1.6 Other Regulations (a) Within the CD1 Zone, land uses shall be permitted in accordance with the plans of

the Comprehensive Development Project, as approved and incorporated as CD1, Map 1.

(b) The heritage building shall be designated under the Heritage Conservation Act, as

either a municipal or provincial heritage site, and shall comply with all the applicable provincial or municipal regulations.

(c) Within the CD6 zone, and subject to the Development Regulations of this section,

lands shall be developed for residential use in accordance with one or more of the RU1/RU1h, RU2/RU2h, RU4/RU4h, RU5, RU6/RU6h, RM2, RM3, RM4, or RM5 zones. Commercial and hotel uses allowed in the CD6 zone shall be developed in accordance with the C2 or C9 zoning districts, and open space or public utility uses shall be developed in accordance with the P2, P3, or P4 zoning districts. All zones shall be as contained in Zoning Bylaw No. 8000, as amended and shall be in accordance with an adopted Area Structure Plan. The specific zone must be identified at the subdivision approval and/or development permit stage and must be in accordance with the Area Structure Plan adopted for the property

(d) The minimum required landscape buffer level is Level 1. (e) Private open space for the multi-family residential units on the site shall be a

minimum total of 15,365 m² of which 3,016 m² is private amenity space and the remaining 12,349 m² is usable open space including landscaped areas. The open space on the site shall be located in accordance with CD1, Map 1, attached to this bylaw.

(f) In addition to the regulations listed above, other regulations may apply. These

include the general development regulations of Section 6 (accessory development, yards, projections into yards, lighting, etc.), the landscaping and fencing provisions of Section 7, the parking and loading regulations of Section 8, the specific use regulations of Section 9.

Schedule 'B' – Comprehensive Development Zones CD2 – Kettle Valley Comprehensive Residential Development 1.1 Purpose The purpose is to provide a zone for the development of a variety of residential uses, a mixed-

use village centre, institutional, and park uses all integrated into a planned residential neighbourhood.

1.2 Principal Uses The principal uses in this zone are:

(a) apartment housing (b) child care centre, major (c) community recreation services (d) congregate housing (e) emergency and protective services (f) financial services (g) food primary establishment (h) health services (i) liquor primary establishment, minor (j) offices (k) participant recreation services, indoor (l) personal service establishments (m) public education services (n) public libraries and cultural exhibits (o) public parks (p) religious assemblies (q) retail liquor sales establishment – applicable only to Lot 1, District Lot 23, Township

28, SDYD, Plan KAP91191 (5305-5315 Main Street) (r) retail stores, convenience (s) retail stores, general (t) row housing (u) semi-detached housing (v) single detached housing (w) utility services, minor impact

1.3 Secondary Uses The secondary uses in this zone are: (a) child care centre, minor (b) home based business, major (c) home based businesses, minor

1.4 Development Regulations (a) The total density for the Comprehensive Development Project shall not exceed 8.92

units per gross hectare (3.62 units per gross acre), with five (5) senior citizen units, which share one kitchen facility, being equivalent to one (1) dwelling unit for the purpose of density calculation. Secondary suites shall not be counted as a dwelling unit for the purposes of calculating the maximum density in the CD2 zone.

(b) Total density for the CD2 zone shall not exceed 1028 units, in accordance with the

Southwest Okanagan Mission Neighbourhood One Area Structure Plan adopted as part of the Kelowna Official Community Plan. Pursuant to the Area Structure Plan, seniors housing which includes a care component and shared kitchen facilities shall count at a 5:1 ratio. Self-contained senior’s units shall be counted as one unit. Secondary suites shall not be counted as a dwelling unit for the purposes of calculating the maximum density in the CD2 zone.

(c) The maximum site coverage shall be in accordance with the Table of the

Comprehensive Development Project, as approved and incorporated as CD2, Map 1.

(d) The maximum height for buildings and structures within the CD2 zone shall be as follows:

Single detached housing, semi-detached housing and row housing (Types II-VI CD2 Map 1): 9.5m

Townhouse Village Centre and apartment housing (Type VIII – CD2, Map 1): 16m

Mixed Use Village Centre (Type IX – CD2, Map 1): 16 m excluding accessory structures

Village Centre Commercial (Type X – CD2, Map 1): 13m Accessory Buildings or Structures: 4.5m (e) [deleted] (f) The following features may be permitted to project into the front and flanking yards

as provided for below: (i) architectural features (ii) unenclosed porch and deck areas; and (iii) unenclosed balconies and canopies. The size of the encroachment area shall be in accordance with the Table, as approved

and incorporated as CD2, Map 1, attached to this bylaw. 1.5 Other Regulations (a) Within the CD2 Zone, land uses shall be permitted in accordance with the plans of

the Comprehensive Development Project, as approved and incorporated as CD2, Map 1.

(b) Within the CD2 Zone, Village Small Single Family/Multi-Family (Type V) lots of less

than 735 m² in area, shall require the registration of a building scheme under Section 219 of the Land Title Act, at time of subdivision to control siting, building design and materials.

