PART IShort Title, Interpretation and Application

Short Title1 These regulations may be cited as The Sedimentary Basin GeophysicalExploration Regulations, 1985.

Interpretation2 In these regulations:

(a) “Act” means The Mineral Resources Act, 1985;

(b) “approved” means approved by the minister;

(c) “crew certificate” means a certificate issued to an operator pursuant tosection 6;

(d) “cut line” means a line cut through vegetation in the course ofgeophysical exploration and includes tailspreads;

(e) “department” means the department over which the minister presides;

(f) Repealed. 13 Dec 96 SR 96/96 s3.

(g) “energy source” means a source of energy or power that is used togenerate a pulse for the purpose of obtaining exploration data;

(h) “geophysical exploration” means any method whereby a physicalscience is applied or used to determine geologic of other conditions in thesubsurface that may lead to the discovery of minerals and mineral resourcesand includes, but is not limited to the following operations:

(i) seismic;

(ii) gravimetric;

(iii) magnetic;

(iv) electrical

(v) geochemical;

(vi) radiometric; and

(vii) logging of wells;

(i) “inspector” means a person authorized by the minister to carry out theduties and responsibilities of an inspector under these regulations;

(i.1) “licence” means a licence issued pursuant to section 6;

(j) “linear explosive” means a surface energy source where the explosive isin the form of a long cord on a spool and is cut to the required length in thecourse of field operations;

(k) “magazine” means a container used for the storage of explosives to beused in any geophysical exploration;

(l) “operator” means any person to whom a licence or a crew certificate hasbeen issued;

(l.1) “permit” means a permit issued pursuant to section 6;

(m) “public highway” means a public highway as defined in The Highwaysand Transportation Act;

(n) “public land” includes all lands in Saskatchewan that are:

(i) the property of Her Majesty the Queen in right of Saskatchewan orin right of any other province or of Canada;

(ii) the property of any rural or urban municipality; and

(iii) part of a road allowance, public highway or roadway;

(o) “road allowance” means a road allowance laid out under the authorityof a statute of Canada or Saskatchewan;

(p) “roadway” means that part of a public highway designated or intendedfor use by vehicular traffic;

(q) “rural municipality” means a rural municipality and hamlet underThe Rural Municipality Act;

(r) “sedimentary basin area” means all that area of Saskatchewan whichis situated south of the Precambrian Shield;

(s) “shot energy source” means an explosive charge in a shot hole that isused to generate an impulse for the purpose of obtaining exploration data;

(t) “shot hole” means a hole drilled for the purpose of firing an explosivecharge in connection with seismic exploration;

(u) “structure” means a building and all things constructed, erected,placed or stored above or below the surface of the earth;

(v) “surface energy source” means an energy source that is placed eitheron or above the surface of the ground and which does not involve the drilling ofa shot hole;

(w) “survey monument” means a stake, post, pin, mound, rock or othermaterial marking the corner of a quarter section, a section, or triangulationpoint, and includes a monument as defined in The Land Surveys Act;

(x) “urban municipality” means a city, town or village incorporated assuch and includes a city, town or village incorporated under The UrbanMunicipality Act, 1984;

Construction3 These regulations are subject to any orders made by the minister under the Actand any further order he may make for the interpretation and effectiveadministration of these regulations.

Application4 These regulations shall apply to all geophysical exploration in the sedimentarybasin area of Saskatchewan.

PART IIExploration Licences, Crew Certificates and Explosive Permits

Licence, crew certificate, permit required5 No person shall:

(a) conduct geophysical exploration unless he is the holder of a licence orunless he is conducting the geophysical exploration under the supervision andcontrol of the holder of a licence issued pursuant to this Part;

(b) operate geophysical equipment unless he is the holder of a crewcertificate issued pursuant to this Part or unless he is the crew chief named inthe crew certificate or is operating the geophysical equipment under thesupervision and control of a crew chief named in the crew certificate; or

(c) handle or fire explosives in geophysical exploration unless he is theholder of a permit issued pursuant to this Part.

Review of applications6 The minister may issue or refuse to issue a licence, crew certificate or permit forwhich application is made to the minister in accordance with this Part and mayrequest any additional information that he deems necessary for the considerationof any application.

Transfer of licence9(1) Subject to subsection (2), a licence may not be transferred.

