AGENCY COORDINATION
Throughout Project planning and development, the Applicant hascoordinated with various Federal, State, and local agencies and governmental authorities to identify potential concerns regarding the proposed Project. The Applicant has coordinated with:

REGULATORY COMPLIANCE
The Project will comply with all Federal, State and local laws.
State Wind Turbine Setback:• At least 1,125 feet from the tip of the turbine blade from the nearest adjacent
property line, including a state or federal highway, unless the applicant obtains the appropriate waivers.
• At least 1.1 times the total height of the turbine structure as measured from the tower base to the tip of a blade at its highest point from electric transmission lines, gas pipelines, gas distribution lines, hazardous liquid pipelines, and public roads.

sPower is committed to minimizing Noise and Shadow Flicker effects on the community.
Noise:• Facility noise levels at non-participating residences within 1 mile of the
project boundary will be within 5 dB (or less) of the project area ambient nighttime average sound level.
Shadow Flicker:• Shadow flicker levels will be limited to 30 hours per year (or less) at any
non-participating residence.

VOLUNTARY COMMITMENT – ADL SYSTEM
Seneca Wind will install an Aircraft Detection Lighting System (ADLS) on Project turbines pending approval by FAA
Tall structures are required to be lit by the FAA as a safety precaution for pilots. The ADLS is designed to mitigate the impact of nightime lights by deploying a radar-based system around a windfarm, turning lights on only when low-flying aircraft are detected nearby. The ADLS sends a signal to keep the light off until a plane is detected, then it stops sending the signal and the lights operate normally until the plane leaves the area and the off signal resumes.

• Project owner will be responsible for removing facilities at end of commercial operations.
• Project owner will provide financial assurance as permits and applicable law require.
• Turbine and substation foundations will be removed to a depth of at least 36 inches unless otherwise agreed to by the landowner
