Please join us … Sept 25th, 2014 at Horizons Banquet Center to honor the past
Presidents, install new RANWW Leadership and award Jenny Ebert and
Dave FitzGerald the RANWW Distinguished Service Award! The Distinguished
Service Award (DSA) is RANWW's most prestigious award. Recipients must demon-
strate a high level of commitment and contribute a substantial amount of time, effort
and creative imagination to RANWW. Jenny and Dave have certainly done that! Jenny
is a familiar face on RANWW committees and a faithful attendee of the Association
golf outings, Christmas parties and membership meetings. Dave served an unprece-
dented 3 terms as RANWW president and provided valuable insight on such issues as
lockbox and MLS conversions and the hiring of a new Executive Vice President.
Krag Blomberg will receive this year’s Realtor® of the Year Award and we will
install the following individuals: Marty Tauger—Treasurer, Mary Jo Bowe - Direc-
tor and Stacey McKinney - Director. Please join us in congratulating them on their
outstanding accomplishments and election to RANWW Leadership!
Installation Banquet: 5:30pm - 6:30pm Social hour, 6:30 - 7:15 plated dinner, 7:15pm
- 8:15pm program. Cost is free to members, guests are $25.
Prior to the Installation Banquet, we will honor RANWW Past Presidents, thanking
them for their steady guidance and wisdom throughout the history of this Association.
Past President Social: 4:30pm - 5:30pm Social Hour and hor d’oeuvre’s, cost is free
to past presidents and members, guests are $10.
The MLS Board has hired Kevin McQueen, Focus Forward Consulting, to gather information
from YOU, its broker-members for help in developing a strategic plan. A stra-
tegic plan will aid the MLS in its decision making in the future on such topics
as listing syndication, data licensing, public websites and so much more.
WE NEED YOUR INVOLVEMENT! This month, expect to see a BROKER
SURVEY in your email inbox. We need you to COMPLETE IT. Then, on Oct
21, there will be an MLS-wide BROKER MEETING at Turtleback in Rice Lake.

Offer to Purchase - Inspection Contingency
QUESTION:
The offer was contingent on a home inspection. The buyer's home inspection revealed electrical problems, specifically knob-and-tube wiring and a problem with an outlet in the garage. The knob-and-tube wiring was throughout the house, including buried in insulation in the attic. The buyer issued a notice of defects to the seller citing the home inspector's recommendations that all electrical be repaired or replaced. The seller elected to cure and indicated all along that the work was being completed.
The seller never delivered any evidence that the work was being completed and failed to deliver the required "written report detailing the work done within 3 days prior to closing." The parties did not close yesterday because the work was not completed. The buyer offered to amend the offer so the seller could finish the work. The seller indicated that they had spoken with an attorney and that they were intending to sue the buyer for breach of contract. Doesn't the seller have to provide a report of the work done prior to closing?
ANSWER:
When a seller agrees to cure under the home inspection contingency of the offer to purchase, the seller agrees to cure in a good and workmanlike manner and deliver to the buyer a written report detailing the work done within 3 days prior to closing. Failing to provide this report is a breach of contract. Failing to close is also a breach of contract. The buyer should consult an attorney to discuss the buyer's full range of legal remedies in this situation