(2) If a corporation which is the holder of a licence amalgamates with one or moreother corporations to form a new corporation, or if all or substantially all of theundertaking, property and assets of a holder of a licence become vested in any otherperson, the licence may, with the written consent of the minister, be held by theresulting corporation or the other person for the remainder of its term.

Application for crew certificate10 An application for a crew certificate may be submitted in duplicate to theminister by the holder of a licence on an approved form and shall be accompaniedby the fee prescribed in Appendix 1.

Designation of crew chief11(1) A crew certificate may only be issued for a designated crew to a holder of alicence and shall name an individual who shall be responsible for the activities ofthe crew at any time during which it is engaged in the operation of geophysicalequipment.

(2) A holder of a licence may change the designation of the individual mentionedin subsection (1) and shall notify the department of the change within seven days ofso doing.

Effective date of certificate12 A crew certificate shall be effective from the date of its issue and shall expireon December 31 of the year in which it is issued.

Transfer of crew certificate13(1) Subject to subsection 2, a crew certificate may not be transferred.

Application for permit14(1) An application for a permit to handle and fire explosives in geophysicalexploration may be submitted by an individual in duplicate to the minister on anapproved form and shall be accompanied by the fee prescribed in Appendix 1.

(2) No person under 18 years of age shall be issued a permit.

(3) No permit shall be issued to any person with fewer than six months’experience in the handling and firing of explosives without the consent of theminister.

(4) No permit shall be issued to a person who is not the holder of a St. John’sAmbulance Standard Certificate of First Aid or its equivalent.

(5) The holder of a permit shall be responsible for the safety of all persons in thevicinity of or engaged in the handling and firing of explosives and shall take allnecessary precautions to ensure that an explosive charge will not cause damage toany structure.

Effective date of permit15 A permit shall be effective from the date of its issue and shall expire onDecember 31 of the year in which it is issued.

Supervision by holder of permit17 No operator or crew chief shall permit any person to handle or fire explosivesin geophysical exploration except under the supervision of the holder of a permit ingood standing.

Minister may include terms17.1 When issuing a licence, crew certificate or permit, the minister may includeany terms the minister considers appropriate, including requirements for specialtraining, bonding, reporting, special inspections and approvals to cross pipelines oruse right of ways.

Amendment, suspension or cancellation of licence17.2(1) The minister may amend, suspend or cancel a licence, crew certificate orpermit where:

(a) the holder of that licence, crew certificate or permit is convicted of anoffence pursuant to these regulations; or

(b) in the opinion of the minister, the holder has acted in a manner that hasendangered public or crew safety.

(2) An amendment may include any term that the minister may have includedwhen the licence, crew certificate or permit was first issued.

(3) During a period of suspension, a licence, crew certificate or permit is deemed,for the purposes of section 6, not to have been issued.

Compliance with terms17.3 No holder of a licence, crew certificate or permit shall fail to comply with anyterm of the licence, crew permit or certificate.

PART IIISubmission of Reports and Notification Requirements

Approval of preliminary plans18(1) At least two weeks prior to the commencement of any geophysical exploration,the operator shall submit to the department for approval two copies of a 1:50,000scale map clearly indicating:

(a) the location of the proposed geophysical exploration;

(b) the proposed survey lines;

(c) the stations or recording parameters;

(d) the name of the operator;

(e) the operator’s licence and crew certificate number;

(f) the name of the client on whose behalf the survey is conducted;

(g) the date of commencement of geophysical exploration; and

(h) the total number of line kilometres of the proposed exploration.

(2) If the operator is conducting geophysical exploration for more than one clientin the survey location, he shall submit a separate map indicating the work to bedone for each client.

Crew location reports19 Upon the request of the minister, every operator shall report the location of theoperations of every crew operating under the authority of crew certificates issued tohim, and the address and telephone number at which the crew chief may becontacted.

Monthly reports20(1) The operator shall submit to the minister on an approved form two copies ofa monthly status report in respect of the operations of each crew operating underthe authority of crew certificates issued to him.

(2) Status reports shall be submitted before the 15th day of the month nextfollowing the month to which they relate.

