2019-21 Housing Trust Fund Program (40000036)28The appropriations in this section are subject to the following29

conditions and limitations:30(1) $129,050,000 of the state taxable building construction31

account—state appropriation and (($45,950,000)) $42,950,000 of the32state building construction account—state appropriation are provided33solely for production and preservation of affordable housing. Of the34amounts in this subsection:35

(a) $35,000,000 of the appropriation is provided solely for1housing projects that provide supportive housing and case-management2services to persons with ((behavioral or)) chronic mental illness.3When evaluating applications for this population, the department must4prioritize low-income supportive housing unit proposals that show:5

(i) Evidence that the application was developed in collaboration6with one or more health care entities that provide behavioral health7care services to individuals eligible for the housing provided under8this subsection;9

(ii) A commitment by the applicant to provide, directly or10through a formal partnership, necessary treatment and supportive11services to the tenants and maintain the beds or housing units for at12least a forty-year period;13

(iii) Readiness to begin structural modifications or construction14resulting in a fast project completion;15

(iv) Program requirements that adhere to the key elements of16permanent supportive housing programs including choice in housing and17living arrangements, functional separation of housing and services,18community integration, rights of tenancy, and voluntary recovery-19focused services; and20

(v) To achieve geographic distribution, the department must21prioritize projects in rural areas as defined by the department per22RCW 43.185.050 and unserved communities with the goal of maximizing23the investment and increasing the number of supportive housing units24in rural, unserved communities.25

(b) $10,000,000 of the appropriation in this section is provided26solely for competitive grant awards for modular housing which27includes high quality affordable housing projects that will quickly28move people from homelessness into secure housing and are29significantly less expensive to construct than traditional housing.30These funds must be awarded to projects with a total project31development cost per housing unit of less than $125,000, excluding32the value of land, off-site infrastructure costs, and any capitalized33reserves, compliant with the Americans with disabilities act, and34with a commitment by the applicant to maintain the housing units for35at least a fifty year period.36

(c) $10,000,000 of the appropriation in this section is provided37solely for a state match or state matches on private contributions38that fund the production and preservation of affordable housing.39Awards must be made using a competitive process. If any funding40

remains unallocated after the first fiscal year during the 2019-20211fiscal biennium, the department may allocate the remaining funding2through its annual competitive process for affordable housing3projects that serve and benefit low-income and special needs4populations in need of housing.5

(d)(i) $10,000,000 of the appropriation in this section is6provided solely for housing preservation grants or loans to be7awarded competitively.8

(ii) The funds may be provided for major building improvements,9preservation, and system replacements, necessary for the existing10housing trust fund portfolio to maintain long-term viability. The11department must require a capital needs assessment to be provided12prior to contract execution. Funds may not be used to add or expand13the capacity of the property.14

(iii) To allocate preservation funds, the department must review15applications and evaluate projects based on the following criteria:16

(A) The age of the property, with priority given to buildings17that are more than fifteen years old;18

(B) The population served, with priority given to projects with19at least 50 percent of the housing units being occupied by families20and individuals at or below 50 percent area median income;21

(C) The degree to which the applicant demonstrates that the22improvements will result in a reduction of operating or utilities23costs, or both;24

(D) The potential for additional years added to the affordability25period of the property; and26

(E) Other criteria that the department considers necessary to27achieve the purpose of this program.28

(e)(i) $7,000,000 of the appropriation in this section is29provided solely for loans or grants to design and construct ultra-30high energy efficient affordable housing projects.31

(ii) To receive funding, a project must provide a life-cycle cost32analysis report to the department and must demonstrate energy-saving33and renewable energy systems either designed to reach net-zero energy34use after housing is fully occupied or designed to achieve the most35recent building standard of the passive house institute US as of the36effective date of this section.37

(iii) The department must consider, at a minimum and in any38order, the following factors in assigning a numerical ranking to a39project:40

(A) Whether the proposed design has demonstrated that the project1will achieve either net-zero energy use when fully occupied or will2achieve the most recent building standard of the passive house3institute US as of the effective date of this section;4

(B) The life-cycle cost of the project;5(C) That the project demonstrates a design, use of materials, and6

construction process that can be replicated by the Washington7building industry;8

(D) The extent to which the project leverages nonstate funds;9(E) The extent to which the project is ready to proceed to10

construction;11(F) Whether the project promotes sustainable use of resources and12

environmental quality;13(G) Whether the project is being well managed to fund maintenance14

and capital depreciation;15(H) Reduction of housing and utilities carbon footprint; and16(I) Other criteria that the department considers necessary to17

achieve the purpose of this program.18(iv) The department must monitor and track the results of the19

housing projects that receive ultra-high energy efficiency funding20under this section.21

Broadway (Seattle) in (f) of this subsection is provided solely for6the purchase of the three south annex properties. The state board for7community and technical colleges must transfer the three south annex8properties located at 1530 Broadway, 1534 Broadway, and 909 East Pine9street in Seattle to Capitol Hill Housing to provide services and10housing for homeless youth or young adults for a minimum of fifty11years. The transfer agreement between the state board for community12and technical colleges and Capitol Hill Housing must specify a13mutually agreed transfer date and require Capitol Hill Housing to14cover any closing costs with a total purchase price of nine million15dollars for all three properties. The contract between the department16and Capitol Hill Housing must provide that Capitol Hill Housing will17be responsible for maintaining and securing the property until it is18developed. The contract must also specify that, if Capitol Hill19Housing does not construct at least seventy affordable housing units20on the site by 2028, this funding must be fully repaid to the state21or the land must revert back to the state.22

(h) $57,050,000 of the appropriation in this section is provided23solely for affordable housing projects that serve and benefit low-24income and special needs populations in need of housing. Of the25amounts appropriated in this subsection, the department must allocate26the funds as follows:27

(i) $5,000,000 of the appropriation in this section is provided28solely for housing for veterans;29

(ii) $5,000,000 of the appropriation in this section is provided30solely for housing that serves people with developmental31disabilities;32

(iii) $5,000,000 of the appropriation in this section is provided33solely for housing that serves people who are employed as34farmworkers; and35

