The U.S. Commission on Civil Rights is a temporary,independent, bipartisan agency established by Congress in19 57 and directed to:

• Investigate complaints alleging that citizens arebeing deprived of their right to vote by reason oftheir race, color, religion, sex, or nationalorigin, or by reason of fraudulent practices;

I. BACKGROUND

Unified School District No. 1 of Racine county,Wisconsin, is 100 square miles in size. The area east of I-94 between the Kenosha County line and Racine County linemerged into one school district in 1961 and includes thecity of Racine, two towns, and four villages. The 1970census estimated the city population at 95,162 with a racialbreakdown of IS,122 whites, 10,000 blacks, and 5,440Hispanics.* The merger contributed to a more equaldistribution of educational services across the district,and made it a more efficient operation. The districtconsists of 36 elementary, 6 junior high, and 3 senior highschools. In 1975, there was a total enrollment of 28,757students: 80.4 percent white, 14.2 percent black, and 5.4percent Hispanic. In that same year, the district employed1,590 teachers of whom 1,456 or 92 perceNt were white, 115or 7 percent were black, and 19 or 1 percent were Hispanic.2

II. HISTORY

In 1966 J.I- Case High School was opened and two juniorhigh schools with predominantly minority enrollments wereclosed. The closing of these schools redistributed minoritychildren—a move which was interpreted by some asdesegregation. However, the president of the local NAACP,Julian Thomas, said, "Even though the closing of theseschools made [Unified School District No. 1] look like aprogressive school system, the truth was they were closedfor better utilization of facilities available.113

The administration noted that these minority schoolshad declined in enrollment and that the surroundingpopulation was changing to almost 100 percent minority. Theclosing of the schools caused some disbursement ofminorities and, while the NAACP was not against this move,Mr. Thomas said, "We began to think in terms of...whatcenters could be utilized within the inner city where whitekids would be brought in and minority children out."4

Actions taken by the board of education forreorganizing the schools because of declining enrollment didnot involve transportation of white children. No plans weredesigned to deal with the racial imbalance in schools atthat time.

It was not until 197 2 that the school board beganplanning to desegregate schools by busing suburban childrento inner-city classrooms. Bitter protest by citizensresulted in the board's deferring any action.5 Instead theboard closed three predominantly minority schools—Beebe,Richards, and Tucker Elementary Schools--and shiftedstudents to other schools in the area. Sister MichelleOlley, a school board member at the time, said, "...failureto develop permanent plans amount[s ] to a commitment topromote segregation....These boundary lines didn't make anymove toward integration...." She later said, "It's a fact wedon't have to create a separate system—we maintain it...."6

In 1973 district figures showed a heavy concentrationof minority students in 8 inner-city schools out of a totalof 33. For example, Stephen Bull and Garfield ElementarySchools had minority enrollments of 88.9 and 90.2 percent,respectively.

Between 1962 and 1973 the NAACP explored thepossibilities of filing a lawsuit against the schooldistrict. During that time the civil rights organizationsleaders cooperated with the school district but continued topress for desegregation. It was not until 1973 that theNAACP made its position clear in a letter to the schooldistrict informing the district of the NAACP's intention notto pursue a lawsuit until the Supreme Court ruled on Detroitand Denver desegregation suits. In his letter, Mr. Thomaswrote:

There is a great similarity between these schooldistricts and ours. Upon receipt and review ofthose decisions we will then proceed with oursuit...providing the Unified Board has notcorrected the situation.7

Even though this letter had the tone of a threat, it wasnot, according to Mr. Thomas. "It was only for the purposeof clarifying the organizations position and to see if theprocess of [voluntary] school desegregation could be pursuedin a spirit of cooperation," he said.8

III. THE DESEGREGATION PLAN

Early in the summer of 1973, the Wisconsin Departmentof Public Instruction sent State guidelines fordesegregation to the district. The guidelines required allschool districts to racially balance their schools within 10percentage points of the proportion of all ethnic groups intheir district. The guidelines also called for the districtto better racially balance its teaching staff and to includecurriculum and textbooks that would reflect ethnic cultureand background.

