CITY OF STEVENSON COUNCIL MEETING MINUTES March 21, 2013

Ken Woodrich GUESTS Dave Prosser, Barry Lutz, Bernard Versari MINUTES The minutes of the February 21, 2013 meeting were presented.

Weissfeld moved to approve with a second by Mayfield. Unanimously approved.

CONSENT AGENDA The following items are presented for council approval:

1. A copy of the Skamania County Sheriff’s Report for February 21, 2013 is attached to the Council packet.

2. Skamania County Chamber of Commerce has requested a Special Occasion Liquor License for April 13, 2013 for the Barnstorming Blue Grass Event at the Exhibit Hall on the Fairgrounds.

3. Stevenson Business Association has requested a Special Occasion Liquor License for June 21-22, 2013 for the Gorge Brews and Blues.

4. Skamania County Chamber of Commerce has requested a Special Occasion Liquor License for July 25, 26, and 27, 2013 for the Bluegrass Festival at the Exhibit Hall on the Fairgrounds.

5. Kristina Heartman has requested a beer wine tavern/off premises liquor license for Lesley’s books.

6. Vibe Café & Espresso Bar has requested a liquor license for Beer/wine restaurant and beer/wine off premises sale at 350 SW Hwy 14.

7. And there were renewals of existing liquor licenses for the following establishments: Fraternal Order of Eagles – private club, spirits, wine, beer Skamania Lodge – Hotel Mama’s LLC – spirits, beer, wine restaurant/lounge

12. Ben Shumaker requests permission to attend SW WA American Planning Association on a monthly basis (mileage only) – he has been asked to represent the County.

Weissfeld moved to approve the Consent Agenda as listed with a

second by Masco. Unanimously approved. PUBLIC COMMENT Dave Prosser commented that in 2013 Lakeview produced $2,700 in

property tax to the City and it is still a dirt road. Prosser stated that the County told him that it should be around $14,000 to pave. Council heard his request.

FIRE DEPT UPDATE None FIRE FACILITY FEASIBILITY There was nine submittals in response to the RFQ for a

Feasibility Study of a Joint Emergency Facility. The team of reviewers included Carol Shields (EMS), Wayne Martin (Fire Chief), Scott Griswold (Fire District II) and Sheriff Brown/John Carlson (EOC). The team did review all nine written submittals and interviewed three finalists. Rice, Fergus and Miller, out of Bremerton, is the consultant firm chosen. Each of the partner entities involved will be represented during the study. Based on the information gained during the interviews Duncan-Cole will rework scope of work and forward the contract for signature. (Legal has already reviewed the contractual piece). This study will encompass not only what to build but also what are the needs and will assess available land Specific details are available in the RFQ. The study should be complete by September 30, 2013. Muth moved with a second by Mayfield to authorize the Mayor to sign the contract to move forward with the Consultant, with approval of legal council. The budget is $53,000. Motion passed.

ZONING AMENDMENT PUBLIC HEARING SET FOR 6:15 PM: Public hearing opened

at 6:22 PM. First and only hearing to amend the SMC 17.16.040 Density and dimensional regulations within the SR Zone replacing the term “maximum” lot with the term “minimum” lot area when defining lot areas within the SR Zone. We believe this was an error/typo that was missed when the zoning code was last amended. Shumaker explained the changes and explained that they were of a “housekeeping” nature. He then reviewed the ordinance. Council members were in agreement with the changes.

A motion regarding these changes will be included in the comp plan motion. Public hearing closed at 6:25 PM.