(iv)(A) $5,000,000 of the appropriation in this section is36provided solely for housing projects that benefit homeownership.37

(B) During the 2019-2021 fiscal biennium, the department must use38a separate application form for applications to provide homeownership39

opportunities and evaluate homeownership project applications as1allowed under chapter 43.185A RCW.2

(C) In addition to the definition of "first-time home buyer" in3RCW 43.185A.010, for the purposes of awarding homeownership projects4during the 2019-2021 fiscal biennium "first time home buyer" also5includes:6

(I) A single parent who has only owned a home with a former7spouse while married;8

(II) An individual who is a displaced homemaker as defined in 249C.F.R. Sec. 93.2 as it existed on the effective date of this section,10or such subsequent date as may be provided by the department by rule,11consistent with the purposes of this section, and has only owned a12home with a spouse;13

(III) An individual who has only owned a principal residence not14permanently affixed to a permanent foundation in accordance with15applicable regulations; or16

(IV) An individual who has only owned a property that is17discerned by a licensed building inspector as being uninhabitable.18

(2) In evaluating projects in this section, the department must19give preference for applications based on some or all of the criteria20in RCW 43.185.070(5).21

(3)(a) The department must strive to allocate all of the amounts22appropriated in this section within the 2019-2021 fiscal biennium in23the manner prescribed in subsection (1) of this section. However, if24upon review of applications the department determines there are not25adequate suitable projects in a category, the department may allocate26funds to projects serving other low-income and special needs27populations, provided those projects are located in an area with an28identified need for the type of housing proposed.29

(b) By June 30, 2021, the department must report on its web site30the following for every previous funding cycle: The number of31homeownership and multifamily rental projects funded by housing trust32fund moneys; the percentage of housing trust fund investments made to33homeownership and multifamily rental projects; and the total number34of households being served at up to eighty percent of the area median35income, up to fifty percent of the area median income, and up to36thirty percent of the area median income, for both homeownership and37multifamily rental projects.38

(4)(a) The department, in cooperation with the housing finance39commission, must develop and implement a process for the collection40

of certified final development cost data from each grant or loan1recipient under this section. The department must use this data as2part of its cost containment policy.3

(b) Beginning December 1, 2019, and continuing annually, the4department must provide the legislature with a report of its final5cost data for each project under this section. Such cost data must,6at a minimum, include total development cost per unit for each7project completed within the past year, descriptive statistics such8as average and median per unit costs, regional cost variation, and9other costs that the department deems necessary to improve cost10controls and enhance understanding of development costs. The11department must coordinate with the housing finance commission to12identify relevant development costs data and ensure that the measures13are consistent across relevant agencies.14

(5) $10,000,000 of the state building construction account—state15appropriation is provided solely for the preservation of affordable16multifamily housing at risk of losing affordability due to expiration17of use restrictions that otherwise require affordability, including,18but not limited to, United States department of agriculture funded19multifamily housing.20

(a) Within the amount provided in this subsection (5), the21department must implement necessary procedures no later than July 1,222020, to enable rapid commitment of funds on a first-come, first-23served basis to qualifying project proposals that satisfy the goal of24long-term preservation of Washington's affordable multifamily housing25stock, particularly in rural areas of the state.26

(b) The department must adhere to the following award terms and27procedures for the rapid response program created with this28appropriation:29

(i) The department shall evaluate applications for funding based30on some or all of the criteria in RCW 43.185.070(5).31

(ii) The funding is not subject to the ninety-day application32periods in RCW 43.185.070 or 43.185A.050.33

(iii) Awards must be in the form of a recoverable grant with a34forty-year low income housing covenant on the land.35

(iv) If a capital needs assessment is required, the department36must work with the applicant to ensure that this does not create an37unnecessary impediment to rapidly accessing these funds.38

(v) Awards may be used for acquisition, or for acquisition and39rehabilitation of, properties to preserve the affordable housing40

units beyond existing use restrictions and keep them in Washington's1housing portfolio.2

(vi) No single award may exceed $2,500,000, although the3department must consider waivers of this award cap if an applicant4demonstrates sufficient need. If the department receives simultaneous5applications for funding under this program, proposals that reach the6greatest public benefit, as defined by the department, must be7prioritized. For purposes of this subsection (5), "greatest public8benefit" includes, but is not limited to:9

(A) The greatest number of units that will be preserved;10(B) Whether the project has federally funded rental assistance11

tied to it;12(C) The scarcity of the affordable housing applied for compared13

to the number of available affordable housing units in the same14geographic location; and15

(D) The program's established funding priorities under RCW1643.185.070(5).17

(vii) The award limit in (vi) of this subsection (5) may only be18applied to the awards provided under this subsection (5). The amount19awarded from this subsection (5) may not be calculated in award20limitations for other housing trust fund awards.21Appropriation:22

Clean Energy Transition 4 (40000042)9The appropriations in this section are subject to the following10

conditions and limitations:11(1) The appropriations are provided solely for projects that12

provide a benefit to the public through development, demonstration,13and deployment of clean energy technologies that save energy and14reduce energy costs, reduce harmful air emissions, or increase energy15independence for the state. Priority must be given to projects that16benefit vulnerable populations, including tribes and communities with17high environmental or energy burden.18

(2) In soliciting and evaluating proposals, awarding contracts,19and monitoring projects under this section, the department must:20

(a) Ensure that competitive processes, rather than sole source21contracting processes, are used to select all projects, except as22otherwise noted in this section; and23

(b) Conduct due diligence activities associated with the use of24public funds including, but not limited to, oversight of the project25selection process, project monitoring, and ensuring that all26applications and contracts fully comply with all applicable laws27including disclosure and conflict of interest statutes.28

(3)(a) Pursuant to chapter 42.52 RCW, the ethics in public29service act, the department must require a project applicant to30identify in application materials any state of Washington employees31or former state employees employed by the firm or on the firm's32governing board during the past twenty-four months. Application33materials must identify the individual by name, the agency previously34or currently employing the individual, job title or position held,35and separation date. If it is determined by the department that a36conflict of interest exists, the applicant may be disqualified from37further consideration for award of funding.38

