PRESENT: Mayor Button, Norm Stanek, Mary Von Ruden, Kevin Brueggeman, Kevin Riley, Josh Lydon,Ed [ukasek, Alli Karrels, Jim ChurchABSENT: NoneALSO PRESENT: Mark Sund, Todd Fahning, Jim Hellman, Dave Kuderer, Kristin Gust, Pat Mulvaney,Garyln Brookshaw, Jim Bialecki, Architect from Community Living Solutions, Mark Van Wormer

Mayor Button called the meeting to order at 6:30 p.m.

Roll Call was done by the Clerk.The Pledge was led by Alderman Church.Mayor Button presented a Service Award to Mark Sund for 25 years of service.

A motion was made by Josh Lydon and seconded by Kevin Brueggeman to approve the consentagenda consisting of the minutes of the regular meeting of November 15, 2017, Special Councilmeeting on December 6, 2017 and monthly bills. Motion carried 8-0.

RESOI-UTIONS

RESOLUTION AUTHORIZING MAYOR AND CITY CLERK TO EXECUTE DEED (ATnoId)

Kevin Riley read the Resolution the first and second time. Norm Stanek moved to read the Resolutionthird time by title only, rules be suspended and placed before the Council for immediate action,seconded by Josh Lydon. Motion passed 8-0. Mayor Button read the Resolution the third time by titleonly and the Resolution was approved on a roll call vote 8-0.

RESOTUTION AUTHORIZING MAYOR AND CITY CLERK TO EXECUTE AGREEMENT BETWEEN CIry OF

SPARTA AND COUNTY OF MONROE (Water and Sewer Supply Agreement)

Norm Stanek read the Resolution the first and second time. Jim Church moved to read the Resolution

third time by title only, rules be suspended and placed before the Council for immediate action,seconded by Kevin Brueggeman. Pa rt of this motion was to approve some m inor word ing cha nges in theagreement and to approve a three year term to build the Senior Living Care Facility. Motion passed 8-0.Mayor Button read the Resolution the third time by title only and the Resolution was approved on a rollcall vote 8-0.

A motion was made by Josh Lydon and seconded by Kevin Brueggeman to approve the "Class B"Liquor License for Kristin Gust dba Cork and Barrel located at 124 N. Water Street. Motion cafried 8-0.

A motion was made by Norm Stanek and seconded by Ed Lukasek to proceed with the final design(Phase 1) for South Pointe Business Park. Motion carried 8-0.

(Mary Von Ruden left at this time - 6:54 and wished everyone a Merry Christmas and to thank theCouncil members for their support with Rolling Hills Nursing Home)

Todd went over the City Administrator Report.

Items listed for future consideration were:Fine Foremost Farms for the odor.......letter sent to them from City Attorney asking them to come to a

council meeting and update them on what the problem is and how they are going to rectify it.

A motion was made by Josh Lydon and seconded by Norm Stanek to adiourn at 6:59 p.m. Motioncarried 7-0.

CITY COUNCILRESOLUTION APPROVING CREATION OF

TAX INCREMENTAL FINANCE DISTRICT NO. 9CITY OF SPARTA, WISCONSIN

. WHEREAS, the City of Sparta desires to promote development, iob growth, infrastructureimprovements, and broaden the property tax base in the designated area oiTax lncremental Finance DistrictNo. 9; and

. , wHEREAS, pursuant to sec. 66.1105, wisconsin statutes, the planning commission, city of sparta,Monroe County, Wisconsin has held a public hearing on the proposed ProjeciPlan and Tax incrementalFinance District No. 9 (herein "Project plan" and "Districf') on september srh, 20j.7 and December lgth, 2017after notice as required by law; and

WHEREAS, prior to publication of notice of said public hearing, a copy of the notice was sent by firstclass mail to the chief executive officer or administrator of the Sparta-ichooi bistrict, Western TechnicalCollege, and Monroe County; and

-WHEREAS, after the public hearing was held the Plan Commission recommended adoption of the

Project Plan by resolution, subject to the approval of the City Council; and

_ wHEREAS, the Project Plan, which is attached to this Resolution and incorporated herein byreference, meets all of the following requirements of sec. 66.11.05, Wisconsin Statutes, to wit:

A lncludes a statement listing the kind, number and location of all proposed public works andimprovements within such District; and

B. Contains an economic feasibility study; and

C. Contains a detailed list of estimated project costs; and

D. Contains a description ofthe methods offinancing, all estimated project costs, and the time whensuch costs or monetary obligations related thereto are to be incurred; and

E. lncludes maps showing boundary of the District, existing land use, zoning, future land use, andproposed improvements of real property in such District; and

F lncludes proposed changes, if any, in zoning ordinances, master plan, map, building codes, and cityordinances; and

G. Contains a list of estimated non-project costs; and

H. Conta ins a stateme nt of the proposed method for the relocation, if a ny, of pe rsons tobe displaced by District projects; and

l. Contains a statement indicating how creation of the District promotes the development of the City;and

J. lncludes an opinion of the City Attorney advising that the project plan is complete andcomplies with sec. 66.1L05, Wisconsin Statutes.

WHEREAS, the City Council makes the following findings:

1. The name ofthe District shall be "Tax lncrement Finance District #9, city of sparta,,, a Mixed-usetype district; and

2. The boundaries of the District are described in the attached Project Plan that is incorporated byreference, and such boundaries are contiguous and of sufficie ni defin ite ness to iueniity wiitrordinary and reasonable certainty the territory included therein. Boundaries include only thosewhole units of property that are assessed for general tax purposes. The boundaries of the Oistrict Oonot include annexed territory that was not within the boundiries of the City within the last threeyears; and

3 The boundaries of the District will overlap a portion of existing Tax lncrement Finance District #6,City of Sparta; and

4 The creation date ofthe District for purposes of determining the expenditure and terminationperiods shall be the date upon which the City Council approves a reiolution adopting the projectPlan For purposes ofallocatingtax increment thecreation date shall beJanuaryr, Iora; ani

5. Not less than 50% of the real property in the District is suitable for mixed-use development, asdefined under State Statute S66.1.105(2)(cm); and

Newly platted residential development, ad defined under wis. stat. 66.1105, will not exceed 35% ofthe area in the Districu and

The City will only allow tax increment revenue to be spent on newly platted residential developmentin the District if one of the following three applies:. Density ofthe residential housing is at least three (3) units per acre, or. Residential housing is located in a conservation subdivision, as defined in sec.66.i.027(1)(a), wis.

Stats., or. Residential housing is located in a traditional neighborhood development, as defined in sec.

65.1027(1)(c), Wis. Stats.

The estimated percentage of territory within the District that will be devoted to retail business at theend of the maximum expenditure period is not anticipated to exceed 35 percent of the area of theDistrict; and

The improvement of such area is likely to enhance significantly the value of substantially all other realproperty in the District; and

The project costs directly serve to promote orderly development consistent with the purposes forwhich the District is created; and

BE lT FURTHER RESOLVED, that the City Council does recommend the Project Plan for adoption by theJoint Review Board for the City of Sparta, Monroe County, Wisconsin.