(c) Child care centre, major; emergency and protective services; participant recreation services, indoor; and religious assemblies shall only be located in the Mixed Use Village Centre and Village Centre Commercial as indicated on Map 1.

(d) Apartment housing shall be located within the mixed use Village Centre, either

above commercial uses, or in a separate building, provided that access to grade shall be separate from the commercial uses.

(e) A minimum of 7.5 m² of private open space shall be provided per bachelor dwelling,

15.0 m² of private open space shall be provided per 1 bedroom dwelling, and 20.0 m² of private open space shall be provided per dwelling with more than 1 bedroom.

(f) Financial services shall have a maximum total gross floor area of 500 m² unless a

larger branch of the Financial services establishment is located within the C7 zone. (g) The minimum required landscape buffer level is Level 1 for all required yards for

residential housing Types II through VIII inclusive. (h) The minimum required landscape buffer level is Level 3 for all required yards for

Village Centre land use Types IX and X. (i) Signs for residential housing Types II through VIII inclusive shall be regulated as if the

site is in an RU1 zone. (j) Signs for the Mixed Use Village Centre Type IX and Village Centre Commercial Type

X shall be regulated as if the site is in the C3 zone. (k) In accordance with the Official Community Plan, all commercial and multi-family

residential areas are designated as Development Permit Areas, and for the purposes of this zone, senior citizens housing is considered to be a multi-family use.

(l) In addition to the regulations listed above, other regulations may apply. These

include the general development regulations of Section 6 (accessory development, yards, projections into yards, lighting, etc.), the landscaping and fencing provisions of Section 7, the parking and loading regulations of Section 8, and the specific use regulations of Section 9.

(n) Drive-in food services are not a permitted form of development in this zone. (o) For Type IX, Mixed Use Village Centre, all buildings shall be oriented facing a

street with the Commercial/Apartment buildings orientated facing Main Street.

(p) For Type X, Village Centre Commercial, street oriented retail/office buildings

shall be oriented facing towards Main Street and one storey retail buildings shall be oriented facing Chute Lake Road.

Schedule 'B' – Comprehensive Development Zones CD3 - Comprehensive Development Three CD3rcs – Comprehensive Development Three (Retail Cannabis Sales) 1.1 Purpose The purpose of this zone is to permit the development of a comprehensively planned,

integrated community consisting of multi-family residential uses and local commercial uses.

1.2 Permitted Uses The permitted principal uses in Area 1 of this zone, as shown on Figure CD 3.1, are:

(a) apartment housing (b) congregate housing (c) row housing (d) stacked row housing

The permitted secondary uses in Area 1 of this zone, as shown on Figure CD 3.1, are: (a) community recreation services (b) health services (c) home based business, minor (d) participant recreation services, indoor (e) personal service establishments (f) short-term rental accommodation, subject to section 9.17 of this Bylaw The permitted principal uses in Area 2 of this zone, as shown on Figure CD 3.1, are: (a) child care centre, major (b) community recreation services (c) financial services (d) food primary establishment (e) health services (f) liquor primary establishment, minor (g) offices (h) participant recreation services, indoor (i) personal service establishments (j) public libraries and cultural exhibits (k) retail cannabis sales establishment (CD3rcs only) (l) retail liquor sales (m) retail stores, convenience (n) retail stores, general

(a) Lots should be configured approximately as shown on Figure CD3.1. (b) The minimum lot width is 45.0 m. (c) The minimum lot depth is 35.0 m. (d) The minimum lot area is 1400 m2

1.4 Development Regulations

(a) The maximum site coverage for all principal and accessory buildings combined in this zone shall be 40%. Not more than 70% of the surface of the land in the zone shall be covered with buildings, parking areas and driveways.

(b) The maximum height in Area 1 is the lesser of 6½ storeys or 33.0 m. The maximum height in Area 2 is the lesser of 2 ½ storeys or 10.5 m. (c) The minimum site front yard is 6.0 m in Area 1. The minimum site front yard is 3.0 m in Area 2. (d) The minimum site rear yard is 6.0 m. (e) The minimum site side yard is 6.0 m, except it is 3.0 m from flanking streets. Entrance

canopies may be sited a minimum of 1.5 m from the boundaries of Glenmore Road and Summit Drive.

1.5 Other Regulations

(a) A minimum of 7.5 m2 of private open space shall be provided for each bachelor unit, boarding or lodging unit, congregate care unit and group home unit, 15 m2 for each one bedroom unit, and 20 m2 for each unit of two bedrooms or more.

(b) Commercial units within Area 1 shall be limited to a maximum Gross Floor Area of 240m2

per unit. (c) Commercial units within Area 2 shall be limited to a maximum Gross Floor Area of 240 m2

per unit, except that one unit may have a maximum Gross Floor Area of 635m2. (d) No nuisance from noise, vibration, smoke, dust, odours, heat, glare, electrical or radio disturbance shall be produced by the any commercial use within Area 1,

as shown on Figure CD-3.1, and at all times, the privacy and enjoyment of residential dwellings shall be preserved and the commercial operations shall not adversely affect the amenities of the area.