Final reports and maps21(1) Within 60 days after the completion of any geophysical exploration, theoperator shall submit to the minister:

(a) a final report summarizing:

(i) all field operations conducted as part of the geophysical exploration,including the date of commencement and completion of the operations;

(ii) the total line kilometres of coverage; and

(iii) the equipment used;

(b) two copies of a 1:50,000 scale map clearly indicating:

(i) the area that was explored by reference to sections, townships,ranges and meridians;

(ii) the location and elevation of any shot holes or surface energy sourcelocations, and of any sample stations, and recording stations;

(iii) any trails or roads constructed during the course of the geophysicalexploration;

(iv) each geophysical survey line, identified by the month and year inwhich the line was surveyed;

(v) the name of the operator;

(vi) the operator’s licence and crew certificate numbers; and

(viii) the name of the client on whose behalf the survey was conducted.

(2) If the operator is conducting geophysical exploration for more than one clientin the survey area he shall submit a separate map indicating the work completedfor each client.

Notification of exploration required22 Prior to the commencement of any geophysical exploration by any crewoperating under the authority of a crew certificate issued to an operator, theoperator shall:

(a) submit to the office of each urban or rural municipality in which thegeophysical exploration is to be done:

(i) a notice of intent to conduct geophysical exploration on an approvedform; and

(ii) a map of any road allowances in the municipality to be used and thelines to be run whether on road allowances or other public or privateproperty;

(b) submit two copies of the notice of intent to conduct geophysical explorationmentioned in clause (a) to the minister; and

(c) notify the District Engineer of the Department of Highways andTransportation in the highway district in which the crew will be operating,informing him of any public highway to be used, the nature of the geophysicalexploration planned to be performed and the expected date of commencementand completion of the geophysical operations.

Notification of completion of operations23 Within 72 hours of completion of any geophysical operations, the operatorshall:

(a) submit to the office of each urban and rural municipality in which thecrew operated a notice on an approved form of the date on which thegeophysical operations in the municipality were completed; and

(b) submit two copies of the notice mentioned in clause (a) to the minister.

Identification of vehicles24(1) All vehicles used in conducting a geophysical exploration except supervisorypassenger vehicles shall be marked for identification as “SASK. CREW CERT.NO.”, followed by the crew certificate number of the operator.

(2) Letters and numbers used in identification shall be at least 10 centimetres inheight.

PART IVRestrictions on Geophysical Operations

Right of entry required25 No person shall conduct a geophysical exploration on lands other than roadallowances unless the prior consent of the owner and occupant of the land has beenobtained.

Consent for exploration in certain areas26 No person shall conduct a geophysical exploration:

(a) within the boundaries of an urban municipality or a hamlet unless he hasobtained the prior consent of the municipal authority;

(b) in areas of underground mining as designated by the minister or in watercovered areas unless approval for the operations has been granted by theminister; or

(c) in restricted areas designated by any other statute or regulation ofSaskatchewan or Canada, unless approval has been obtained from anauthority empowered by the statute or regulation to grant the approval.

Exploration on road allowance27(1) No person shall conduct any geophysical exploration on a road allowancewithin one metre of the boundary of that road allowance.

(2) No person shall conduct any clearing, ditching, grading or trail construction inconnection with any geophysical exploration on any road allowance without firstobtaining the approval of:

(a) the District Engineer of the Department of Highways and Transportation,if the road allowance is situated within a district; or

(b) the municipal authority, if the road allowance is situated within anurban or rural municipality.

(3) Any of the operations specified in subsection (2) are subject to inspection bythe appropriate authority.

(4) If the operations are not conducted in a manner and to a standard satisfactoryto the authority, then, upon the request of the authority, the holder of the crewcertificate or other person responsible for the conduct of the operations shallperform to the satisfaction of the authority and pay for any remedial work requiredby the authority.

Restoration of road allowance28(1) Any person conducting geophysical exploration on a road allowance shallremove all debris, refuse, equipment and other materials from the road allowanceremaining as a result of his operations.

(2) All trees, bushes, shrubs and other young forest growth removed in the courseof a geophysical exploration shall be cut so that they lie flat along the edge of theroad allowance.

Free passage29 Every person, while engaged in the conduct of geophysical exploration, shall:

(a) not impede the free and uninterrupted passage of traffic on any publichighway or roadway;

(b) provide for traffic control and protection where necessary or prescribed;and

(c) comply at all times with The Highways and Transportation Act andregulations thereunder.