The director of the Wisconsin Department of PublicInstruction, William Colby, was quoted as saying, "We aregoing to push these as far as we can. The guidelines couldlead to legal action."9 Mr. Colby later explained that theguidelines were only recommendations and did not have verymuch force, but he was hopeful they would become

On September 9, 1973, the Racine Unified District Boardof Education moved closer to resolving its racialdesegregation problems. The Racine Journal Times observed,"Despite tirades from men wearing swastika armbands andstiff opposition from its only minority member, the board,meeting as a committee of the whole, narrowly voted torecommend approval of a proposal which set maximum quotasfor minority students."1* The proposal by GilbertBerthelsen, president of the board, called for a minorityenrollment in each school of no more than 10 percentagepoints above the proportion of all minority students in thedistrict to be effective September 1975. Under the plan (asof September 1976) no school in the district could have aminority enrollment greater than 30.7 percent because thesystemwide minority enrollment at that time was 20-7percent.* 2

All these factors may have pressed the district todecide to desegregate voluntarily. A resolution adopted bythe Racine School Board in October 1973 resulted in thecreation of a citizens1 advisory committee by the

superintendent of schools. The committee was composed ofmembers from the Title VII Emergency School Aid Act fundscommittee, community organizations, and the community atlarge. This committee was the first of two organized todevelop plans for the desegregation process. The firstcommittee focused on establishing five basic guidelines tobe followed during implementation of desegregation. Theguidelines were:

1. Minimum busing—including no extreme distances,limited amount of time on the bus, and limits onthe age of the children bused.

2. Integration could begin in either kindergarten,first- or second-grade, with the most popularoption appearing to be first grade.

3. Equal educational opportunity should beprovided for all children.

4. Children should be moved within groups(neighborhood groups) .

5. Flexibility and choice should be provided,either through varied programs in individualschools or through the development of magnet oroption schools.

The advisory committee also emphasized that anydesegregation plan should affect and include all of theelementary schools in the unified district.13

In July 1974, using the above criteria, districtadministration and staff developed and presented to theboard four plans:

Reorganization Plan

This plan proposed reorganizing nine fifth- and sixth-grade (middle) schools. Each middle school would be groupedwith three or four elementary schools. All fifth- andsixth-grade students within a group of schools would attendthe middle school. The other schools within the group wouldcontain grades one through four, including those studentsreassigned from the designated middle school. All schools(middle and one through four) would have kindergartenscomposed of neighborhood children.

Redistribution Plan

The redistribution plan proposed adoption of thecriterion presented in the board of education motion that noschool shall exceed the district minority percentage by morethan 10 percentage points. Minority students in grades onethrough six would be transferred from the 7 inner-cityschools and reassigned to the 23 outer-city schools to reachthe prescribed percentage. Redistribution would be based onthe current minority enrollment and capacity of each outer-city school. The end result of this plan would be studentenrollments lower than capacity, allowing room for magnetprograms, optional elementary or secondary programs, specialeducation programs, traditional one through six programs, orbuilding abandonment or sale. The plan also proposed thatkindergartens continue to operate in the neighborhoodschools.

Exchange Plan

This plan proposed making use of all public schoolfacilities and satisfying a motion by the board to exchangeminority students from 7 inner-city schools with whitestudents from the 23 outer-city schools. The percentage ofminority students for outer-city schools would beestablished by the board and any additional number ofminority students could then be added to a school keepingthe enrollment at the previous level. Once this number wasdetermined for all outer-city schools, the exchange ofstudents would begin. Selection of actual students wouldprobably be based on neighborhoods within the present schoolattendance areas. The exchange would operate whether or notkindergarten students were included.

Cluster Plan

The cluster plan proposed the division of the districtinto four clusters or organizational patterns of education:modified self-contained, multi-unit, nongraded continuousprogress, and academic. The parents within each clusterwould choose, on a priority basis, the type of school theywished their child or children to attend. The school wouldbe organized to meet the needs of students choosing eachtype of school. Students would be assigned to the schoolsof their choice based on nearness to their homes and theminority percentage established by the board.