PM. Public hearing opened at 6:26 PM. This is the final public hearing on the Stevenson Comprehensive Plan. For final adoption we will need to amend the Zoning Code SMC17.11.010 Comprehensive Plan to recognize the new comprehensive plan. Prior to final adoption staff will be preparing a Non-Project SEPA checklist review of the City’s amended Comprehensive Plan. Public hearing closed at 6:32 PM. The two zoning amendments identified will be combined into a single ordinance for adoption at the April meeting. Shumaker reviewed each item that was changed from the previous meeting. There is a severability clause added. Page 29 of the Comp Plan addressed the topic of a marina. Support was removed for the marina and an objective and a tactic were combined (Pg. 31). On page 38 a marina was combined with other options. Other changes included were Pg. 93 updated description of planning process; Pg. 96 the definition of light industry was also changed.

Next week a SEPA threshold impact will go to state agencies and affected parties. Shumaker is hoping to adopt the Comp Plan in April.

Mayfield moved with a second by Weissfeld to direct staff to update Figure E2 based on tonight’s participation and the updated objective numbers, to make the changes discussed tonight (the second bullet point and front page changes), that the area to the east be removed from the Urban Reserve High Density residential and moved to low density residential and then accept the resulting draft as the anticipated plan to be adopted at the next meeting pending a determination of non-significance under the State Environmental Policy Act (SEPA). Motion passed.

PLANNING APPOINTMENTS To date $16,000 has been received from the DOE Shoreline

Planning Grant to update the Shoreline Master Plan. The Public Participation Plan that the Planning Commission created will be implemented. That created a local advisory committee and a technical advisory committee. Members are: Floodplain Planning Committee – Staff – Ben Shumaker, Planning Dir., Eric Hansen, Public Works Dir., Dave Nail, Building Inspector / Public – Joe Birkenfeld, Owner, John McSherry, Port Manager (Julie Mayfield as alternate), Bernard Versari, Owner (Kristi Versari alternate) Planning Commission Advisory Member – One member to be elected by Commission. Shoreline Local Advisory Committee – Romona Bennett, Brian Birkenfeld, Joe Birkenfeld, Gerald Doblie, Eran Howell, Gloria Howell, John McSherry, Scott Pineo, Tim Todd, Bernard Versari

(Kristi Versari as alternate), Ken Wieman and up to two Planning Commission Liaisons. Shumaker briefly explained the differences in the two committees. There are eight steps for flood plain plan and updating the Shorelines Act will complete six. If we do the other two steps we will get additional points for our floodplain property owners towards 15-20% reductions in flood plain insurance. Outside the flood plain could see a 5-10% reduction. This may also benefit people in the slide area.

Masco moved with a second by Weissfeld to appoint this list of

members and acknowledge the list of advisory members. Motion passed.

COUNCIL MEETINGS PUBLIC HEARING SET FOR 6:55 PM Public hearing opened at

6:55 PM. First and only public hearing to amend SMC 2.04.010 meeting time as outlined in Ordinance 2013-1066 “ An Ordinance by the City Council of the City of Stevenson, Washington, Changing the Day of the August Regular Monthly Meeting of the City Council and Establishing an Amended Regular Monthly Meeting Schedule”. Public hearing closed at 6:56 PM. Mayfield moved with a second by Muth to adopt ordinance 2013-1066. Motion approved.

OUTFALL EMERGENCY The engineering firm Gray and Osborne has been contracted and the

sub-contractor is Cosmopolitan Marine Engineering. We are still operating under an emergency resolution. The USDA grant loan application is intensive and they are hopeful that construction will begin in mid-May. Duncan-Cole is trying to shorten the bid time and this may take a short special emergency meeting for council approval. Council members agreed that communication is key during the construction phase. Mayfield will send Windsurf/Kite board email addresses to Duncan-Cole.

STREET REPORT Hansen introduced a memo to begin the discussion for setting policy

for the improvement of public/private roads that do not meet minimum standards for surfacing. Hansen’s memo on Unimproved Right of Ways’ did not include a possible additional cost for deeded right-of-way. Lengthy discussion followed on liens, minimum surface requirements, Public Duty Doctrine, LID’s, general roads and how to prioritize the needs. The dilemma is having a plan but insufficient funds to implement the plan. The City does not like to vacate roads or make private roads. The City has adopted an ordinance for Latecomer’s.