Damage caused to a public highway or roadway30 If any person, while engaged in the conduct of geophysical exploration on apublic highway or roadway, causes:

(a) the disturbance of soil;

(b) the obstruction of normal drainage;

(c) other damage;

to the public highway or roadway, he shall:

(d) immediately notify the appropriate authority mentioned in sub-section 27(2) specifying the location, nature and extent of the disturbance,obstruction or damage; and

(e) carry out at his own expense any repairs that the authority may require.

PART VShot Hole and Surface Energy Source Operations

Shot hole distance31 No person shall drill a shot hole within the minimum distance from anystructure specified in Table 1.

Shot holes near road allowance and roadway32(1) Shot holes shall not be drilled within one metre of the boundary of any roadallowance.

(2) All shot holes shall be confined to an area on either side of a roadway which isbounded on one side by a line one metre from the boundary of the road allowanceand on the other side by a line one metre from the toe of the road grade sideslope.

Maximum depth of shot hole33 No person shall drill a shot hole in excess of 30 metres in depth unless priorpermission is obtained from the minister.

Maximum size of charge34 No person, while engaged in the conduct of geophysical exploration, shall use asingle charge having a strength in excess of two kilograms of explosives unlessprior permission has been obtained from the minister.

Release of ground water35(1) If a flow of gas or water is encountered in a shot hole:

(a) drilling of the hole shall cease and the hole shall be abandoned byplugging the porous horizons of the hole in a manner approved by theminister; and

(b) the operator shall notify the minister within 72 hours of the completion ofthe geophysical operations during which the flow of gas or water wasencountered on an approved form indicating:

(i) the location, elevation, and depth of the hole;

(ii) the depth of the flowing horizon; and

(iii) the action taken to control the flow.

(2) The minister may grant an exemption from this section in respect of a hole inwhich a flow of water is encountered if the land owner and the operator have agreedto convert the flowing hole to a producing water well.

(3) On completion of the conversion of a shot hole to a producing water well, theoperator shall forward to the minister a release on an approved form whichsatisfies the minister that the land owner has assumed full responsibility for theflowing hole which has been converted to a producing water well.

Shot hole abandonment36(1) Every shot hole shall be abandoned as soon as possible and, in any event,not more than 20 days after it is drilled unless otherwise authorized in writing bythe minister.

(2) A shot hole shall be abandoned by:

(a) filling the hole with drilling mud and material obtained from the hole;

(b) inserting to a depth of 45 centimetres below the surface:

(i) an approved metal or plastic cap;

(ii) a wooden plug one metre in length; or

(iii) a cement plug one metre in length;

(c) filling the hole from the plug to the surface and tamping the fill material;and

(d) spreading any excess drilling mud and material obtained from the holeover the surrounding ground.

(3) The ground surrounding an abandoned shot hole shall be restored as nearly asis possible to its original condition.

Abandonment in winter37 If winter conditions prevent the proper plugging of a shot hole, the plug usedmay be inserted temporarily to the surface level, but as soon as the frost issufficiently out of the ground abandonment shall be completed in accordance withsection 36.

Disturbance of set plugs39 Any person who disturbs the plug of an abandoned hole by firing a shot or byany other manner while engaged in the conduct of geophysical exploration shallrestore the plug in accordance with section 36.

Surface energy sources40(1) No surface energy source of an explosive nature shall be used for seismicexploration unless it has been approved by the minister who may impose conditionsupon its use.

(2) No person shall locate a surface energy source within the minimum distancefrom any structure specified in Table 1.

(3) Every operator and crew chief shall ensure that the magnitude of the energyimpulse of any surface energy source shall not cause damage to any structure.

PART VIRestoration of Damaged Property

Damage to land and structures41(1) If damage to any public or private land or structure is caused by theoperations conducted during any geophysical exploration the operator under whoseauthority the geophysical exploration is being conducted shall:

(a) immediately take all action necessary to prevent further damage;

(b) notify the owner of the structure or land of the extent, location andnature of the damage; and

(c) repair the damage.

(2) If an operator fails to repair any damage of the nature described in sub-section (1) to the satisfaction of the member of the Executive Council to whom isassigned the administration of the public land:

(a) that minister may undertake the inspection and repair of the damage;and

(b) the operator shall pay the costs of the inspection and repair.

Damaged survey monuments42(1) Any survey monument found to be in a damaged or disturbed condition byany person engaged in geophysical exploration shall be immediately reported to theminister by that person.

