SECTION 1. SHORT TITLE.3

This Act may be cited as the ‘‘Jerusalem Embassy 4

and Recognition Act of 2011’’.5

SEC. 2. RECOGNITION OF JERUSALEM AS THE CAPITAL OF1

ISRAEL AND RELOCATION OF THE UNITED2

STATES EMBASSY TO JERUSALEM.3

(a) STATEMENT OF POLICY.—It is the policy of the4

United States to recognize Jerusalem as the undivided5

capital of the state of Israel, both de jure and de facto.6

(b) SENSE OF CONGRESS.—It is the sense of Con-7

gress that—8

(1) Jerusalem must remain an undivided city in9

  which the rights of every ethnic and religious group10

are protected as they have been by Israel since11

1967;12

(2) every citizen of Israel should have the right13

to reside anywhere in the undivided city of Jeru-14

salem;15

(3) the President and the Secretary of State16

should publicly affirm as a matter of United States17

policy that Jerusalem must remain the undivided18

capital of the State of Israel;19

(4) the President should immediately implement20

the provisions of the Jerusalem Embassy Act of 21

1995 (Public Law 104–45) and begin the process of 22

relocating the United States Embassy in Israel to23

Jerusalem; and24

(5) United States officials should refrain from1

any actions that contradict United States law on2

this subject.3

(c) A MENDMENT OF  W AIVER  A UTHORITY.—The Je-4

rusalem Embassy Act of 1995 (Public Law 104–45) is5

amended—6

(1) by striking section 7; and7

(2) by redesignating section 8 as section 7.8

(d) IDENTIFICATION OF JERUSALEM ON GOVERN-9

MENT DOCUMENTS.—Notwithstanding any other provi-10

sion of law, any official document of the United States11

Government which lists countries and their capital cities12

shall identify Jerusalem as the capital of Israel.13

(e) RESTRICTION ON FUNDING SUBJECT TO OPEN-14

ING DETERMINATION.—Not more than 50 percent of the15

funds appropriated to the Department of State for fiscal16

 year 2013 for ‘‘Acquisition and Maintenance of Buildings17

 Abroad’’ may be obligated until the Secretary of State de-18

termines and reports to Congress that the United States19

Embassy in Jerusalem has officially opened.20

(f) FISCAL YEARS 2012  AND 2013 FUNDING.—21

(1) FISCAL YEAR 2012.—Of the funds author-22

ized to be appropriated for ‘‘Acquisition and Mainte-23

nance of Buildings Abroad’’ for the Department of 24

State for fiscal year 2012, such sums as may be nec-25

essary should be made available until expended only 1

for construction and other costs associated with the2

establishment of the United States Embassy in3

Israel in the capital of Jerusalem.4

(2) FISCAL YEAR 2013.—Of the funds author-5

ized to be appropriated for ‘‘Acquisition and Mainte-6

nance of Buildings Abroad’’ for the Department of 7

State for fiscal year 2013, such sums as may be nec-8

essary should be made available until expended only 9

for construction and other costs associated with the10

establishment of the United States Embassy in11

Israel in the capital of Jerusalem.12

(g) DEFINITION.—In this section, the term ‘‘United13

States Embassy’’ means the offices of the United States14

diplomatic mission and the residence of the United States15

chief of mission.16