Lakeview Road was discussed in length. Prosser indicated that he and Allaways would lose property while Garrity would gain some. Hansen stated that there would be two eleven foot travel lanes with a minimum of six inches past the fog line with a total of 23 ft. paved surface. There would be a 41 ft. inside curb radius for the cul-de-sac. Lakeview Road will be back on the agenda for next month. Muth would like to add these roads to the six-year road plan and have a rational process for initiating projects. Woodrich explained why the road standards were not applied in Chinidere or Angel Heights. Russell and Angle Parking. The business people want more parking. Council is worried about larger vehicles and visibility. Masco would like an engineer to look at both parking and road items. Mayor Cox feels it is very dangerous backing out of angle parking. Hansen has a concern with a single lane of heavy traffic backing up onto Hwy 14 that could be the scenario on Russell.

There was brief discussion about Crossing Flags. NEW BUSINESS WATER/SEWER RATES PUBLIC HEARING SET FOR 7:30 PM Public hearing

opened at 7:46 PM. This hearing is to review and evaluate water and sewer rates to ensure the rates are addressing the operational and capital needs of the utility in a fair and equitable manner.

Duncan-Cole stated that due to the new software they are still having difficulties accessing the necessary reports for her to evaluate the needs. The Lodge is asking the City to review their costs. She is trying to look at the transient lodging rates. She is hoping to have valid numbers by the next meeting.

Public hearing closed at 7:51 PM. BRIDGE OF THE GODS Update on the Bridge of the Gods – The Port of Cascade Locks

has lowered weight restrictions on the bridge from 80,000 lbs to 60,000 lbs. (See agenda for more background.) From 8 AM to 3 PM there will be flaggers for overweight loads. ODOT is starting to assess the quality and safety of the bridge. Testing should start within a month. The City emergency equipment falls below the restricted weight. Duncan-Cole spoke highly about Mr. Schneider’s presentation.

STAFF REPORTS Duncan-Cole addressed the cost to prepare local voters pamphlet.

Information was obtained from the auditor. They said if the City opts out of the voter’s pamphlets it will save $1,000 to $1,500. (Does not include Election costs ~$7,000 & Voter Registration costs ~$2,500). Mayor Cox and Masco would prefer to save the money

but Weissfeld stated she thinks we should be represented. It was suggested they found out the price if we just had a line with the City website suggest going to the library and pull up the website if they don’t own a computer. Duncan-Cole will investigate further.

Quiet Zone First contract proposal has been received. The City identified two issues in the standard contract that needed resolution:

• sole proprietorship/prevailing wage issues for BNSF’s compliance requirements during installation, and

• final equipment ownership of the electronic controls and quad gates.

Both issues were forwarded to their legal department. The SEPA is completed and the city has complied with the notification to Native American tribes. We are waiting for the release and the contract. Woodrich suggested preparing a sole source for the next meeting. WEB Site – There is an ULR available. City staff and some council members need to get content written. Weissfeld suggested we flip live with a couple of sections and have a note…coming soon etc. SWIM (Stevenson Wellness Improvement) team met in initial meeting. Candace Ford was the leader. Benchmarks were established with the goal to lower our insurance rates by complying. Rosander, Shumaker, Muth, Duncan-Cole and Ford were in attendance. A box on the web will also have wellness tips and contacts.

LEAK ADJ CORRECTION Miscalculated Ditzler leak adjustment from last month. R.Muth moved to approve the additional amount of $159.71 for a total of $906.42 with a second by Masco with a request to add the meter number. Meter Number is 701600.0. Motion passed.

JOINT MINUTES Masco moved to approve with a second by Muth the Joint City

Council Meeting minutes for N. Bonneville, Stevenson and Cascade Locks held on March 19, 2013. Motion approved.