(2) If a survey monument is destroyed, moved or damaged as a result of anygeophysical exploration, the operator under whose authority the geophysicalexploration is being carried out shall immediately report the destruction, movementor damage to the minister who shall arrange to investigate the matter and restorethe survey monument.

(3) The operator shall pay the costs of the restoration undertaken pursuant tosubsection (2).

PART VIIStorage, Transportation and Firing of Explosives

Magazine safe distance43 No portable magazines shall be located within the minimum distances fromany structure specified in Table 2.

Magazine specifications44(1) All magazines shall be completely sheathed on the outside with a thicknessof boiler plate sufficient to deflect small arms ammunition or other missiles.

(2) The interior of magazines shall:

(a) be completely lined with tongue and groove lumber or an adequatesubstitute of non-sparking, electrically non-conductive material such asplywood, masonite or fibre board;

(b) have all screws or nails countersunk and covered by an adequate filler;and

(c) have all cracks securely sealed.

(3) All magazines shall be adequately ventilated and protected by suitable lockingdevices against breaking and entering.

(4) All explosives and detonators shall be stored and maintained in separatemagazines.

(5) All magazines shall be separated by at least 50 metres.

(6) All detonating fuses, such as primacord, shall be stored in the explosivesmagazine.

(7) No material other than explosives or detonators shall be stored in a magazine.

(8) All brush and other inflammable debris shall be kept at least 10 metres fromthe magazine.

(9) No cartridge, part cartridge or explosive shall be placed in any magazineunless it is contained in the box in which it was shipped by the manufacturer.

(10) Illumination in magazines shall be by natural means whenever possible, butif artificial illumination is required, portable electric lanterns or flashlightsapproved for use in similarly hazardous locations shall be used.

Transportation of explosives45(1) No explosives for use in geophysical exploration shall be transported in anykind of trailer and no vehicle transporting explosives shall tow any kind of trailer.

(2) When explosives and detonators are transported from the magazine to theplace of work by any vehicle they shall be stored in separate, enclosed, lockedcompartments on the vehicle.

(3) Explosives on the vehicles shall be stored in their own compartmentsseparated from the compartment for detonators by not less than 15 centimetres ofsolid lumber or its equivalent.

(4) All vehicles transporting explosives shall be:

(a) clearly marked in the front and rear of the vehicle with signs carrying theword “EXPLOSIVES” in letters:

(i) of a height of not less than 15 centimetres; and

(ii) in red on a white background or vice versa;

(b) marked on each corner of the vehicle during the daylight by a red flag notless than 30 centimetres square;

(c) marked during darkness by amber standard clearance lights or theirequivalent on the front corners of the vehicle, and red standard clearancelights or their equivalent on the rear corners;

(d) equipped with at least two approved fire extinguishers in good workingorder and with any other equipment required under The Vehicles Act and theregulations thereunder; and

(e) equipped with a first aid kit approved by the Workers’ CompensationBoard.

(5) No material other than explosives shall be carried in the explosives compartmentof vehicles transporting explosives.

(6) No vehicles containing explosives shall be taken inside a garage or otherbuilding.

(7) No explosives shall be kept in or on a vehicle while it is being repaired exceptfor emergency running repairs on the vehicle.

(8) Every person owning or contracting vehicles for conveying explosives inconnection with geophysical exploration shall establish a preventative maintenanceschedule for the vehicles to ensure that:

(a) fire extinguishers are filled and in working order;

(b) electric wiring is completely insulated and firmly secured and protectedby suitable fuses;

(c) fuel tanks and feed lines have no leaks; and

(d) brakes and steering apparatus are in good condition.

(2) No person in the vicinity of explosives shall smoke during the period when theexplosives are being handled or at any time when a magazine is open.

(3) No explosives shall be placed near an open flame, fire or directly heated stove.

(4) No explosive shall be warmed in any manner.

Safety hats48 All persons engaged in handling and firing of explosives in connection withgeophysical exploration shall wear safety hats equipped with a cradle.

Opening cases and cutting explosives49(1) Cases of explosives shall be opened with a wedge and mallet, both madeentirely of wood or other non-sparking material.

(2) Sticks of dynamite shall be cut on a wooden surface with a fixed bladed bronzeknife.

Deteriorated explosives prohibited50(1) No explosive shall be used unless, immediately prior to its use:

(a) it is drawn from the case in which it was received from its manufacturer;and

(b) the case is plainly marked with the name of the manufacturer, thedescriptive name of the explosive and its date of manufacture.