(e) Parking and loading for all uses shall be provided in accordance with the requirements of

Section 8 of this Bylaw.

(g) [deleted] 1.6 Sign Regulations

(a) Signage for residential uses shall be in accordance with the sign regulations for land in the RM5 zone as determined by the City of Kelowna Sign Bylaw of the day.

(b) Signage for commercial uses within Area 1 shown in Figure CD-3.1 shall be in accordance

with the requirements for Identification Signs, as determined by the City of Kelowna Sign Bylaw of the day.

(c) Signage for commercial uses in Area 2 shown in Figure CD-3.1 shall be in accordance with

the sign regulations for land in the C4 zone as determined by the City of Kelowna Sign Bylaw of the day.

Schedule 'B' – Comprehensive Development Zones CD4 – Comprehensive Small Lot Residential 1.1 Purpose The purpose is to provide for the development of a comprehensively planned small lot, single

family bareland strata residential development. 1.2 Principal Uses The principal uses in this zone are: (a) single detached housing 1.3 Secondary Uses The secondary uses in this zone are: (a) child care centre, minor (b) home based businesses minor (c) residential-work home occupation (d) short-term rental accommodation, subject to section 9.17 of this Bylaw 1.4 Subdivision Regulations (a) The minimum lot width is 10.0 m for cottage lots, and 18 m for cluster lots, as

identified on CD4 Maps A to E inclusive. (b) The minimum lot area is 270 m². 1.5 Development Regulations (a) The maximum overall density shall be 30 units per gross hectare. (b) The maximum lot coverage by principal buildings and accessory buildings is 55% for

each bareland strata lot. (c) The maximum height is the lesser of 9.5 m or 2 storeys, except it is 4.5 m for

accessory buildings and 13 m for accessory structures. (d) The minimum front yard is 6.0 m where the front yard abuts land that is not zoned

CD4, and/or the front yard abuts a public street. Where the front yard abuts land that is zoned CD4, or a private street within the CD4 zone the front yard setback shall be 2.44 m.

(e) Unenclosed verandas may project a maximum of 1.0 m into the required front yard

setback. (f) The minimum side yard is 0.6 m, except it is 1.2 m from a flanking street within the

CD4 zone for cottage lots, and 0.0 m for cluster homes as described on CD4 Maps D and E. In no case shall the edge of a roof be less than 1.2 m from an adjacent cluster roof.

(g) The minimum rear yard is 3.0 m where the rear yard abuts land not zoned CD4.

Where the rear yard is adjacent to a private lane that is within the CD4 area, the rear yard setback shall be 0.6 m.

1.6 Other Regulations (a) Within the CD4 zone, the lands shall be developed in general accordance with the

plans of the Comprehensive Development Project as approved and incorporated as CD4 Maps A to E inclusive.

(b) A building scheme, registrable under Section 219 of the Land Title Act. Shall be

registered to control building design and materials at time of subdivision. (c) A minimum of 10% of the gross site area must be allocated for usable open space,

excluding the required yard areas. (d) Residential-Work Home Occupation shall be permitted in Area 1, as shown on CD4

Map A. The Residential-Work Home Occupation shall comply with the following: (i) The Residential-Work Home Occupation shall be entirely enclosed within

the dwelling unit or a permitted accessory building. (ii) The Residential-Work Home Occupation shall not occupy more than 50% of

(v) The Residential-Work Home Occupation shall not change the principal

character or external appearance of the dwelling involved. (vi) The Residential-Work Home Occupation shall have no external indication

that the unit or building is used for a purpose other than a residential use, except for a sign, as permitted.

(vii) There shall be no external storage or display of materials, equipment or

finished products. (viii) There shall be no mechanical or electrical equipment used that create any

external noise, or any interference with electrical equipment in adjacent buildings.

(ix) Residential-Work Home Occupation that discharge or emit odours or

noxious matters or vapours, smoke, dust, heat, glare, radiation, or recurrently generated vibrations shall not be permitted.

(x) Operators of all home occupations shall obtain a business license and comply

with all provisions of the Business License and Regulation Bylaw No. 7878. (xi) Any Residential-Work Home Occupation that represents a fire hazard by

virtue of the manufacturing process or materials storage shall be prohibited.

Schedule 'B' – Comprehensive Development Zones CD5 – Multi-Purpose Facility/ CD5lp – Multi-Purpose Facility (Liquor Primary) 1.1 Purpose This zone shall be subject to the provisions of Zoning Bylaw, 1976, No. 4500, as it existed on

May 4, 1998. The terms and phrases used in this zone shall have the same meaning as in City of Kelowna Zoning Bylaw, 1976, No. 4500 as it existed on May 4, 1998. The purpose of this zone is to designate and preserve land for the orderly development of a Commercial and Public Athletic and Recreation Facility and the adjacent commercial lands, which shall provide for high density residential, office and commercial uses not provided for in the intended purposes of the C-3 and C-7 (B/L 4500) zones. Such commercial uses shall include retail stores and shops customarily oriented to random, comparative pedestrian shopping and shall be complementary to and supportive of the Commercial and Public Athletic and Recreation Facility.