VOUCHER APPROVAL February 2013 Payroll Checks and March Claims Checks have been

audited and are presented for approval and payment. February payroll checks 7303 thru and including 7326 for a total amount of $72,676.48 (list includes EFTPS electronic tax payment for $12,716.78.) Check 7302 was voided due to clerical error. March 2012 Accrual/ March 2013 Claims Checks 7327 thru and including 7375 for a total of $75,171.94. (list includes $1,648.39 ACH excise tax payment) Check 7341 voided and reprinted on 7374. One $100,000 investment matured and was rolled over from 3/1/2013 to 3/31/2013.

Gorge Commission Charts Important Priorities for Coming Year At its April 9, 2013 meeting at the Columbia Gorge Discovery Center in The Dalles, the Columbia River Gorge Commission began charting an action plan to continue to protect the region's farms and forests, provide outdoor recreation opportunities and ensure local cities and towns have the ability to create good jobs and affordable homes now and in the future. A warm welcome by The Dalles Mayor Steve Lawrence and Wasco County Commission Chair Rod Runyon set the tone for positive, regional collaboration as Gorge Commissioners considered potential priorities for the coming year. After much discussion, the consensus of the Commission was to:

· Focus on a comprehensive review of urban area boundaries;· Continue progress on the Gorge Vital Signs Indicators program; and· Thoroughly review the opportunities and impacts of recreation in the Gorge.

At its May 14, 2013 meeting in Troutdale, the Commission will continue its discussion to identify specific projects within these larger priorities. Gorge Commission Chair, Carl McNew emphasized, “The Commission is enthusiastic and engaged and will continue to work with local, state, federal and tribal partners to help create good jobs, provide recreation opportunities and protect our clean air and water. By working across government boundaries we can pave the way to a stronger economy while we protect and enhance the natural wonders that define who we are as a community." The Commission is also committed to continuing its work with Cascade Locks, North Bonneville, and Stevenson, by exploring ways each city might share services, even across the state line. Executive Director Darren Nichols explained, “We are excited to help Gorge communities realize the full potential of the National Scenic Area Act. Our staff has special expertise in identifying innovative opportunities and working together to build stronger communities and support our regional economy.” Information on the Columbia River Gorge Commission is available on the web at www.gorgecommission.org.

The Columbia River Gorge Commission is a thirteen-member public body established through an innovative agreement between Oregon and Washington and the United States Congress to oversee land use and resource protection policy for the 292,000-acre Columbia River National Scenic Area. The Commission’s unique structure and its state/federal mandate include regional roles in resource protection and economic development. Ben Shumaker From: Wes Wegner [mailto:[email protected]] Sent: Monday, April 15, 2013 2:30 PM To: Ben Shumaker Subject: RE: Detour Ben, With the asphalt removal and space needed to construct the retaining wall, the southbound lane of Rock Creek Drive is proposed to be closed during both working hours and through the night. The curb and restorations required encroach into the roadway more than 4 feet which does not allow adequate space to accommodate 2 lanes of travel. As we discussed, the Contract will require the Contractor to minimize the duration of this closure through an approved phasing plan, but it will likely be 6 weeks or so. Once the curb, retaining wall, and road restorations are complete, the travel lane could be opened back up. The intent with allowing the lane closure and detour is to eliminate the need for temporary restorations and flagging of this travel lane. The reduction in temporary restorations and flagging eliminates the costs associated with these work efforts. If Council is not on board with this, we can keep both directions open but it will have some cost implications. Let me know if additional information would be helpful, Wes Wegner, P.E. CITY OF STEVENSON, WASHINGTON

ORDINANCE NO. 2012-1067

AN ORDINANCE ADOPTING THE APRIL, 2013 STEVENSON

COMPREHENSIVE PLAN; CORRECTING A LIKELY

SCRIVENER’S ERROR RELATED TO LOT SIZES IN THE

SUBURBAN RESIDENTIAL DISTRICT; AMENDING SMC TITLE

17; REPEALING PORTIONS OF ORDINANCES 919 AND 1030;

AND REPEALING ORDINANCE 1019 IN ITS ENTIRETY.

