One of the distilptive features of American education.is thatthe development and maintenance of eduCational standards are,
the responsibilities of nongovernmental, voluntary accreditingassociations. The Office of Education Is cognizant of theinvaltiable contribution which the voluntary accrediting associa-
. tions have made to the development of, educational quality in theNation. It is the policy of the Office of Education generally tosupport and encouage the various recognized voluntary accredit-
ing associations in their role as the primary agents' in thedevelopment and maintenance of, educational' standards in the
United States.

ACCREDItATION IN THE UNITEDITATES
The United States has no Fheral ministry of educatio 0 rother centralized authority exercising single national con-..trol over educational institutions in this country. The Statesassume iarying degrees of control over education, but, ingeneral, institution's of postsecondary education are per-mitted to operate With considerable independence andautonomy. As a consequence, American educational institutions can vary widely in the character and quality of theirp rams.

standards;2. Assisting prospective students in identifying- accept-
.able institutions;3. 'Assisting institutions in determining the acceptability
of transfer credits;4: -lelping to identify institutions and programs for the
investment of public and private 'funds;.5. Protecting an institution against harmful internal and
external pressures
In order to insure a basic level of quality; the practice ofaccreditation arose in the United States as a means ofconducting nongovernmental, peer evaluation of educe-
.tional institutions and programs. Private educatioPal associations of regional or national scope have adoptedr,coterie reflecting the qualities of a sound educationalprogram and have devaped procedures fo'r evaluatinginstitutions or programs to determine whether or not theyare operating at basic levels ofiquality.
Functions of Accreditation
,.Accrediting usually involves five basic steps:
1. Standards: The accredit' g agency,' in collaborationwith educational instituti ns, 8tablishes standards.
2. Selfstudy: The institution or program seeking adcreditation prepares a self- aluation study thatmeasures its performance agai the standards estab-
lished by the accrediting agency \,
6. Creating goals for self - improvement of weaker pro-grams and stimulating a general raising of standardsamong educational institutions;
7. Involving the facult and staff compiehensively ininstitutional evaluation and planning;
8. Establishing criteria for professional certification,licensUre, and for upgrading courses offering suchpreparation; and
9. Providing one of several. copsid ions used as a basis
for determining eligibility for Federa tdrice.

Types of Accreditation
There are two basic 'types of ediaciitional accreditation, oneidentified as "institutional" and one referred to as "special-
ized." or "prOgramm'atic.".
'institutional accreditation normally applies to an entireinstitution, indicating that each of its parts is contributingto the achievement of,an institution's objectives, althoughnot necessarily all on the same level of qUality. The variouscommissions of the regional accrediting associations, forexample, perform institutional aecreditation, as do somenational accrediting agencies.
Specialized accreditation normally applies to evaluation of,progOns, depar,tments or schools which usually are part-s7f)a total collegiate or other postsecondary institution. Theunit accredited may be as large as a college or school withina university or as small as a curriculum within a discipline.Most of the speCialized accrediting agencies review unitswithin a postsecondary institution which is ,acpredited byone of the regional accrediting commissions. However,certain of th*e specialized accrediting agencies do accreditprofessional schools and other specialized ormocational orOther postsecondary institutions which are free-standing in

Nongovernmental Coordinating Age9cies
ThePCouncil of RegionarSchool Accrediting Commissionsserves as the coordinating agency for the seven commissionson secondary education of the regional associations. Itsgeneral purpose is to provide an organization through whichthe regional commissions for secondary schools can uniteand communicate to advance the cause of voluntaryinstitutionbased evaluation aid accreditation for publicand non-public schools and for a diversity of other types ofsecondary schools. .
The 6ouncil on Postsecondary, Accreditation, in January1975, assumed the functions of'the Federation of RegionalActrediting Commissions of Higher Education and theNational Commission on Accrediting, It ,is a nongovernmental organization intended to foster and fat'ilitate the

role of accrediting agencies in promoting and ensuring thequality and diversity of Americanpostsecondery educalien.The Council recognizes, coordinatdoand periodically re-views the work of its member accrediting agencies, deter-mines the appropriateness of existing or proposed accredit-ing activities, and performs other related functions.
The Council of Specialized Accrediting Agencies, which isrepresented on the Council on Postsecondary Accredita-tion, was organized in 1973 to strengthen the effectiVenessand quality of postsecondary profeisional and specializededucation through accreditation and to collaborate withother postsecondary accditing agencies on behalf ofthespecial ized organizations,