(b) If the department finds, after due notice and examination,1that there is a violation of chapter 42.52 RCW, or any similar2statute involving a grantee who received funding under this section,3either in procuring or performing under the grant, the department in4its sole discretion may terminate the funding grant by written5notice. If the grant is terminated, the department must reserve its6right to pursue all available remedies under law to address the7violation.8

(4) The requirements in subsections (2) and (3) of this section9must be specified in funding agreements issued by the department.10

(5) $6,107,000 of the state building construction account—state11appropriation is provided solely for grid modernization grants for12projects that: Advance clean and renewable energy technologies and13transmission and distribution control systems; support integration of14renewable energy sources, deployment of distributed energy resources,15and sustainable microgrids; and increase utility customer options for16energy sources, energy efficiency, energy equipment, and utility17services.18

(a) Projects must be implemented by public and private electrical19utilities that serve retail customers in the state. Priority must be20given to: (i) Projects that benefit vulnerable populations, including21tribes and communities with high environmental or energy burden; and22(ii) projects that have a partner that is a tribe or nonprofit23organization that serves community eligible entities. Utilities may24partner with other public and private sector research organizations,25businesses, tribes, and nonprofit organizations in applying for26funding.27

(b) The department shall develop a grant application process to28competitively select projects for grant awards, to include scoring29conducted by a group of qualified experts with application of30criteria specified by the department. In development of the31application criteria, the department shall, to the extent possible,32allow smaller utilities or consortia of small utilities to apply for33funding.34

(c) Applications for grants must disclose all sources of public35funds invested in a project.36

(d) $4,400,000 of the state building construction account—state37appropriation is provided solely for providing shore power38electrification at terminal five for the northwest seaport alliance.39In order to receive this grant, the northwest seaport alliance must40

demonstrate that they applied to the VW settlement for this project1and were denied.2

(6)(a) $8,100,000 of the state building construction account—3state appropriation is provided solely for competitive grants for4strategic research and development for new and emerging clean energy5technologies. These grants will be used to match federal or other6nonstate funds to research, develop, and demonstrate clean energy7technologies.8

(b) The department shall consult and coordinate with the9University of Washington, Washington State University, the Pacific10Northwest national laboratory and other clean energy organizations to11design the grant program. Clean energy organizations who compete for12grants from the program may not participate in the design of the13grant program. Criteria for the grant program must include life cycle14cost analysis for projects that are part of the competitive process.15

(c) The program may include, but is not limited to: Solar16technologies, advanced bioenergy and biofuels, development of new17earth abundant materials or lightweight materials, advanced energy18storage, battery components recycling, and new renewable energy and19energy efficiency technologies.20

(d) $1,000,000 of the state building construction account—state21appropriation is provided solely for grants that enhance the22viability of dairy digester bioenergy projects, energy efficiency,23and resource recovery to demonstrate advanced nutrient recovery24systems that produce value added biofertilizers, reduce trucking of25lagoon water, and improve soil health and air and water quality.26Grants shall include at least one project east of the Cascades and27one project west of the Cascades. State agencies must promote and28demonstrate the use of such recovered biofertilizers through state29procurement and contracts.30

(7)(a) $3,000,000 of the state taxable building construction31account—state appropriation is provided solely as grants to nonprofit32lenders to create a revolving loan fund to support the widespread use33of proven energy efficiency and renewable energy technologies by34households with high energy burden or environmental health risk now35inhibited by lack of access to capital.36

(b) The department shall provide grant funds to one or more37competitively selected nonprofit lenders that will provide matching38private capital and will administer the loan fund. The department39

must select the loan fund administrator or administrators through a1competitive process, with scoring conducted by a group of qualified2experts, applying criteria specified by the department.3

(c) The department must establish guidelines that specify4applicant eligibility, the screening process, and evaluation and5selection criteria. The guidelines must be used by the nonprofit6lenders.7

(8) $5,000,000 of the state building construction account—state8appropriation is provided solely for the Washington Maritime9Innovation Center. The center must be used to support technology10acceleration and incubation, and act as a focal point for maritime11sustainability, including, but not limited to, supporting technology12development for maritime decarbonization and electrification.13

(9) $8,300,000 of the state taxable construction account—state14appropriation is provided solely for scientific instruments to help15accelerate research in grid-scale energy storage at the proposed16grid-scale energy storage research, development, and testing facility17at the Pacific Northwest national laboratory. The state funds are18contingent on securing federal funds for the new facility, and are19provided as a match to the federal funding. The instruments will20support collaborations with the University of Washington and the21Washington State University.22

(10) $593,000 of the state building construction account—state23appropriation is provided solely to the port of Grays Harbor for an24offshore ocean wave renewable energy demonstration project.25

(11) $1,500,000 of the state building construction account—state26appropriation is provided solely to the ((Port of)) Skagit county27public works department for the Guemes ferry dock shore power28charging infrastructure.29Appropriation:30

FOR THE DEPARTMENT OF COMMERCE12019-21 Behavioral Health Capacity Grants (40000114)2The appropriation in this section is subject to the following3

conditions and limitations:4(1) The appropriation in this section is provided solely for the5

department of commerce to issue grants to community hospitals or6other community providers to expand and establish new capacity for7behavioral health services in communities. The department of commerce8must consult an advisory group consisting of representatives from the9department of social and health services, the health care authority,10one representative from a managed care organization, one11representative from an accountable care organization, and one12representative from the association of county human services. Amounts13provided in this section may be used for construction and equipment14costs associated with establishment of the facilities. The department15of commerce may approve funding for the acquisition of a facility or16land if the project results in increased capacity. Amounts provided17in this section may not be used for operating costs associated with18the treatment of patients using these services.19

(2) The department must establish criteria for the issuance of20the grants, which must include:21

(a) Evidence that the application was developed in collaboration22with one or more regional behavioral health entities that administer23the purchasing of services;24

(b) Evidence that the applicant has assessed and would meet gaps25in geographical behavioral health services needs in their region;26

(c) Evidence that the applicant is able to meet applicable27licensing and certification requirements in the facility that will be28used to provide services;29

