    lntroduction1 This is an appeal under Section 77 of theRichmond lcon Pty Ltd against a FailureApplication PLN 1010734 by the Yarra CitySwan Street, Richmond.

    Planning and Environment Act 1987 byto grant a permit for Planning PermitCouncil for a development at 140-160This submission is made on behalf of VicRoads.VicRoads is a referral authority for this Permit Application and is the CoordinatingRoad Authority for Swan Street under the Road Management Act 2004.!t is VicRoads' position that a permit for the proposed development could be grantedsubject to VicRoads "without prejudice" conditions being included on any permitissued.

    The Subject Land and Locality5 The subject land,140-160 Swan Street, Richmond is located on the south side ofSwan Street, between Byron Street and Green Street.6 The site is zoned "Business 1 Zone" under the Yarra Planning Scheme, and iscurrently occupied by Dimmey's department store. Vehicle access is provided via

    Green Street at the southern end of the site.Swan Street is State Arterial Road under the Road Management Act 2004, and aRoad Zone Category 7 under the Yarra City Council planning scheme.It is proposed to redevelop the site with a multi-storey building comprising groundfloor retail, and upper level lofts and residential uses. Proposed vehicle access pointsto the site are via Byron Street and Green Street.

    History of Proposal9 The application was referred to VicRoads by the City of Yarra on 6 December 2010.10 VicRoads responded to Council by letter dated 30 December 2010 requesting furtherinformation on traffic impacts associated with development generated traffic at the

    Swan Street / Green Street intersection, and the adequacy of Byron Street to caterfordevelopment traffic. A copy of VicRoads letter is provided as Attachment 1.11 VicRoads received an email from O'Brien Traffic on 27 of January 2011 requestingclarification from VicRoads on the further information requested. VicRoads provided aresponse by emai! to O'Brien Traffic on 3 February 2011. A copy of VicRoads emailis provided as Attachment2.12 Further correspondence occurred between VicRoads and Yarra City Council between7-9 February 2011 regarding the information requested by VicRoads and VicRoadsconcerns over the application. VicRoads role as a referral authority under Clause

    52.29 of the Yarra Planning Scheme was discussed, in particular Councils view thatVicRoads was a Section 55 referral authority by virtue of the Citylink Project Overlayrather than the creation or alteration of access to a road zone category 1.

    13 VicRoads provided a view that the definition of altering access goes beyond thephysical creation or alteration of access to the arterial road, which is a function of theRoad Management Act, but directly relates also to what is happening on private landadjacent to the road, particularly where land use changes alter the way an access isbeing used, ie. a significant increase in traffic generation on an existing access pointhas an impact on the safety and operation of the arterial road I road zone 1 , which isa key interest and responsibility of VicRoads in its role of managing the arterial roadnetwork. A copy of the relevant correspondence is provided as Attachment 3.Notwithstanding the above, Council was happy to receive general comments fromVicRoads on the operating conditions on Swan Street to assist in its decision making.VicRoads received a Notice of Refusal from the City of Yarra on 28 February 2011.One of Councils grounds of objection was "The proposed vehicle access will createan unreasonable impact on traffic, car parking and safety within surrounding streets,particularly along Swan Street, Green Street and Byron Street".VicRoads received the Notice of Hearing on 15 March 2011 from the Victorian Civiland Administrative Tribunal. Accordingly, VicRoads submitted a Statement ofGrounds requesting it be joined as a Party to the Hearing.VicRoads attended the Practice Day hearing on 8 April 2011.

    State Planning Policy FrameworkClause 18 - Transport18 Clause 18 sets out the State Policy on Transport, stating that:

    Planning should ensure an integrated and sustainable transport system thatprovides access to social and economic opportunities, facilitates economicprosperity, contributes to environmental sustainability, coordinates reliablemovements of people and goods, and is safe.

    Clause 18.01-2, Transport system, includes the following Strategy:Plan or regulate new uses or development of land near an existing or proposedtransport route to avoid detriment to, and where possible enhance the service,safety and amenity desirable for that transport route in the short and long terms.

    Referral Triggers - VicRoadsGlause 45.07 - City Link Project Overlay21 Under clause 45.07-O an application within this overlay must be referred underSection 55 of the Act to the Roads Corporation.22 Other relevant clauses relate primarily to outdoor advertising signs and business

    identification signs.23 VicRoads raised no issue with the proposed development in respect to the City Link

    Overlay.

    Clause 52.29 - Land Adjacent to a Road Zone, Category I24 Under clause 52.29 a permit is required to create or alter access to a road in a RoadZone, Category 1. Such applications need to be referred to VicRoads under Section

    55 of the Act.25 The decision guidelines under clause 52.29 include that the Responsible Authority

    must consider:. The State Policy Planning Framework and the Local Policy PlanningFramework, including the Municipal Strategic Statement and local planning

    policies;. the views of the relevant road authority;. the effect of the proposal on the operation of the road and on public safety.. Any policy made by the relevant Road Authority pursuant to Section 2,Clause 3 of the Road Management Act 2004 regarding access between a

    controlled access road and adjacent land.26 While the proposed development did not originally contemplate any physical

    alteration to access points to Swan Street, which is a declared arterial road and RoadZone 1 underthe Planning Scheme, VicRoads considers that there is an alteration ofaccess associated with the development by virtue of the change in land use andassociated traffic generation, as mentioned in paragraph 13 above.