For purposes ,of determining eligibility for United StatesGovernment assistance under certain legislation, the U.S.'Commissioner of Education is required to publish a list ofnationally recognized accrediting agencies and associationsWhich he determines to be reliable authorities as to thequality of training offered by educational institutions andprograms. Most institutions thus 'attain eligibility forFederal funds by holding accredited or preaccredited stateswith one 0N:he accrediting bodies recognized by, theCommissioner of Education, in addition to fulfilling othereligibility requirements. The Division of Eligibility and Agency Evaluation,formerly the Accreditation and Institutional EligibilityStaff, was established in 1968 by the Commissioner ofEducation to deal with accreditation and eligibility matters.Located in the Bureau of Postsecondary Education; theDivision has the following major functions:
1. Continuous review of procedures, policies, and issuesin the area of the Office of Education's interests and
-responsibilities relative to accreditation and eligibilityforfunding;
2. Administration of the eligibility for funding process;3. Administration of the process whereby accrediting

associations secure initial and renewed, recognition bythe Commissioner of-Education;
4. Liaison with accrediting associations;5./. Consultative services to institutions, associations,
other Federal agenCies, and Congress regarding ac-creditation and Eligibility for funditig considerations;
6. Interpretation and4distemination of policyrelative toaccreditation and eligibibolior funding issues in the
. case of All appropriate programt adminsisterd by the.Office of Education;
7. Conduct and stimulation Of appropriate research; and8. Supp6rt for the Commissioner's Advisory Committee
on Accreditation and Institutional Eligibility.
THE ADVISORY COMMITTEE ON ACGREDITATION AlIDINSTITUTIONALILIG TY-
The -Advisory Committee on Accreditation:-and Institu-- tional Eligibility is established by charter under the Federal
Advisory Committee Act (P.1. 92-463).. It is composed of15 persons appointed to three -year terms by the Secretaryof Health, Education; and Welfare from various segments ofthe secondary and postsecondary education 'community,the student/youth population, State departments of educa-tion, profeisional associations, and the general public.

The Committee functions to assist the U.S. Commii.'sioner
of Education in the performance of eligibility determiningqpties imposed by P.L. 82-550, the Veterans' ReadjustmentA\ssistance Act of 1952, and Subsequent legislation. It alsoserves to advise him on broader policy matters and specific
issues relating to accreditation and institutional eligibilityfor Federal funding. Specifically, the Committee is Man-
dated to:
1. Review alrcurrent and future policies relating to therespoEibility of the Commissioner for the recogni-
b tion Td designation of accrediting agencies andassociations wishing to be designated,as nationallyrecognized accrediting agencies and associations,and recommended desirable changes in iriteria and
procedurei;2. Review all current and future policies relating to the
responsibility °of the Commissioner for the recogni-tion and listirtg of State agencies wishing to:bedesignated as reliable authority as to the quality ofpublic postsecondary vocational education, and ofnurse education, and recommend desirable changes
in criteria and procedures;3. Review and advise the Commissioner of Education
in the forrattion of all current and future policyrelating to the matter of institutional eligibility,
4. Review the provisions of current legislation affect-ing Office of Education responsibility in the area ofaccreditation and institutional eligibility and suggestneeded changasto the Commissioner of Education;
5. Develop pnd recommend to the Commissioner ofEducation criteria and procedures for the recogni-tion and designation of accrediting agencies andassociations in accordance with legislatiye provi-sions, Presidetitial directives, or interagency agree-ments;
6. Revie* and recommend to the Commissiortr ofEducation for designation as nationally recognized
accrediting agencies and associations of reliable
authority all applicant accrediting agencies andassociations which vrneet criteria established under(5) above;
7. develop and recommend to the CoMmissioner ofEducation criteria and procedures far the recosantion, designation and listing of Stale agencies inaccordance'with statutory provisions, Executive Or-