(d) A commitment by applicants to serve persons who are publicly30funded and persons detained under the involuntary treatment act under31chapter 71.05 RCW;32

(e) A commitment by the applicant to maintain and operate the33beds or facility for a time period commensurate to the state34investment, but for at least a fifteen-year period;35

(f) The date upon which structural modifications or construction36would begin and the anticipated date of completion of the project;37

(g) A detailed estimate of the costs associated with opening the38beds;39

(h) A financial plan demonstrating the ability to maintain and1operate the facility; and2

(i) The applicant's commitment to work with local courts and3prosecutors to ensure that prosecutors and courts in the area served4by the hospital or facility will be available to conduct involuntary5commitment hearings and proceedings under chapter 71.05 RCW.6

(3) In awarding funding for projects in subsection (5) of this7section, the department, in consultation with the advisory group8established in subsection (1) of this section, must strive for9geographic distribution and allocate funding based on population and10service needs of an area. The department must consider current11services available, anticipated services available based on projects12underway, and the service delivery needs of an area.13

(4) The department must prioritize projects that increase14capacity in unserved and underserved areas of the state.15

(5) $47,000,000 is provided solely for a competitive process for16each category listed and is subject to the criteria in subsections17(1), (2), (3), and (4) of this section:18

(a) $4,000,000 is provided solely for at least two enhanced19service facilities for long-term placement of patients discharged or20diverted from the state psychiatric hospitals and that are not21subject to federal funding restrictions that apply to institutions of22mental diseases;23

(b) $10,000,000 is provided solely for enhanced adult residential24care facilities for long-term placements of dementia discharged or25diverted from the state psychiatric hospitals and are not subject to26federal funding restrictions that apply to institutions of mental27diseases;28

(c) $4,000,000 is provided solely for at least two facilities29with secure withdrawal management and stabilization treatment beds30that are not subject to federal funding restrictions that apply to31institutions of mental diseases;32

(d) $2,000,000 is provided solely for one or more crisis33diversion or stabilization facilities to add sixteen beds in the34Spokane region that will address both urban and rural needs,35consistent with the settlement agreement in A.B, by and through36Trueblood, et al., v. DSHS, et al. and that are not subject to37federal funding restrictions that apply to institutions of mental38diseases;39

(e) $5,000,000 is provided solely for at least four mental health1peer respite centers that are not subject to federal funding2restrictions that apply to institutions of mental diseases. No more3than one mental health peer respite center should be funded in each4of the nine regions;5

(f) $8,000,000 is provided solely for the department to provide6grants to community hospitals, freestanding evaluation and treatment7providers, or freestanding psychiatric hospitals to develop capacity8for beds to serve individuals on ninety-day or one hundred eighty-day9civil commitments as an alternative to treatment in the state10hospitals. In awarding this funding, the department must coordinate11with the department of social and health services, the health care12authority, and the department of health and must only select13facilities that meet the following conditions:14

(i) The funding must be used to increase capacity related to15serving individuals who will be transitioned from or diverted from16the state hospitals;17

(ii) The facility is not subject to federal funding restrictions18that apply to institutions of mental diseases;19

(iii) The provider has submitted a proposal for operating the20facility to the health care authority;21

(iv) The provider has demonstrated to the department of health22and the health care authority that it is able to meet the applicable23licensing and certification requirements for the facility that will24be used to provide services; and25

(v) The health care authority has confirmed that it intends to26contract with the facility for operating costs within funds provided27in the omnibus operating appropriations act for these purposes.28

(g) $4,000,000 is provided solely for competitive community29behavioral health grants to address regional needs;30

(h) $8,000,000 is provided solely for at least four intensive31behavioral health treatment facilities for long-term placement of32behavioral health patients with complex needs and that are not33subject to federal funding restrictions that apply to institutions of34mental diseases; and35

(i) $2,000,000 is provided solely for grants to community36providers to increase behavioral health services and capacity for37children and minor youth including, but not limited to, services for38substance use disorder treatment, sexual assault and traumatic39stress, anxiety, or depression, and interventions for children40

exhibiting aggressive or depressive behaviors in facilities that are1not subject to federal funding restrictions. Consideration must be2given to programs that incorporate outreach and treatment for youth3dealing with mental health or social isolation issues.4

(6) $1,000,000 of the state taxable building construction account5—state is provided solely for deposit into the revolving fund6established in Second Substitute House Bill No. 1528 (recovery7support services) for capital improvements. (((11))) (10) To accommodate the emergent need for behavioral25health services, the department of health and the department of26commerce, in collaboration with the health care authority and the27department of social and health services, must establish a concurrent28and expedited process to assist grant applicants in meeting any29applicable regulatory requirements necessary to operate inpatient30psychiatric beds, freestanding evaluation and treatment facilities,31enhanced services facilities, triage facilities, crisis stabilization32facilities, or secure detoxification/secure withdrawal management and33stabilization facilities.34

(((12))) (11) The department must strive to allocate all of the35amounts appropriated within subsection (5) of this section in the36manner prescribed. However, if upon review of applications, the37department determines, in consultation with the advisory group38established in subsection (1) of this section, that there are not39adequate suitable projects in a category, the department may allocate40

funds to other behavioral health capacity project categories within1subsection (5) of this section, prioritizing projects in unserved2areas of the state.3

(((13))) (12) The department must provide a progress report by4November 1, 2020. The report must include:5

(a) The total number of applications and amount of funding6requested;7

(b) A list and description of the projects approved for funding8including state funding, total project cost, services anticipated to9be provided, bed capacity, and anticipated completion date; and10

2020 Local and Community Projects (40000116)26The appropriation in this section is subject to the following27

conditions and limitations:28(1) The department shall not expend the appropriation in this29

section unless and until the nonstate share of project costs have30been either expended or firmly committed, or both, in an amount31sufficient to complete the project or a distinct phase of the project32that is useable to the public for the purpose intended by the33legislature. This requirement does not apply to projects where a34share of the appropriation is for design costs only.35

(2) Prior to receiving funds, project recipients must demonstrate36that the project site is under control for a minimum of ten years,37either through ownership or a long-term lease. This requirement does38

not apply to appropriations for preconstruction activities or1appropriations in which the sole purpose is to purchase real property2that does not include a construction or renovation component.3

