    Notice Inviting tender

    Supply, Installation, Testing, Commissioning and Maintenance

    of UPS at SEBI Bhavan II – Tender No. FMD-IV/26/2019

    Securities and Exchange Board of India invites tender for supply, installation, testing, commissioning (SITC) and maintenance of Uninterrupted Power Supply (UPS) alongwith Sealed Maintenance Free (SMF) Valve Regulated Lead Acid (VRLA) batteries, Power Distribution Unit (PDU) and related accessories from the Original Equipment Manufacturer (OEM) or their authorized dealers for sales as well as service of the approved makes of UPS for its office premises located in Mumbai at the address mentioned below: SEBI Bhavan II Plot No.C-7,’G’ Block, Bandra-Kurla Complex, Bandra (E), Mumbai 400 051 Accordingly, interested tenderers are requested to submit their quotation in the attached Tender Document duly filled in and signed on each page comprising of following parts:

    (a) Part I (Eligibility)

    (b) Part II (Technical Bid)

    (c) Part III (Price Bid) The bids may be submitted in three separate sealed envelopes superscribing “Tender Document for SITC and Maintenance of UPS – Part I (Eligibility)” “Tender Document for SITC and Maintenance of UPS – Part II (Technical Bid)” and “Tender Document for SITC and Maintenance of UPS – Part III (Price Bid)” respectively. The EMD instrument shall be kept inside the envelope Part I. All the three sealed envelopes should be kept in a sealed common envelope superscribing “Tender Document for SITC and maintenance of UPS - Tender No. FMD-IV/26/2019” and addressed to Deputy General Manager, Facilities Management Division IV, Securities and Exchange Board of India, SEBI Bhavan, Plot No. C-4A, ‘G’ Block, Bandra - Kurla Complex, Bandra (E), Mumbai 400 051 so as to reach us on or before 03:00 PM on February 07, 2020. Late tenders will not be accepted and are liable to be rejected. The above tender will be subject to various terms and conditions given in the Tender Document.

    The tender must accompany a Demand Draft of Rs.5,55,000/- (Rupees Five Lakh and Fifty Five Thousand only) drawn in favour of ‘Securities and Exchange Board of India’ towards Earnest Money Deposit (EMD). The EMD of unsuccessful tenderers will be refunded after award of work to the successful tenderer. Please note that tenders received without requisite EMD is liable to be rejected. EMD will not bear any interest. The pre-bid meeting will be held at 11:00 AM on January 24, 2020 in the office of the undersigned at the abovesaid address with all the interested tenderers. Tenderers/ their representatives are requested to be present during the pre-bid meeting. Any change in the Tender Document pursuant to the pre-bid meeting will be uploaded on SEBI’s website under section ‘Tender’ as ‘Minutes of Pre-Bid Meeting’ and the minutes shall also be signed, stamped and submitted alongwith (Technical Bid) Part II. No extra sheet or extra conditions should be attached with the Tender Document. Conditional tenders will be summarily rejected and the tender may not be considered for evaluation. Any doubt or clarification may be clarified from the officer-in-charge during pre-bid meeting before submitting the Tender Document. The validity of tender will be 90 days from the date of opening of the Tender Document, subject to extension upto mutually agreed date, if required.     3 Completion of SITC Works

    Within 60 days from the date of receipt of work order

    4 Warranty Period

    The UPS, batteries, PDU and related accessories shall be under warranty for a period of 1 year w.e.f. Date of Completion of SITC Works and handover of UPS batteries, PDU and related accessories to SEBI.

    5 Comprehensive Service Maintenance Contract Period (CSMC)

    All the UPS/PDU and related accessories will be covered under CSMC after the expiry of their respective warranty period for a further period of five years.

    6

    Earnest Money Deposit (EMD)

    Demand draft for an amount of Rs.5,55,000/- (Rupees Five Lakh and Fifty Five Thousand only) drawn in favour of ‘Securities and Exchange Board of India’ payable at Mumbai.

    7 Refund of EMD

    (i) to unsuccessful tenderer: Within three weeks from the date of written acceptance of purchase order by the successful tenderer or three months from the date of opening of price bid, whichever is earlier

    (ii) to successful tenderer: Within three weeks from the date of receipt of Performance Bank Guarantee

    8 Performance Bank Guarantee (PBG)

    PBG Value: 10% of the work order value towards SITC (i.e. cost of UPS, battery banks, PDU and related accessories) excluding CSMC charges.

    (i) (ii) Validity Period: 6 years and 6 months

    from the date of Completion of SITC Works to be submitted within 15 days of award of work

    (iii) (iv) PBG will be released to the party after

    successful Completion of SITC Works (i.e. UPS, battery banks, PDU and related accessories), their warranty period and subsequent CSMC period of five years and extension of CSMC period, if any.