9. Develop, under the authority of the VocationalEducation Act of 1963, as amended, and recom-mend for the approval of the Commissioner of
Education, standards and criteria for specific cate-
gories of private vocational training institutions
which have no alternative robte, by which toestablish eligibility for Fedeiral funding programs;
10: Develop, under' the authority of the Higher EduCa-
tion Act of 1965, as amended, and recommend forthe approval of the Commissioner of Education,
standards and criteria for specific categories ofinstitutions of higher education, for which there isno recognized accrediting agency or association, in
order to establish eligibility for participation in the
student loan programs authorized by Title IV-8thereof;
11. 'Maintain a continuous" review of Office of Educa-tion administrative' practice, procedures and judg-
ments relating to' accreditation and institutionaleligibility anii advise the Commissioner of neededchanges;

Agencies and Associations
§149.1 Scope.'
Accreditation of institu'tiohs or programs of institutions
0. by agencies or associations nationally recognized by the U.S.Commissioner of Education is a prerequisite to the, eligi-bility for Federal finaial assistance of institutions and of
the students attendin6 such institutions under a widevariety of federally Supported programs. The recognition ofsuch agencies is reflected in lists published by the Commis-
sioner in the FEDERAL REGISTER. Inclusion on such listis dependent upon the Commissioner'sding that any suchrecognizid agency or association is reliable authority as tothe quality of training offered. The Commissioner's recogni-tion is granted and the agency or association is included on
,, J the list only when it meets the criteria established by theCommissioner and set forth in § 149.6 of this part.

§ 149.2 Definitions.
"Accrediting" means the process whereby an.age- ncy orassociation grants public recognition to a school, institute,'
college, university, or specialized program of study whichmeets certain established qualifications and educational
standards, as determined through, initial and periodic
evaluations. °The essential purpose of the accreditationprocess is to provide a professional judgment as to the
quality of the educational institution or program(s) offered,and to encourage continual improvement thereof;
"Adverse-accrediting action" means denial of accredita-
tion or preaccreditation status or the withdrawal ofaccreditation or preaccreditation status;
"Agency or 'association" means a corporation, associa-tion, or other legal entity or unit thereof which has theprincipal responsibility for carrying out the accreditingfunction;,
"Institutional accreditation" applies to the total institu-tion and signifies that the institution as a whole is achieving
its educational'objectives,satisfactorily;"Regional" me s the conduct of institutional accredita-
tion in three or more Cates;
"Representatives of the public" means representativeswho are laymen in the sense that they areNnot educators in,
or members of the profession for which the students are
being prepared, nor in any way are directly related to the
institutions or programs being evaluated;"States" .includes the District of Columbia and terri-
tories and possessions of the United States..

§ 149.3 Publication of list.
Periodically the U.S. Commissioner of Education will
publish a list in the FEDERAL REGISTER of the
accrediting agencies 'and associations which he determines'
to be reliable authorities as to the quality of trainingoffered by educational institutions or programs, either in a
geographical area or in a specialized field. The general scopeof the recognition granted to each ofthe listedaccrediting
bodies will also be listed.

§149.4 Inclusion on list.
Any accrediting agency or aslociation which desires to
be listed by the Commissioner as meeting the criteria set
forth in § 149.6 should apply in writing to the Director,
Division of Eligibility and Agency Evaluation, Bureau ofPostsecondary Education, Office of Education, Washing-

§ 149.5 Initial recognition and renewal of recogniti
(a) For initial recognition and for renewal recogni-tion, the accrediting agency or association w II furnish.information establishing its compliance with the criteria setforth in §149.6. This information may be suppl mented bypersonal intervieiks or by review of-the agenc s facilities,records, personnel qualifications, and administr tive manage-ment. Each agency listed will be reevaluated by theifCommissioner at his i etion, but at least o ce every fouryears. No adverse d isici will become final ithout afford-ing opportunity for a hearing.
(b) In view of the criteria set forth i § 149.6, it is
unlikely that more than one association or agency willqualify for recognition (1) in adefined ge raphical area ofjulisdiction or (2), in a defined field of pr grain specializa-tion within secondary or postsecondary' duration, If twoor more separate organizations.in, a de ined field do seekrecognition, they will both be ,expeciad to demonstrateneed for their activities and show t at their accrediting,activities do not unduly disrupt the ofected institution orprogram.