The board of education approved the redistribution planon August 15, 1974. Reverend Eugene Boutilier, a member ofthe Racine Urban Ministry, expressed his belief regardingthe general feeling about the plan by some people saying,"Most knowledgable members of the community were not infavor of this plan."1* Members of the clergy present at theboard meeting continually voiced their dissatisfaction withthis plan. According to them, the burden of busing wasplaced on the minority community.

The representative from the Racine EducationAssociation (REA) was of the opinion that the board wouldnot make any irrevocable decisions until elementary teachershad an opportunity to meet, discuss the various plans, andmake their own recommendations.15 Other organizations suchas the Racine Urban League and the Racine County ActionProgram commended the board for its early action on schooldesegregation. These two organizations did not favor anyparticular plan at that meeting, but later opposed theredistribution plan. The cluster plan received the mostsupport at the meeting, according to newspaper accounts andpersons interviewed.16

Declining school enrollment had convinced schoolofficials that schools on the fringe of the district couldaccommodate student transfers from the inner city. The planwould also permit some inner-city schools to be used formagnet and alternative school programs. The board agreed onthe redistribution plan, even though the plan would requiretransporting primarily minority children. Superintendent C.Richard Nelson said, "It would be the most acceptable planto the white community."17

The approved plan was subject to some specificmodifications. The areas which the board asked thesuperintendent to improve were: the lack of specificity indescribing the use of vacated spaces in the inner city; thelack of any attempt to straighten some present boundarylines; and possible crowding in the outer city as a resultof reassignment.4 8

The citizens1 advisory committee was expanded to 45persons and included parents, teachers, and students fromvarious racial and ethnic backgrounds. This committeeplayed an important role in getting support for the finalplan and for its smooth implementation. The politicalmembers of the community did not voice their opinion one wayor the other on desegregation, although it was noted in

local newspapers that representatives from the countyRepublican Party and the county Democratic Partyparticipated in the advisory committee. Religious,businesS, and other community leaders were also involved inthe advisory committee.

IV. COMMUNITY REACTION

Some community leaders noted that opposition to schooldesegregation from members of the white community primarilyfocused on how the reorganization plan would be implemented.Many white parents did not want their children bused toinner-city schools.19

Two major concerns of the minority community were theamount of travel required to desegregate the system andwhether desegregation would be implemented only at theexpense of the minority community.20 The strongestopposition to desegregation was voiced by spokespersons fromthe American Nazi Party in Racine. They attended the boardmeetings and passed out literature. However, their actionsdid not impede the process of desegregation. Althoughtension existed during many of the meetings at which thevarious desegregation plans were discussed, no organizedviolence or disruptions occurred during desegregation.21

However, in February 197 5 just prior to the finalapproval of the plan, strong protest developed from citizensresiding in the predominantly white township of Caledonia;the spokesperson for the residents was a member of thecitizens1 advisory committee who worked on the plan. Fivehundred residents signed a petition (which was presented tothe school board) opposed to busing. The petitionersreportedly were not opposed to desegregation, but rather tothe busing of children from Caledonia to the inner city ofRacine.22 Based on the provisions of the unified plan, thosechildren who resided in Caledonia and attended North Parkand the Western Complex schools would be transported to theinner city.

A spokesperson for the Caledonia residents, Roger Hay,stated, "The busing plan exceeds State and Federal busingguidelines and imposes severe hardships on many parts of theschool district."23 in a later interview, he said, "We feelthe plan is unacceptable because of the busing as it affectsone or two areas—the sheer movement of bodies

unnecessarily."2* The group reportedly wanted to file alawsuit in Federal court against the school district toenjoin the plan but found that it had no cause. A leader ofthe group said, "We've had to admit defeat. We found wehadn't a leg to stand on.""

Minorities also expressed opposition to the plan manytimes, but most eventually agreed to work with the schoolsto make the plan a success.26

Idela Shelton, a parent with children and grandchildrenin the schools, said:

I don't drive. What would I do if my kids gotsick. How would I get them? They [the officials]say they will take care of it but they make allkinds of promises.27

Lois Heider, Racine PTA president, was quoted assaying:

From what I can pick up, parents don't want theirkids taken away where they can't get at them.They are concerned their kids are not going to beaccepted.

