Sec 7001 Requirements Section 7001 requires a notice to be published in the Federal

Register for proposed feasibility studies, proposed modifications to a to authorized projects and proposed feasibility studies to be conducted by non-federal interest.

The results are published in the federal register and included in an annual report

Deadline for submittals is September 23rd

Secretary certifies proposals meet five WRRDA criteria Proposals that don’t meet criteria are included in an appendix

1. Related to USACE authorities and one or more of the core missions USACE primary missions are navigation, flood risk

management, and aquatic ecosystem restoration. Recreation, hydropower and/or water supply will be

considered “related” when it is performed in conjunction with one or more of the primary mission(s).

3. Have not been congressionally authorized;

4. Have not been included in any previous annual report (under 7001); AND

5. If authorized, could be carried out by the USACE. Update from last year: Studies that are working toward a decision document – but which do not yet have a decision document that has completed Executive Branch Review – may meet this criteria and be included in the Main Report

The Appendix

Proposals that do not meet the criteria or do not contain all the required information will not be included in the main Annual Report, but will be included in an appendix, citing which criteria were not met.

Primary Reasons Proposals Included In Appendix

1 – Either Authority already exists to perform the requested work;

• It is noted that where authority already exists to perform requested work, inclusion in the Appendix to the 2016 Annual Report does not preclude the Army from carrying out either the study or construction.

2 – OR The Proposal did not fit within the identified Corps core mission areas.

What about Studies that have Completed Chief’s Reports?

HQ will ensure that all studies with Chief’s Reports that have successfully completed Executive Branch Review since the last Report to Congress are included.► Non-federal sponsors may have submitted

these for consideration – but it was not required / expected.

Federal Register noted two considerations for non-Federal interests proposals

First ► if Congressional authorization of a new feasibility

study results from inclusion in this report, it is anticipated that such authorization would be for the study only and not construction.

Second► a Post Authorization Change Report (PACR) is

required to be completed to support potential project modifications, updates to project costs and increases to the maximum project cost set by 902 of WRDA 86, as amended.

Assistant Secretary of the Army (Civil Works)

ASA(CW) Certifies that, based on the information received from the non-Federal interests, each proposed feasibility study and proposed modification to an authorized water resources development project or feasibility study included in this main report meets the criteria established in WRRDA 2014 Section 7001.

The information contained in proposals provided by non-Federal interests has not been revised or developed by the Corps or Army and the proposals are not endorsed by the Corps or Army.

This report is in response to the requirements of Section 7001 only, and does not reflect program, policy, or budgeting priorities.
