record and attached a copy to this report. The report logged a single trigger 5 second activation which was consistent with how I had manually discharged my Taser during the incident. I transferred the two digital photographs onto compact disc, and placed them into evidence at the Ramona Sheriff's Substation. Background: None.

Use of Force Supplemental Instructions Every section of the Use of Force (UOF) Supplemental must be completed.  Do not skip any applicable sections.    DATE/TIME: Date/Time force was used.  EVENT/CASE NUMBER:  Event/Case number related to the use of force.  STATION/FACILITY: Station/Facility where the use of force occurred and the report will be reviewed and approved.   INCIDENT DESCRIPTION/OFFENSES:  List the code section (i.e. Penal, Welfare & Institutions, etc.) that the suspect was arrested or detained for at the time force was used.  If there is no code section put a detailed description of the incident related to the use of force (i.e. Safety Cell Placement, Cell Extraction, High Risk Vehicle Stop, etc.).  Do not put "Use of Force" in this box.  SUBJECT'S NAME (Last, First, MI):  Name of subject force was used on.  Each subject force was used on requires a separate UOF Supplemental form.    DATE OF BIRTH:  Date of birth of subject force was used on.  ARRESTED:  Mark "Yes" if subject was arrested for new charge(s).  Do not mark "Yes" for a subject already in custody, unless there is an arrest report documenting new charges related to the incident where force was used.  If there is no new arrest report, mark "No."  SUPERVISOR PRESENT:  Mark "Yes" if any supervisor was present during any portion of the actual use of force incident.  Mark "No" if a supervisor was not present for any portion of the use of force. (For sergeants using force, mark "Yes".)    DATE/TIME SUPERVISOR NOTIFIED:  The date and time a supervisor was notified of the use of force.  If a supervisor was present, use the same time as the use of force.  This time should not be earlier than the date/time force was used in the first two boxes.    PRIMARY REASON FOR USING FORCE:  Mark all boxes that apply.  SUBJECT APPEARED TO BE:  Mark "Under the Influence of Alcohol and/or Drugs" and/or "Mentally Impaired," if appropriate.  If one of these boxes is checked it should be articulated in the narrative.   NUMBER OF OFFICERS ON SCENE: Represents the total number of deputies on scene as force is being used.  This number should not include deputies who arrived after force was used.  The number of deputies on scene may vary from one UOF Supplemental to another because the number of deputies on scene may change over the course of an incident.  The number of deputies on scene should only include San Diego Sheriff's Department employees.  If there are officers from other agencies it should be detailed in the narrative.    NUMBER OF OFFICERS USING FORCE:  Each deputy that uses force is required to write an SO120 indicating the force they used. Therefore, the Number of Deputies Using Force for each SO120 will always be 1. (Exceptions may apply to investigative units or SED during the execution of a search warrant.)  LEVEL(S) OF RESISTANCE ENCOUNTERED:  Mark all that apply and at least one box.  Every level of resistance that is marked must be articulated in the narrative.  Additionally, the Use of Force Supplemental form should coincide with the corresponding narrative.  If for example, you mark Assaultive Behavior, then Assaultive Behavior should be described in your narrative.  Every deputy involved in a use of force incident must document the level of resistance THEY perceived.  The level(s) of resistance might vary from deputy to deputy due to differing perceptions, prior knowledge, when they got involved, etc.  The deputy's actions must be objectively reasonable and their responses should coincide with Department Policy & Procedure (e.g. TASER is used in response to Assaultive Behavior).    LAW ENFORCEMENT TOOL/TECHNIQUE USED:  Check all appropriate boxes under Empty Hand Control, Tool/Device/Weapon, Less Lethal Weapon System, Firearm, Other.  If known and/or applicable, include the duration (approximate length of time) tool/technique was used.  If known and/or applicable, include the number of contacts (approximate number of strikes, impacts, etc.) when requested on the form.  If a weapon system was pointed at the subject(s), it should be documented on the left side of the form or under Tool/Device/Weapon in NetRMS.  The right side of the form is for actual discharges of less‐lethal or lethal weapons systems.    WAS THE INITIAL USE OF FORCE EFFECTIVE?  If the initial force used was effective mark "Yes."  If the initial force used was not effective and additional force was necessary mark "No."  If you mark "Yes" the initial force was effective, then the following box labeled, "Was Additional Control or Force Needed?" should generally be marked "No."  WAS ADDITIONAL CONTROL OR FORCE NEEDED:  Mark "No," if no additional force was needed after the initial use of force.  Mark "Yes" if additional force was necessary.  In some instances, additional force may be necessary even if the initial force was effective.  If so, mark "Yes" (additional control/force needed) and describe the circumstances in your narrative.  SUBJECT INJURED:  All deputies involved should mark "Yes" if the suspect was injured as a result of their use of force.  Do not mark "Yes" for preexisting injuries or injuries caused by non‐law enforcement contact prior to the use of force (i.e. inmates involved a fight or DV victim injured by partner, etc.).  For reporting purposes, a complaint of pain should be considered an injury.  If the subject was not injured as a result of your use of force, mark "No."  If it is unknown who caused the injuries from the use of force, all deputies should mark "Yes."      EXTENT OF TREATMENT (SUBJECT):  One of the treatment boxes (Treated at Scene, Treated at Hospital, Hospitalized, or Refused Treatment) should be marked if the subject was treated or evaluated as a result of the use of force.  This might include a preliminary medical assessment or evaluation by paramedics in the field or jail medical staff.  5150 W&I commits do not fall into this category unless they are evaluated or treated due to the use of force.  If not treated or evaluated as a result of use of force then mark "None."   The narrative should coincide with the checked boxes.    OFFICER(S) INJURED:  If you are injured as a result of the use of force then mark "Yes," otherwise mark "No."  If your partner was injured, and you were not, you mark "No."  EXTENT OF TREATMENT (DEPUTY):  Same as the previous guidelines regarding the "Extent of Treatment" (Subject).  OFFICER/SUSPECT INJURY DESCRIPTION:  The primary deputy should try and obtain the most updated description of any injuries to the suspect or deputy prior to submitting their reports.  The arrest report or crime report narrative should have this description as well.    OTHER FORCE USED/COMMENTS/EQUIPMENT PERFORMANCE:  This section can be used to document other force options not listed, relevant comments about the use of force, or negative/positive comments regarding equipment performance.  FIGURE DIAGRAM: Anytime contact is made with the subject during a use of force (utilizing various force options, including hands on control), the figure diagram should be marked to show where contact was made.  Do not mark the figure diagram for the pointing of a firearm or less lethal weapon system.   SERGEANT/LIEUTENANT/CAPTAIN SIGN OFF:  This is handled electronically through NetRMS.