(3) Projects funded in this section may be required to comply4with Washington's high performance building standards as required by5chapter 39.35D RCW.6

(4) Project funds are available on a reimbursement basis only,7and shall not be advanced under any circumstances.8

(5) In contracts for grants authorized under this section the9department shall include provisions which require that capital10improvements be held by the grantee for a specified period of time11appropriate to the amount of the grant and that facilities be used12for the express purpose of the grant. If the grantee is found to be13out of compliance with provisions of the contract, the grantee shall14repay to the state general fund the principal amount of the grant15plus interest calculated at the rate of interest on state of16Washington general obligation bonds issued most closely to the date17of authorization of the grant.18

(6) Projects funded in this section, including those that are19owned and operated by nonprofit organizations, are generally required20to pay state prevailing wages.21

2021 Local and Community Projects (40000130)1The appropriation in this section is subject to the following2

(a) The superintendent of public instruction must appoint an1advisory committee, which must include at least one representative2from the department of natural resources, whose members have3experience in seismic engineering and construction to assist the4office in designing the grant application process, developing the5prioritization criteria, and evaluating the grant applications.6Advisory committee members may not be involved in developing projects7or applying for grants funded in this section.8

(b) In addition to prioritization criteria developed by the9office of the superintendent of public instruction and the advisory10committee pursuant to (a) of this subsection, the superintendent of11public instruction and the advisory committee must also prioritize12projects that: (i) Are located in areas of high seismic risk; (ii)13have ten or more years of remaining useful life; and (iii) meet the14criteria to participate in the school construction assistance program15except in cases where low property values prevent a school district16from generating sufficient local revenue.17

(c) The superintendent of public instruction must submit a list18of school seismic safety retrofit projects, as prioritized by the19advisory committee, to the legislature by January 15, 2021. The list20must include: (i) A description of the project; (ii) the proposed21state funding level, not to exceed $4,000,000; (iii) estimated total22project costs; and (iv) local funding resources. The appropriated23funds in this subsection may be awarded only after the legislature24approves the list.25

(2) For projects in this section that are also eligible for26funding through the school construction assistance program, the27office of the superintendent of public instruction must expedite and28streamline the administrative requirements, timelines, and matching29requirements for the funds provided in this section to be used30promptly. Funds provided in this section plus state funds provided in31the school construction assistance program grant may not exceed total32project costs minus available local resources.33

(3) $1,800,000 of the appropriation is provided solely for grants34to school districts to perform rapid visual screening assessments of35school buildings constructed prior to January 1, 1997, and used for36the instruction of students in kindergarten through twelfth grade.37The office of the superintendent of public instruction must enter the38collected assessment data into its information and condition of39schools data system.40

2019-21 Small District Modernization Grants (92000139)19The appropriation in this section is subject to the following20

conditions and limitations:21(1) The legislature finds that small school districts with total22

enrollments of one thousand students or less may have school23facilities with significant building systems deficiencies and low24property values, and that raising enough funds to participate in the25school construction assistance program to replace or modernize their26school facilities would present an extraordinary tax burden on27property owners or would exceed allowable debt.28

(2) $200,000 of the appropriation is provided solely for the29office of the superintendent of public instruction to administer the30grant program and provide technical assistance to small school31districts seeking grants funded in this section.32

(3) (($1,000,000)) $957,000 of the appropriation is provided33solely for planning grants for small school districts interested in34seeking modernization grants in subsection (4) of this section. The35superintendent may prioritize planning grants for school districts36with the most serious building deficiencies and the most limited37

financial capacity. Planning grants may not exceed $50,000 per1district.2

(4) The remaining portion of the appropriation is provided solely3for modernization grants for small school districts with significant4building system deficiencies and limited financial capacity with the5following conditions:6

(a) The superintendent of public instruction must appoint an7advisory committee whose members have experience in financing and8managing school facilities in small school districts to assist the9office in designing the grant application process, developing the10prioritization criteria, and evaluating the grant applications.11Advisory committee members may not be involved in developing projects12or applying for grants funded in this section.13

(c) The superintendent must submit a list of small school23district modernization projects, as prioritized by the advisory24committee, to the legislature by January 15, 2020. The list must25include: (i) A description of the project; (ii) the proposed state26funding level, not to exceed $5,000,000; (iii) estimated total27project costs; and (iv) local funding resources. The appropriated28funds in this subsection may be awarded ((only after the legislature29approves the list)) to projects approved by the legislature, as30identified in LEAP capital document No. 2020-51, developed February3112, 2020.32

The grant recipient must be12a regional nonprofit nature conservancy that works to conserve13keystone properties selected by the city of Federal Way.14

(10)(a) $900,000 of the appropriation in this section is provided15solely for an Interbay public development advisory committee. It is16the intent of the legislature to examine current and future needs of17a state entity that performs an essential public function on state-18owned property located in one of the state's designated manufacturing19industrial centers. The legislature further intends to explore the20potential future uses of this state-owned property in the event that21the state entity determines that it must relocate in order to protect22its ability to perform its essential public function.23

(b) The Interbay public development advisory committee is created24to make recommendations regarding the highest public benefit and25future economic development uses for the Washington army national26guard armory facility in the city of Seattle, pier 91 property,27located at the descriptions referred to in the quit claim deeds for28two parcels of land, 24.75 acres total, dated January 8, 1971, and29December 22, 2009.30

(c) The Interbay advisory committee consists of seven persons31appointed as follows:32

(i) One person appointed by the speaker of the house of33representatives;34

(ii) One person appointed by the president of the senate; and35(iii) Five persons appointed by the governor, who must36

collectively have experience in forming public-private partnerships37to develop workforce housing or affordable housing; knowledge of38project financing options for public-private partnerships related to39

housing; architectural design and development experience related to1industrial lands and mixed-use zoning to include housing; and2experience leading public processes to engage communities and other3stakeholders in public discussions regarding economic development4decisions.5