.-------§149.6 Criteria.,
In requesting designation by the U.S. Commissioner ofEducation as a nationally recognized accrediting agency orassociation,- an accrediting agency or association mustshow:
(a' Functional aspects. Its fOnctional aspects will bedemonstrated by:
(1* Its scope of operations
(i) The- agency or association is-national or re;gional in its scope of operations.
} (ii) The agency or association clearly defines in itscharter, _byzlaws or accreditin standards the
.'scope of its activities, including thegeograph-_'ical area.and the types and levels of institutions..or programs covered.
(2) Itsorganization:
(i) The agency or association ho.,the administra-tive personnel and procedures to carry out itsoperations in a timely and effective manner.
(ii) The agency or association defines ifs fisealneeds, Manages its expenditures, and hasadequate financial resources to carry out itsoperations, is,shown by an externally auditedfinancial statehlent.
(iii) The agency's or association's fees, if any, forthe accreditation process do not exceed thereasonable cost of sustaining and improvingthe process.
liv) The agency or association uses competent andknowledgeable persons, qualified by experi-ence and training, and selects such personsnaccordance with nondiscriminatory practices:,(A) to participate on visiting evaluation_ teams;(B) to engage in consultative services for theevaluation and accreditation process; and (C)to serve on policy and decision-making bodies.
(v The agency or association includes on eachvisiting evaluation team at least one personwho is not a member of its policy or decision, -making body or its administrative staff.
(3) Its procedures:
(i) The agency or association maintains cleardefinitions of each level of accreditatida statusand has dearly written procedures for grant-ing, denying, reaffirming, revoking, and rein-stating such accredited statuses.
(ii) The agency or association, if it has-developeda preaccreditation status, provides for theapplication of criteria and procedures that arerelated in an appropriate manner to thoseemployed for accreditation.
(O The agency or association requires, as anintegral part orits accrediting process, institu-tional or, program self-analysis and an on-sitereview by a visiting team.(A) The self-analysis shall be a qtralitative
assessment of the strengtheand limitationsof the institution or program, including theachievement bilfl.institutional or .program.ofilietives, and sti&O involve a representa-tive portion of the institution's administra-tive staff, teaching faculty, students, gov-erninLbody, and other appropriate con-st i talk ies.
(B) The agency - or association provideswritten 4nd consultative guidanceto theinstitution or program and to the visitingteam.
(b) Responsibility. Its responsibility will be demonstratedby the way-in which "

(i) The agency or association includes representa
tives of the public ,in its policy and decision-
making bodies, or in an advisory or consulta-tive capacity -. that assures attention by the
policy and decision-making bodies.(ii) The agency or association publishes or other-
wise makes publicly available:
(A) The standards by which institutions orprograms are evaluated;
($) The procedures utilized in arriving at
decisions regardirig the accreditation
status of an institution or program;(C) The cu' rent accreditation status of insti-
tutions or programs and'the date of thenext currently scheduled review or recon-
. sideration of accreditation;_PI The names and affiliations of members of
its policy aradicisionmaking bodies, and _
the name(s) of its principal administrativepersonnpl;
(E) A description cif the ownership, controland type of legal organization of theagency,or association.

(iii) The agency or association provides 'advance
notice of proposed or revised standards to allpersons, institutions, and organization signif-
icantly affected by its accrediting process, andprovides such persons, institutions and organ,zations adequate opportunity to comment onsuch standards prior to their adoption.

a written re ort to the institution or program
commenting on areas of strengths, areas
needing imp ement and, when appropriate,
suggesting -means of improvement and includ-
ing specific reas, if any, where the in-
stitution or pr'ogram may not be in compli-
ance with the aiency's standards;
(iv) Providing the chief executive officer of theinstitution or program with an opportunityto comment upon the written report and tofile quppietnental materials pertinent, to the
facts and conclusions i the written report of
the visiting. team .before the accrediting

report; \(v) Evaluating, when apprOpriate, the report of

which meet its published standards, and demon-strates that its standards, policies,and proceduresare fairly applied and, that its evaluations areconducted and decisions rendered under condi-tions that__ assur e an impartial 'and objectivejudgment.
(9) It -reevaluates at reasonable intervals institutionsor programi which it has accredited.

(c) Reliability. Its reliability is demonstrated by
(1) Acceptance throughout the United States of itsevaluatiiln -methods, and decisions by
