What is the Section 504 Rehabilitation Act?

“Sec. 504 No otherwise qualified handicapped individual in the United States shall, solely by reason of this handicap, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under only program or activity receiving Federal Financial Assistance.”● A national law that protects qualified

individuals from discrimination based on their disabilities

○ filed lawsuit against Department of Health, Education, and Welfare (HEW) on Feb. 13, 1976

● Wanted regulations implemented for Section 504○ Without federal regulations, “disability rights would still be in

the dark ages…”● (HEW) Secretary David Mathews refused to sign the regulations

drawn up by HEW○ “...he did not like the idea of people who were receiving

rehabilitation assistance challenging their providers on the basis of civil rights.”
