Secondhand Smoke (SHS)
The problem:“The scientific evidence is now indisputable: secondhand smoke is not a mere annoyance. It is a serious health hazard that can lead to disease and premature death in children and nonsmoking adults.” US Surgeon General, 2006

“Treatments Can Make it Worse”
• Using air cleaning technologies or ventilating buildings does not eliminate SHS exposure.
• Heating, ventilation and air conditioning systems can actually distribute SHS throughout a building

Oregon Smokefree LawsAlmost all workplaces and public places are SMOKEFREE
• This includes public and common areas and anywhere an employee must pass through in the course of their duties.
• No-smoking within 10 feet (OR) and 25 feet (WA) of any entrance, window or intake unit.

Prohibiting Smoking is Not Illegal
Discrimination• Smokefree policies are not discriminatory under state and federal fair housing laws. Smoking is not considered a disability, or a reasonable accommodation for a disability.
• Addiction to nicotine does not fit within the definition of “handicap” under fair housing laws.

Nuisance Clauses- Courts Differ
• Chauncey v. Bella Palermo Homeowners’ Association, et al. OCSC Case No. 30-2011-00461681 (Orange County, California) – HOA and manager negligent for not enforcing nuisance clause to stop SHS (CC&Rs silent on smoking)
• Shuman v. Greenbelt Homes, Inc., Maryland Court of Appeals – On these facts, no nuisance since defendant smoked only outside and plaintiff could have closed his windows to keep out SHS
