CLEAN WATER ACT – Bill 43

The purpose of this Act is to protect existing and future sources of drinking water

from contamination and over use.

Four vulnerable areas under Clean Water Act:

• *Wellhead protection areas

• *Surface water intake protection zones

• *Significant groundwater recharge areas

• *Highly vulnerable aquifers

• Assessment Report: additional technical work

• Modelling of spill scenarios near municipal water intakes (e.g. fuel spill at a

marina);

> > may result in policies applying in Intake Protection Zone

• Review of WHPA-E streamflows (Wellhead Protection Area for wells affected

by surface water)

> > may result in smaller WHPA-E extent where

policies apply

• Water quantity stress assessment in

Lake Rosalind area near Hanover

> > may result in new policies to

protect the quantity of water

available to the municipal wells

in the Lake Rosalind Area

• Threat Verification

• Activities considered significant threats, only on part of property where

the vulnerability score is high and activity occurs under a specific set of

circumstances

• Source Protection staff reviewed all vulnerable areas where there could

be significant threats

• Conducted “windshield survey”

• Sent fuel surveys to 700 properties

• Substantial decreases in numbers of threats for some activities

• Improved data to share with implementing agencies

• Assessment Report amendments to include current technical work and threat verification

• Comments from Ministry of Environment on Proposed Source Protection Plan (PSPP); initial comments received Feb. 28, 2014

• Re-submission of PSPP to Ministry (April 2015)

General Approach to Policies

• Policies in the Source Protection Plan address significant drinking water threats

• Source Protection Plan uses a combination of policies to address significant drinking water threats

• Policies tend to manage existing threats and either manage or prohibit future threats, depending on the activity

• Use existing legislation, rules and procedures where possible for addressing threats instead of creating duplication