Parents, she said, were not "thrilled" with the plan,but they would go along with the plan and "make it easy onthe kids."28

NAACP Chapter President Julian Thomas noted, "The plandoes not meet all of our criteria but it's not far off. Wefeel it's a workable plan."29

George Bray, director of the Franklin NeighborhoodCenter, said:

My one concern is the weight of the program on theblacks and the browns, but I don't think it couldhave been modified. All the minorities' childrenare going to be outnumbered 5 to 1 and miles awayfrom home.30

There were some complaints voiced by the RacineEducation Association. Executive Director James Ennis saidthat teachers were not seriously considered in theimplementation program. He also expressed concern aboutteacher-student ratios and the transfer system the district

was planning to use. In the Racine Journal Times, Mr. Enniswas quoted as saying that "although the plan calls forreduced student-teacher ratios overall, many teachers willactually have increased numbers of students in theirclassrooms, some as much as 11 over the called for 24.9 to 1ratio."31 In an interview with Commission staff, Mr. Ennissaid that the districts motivation to desegregate was tosave $500,000. With the increase in class size, there wouldbe a decrease in faculty, he said. Teachers were notadamantly against desegregation, although there were somewho tried to impede the REA from becoming involved in thedesegregation effort.32

According to Mr. Ennis, most minority parents believethat their children were at an advantage in a smaller classsetting, but that with desegregation they would be disbursedinto larger and less sensitive classroom situations. Hefeared the situation could be overwhelming for minoritychildren and consequently could affect their academicachievement.3 3

V. IMPLEMENTATION OF DESEGREGATION

The Racine desegregation plan reassigned approximately2,186 students in the fall of 1975. This total reflected14.7 percent of all children enrolled in the system. In1974, the district transported 10,500 public school studentsand 4,000 parochial and private school students. With thedesegregation plan in effect, an additional 1,500 studentswould be transported in 197 5.3*

The cost of implementing the plan was the reason givenby board members Lowell McNeil and Harold Hay for votingagainst the plan. Mr. Hay said, "The real cost of the planwill be obvious 10 to 15 years from now when the districttries to live up to the higher staffing level."35

Even though the board had not studied the possible costof the plan, a majority urged the board to act now and studythe cost later.

Teachers were required to attend 2 days of humanrelations training prior to implementation. Many teachershave attended more than the required 2 days. There weremixed reactions about the results of that training. Oneprincipal said, "It's a necessary day and a good day. We'regetting serious about this. I am certainly going to workwith my staff about this."36 One teacher said that theseminar was superfical and perhaps too late.37 Anotherteacher openly criticized the racism seminar: "I've got somepretty good rapport with some of these colored students....I don*t know why we have to keep listening to this damnstuff."3»

VI. EFFECTS OF DESEGREGATION

To assess the impact of desegregation in the Racineschools, it is necessary to examine the eight inner-cityelementary schools that had more than 50 percent minorityenrollments in 1973. Four of the schools were changed toinclude alternative or magnet programs. Stephen Bull Schoolin 1976, for example, had a fine arts school with 20.5percent minority enrollment and a fundamental school with 31percent minority enrollment. (Stephen Bull was 89 percentminority in 1973.) Two of the heavily minority elementaryschools were closed. Only one of the schools, Jefferson,with a 1976 minority enrollment of 42 percent, exceeded thedistrict's guidelines of more than 10 percentage pointsabove the districtwide 1975-76 minority percentage of 20.7percent.

Many schools which were virtually all white in 1973have gained substantial minority enrollment. Cady VistaSchool, for example, had only 2 percent minority enrollmentin 1973 but 21 percent enrollment in 1976. Minorityenrollment at Jerstad Junior High School increased from 2percent in 1973 to 19 percent in 1976.39 Kindergartenclasses were not included in the redistribution plan adoptedby the district, and have remained racially structuredaccording to neighborhood housing patterns. With theexception of kindergarten classes, the Racine district hasundergone what appears to be fairly effective desegregationof its schools.