    9 Liquidated Damage (LD)

    0.5% of work order value except CSMC charges (i.e. total cost of UPS, battery banks, PDU and related accessories) per week subject to a maximum of 10%.

    10 Payment Terms

    (i) 100% of the cost of UPS, batteries,

    PDU and related accessories after

    Completion of SITC Work.

    Eligibility Criteria

    The tenderer should fulfill the minimum Eligibility Criteria as per the details given below:

    (i) The tenderers should have registered office in India and should have its own offices (Not through channel partners/ franchises etc.) at Mumbai.

    (ii) Should be a registered company in case of a company.

    (iii) Should be registered with GST (Goods and Services Tax)

    (iv) Should be an original equipment manufacturer (OEM) of UPS or authorized dealer for sales as well as service for the approved makes of UPS ≥ 160 KVA capacity for at least last 3 years ending December 31, 2019.

    (v) The average annual turnover for last three financial year ending March

    31, 2019 shall not be less than Rs.83 Lakh.

    (vi) They shouldn’t have incurred loss in more than 1 year during last 3 financial years ending March 31, 2019.

    (vii) The tenderer must meet the following experience in similar works during last 7 years ending December 31, 2019:

    a) Three similar completed works each of the value not less than

    Rs.1.1 Crore.

    or

    b) Two similar completed works each of the value not less than Rs.1.4 Crore.

    or

    c) One similar completed works each of the value not less than Rs.2.2 Crore.

    Similar works means experience in completion of supply, installation, testing, commissioning and maintenance of UPS of capacity ≥ 160 KVA.

    General Rules and Instructions

    1. The tenderer should be Original Equipment manufacturer (OEM)/

    Subsidiary of OEM/ Authorized Distributor/ Associates of Channel Partners/ Authorized Dealers/ Subsidiary Dealers of the approved makes of UPS.

    2. The tenderer shall also be an authorized service provider (in case where they are not OEM) for the respective makes of UPS.

    3. Other than OEM such as Subsidiary of OEM/ Authorized Distributor/

    Associates of Channel Partners/ Authorized Dealers/ Subsidiary Dealers shall submit a certificate of their OEM authorizing the tenderer to participate in SEBI’s tender for sales as well as service as per the format in Part I(D). The OEM shall provide service in case of tenderer failing to provide the service support. The undertaking has to be provided by OEM.

    4. The tenderers are advised to enclose photocopies of all relevant documents

    as mentioned in the list of testimonials and other required documents wherever required.

    5. The tenderer shall submit EMD for an amount of Rs.5,55,000/- (Rupees

    Five Lakh and Fifty Five Thousand only) drawn in favour of ‘Securities

    and Exchange Board of India’ payable at Mumbai in the form of Demand

    Draft and should be submitted along with Tender Document (Part I) as

    EMD. This amount shall not bear any interest.

    The EMD deposited by the tenderers will be refunded as per the details

    given below:

    (i) to unsuccessful tenderer: Within three weeks from the date of written acceptance of purchase order by the successful tenderer or three months from the date of opening of price bid, whichever is earlier

    (ii) to successful tenderer: Within three weeks of completion of SITC

    works and submission of Performance Bank Guarantee

    6. SEBI may desire to inspect the facilities of the tenderers to verify the genuineness and to ensure the conformity with the details given.

    7. Intending applicants are required to submit their full bio-data giving details

    about their organization, experience, competence and adequate evidence of their financial standing, etc., in the enclosed statement (Application Form I(A), I(B) and I(C) along with requisite testimonials). Incomplete applications

    or applications without proper proofs for establishing their credentials may not be considered.

    8. Each page of the tender shall be signed. The tender shall be signed by

    person / persons on behalf of the organization having necessary authorization / Power of Attorney to do so.

    9. If the application is made by a partnership firm, a certified copy of the partnership deed, current address of the firm and the full names and current addresses of all the partners of the firm shall also accompany the tender.

    10. If the application is made by a limited company it shall be signed by a duly authorized person holding the power of attorney for signing the application in which case certified copies of the power of attorney and the certification of incorporation, Memorandum of Articles of Association shall accompany the tender.

    11. If the space in the proforma is insufficient for furnishing full details, the

    information shall be supplemented in separate sheets of paper stating therein the part of the statement and serial number. Separate sheets shall be used for each part.

    12. Applications received after due date and time or incomplete in any respect

    are liable to be rejected.

    13. No costs incurred by the applicant in applying, in providing necessary clarifications or attending discussion or site visits will be reimbursed by the SEBI.

    14. SEBI reserves the right to reject any or all the applications without assigning any reason thereof. SEBI also reserves the right to restrict number of applicants for tendering at its sole discretion. SEBI’s decision in this regard shall be final and binding on all concerned.