    Road Management Act 2004 (RMA)27 The RMA provides VicRoads with wide ranging powers and objectives in terms of themanagement of the declared road network.28 Section 20 of the RMA provides VicRoads the following principa! objectives andmanagement principles :

    (2) The following principles apply in respect of the management of works andinfrastructure under this Act-(a) the minimisation of road safety hazards;...(d) the avoidance or minimisation of disruption to traffic;...

    29 Section 34 of the RMA provides the Coordinating Road Authority with the followinggeneral functions:(1) A road authority has the following general functions

    (b) to manage the use of roads having regard to the principle that the primarypurpose of a road is to be used by members of the public and that otheruses are to be managed in a manner which minimises any adverse effecton the safe and efficient operation of the road and on the environment;(c) to manage traffic on roads in a manner that enhances the safe and efficientoperation of roads;

    VicRoads is the Coordinating Road Authority for Swan Street.0

    VicRoads' SubmissionWith regard to the proposed development, VicRoads submits the following:Byron Streef31 One of VicRoads original concerns was the inadequate width of Byron Street to caterfor development traffic. Byron Street, which has a carriageway width of 4.5 metres,does not adequately cater for a significant number of two-way movements. Applyingthe relevant standards in both the Planning Scheme and Australian Standards to this

    development results in a recommended road width / passing area of at least 5m wide.32 The Evidence Statement by Traffix Group, on behalf of Yarra City Council, confirms

    that the existing road width in Byron Street is insufficient to cater for developmentgenerated traffic. The recommendation by Traffix Group is for a Shared Zone to becreated along Byron Street providing a pavement width in the order of 6m to allowpassing opportunities.

    33 VicRoads has no objection to this recommendation, however the ability to achievethis along the length of Byron Street is questioned, noting that (a) the integration ofthe road at its intersection with Swan Street would need careful consideration,particularly with respect to pedestrian movements and footpath modificationsrequired, and (b) there is existing road side furniture and features along Byron Streetthat may restrict widening over the full length.

    34 The Evidence Statement by Cardno Grogan Richards, on behalf of the applicantRichmond lcon Pty Ltd, offers an alternative proposal to address the matter of ByronStreet road width. This comprises an alternative access arrangement to Byron Streetfrom what was originally proposed, and is shown in the amended plans issued forVCAT Circulation by Armsby Architects, Rev. D, dated 1 1 May 2011. The amendedplans propose egress movements only to Byron Street from the subject site, ratherthan two-way traffic.

    35 While there will still be occasions where egressing vehicles will meet vehiclesentering Byron Street, this will be significantly less than if two-way movements werepermitted from the subject site. Accordingly, VicRoads has no objection to thisrecommendation, which addresses the original concern, however that as a minimum,widening of Byron Street to at least 5.5m at the Swan Street intersection beundertaken.

    Green Street36 VicRoads primary concern has been the impact of development generated traffic onSwan Street at the Green Street intersection, which will accommodate the majority of

    development generated traffic. ln the initial stages of the development and at furtherinformation stage, VicRoads sought detailed information and supporting trafficanalysis on the traffic impacts at the intersection and consideration to any mitigatingworks that may be required. This information was never provided.

    37 The Evidence Statement by Traffix Group, on behalf of Yarra City Council,acknowledges a significant increase in traffic on Green Street above existingvolumes, and suggests that subject to the remova! of parking on at least one side ofGreen Street, that based on site observations, there are adequate gaps available toaccommodate the development traffic at this intersection.

    38 VicRoads concerns with this is that given the significant increase in traffic generatedby the development at the Swan Street / Green Street intersection, no traffic analysiswas carried out to justify this Statement.39 The Evidence Statement by Cardno Grogan Richards, on behalf of the applicantRichmond lcon Pty Ltd, provides a more detailed analysis of the existing and post-

    development conditions at the intersections of Byron Street and Green Street withSwan Street. SIDRA analysis has been used to model the traffic impact at theseintersections.

    40 ln relation to the intersection of Swan Street and Green Street, which will be subjectto the greatest increase in traffic, the Evidence Statement concludes, based on theSIDRA analysis undertaken, that the proposed development will have minor impactson the Swan StreeVGreen Street intersection but will continue to operate under'excel lent' cond itions.

    appropriate method of analysis has been undertaken by way of SIDRA,queries the results of the analysis, in particular:-Reduction in queue length for vehicles turning right into Green Street fromSwan Street, despite a four-fold increase in turning movements (ie. existing21 vehlhr increases to 85 veh/hr).No change in delays to left turn movements from Green Street to SwanStreet despite a four-fold increase in turning movements (ie. existing 22veh/hr increases to 86 veh/hr).Minima! change in delay to right turn movements from Green Street toSwan Street despite a twentytwo-fold increase in turning movements (ie.existing 3 veh/hr increases to 67 veh/hr).