(d) The Interbay public development advisory committee must:6(i) Work in collaboration with the military department to7

determine the needs of the military department if it is relocated8from the land described in subsection (1) of this section, including9identifying:10

(A) Current uses;11(B) Future needs of the units currently at this location;12(C) Potential suitable publicly owned sites in Washington for13

relocation of current units; and14(D) The costs associated with acquisition, construction, and15

relocation to another site or sites for these units;16(ii) Explore the future economic development opportunities if the17

land described in subsection (1) of this section is vacated by the18military department, and make recommendations, including identifying:19

(A) Suitable and unsuitable future uses for the land;20(B) Environmental issues and associated costs;21(C) Current public infrastructure availability, future public22

infrastructure plans by local or regional entities, and potential23public infrastructure needs;24

(D) Transportation corridors in the immediate area and any25potential right-of-way needs; and26

(E) Existing zoning regulations for the land and potential future27zoning needs to evaluate workforce housing, affordable housing, and28other commercial and industrial development compatible with the29Ballard-Interbay manufacturing industrial center designation;30

(iii) Explore the potential funding sources and partners as well31as any needed transactions, and make recommendations, including:32

(A) Any potential private partners or investors;33(B) Necessary real estate transactions;34(C) Federal funding opportunities; and35(D) State and local funding sources, including any tax-related36

programs; and37(iv) Conduct at least three public meetings at a location within38

the Ballard-Interbay manufacturing industrial center, where a quorum39of the Interbay public development advisory committee members are40

present, at which members of the public are invited to present to the1Interbay advisory committee regarding the future uses of the site and2potential issues such as industrial land use, commercial development,3residential zoning, and public infrastructure needs.4

(e) Nothing in this section authorizes the solicitation of5interest or bids for work related to the purposes of this section.6

(f) The department of commerce shall provide staff support to the7Interbay advisory committee. The department may contract with outside8consultants to provide any needed expertise.9

(g) Legislative members of the Interbay advisory committee are10reimbursed for travel in accordance with RCW 44.04.120.11Nonlegislative members are not entitled to be reimbursed for travel12expenses if they are elected officials or are participating on behalf13of an employer, governmental entity, or other organization. Any14reimbursement for other nonlegislative members is subject to chapter1543.03 RCW.16

(11) $2,000,000 of the appropriation in this section is provided17solely to the city of Lakewood for the purchase of property within18the federally designated north clear zone at joint base Lewis-19McChord. Once acquired, the property must be zoned for use compatible20with the mission and activity of McChord airfield. The city may lease21or resell the acquired property for fair market value, but any such22lease or sale must include restrictions or covenants ensuring that23the use of the property is safely compatible with the mission and24activity of McChord airfield. If the city subsequently resells,25rezones, develops, or leases the property for commercial or26industrial uses contrary to the allowed uses in the north clear zone,27the city must repay to the state the amount spent on the purchase of28the property in its entirety within ten years.29

(12) $250,000 of the appropriation in this section is provided30solely for a grant to the Federal Way chamber of commerce for two31economic development projects focused in the south Puget Sound area.32The amounts in this section must be used for a business retention and33expansion program to conduct economic research in collaboration with34stakeholders, develop data-driven economic strategies, and produce a35written evaluation; and a tourism enhancement program to develop and36inventory the Federal Way area tourism sector, analyze data regarding37visitation, and produce a written evaluation.38

(13) $400,000 of the appropriation in this section is provided1solely for the Northshore athletic field which shall be named "Andy2Hill Sports Complex."3

(14) $1,177,000 of the appropriation in this section is provided4solely for the Harmony sports complex infrastructure and safety5improvements in Vancouver and is contingent upon the facility being6open to the public.7

(15) $250,000 of the appropriation in this section is provided8solely for the Asia Pacific cultural center in Tacoma. It is the9intent of the legislature that beyond the 2017-2019 fiscal biennium10no state funding is provided to the Asia Pacific cultural center in11Tacoma.12Appropriation:13

2017-19 Housing Trust Fund Program (30000872)23The appropriations in this section are subject to the following24

conditions and limitations:25(1) $83,500,000 of the state taxable building construction26

account—state appropriation, $19,631,000 of the state building27construction account—state appropriation, and $8,658,000 of the28Washington housing trust account—state appropriation are provided29solely for affordable housing and preservation of affordable housing.30Of the amounts in this subsection:31

(a) $24,370,000 is provided solely for housing projects that32provide supportive housing and case-management services to persons33with chronic mental illness. The department must prioritize low-34income supportive housing unit proposals that provide services or35include a partner community behavioral health treatment provider;36

(b) $10,000,000 is provided solely for housing preservation1grants or loans to be awarded competitively. The grants may be2provided for major building improvements, preservation, and system3replacements, necessary for the existing housing trust fund portfolio4to maintain long-term viability. The department must require that a5capital needs assessment is performed to estimate the cost of the6preservation project at contract execution. Funds may not be used to7add or expand the capacity of the property. To receive grants,8housing projects must meet the following requirements:9

(i) The property is more than fifteen years old;10(ii) At least 50 percent of the housing units are occupied by11

families and individuals at or below 30 percent area median income.12(iii) The improvements will result in reduction of operating or13

utilities costs, or both; and14(iv) Other criteria that the department considers necessary to15

achieve the purpose of this program.16(c) $5,000,000 is provided solely for housing projects that17

benefit people at or below 80 percent of the area median income who18have been displaced by a natural disaster declared by the governor,19including people who have been displaced within the last two biennia.20

(d) $1,000,000 of the Washington housing trust account—state21appropriation is provided solely for the department to work with the22communities of concern commission to focus on creating capital assets23that will help reduce poverty and build stronger and more sustainable24communities using the communities' cultural understanding and vision.25The funding must be used for predevelopment costs for capital26projects identified by the commission and for other activities to27assist communities in developing capacity to create community-owned28capital assets.29