REPORT NARRATIVE

ORIGIN: On 06/24/2014, at approximately 2120 hours, I was working as a Patrol Deputy in Ramona California. I responded to H Street and 11th Street to investigate reports of an intoxicated male charging at passing cars. I had seen a male matching the description in that area approximately 20-30 minutes earlier, and recognized him as possibly being Skipp Jackson. I knew Jackson from a previous contact in which he was heavily intoxicated, noncompliant, and physical force was required to take him into custody. I relayed that information to partners via the radio. DEPUTY'S OBSERVATIONS AND ACTIONS: At approximately 2127 hours, I arrived on scene and saw a male whom I recognized as Skipp Jackson. Jackson was staggering on the side of the road and I noticed his eyes were watery and bloodshot. I exited my patrol car and contacted Jackson. I asked Jackson to sit down on the curb. Jackson said, "No, I'm not going nowhere." I noticed Jackson's speech was heavily slurred, and I smelled an odor of alcoholic beverage emanating from his body. I noticed that Jackson had his hand inside his pants pocket. I told Jackson to take his hand out of his pocket. He did not respond. I asked Jackson what was in his pocket. He said, "A flashlight." Jackson then began walking eastbound across the intersection. I gave several commands for Jackson to stop walking, and to sit down. Jackson ignored my commands. Based on Jackson's symptoms of alcohol intoxication, his apparent inability to care for his safety, and the fact that he was interfering with vehicles driving on the street; I believed he posed a significant risk to himself and others and was in violation of 647(f) PC - Drunk in Public. At approximately 2128 hours, Deputy Dorroh arrived on scene to assist me. I noticed that Jackson was becoming increasingly agitated. I continued to give Jackson commands to sit down on the ground. He ignored my commands and said, "You guys are gonna have to fuckin' shoot me." I feared that the situation was escalating, and Jackson may have had a weapon in his pocket. In an effort to prevent Jackson from assaulting me or my partner, I drew my OC spray from my belt. I gave Jackson another command to sit down. He ignored my command. I sprayed Jackson in the face with OC spray for approximately 3-4 seconds while keeping a distance of about 6-8 feet. Immediately after deploying OC spray Jackson turned his body toward

me, clinched his fists, and lunged at me. I jumped back to avoid being assaulted. Deputy Dorroh deployed his TASER and contacted Jackson. Jackson fell backwards onto the asphalt. While Jackson was on the ground, I rolled him onto his stomach and placed handcuffs onto his wrists. Jackson began to struggle on the ground and attempted to stand. I applied body weight to his arms and back to prevent him from standing. I feared that if he was able to stand he may continue to be assaultive toward me and my partner. The force was affective, and Jackson was not unable to stand back up. Paramedics arrived shortly after to evaluate Jackson's injuries. Jackson was tranported to Palomar Hospital via ambulance.