RECITALS

WHEREAS, a potential scrivener’s error regarding lot sizes in the Suburban

Residential District results in confusion on the allowed minimum and maximum lot sizes

in the district; and

WHEREAS, on September 17th

, 2009 the City Council initiated a comprehensive

plan update, and

WHEREAS, the laws of Washington, Chapter 35A.63 RCW, control the creation

and amendment of comprehensive plans and authorize their implementation through such

means as, zoning and design standards; and

WHEREAS, in the course of updating the comprehensive plan, the City complied

with Chapter 35A.63 RCW and engaged the public on more than 700 occasions; and

WHEREAS, the City Council deems the updated Comprehensive Plan and zoning

provision necessary for the purpose of securing and promoting the health, safety and

general welfare of the people of the City; and

WHEREAS, the Planning Commission and City Council have given due public

notice of hearings relating to this ordinance and have held such hearings;

WHEREAS, the City has complied with the Environmental Policy Act and

reached a determination of nonsignificance;

AND WHEREAS, the Planning Commission has reviewed and recommended that

the City Council approved these regulations.

NOW, THEREFORE, the City Council of the City of Stevenson do ordain as

follows:

Section 1- THAT, the “Stevenson Comprehensive Plan” dated April, 2013 is

hereby adopted as the City’s comprehensive plan for anticipating and influencing the

orderly and coordinated development of land and building uses of the City and its

environs.

Section 2- THAT, Stevenson Municipal Code section 17.11.010 (A portion of

Section 2 of Ordinance 1030) shall be repealed in its entirety and replaced with the

following: “SMC 17.11.010 Comprehensive Plan. The comprehensive land use plan for

the City of Stevenson includes the text, diagrams, charts and maps adopted by Ordinance

2012-1067 on April 18th

, 2013, entitled “Stevenson Comprehensive Plan”. The

comprehensive plan includes all subsequent amendments.

Section 3- THAT, Stevenson Municipal Code section 17.16.040 (Ordinance

1019 and Section III of Ordinance 919) shall be repealed in its entirety and replaced with

the following:

Section 4- THAT, this ordinance affects Title 17 of the Stevenson Municipal

Code only insofar as set forth herein. All other provisions of Title 17 shall remain in full

force and effect, and that where the provisions of this ordinance are the same as the

provisions they replace, the provisions of this ordinance shall be interpreted as a

continuation of those previous provisions and not as a new enactment.

Section 5- THAT, if any section, subsection, paragraph, sentence, clause, or

phrase of this ordinance is declared unconstitutional or invalid for any reason, such

decision shall not affect the validity of the remaining portions of this ordinance.

This Ordinance shall take effect and be in force five (5) days after its publication

according to law.

PASSED by the City Council of the City of Stevenson and approved by the

Mayor this 18h day of April, 2013.

WHEREAS, the Stevenson Business Association has been begun a downtown revitalization effort to make our downtown an attractive destination for residents, businesses and tourists. 

WHEREAS, the Stevenson Business Association has seen business and property owners rally around a more vibrant downtown area, and has seen the enthusiasm and passion grow at every meeting and gathering.   

WHEREAS, these efforts have promoted a sense of community pride and has fostered a sense of teamwork that continues to grow. 

WHEREAS, the Stevenson Business Association and business owners are furthering this teamwork, and city pride, by organizing a Stevenson Community Clean‐up Day.  Business owners are reaching out to other businesses and residents, asking them to show their community spirit, and to get ready for the upcoming tourist season, by volunteering time to perform “Spring Cleaning” in Stevenson. 

THERFORE, let it be recognized that Saturday, May 18, 2013 is Stevenson Community Clean‐up Day, and the Stevenson Business Association encourages all citizens, businesses, public and private agencies, media to volunteer their time to show their pride in their city to visitors and residents alike.