(e) $1,000,000 of the Washington housing trust account—state30appropriation and $1,500,000 of the state taxable building31construction account—state appropriation are provided solely for the32purchase of the three south annex properties. The state board for33community and technical colleges must transfer the three south annex34properties located at 1530 Broadway, 1534 Broadway, and 909 East Pine35street to ((one or more nonprofits or public development authorities36selected by the department, if the selected entities agree to use the37properties)) Capitol Hill Housing to provide services and housing for38homeless youth or young adults for a minimum of ((twenty-five)) fifty39

years. The transfer agreement between the state board for community1and technical colleges and ((the selected entities)) Capitol Hill2Housing must specify a mutually agreed transfer date and require3((the selected entities)) Capitol Hill Housing to cover any closing4costs with a total purchase price of nine million dollars for all5three properties. The contract between the department and Capitol6Hill Housing must provide that Capitol Hill Housing will be7responsible for maintaining and securing the property until it is8developed. The contract must also specify that, if Capitol Hill9Housing does not construct at least seventy affordable housing units10on the site by 2028, this funding must be fully repaid to the state11or the land must revert back to the state.12

(f) $25,506,000 is provided solely for the following list of13housing projects:14

(x) $6,000,000 is provided solely for grants for high quality29low-income housing projects that will quickly move people from30homelessness into secure housing, and are significantly less31expensive to construct than traditional housing. It is the intent of32the legislature that these grants serve projects with a total project33development cost per housing unit of less than (($125,000)) $135,000,34excluding the value of land, and with a commitment by the applicant35to maintain the housing units for at least a twenty-five year period.36Amounts provided that are subject to this subsection must be used to37plan, predesign, design, provide technical assistance and financial38services, purchase land for, and build innovative low-income housing39units. $3,000,000 of the appropriation that is subject to this40

subsection is provided solely for innovative affordable housing in1Shelton and $3,000,000 of the appropriation that is subject to this2subsection is provided solely for innovative affordable housing for3veterans in Orting. Mental health and substance abuse counseling4services must be offered to residents of housing projects supported5by appropriations in this subsection. $500,000 of the appropriation6for housing units in Shelton can be released for purchase of land,7planning, or predesign services before the project is fully funded.8$500,000 of the appropriation for housing units in Orting can be9released for purchase of land, planning, or predesign services before10the project is fully funded.11

(xi) $7,290,000 is provided solely for grants to the following12organizations using innovative methods to address homelessness:13$4,290,000 for THA Arlington drive youth campus in Tacoma and14$3,000,000 for a King county housing project.15

(xii) $1,500,000 is provided solely for Valley Cities modular16housing project in Auburn.17

(g) Of the amounts appropriated remaining after (a) through (f)18of this subsection, the department must allocate the funds as19follows:20

(i) 10 percent is provided solely for housing projects that21benefit veterans;22

(ii) 10 percent is provided solely for housing projects that23benefit homeownership;24

(iii) 5 percent is provided solely for housing projects that25benefit people with developmental disabilities;26

(iv) The remaining amount is provided solely for projects that27serve low-income and special needs populations in need of housing,28including, but not limited to, homeless families with children,29homeless youth, farmworkers, and seniors.30

(2) In evaluating projects in this section, the department must31give preference for applications based on some or all of the criteria32in RCW 43.185.070(5).33

(3) The department must strive to allocate all of the amounts34appropriated in this section within the 2017-2019 fiscal biennium in35the manner prescribed in subsection (1) of this section. However, if36upon review of applications the department determines there are not37adequate suitable projects in a category, the department may allocate38funds to projects serving other low-income and special needs39

RCW 43.88.031 requires the disclosure of the estimated debt5service costs associated with new capital bond appropriations. The6estimated debt service costs for the appropriations contained in this7act are ((forty-eight million six hundred eighteen thousand two8hundred eighteen dollars for the 2019-2021 biennium, three hundred9six million nine hundred two thousand nine hundred ninety-six dollars10for the 2021-2023 biennium, and four hundred thirty-three million two11hundred fifty-nine thousand five hundred seventy-three dollars for12the 2023-2025 biennium)) forty-three million three hundred fourteen13thousand six hundred forty-two dollars for the 2019-2021 biennium,14three hundred million four hundred twenty-two thousand three hundred15forty-three dollars for the 2021-2023 biennium, and four hundred16seventeen million four hundred fifty-five thousand six hundred sixty17dollars for the 2023-2025 biennium.18


ACQUISITION OF PROPERTIES AND FACILITIES THROUGH FINANCIAL21CONTRACTS. (1) The following agencies may enter into financial22contracts, paid from any funds of an agency, appropriated or23nonappropriated, for the purposes indicated and in not more than the24principal amounts indicated, plus financing expenses and required25reserves pursuant to chapter 39.94 RCW. When securing properties26under this section, agencies shall use the most economical financial27contract option available, including long-term leases, lease-purchase28agreements, lease-development with option to purchase agreements or29financial contracts using certificates of participation. Expenditures30made by an agency for one of the indicated purposes before the issue31date of the authorized financial contract and any certificates of32participation therein are intended to be reimbursed from proceeds of33the financial contract and any certificates of participation therein34to the extent provided in the agency's financing plan approved by the35state finance committee.36

(2) Those noninstructional facilities of higher education37institutions authorized in this section to enter into financial38

contracts are not eligible for state funded maintenance and1operations. Instructional space that is available for regularly2scheduled classes for academic transfer, basic skills, and workforce3training programs may be eligible for state funded maintenance and4operations.5

(3) Secretary of state: Enter into a financing contract for up to6$103,143,000 plus financing expenses and required reserves pursuant7to chapter 39.94 RCW to construct a new library-archives building.8

(4) Washington state patrol: Enter into a financing contract for9up to $7,450,000 plus financing expenses and required reserves10pursuant to chapter 39.94 RCW to construct a burn building for live11fire training.12

(5) Department of social and health services: Enter into a13financing contract for up to $3,600,000 plus financing expenses and14required reserves pursuant to chapter 39.94 RCW to purchase the King15county secure community transition center.16