In the document submitted to the board explaining theplans, the superintendent of schools wrote:

No plan will affect all people in exactly the sameway. All persons will not be equally happy orunhappy with this plan or with any plan.Significant logistical and facility realities hadto be dealt with in the development of thisplan....The staff feels this plan has much merit.We know it can work. We believe it would be of

real benefit to our children and to our communityand would finally eliminate all remainingimbalance that we have been faced with for anumber of years.*o

The issue of "flight" to parochial schools was never aserious problemr although an increase in enrollments wasrecorded in the Cady Vista area.41 The churches for the mostpart discouraged parents from removing their children frompublic school, communicating from the pulpits and throughchurch newsletters distributed at services.42

One major issue that mushroomed into a confrontationbetween the school board and some parents occurred after theschool year opened in September 1975. Two or 3 months intothe school year, children from Wadewitz and Jefferson areaswere denied further bus service. The parents had supportedthe redistribution plan because they had been told theirchildren would be transported to their new schools. TheState would reimburse the district the cost of transportingchildren 2 miles or more. After reviewing the distancebetween the two points, administrators found that thedistance was under the 2-mile limit. Parents from Wadewitzand Jefferson areas were outraged and threatened to boycottthe schools if bus service were not continued. Thecontroversy was resolved when some townships assumed thecost of transportation and private sources offered tosubsidize the cost in other areas.

One white student said his concern about theimplementation of desegregation was the possibility ofstudents being close-minded and unwilling to mix with otherracial groups. He also spoke about the "...fear ofsomething new and what it is going to be like could possiblyget in the way of change."43

A black parent said, "Minorities were concerned thattheir children would not be treated equally."44 Some whiteparents were displeased about their children's changingschools.45 But in spite of apprehensions expressed by some,the Racine Unified District began its first day of thedesegregation plan without incidents of violence.

The Milwaukee Journal reported, "After a month ofschool...the children, the throes of integration behindthem, have quietly gone about their learning."46 A surveyconducted January 12, 1976, by the school district showedthat approximately 8 out of 10 parents contacted believed

desegregation was working successfully.•* Another survey ofthe nonadministrative personnel showed that 90 percent ofall nonadministrative personnel believed desegregation wasworking.*8 Preparation for desegregation and the earlyinvolvement of the community were contributing factors inthe successful implementation of the plan.49

VII. FINDINGS

•The Racine Unified School District in 1973 voluntarilyadopted a resolution mandating that no school couldexceed the districts minority percentage by more than10 percentage points. This means that, according to1976 enrollment figuresr no school in the districtcould have a minority enrollment greater than 30.7percent. With the exception of Jefferson ElementarySchool, which has 42.0 percent minority enrollment, allother elementary schools fall within the district'sdesegregation goals. However, these percentages do notinclude kindergarten classes which were not included inthe desegregation plan.

•When the desegregation plan was adopted, some segmentsof the minority community and one predominantly whitearea protested. At the time the plan was implemented,there were no incidents of physical disruption orviolence, in part because the minority communitydecided to accept the plan and help the school districtimplement it. White dissident groups found that theirprotests had no legal basis.

Attendance has not changed, although there has beensome noticeable decline in the number of white-students andan increase in the parochial schools1 enrollment. The issuewhich has created some dissatisfaction within the minoritycommunity has been the fact that black children are bearingthe brunt of busing. State funds are available for busingonly for distances of 2 or more miles. As a result, somechildren have to walk a longer distance to school becausetheir school falls within the 2-mile limit. The schoolsystem has stated that it does not have the funds to providebuses for those children. This has aroused a group ofparents to confrontations with the board of education.

Most of the persons interviewed in Racine believe thatacademic achievement has improved in school programs sincedesegregation. The school district has taken several

surveys on attitudes towards desegregation and the resultshave proven to be favorable. Most agree that interracialand intercultural relations have been improved. Studentsseem to be adjusting very well with no serious disruptionsoccurring at any of the schools. Overall, the opinion ofthe community is that the Racine desegregation effort wassmooth and successful. Most would agree that the key factorfor a cooperative spirit was the school administration,which set the tone and planned carefully for smoothimplementation.