    VicRoads considers that further evaluation of these results would be appropriate priorto forming a conclusion on traffic impacts at the intersection. ln particular, this iscritical to determining how well the proposed development will operate within the roadnetwork upon which it relies, and whether any mitigating works at the intersection arenecessary to ensure satisfactory operating conditions.

    ln addition, it is also critical in ensuring impacts on public transport (ie. Route 70 tramin Swan Street) are accounted for and minimised, given the significant reliance thatsuch developments within activity centres have on public transport.

    VicRoads suggests that the evidence presented through Traffic Expert Evidence onbehalf of both Council and the Applicant goes a significant way to responding to theissue of traffic impacts on the surrounding road network.However, should a permit be granted for the development, this should be conditionalupon further traffic analysis being undertaken for the intersection of Swan Street /Green Street, to the satisfaction of VicRoads, which addresses concerns raisedabove, incorporates additional entry movements should the altered accessarrangements be agreed to (ie. egress only to Byron Street option) and furtherconsiders the need for mitigating works.Additionally, it is suggested that consideration be given to the use of electronicparking signage indicating the availability of parking spaces within the proposedcarpark. This will avoid unnecessary circulating movements'

    Conclusion47 lt is VicRoads' respectful submission that should a planning permit be granted for theproposed development, conditions relating to Byron Street access and traffic impactsat the Swan Street /Green Street intersection are incorporated, generally in

    accordance with VicRoads "without prejudice" conditions.

    VicRoads "Without Prejudice" Conditions.1. Prior to the commencement of any works on site, amended plans to the satisfaction ofVicRoads and the responsible authority must be submitted to and approved by theresponsible authority showing revised access arrangements to Byron Street, in theform of a shared zone arrangement, generally 6m wide, or egress only access to

    Byron Street from the subject site with widening to a minimum of 5.5m at theintersection of Swan Street.2. Prior to the commencement of any works on site, a revised traffic engineeringassessment shall be submitted to VicRoads for approval, analysing the traffic impactson the intersections of Swan StreeU Byron Street and Swan StreeUGreen Street andpublic transport (tram) movements. This report should identify any mitigating worksrequired on Swan Street.3. The road mitigating works identified in the above Condition shall be agreed byVicRoads and the functional design approved by VicRoads. The works shall becompleted prior to commencement of use of the development, at no cost to VicRoadsand to the satisfaction of VicRoads and the Responsible Authority.

The information in relation to the frequency of operation of the signal is associatedwith the request for gap analysis. The frequency of gaps available will determine ifthe right turning movements proposed can be accommodated and undertaken in asafe and efficient manner without significant delay or disruption to movements onSwan Street, such as traffic and trams.4. The scale of the traffic generated by the proposed development is significantlygreater that what is identified by the survey of turning movements undertaken on11June 2009. Therefore it is not accepted that this increase in traffic will be able tojoin Swan Street without delay unless is can be demonstrated through GAP analysisor other appropriate analysis.5. (I note also thataccess alterations are proposed within Green Street though the removal of on-streetparking)While the traffic report provided as part of the application considered the operation ofSwan Street, and access to Swan Street (via Green St and Byron St), it did not providethe usual analysis to justify statements in the report (eg. adequacy of width of ByronSt to cater for 2-way traffic, gap analysis on Swan Street), hence VicRoads request forfurther information.As documented in Noel Treacy's recent email to O'Brien Traffic (and forwarded toyourself), the further information submitted did not provide an adequate level ofinformation to enable an assessment of the application.As far as our concerns go, the main issues are:-- adequacy of Byron Street at4.5m wide to caterfor 2-way traffic (both the PlanningScheme and Australian Standards would suggest that road width or passing area atleast 5m wide should be provided for access on the approach to a road on a declaredroad, where the access serves a carpark of the proposed nature). Our main concern isthat if 2 way movements into & out of Byron Street are not provided for, there will be adetrimental impact on traffic and tram movements along Swan Street throug.h queuingback onto Swan Street.- Impacts on the operation of Swan Street have not been adequately considered -O'Brien traffic has considered the matter, however provided general statements aboutSwan Street being able to accommodate the additional traffic / turning movementswithout the required justification (eg.gap analysis). This is not an unreasonablerequest for a redevelopment proposal of this nature, and is a simple matter of providingthe numbers / analysis to back up the statements made.- Swept path movements of delivery vehicles into Green Street were requested toensure that the extent of parking restrictions proposed in Green Street are adequate to

    accommodate such turning movements.