(6) Department of social and health services: Enter into a17financing contract for up to $118,000,000 plus costs and financing18expenses and required reserves pursuant to chapter 39.94 RCW to19design and construct a nursing facility on the Fircrest Residential20Habilitation Center campus on the existing adult training program21site. The department may contract to lease develop or lease purchase22the facility. Before entering into a contract, the department must23consult with the office of financial management and the office of the24state treasurer. Should the department of social and health services25choose to use a financing contract that does not provide for the26issuance of certificates of participation, the financing contract27shall be subject to approval by the state finance committee as28required by RCW 39.94.010. In approving a financing contract not29providing for the use of certificates of participation, the state30finance committee should be reasonably certain that the contract is31excluded from the computation of indebtedness, particularly that the32contract is not backed by the full faith and credit of the state and33the legislature is expressly not obligated to appropriate funds to34make payments. For purposes of this subsection, "financing contract"35includes but is not limited to a certificate of participation and tax36exempt financing similar to that authorized in RCW 47.79.140.37

(7) Department of fish and wildlife: Enter into a financing38contract for up to $3,099,000 plus financing expenses and required39

reserves pursuant to chapter 39.94 RCW to purchase automated salmon1marking trailers.2

(((7))) (8) Department of natural resources: Enter into a3financing contract for up to $1,800,000 plus financing expenses and4required reserves pursuant to chapter 39.94 RCW to remodel spaces5within agency-owned commercial buildings that will benefit the common6school trust.7

(((8))) (9) Western Washington University: Enter into a financing8contract for up to $9,950,000 plus financing expenses and required9reserves pursuant to chapter 39.94 RCW to construct a consolidated10academic support services facility. Debt service for this facility11may not be paid from additional student fees.12

(((9))) (10) Community and technical colleges:13(a) Enter into a financing contract on behalf of Columbia Basin14

Community College for up to $27,000,000 plus financing expenses and15required reserves pursuant to chapter 39.94 RCW to construct a16student recreation center.17

(b) Enter into a financing contract on behalf of Pierce College18Puyallup for up to $2,831,000 plus financing expenses and required19reserves pursuant to chapter 39.94 RCW to purchase land and construct20parking.21

(c) Enter into a financing contract on behalf of Walla Walla22Community College for up to $1,500,000 plus financing expenses and23required reserves pursuant to chapter 39.94 RCW to build a student24activity center on the Clarkston campus.25

(d) Enter into a financing contract on behalf of Walla Walla26Community College for up to $6,500,000 plus financing expenses and27required reserves pursuant to chapter 39.94 RCW to build a student28recreation center.29

(e) Enter into a financing contract on behalf of Wenatchee Valley30College for up to $4,500,000 plus financing expenses and required31reserves pursuant to chapter 39.94 RCW for the Wells Hall replacement32project.33

(f) Enter into a financing contract on behalf of Yakima Valley34Community College for up to $22,700,000 plus financing expenses and35required reserves pursuant to chapter 39.94 RCW to build additional36instructional and lab classroom space.37

(g) Enter into a financing contract on behalf of Everett38Community College for up to $10,000,000 plus financing expenses and39

required reserves pursuant to chapter 39.94 RCW to purchase one or1more properties adjacent to the campus.2

(h) Enter into a financing contract on behalf of South Seattle3College for up to $10,000,000 plus financing expenses and required4reserves pursuant to chapter 39.94 RCW to build a student wellness5and fitness center.6

(11) Eastern Washington University: Enter into a financing7contract for up to $3,000,000 plus financing expenses and required8reserves pursuant to chapter 39.94 RCW for roof replacement projects.9

Sec. 7003. RCW 43.19.501 and 2018 c 2 s 7027 are each amended to10read as follows:11

The Thurston county capital facilities account is created in the12state treasury. The account is subject to the appropriation and13allotment procedures under chapter 43.88 RCW. Moneys in the account14may be expended for capital projects in facilities owned and managed15by the department in Thurston county. ((For the 2015-2017 biennium,16moneys in the account may be used for studies related to real17estate.))18

During the ((2017-2019)) 2019-2021 fiscal biennium, the Thurston19county capital facilities account may be appropriated for costs20associated with staffing to support capital budget and project21activities and lease and facility oversight activities.22


The department of natural resources, in coordination with the25department of social and health services, may enter into long-term,26revenue generating opportunities for underutilized portions of the27Fircrest Residential Habilitation Center bounded by 15th Ave NE and28NE 150th Street to benefit the charitable, educational, penal, and29reformatory trust. Long-term, revenue generating opportunities may30include, but are not limited to, land leases, land sales, and land31swaps. It is the intent of the legislature that any revenue obtained32from these opportunities be utilized by the department of social and33health services for community services benefiting those with34developmental disabilities. The department of social and health35services and the department of natural resources must amend their36lease if necessary to conform with this section.37

In order to accelerate the reduction of embodied carbon and3improve the environmental performance of construction materials,4agencies shall, whenever possible, review and consider embodied5carbon reported in environmental product declarations when evaluating6proposed structural materials for construction projects.7


(1) The department of enterprise services, in consultation with10the office of financial management, is granted the authority to sell11the real property known as the Tacoma Rhodes complex. The property12consists of the Broadway building, Market building, and parking13garage.14

(2) The department may negotiate a sale with the city of Tacoma15for less than fair market value, but the purchase price must cover16appraisal costs, all debt service, all closing costs, all financing17contracts, and the cost of outstanding liabilities necessary to keep18the department whole.19

(3) If the department and the city of Tacoma are unable to20negotiate agreed upon terms and execute a purchase and sale agreement21by December 31, 2019, the department may sell the property to any22purchaser for no less than fair market value.23

(4) The terms and conditions of the sale must meet the business24needs of the state tenants.25

(5) Any sale proceeds remaining after the department has26satisfied all of the obligations, including appraisal costs, all debt27service, all closing costs, all financing contracts, and the cost of28outstanding liabilities, must be deposited into the Thurston county29capital facilities account. It is the intent of the legislature to30use the sale proceeds for projects on the Capitol Campus.31

NEW SECTION. Sec. 7007. If any provision of this act or its32application to any person or circumstance is held invalid, the33remainder of the act or the application of the provision to other34persons or circumstances is not affected.35

NEW SECTION. Sec. 7008. This act is necessary for the immediate36preservation of the public peace, health, or safety, or support of37

the state government and its existing public institutions, and takes1effect immediately.2
