Postdated checks (PDC) are checks which have been written by the maker for a date in the future. They are a commonly used way of payment in Kuwait and in other countries in MENA region as Saudi Arabia (KSA), United Arab Emirates (UAE) and Qatar

Income Tax

• Foreign Companies operating in Kuwait subject to income tax as per Income Tax Decree No. 3 of 1955 and Law No. 2 of 2008, tax rate 15%

• Foreign Companies carrying on operations in the neutral zone are liable to income tax under Income Tax Law No. 23 of 1961, Tax rate 20% for taxable income up to KWD 500,000,000, and 57% if exceeding that.

Withholding Tax

• Financial companies are required to deduct 15% of any dividend paid to taxpayer companies and transfer such amounts to the Ministry of Finance as part of the Tax Department’s policy to identify the foreign companies operating in Kuwait

Tax Retention

• 5% of the contract value or from each payment to any taxpayers with whom they concluded contracts or agreements. Release of the tax retention, in whole or in part, is not allowed except after the approval by the tax authorities based on a request to release such amounts.