(2) No explosive which has evidence of deterioration including:

(a) damage or exudation from the cartridge; or

(b) soft or mushy cartridges that have an oily or greasy appearance andsurface texture;

shall be used but shall be promptly destroyed by approved methods.

(3) No explosives shall be burnt except by the direct order of the operator.

Priming of cartridges51(1) The priming of cartridges shall only be done at or near the place of use.

(2) When a charge is primed, all other explosives at or near the shot-point shall bekept inside the explosives compartment of the transporting vehicle and thecompartment shall be kept closed until the primed charge is fired or otherwiserendered harmless.

(3) No second charge shall be prepared before the one before it is fired.

(4) No shunt shall be removed from the cap leg wire until the charge is in the holein position to be fired, but where the depth of the hole is greater than the length ofthe cap leg wire that wire shall be connected to the short circuited firing line, andthe charge lowered into firing position before the firing line is connected to theexploder.

(5) Cap leg wires shall be slowly unraveled while the charge is being lowered intothe hole and in no circumstances shall they be unraveled by being thrown ordragged along the ground.

Loading of shot holes52(1) All poles used for the loading of shot holes shall be of wood except the fittingwhich shall be of non-sparking material.

(2) No person shall stand over or look directly into the open shot hole while thehole is being loaded with explosives.

Carrying explosives in pockets prohibited54 No detonators or explosives shall be carried in the pockets of workers’ clothing.

Blasting near structures and inhabited areas55(1) When conducting blasting operations in the vicinity of structures orinhabited areas, the holder of a permit under whose supervision the operations arebeing conducted shall take adequate precautions against possible injury to personsand property by:

(a) limiting the explosive charge to an absolute minimum;

(b) using protective mats over the shot hole;

(c) closing the approaches and thoroughfares to the shot-point; and

(d) taking other reasonable precautions that are required at the time orprescribed by the minister.

(2) The permit holder shall ensure that all persons are protected from the dangerof falling or flying rocks, mud, and other debris.

Explosives left in holes56(1) No explosives shall be left in a hole prior to the proper firing or removal andsafe-keeping unless:

(a) sufficient earth is placed in the hole to secure the explosive; and

(b) wires attached to the explosive are left a safe distance below the surfaceuntil the explosive is properly fired or removed and placed in safe keeping.

(2) If an explosive charge fails to discharge, the permit holder shall firstimmediately attempt to detonate it by another shot, but if it is impossible or unsafeto carry out the detonation, the charge and any wires remaining attached theretoshall be buried in the hole and the hole shall be plugged in accordance withsection 36.

(3) If a shot hole containing an unexploded charge within 4.5 metres of the surfaceof the land is abandoned, the operator shall report the location of the hole to theminister within 10 days after the abandonment giving the size and depth of theunexploded charge and the condition in which the shot hole was left.

Exploder at shot-point57 While at the shot-point, the exploder shall at all times be kept under the directsupervision and control of a permit holder.

Abandoning at shot-point58 Before abandoning a shot-point, all:

(a) portions of charges that have been blown from the shot hole;

(b) wrappings of containers used in the handling of explosives; and

(c) other waste from the blasting operations;

shall be destroyed or carried away.

Testing of circuits59 The testing of circuits shall be done with a functioning device designed for thatpurpose.

Breaking connections after firing60(1) Immediately after firing, whether the charge has exploded or not and beforeanyone inspects the shot hole or the firing line, the permit holder shall ensure thatthe connection between the exploder and the firing line has been broken and thatthe line has been short circuited.

Summary offence68 Any person who contravenes these regulations is guilty of an offence and liableon summary conviction:

(a) if a corporation, to a fine of not more than $1,000 for a single offence ornot more than $100 for each day during which the offence continues; and

(b) if an individual, to a fine of not more than $100 for a single offence or notmore than $25 for each day during which the offence continues.

Service of notice69(1) Any notice required to be given to the operator by these regulations may begiven orally to the operator or to any person engaged in the geophysical explorationto which the notice relates.

Responsibility of operator70 The operator is responsible for ensuring that the geophysical exploration isconducted strictly in compliance with these regulations and, if any provision ofthese regulations is not strictly complied with during the conduct of any geophysicalexploration, then upon receipt of the written direction of the minister, the operatorshall remedy the default at his own expense.