I. Respect for the Public
1. Follow the "Golden Rule”: Do
unto other as you would have them do unto you.
2. Respond promptly to inquiries
and requests for information.
3. Schedule appointments and showings as far in advance as pos-sible.
4. Call if you are delayed or must
cancel an appointment or showing.
5. If a prospective buyer decides not to view an occupied home, promptly explain the situation to the listing broker or the occupant.
6. Communicate with all parties in
a timely fashion.
7. When entering a property en-sure that unexpected situations, such as pets, are handled appropri-ately.
8. Leave your business card if not prohibited by local rules.
9. Never criticize property in the
presence of the occupant.
10. Inform occupants that you are leaving after showings.
11. When showing an occupied home, always ring the doorbell or knock—and announce yourself loudly before entering. Knock and announce yourself loudly before entering any closed room.
12. Present a professional appear-ance at all times; dress appropri-ately and drive a clean car.
13. If occupants are home during showings, ask their permission be-fore using the telephone or bath-room.
14. Encourage the clients of other brokers to direct questions to their agent or representative.
15. Communicate clearly; don’t use jargon or slang that may not be readily understood.
16. Be aware of and respect cultur-al differences.
17. Show courtesy and respect to
everyone.
18. Be aware of—and meet—all
deadlines.
19. Promise only what you can de-liver—and keep your promises.
20. Identify your REALTOR® and
your professional status in contacts with the public. Do not tell people what you think—
tell them what you know.
II. Respect for Property
1. Be responsible for everyone you allow to enter listed property.
2. Never allow buyers to enter
listed property unaccompanied.
3. When showing property, keep all members of the group together.
4. Never allow unaccompanied access to property without permis-sion.
5. Enter property only with permis-sion even if you have a lockbox key or combination.
6. When the occupant is absent, leave the property as you found it (lights, heating, cooling, drapes, etc.) If you think something is amiss (e.g. vandalism), contact the listing broker immediately.
7. Be considerate of the seller's property. Do not allow anyone to eat, drink, smoke, dispose of trash, use bathing or sleeping facilities, or bring pets. Leave the house as you found it unless instructed other-wise.
8. Use sidewalks; if weather is
bad, take off shoes and boots in-side property. Respect sellers’ instructions about
photographing or video graphing
their properties’ interiors or exteri-
ors.
III. Respect for Peers
1. Identify your REALTOR® and
professional status in all contacts with other REALTORS®.
2. Respond to other agents' calls,
faxes, and e-mails promptly and courteously.
3. Be aware that large electronic
files with attachments or lengthy faxes may be a burden on recipi-ents.
4. Notify the listing broker if there
appears to be inaccurate infor-mation on the listing.
5. Share important information
about a property, including the presence of pets, security systems, and whether sellers will be present during the showing.
6. Show courtesy, trust, and re-spect to other real estate profes-sionals.
7. Avoid the inappropriate use of endearments or other denigrating language.
8. Do not prospect at other REAL-
TORS®' open houses or similar events.
9. Return keys promptly.
10. Carefully replace keys in the
lockbox after showings.
11. To be successful in the busi-ness, mutual respect is essential. Real estate is a reputation busi-
ness. What you do today may af-
fect your reputation—and busi-
ness—for years to come.

Do you need CE this year? Would you prefer to have a
live instructor? Then mark you calendars for October 7th,
8th & October 16th, Instructor Rob Sayas will be present-
ing CE 1,2,3 & 4 along with electives C & D in Rice Lake
at the Turtleback Convention Center. Registration forms
will be available in this newsletter. A full day of courses
will be $70 for members and $80 for non-members, half
day of courses is $35 for members and $40 for non-
members. In addition these courses qualify for Minneso-
ta credits.
Robert Sayas is an attorney with
the law offices of Sayas, Schmuki,
Rondini & Plum S.C. Rob is a Le-
gal Hotline attorney for the WRA,
answering member questions
about real estate related matters.
He received his Juris Doctor from
Valparaiso University in Indiana.
LegalTalks is a new video series designed by WRA to
provide REALTORS® with information on contemporary
legal issues in short segments. This series of videos will be
based on questions received by the Legal Hotline, email
requests and other direct communications with the WRA
legal team. The first segments in this series relate to elec-
tronic consent and email delivery. Other topics coming
soon will be landlord/tenant law, form changes and the in-
spection contingency.

RANWW’s 2014 RPAC fundraising goal is $28,000 this year! At this time we are
not quite half way to our goal. A few ways everyone can help to reach this goal;
1. When paying your 2015 Realtor® dues, consider investing $35 in RPAC
by keeping the $35 added into your total amount due.
2. Invest in the Bucket List Challenge. Not only are you investing in RPAC

3. Consider becoming a Direct Giver and controlling who your money sup-

Once again “Hope for Homes” 5k Family Fun Run
was a successful event! The weather was beautiful
the volunteers were ready, the runners were willing
and the course was challenging.

Overall the run raised $1,192.59 in funds for the
RANWW Foundation! We look forward to hosting
this event again next year with some added incen-
tives and possible chip timing to draw a larger venue.
Thank you to everyone who sponsored and partici-

We had over 195 members participate in this event
in some fashion! Some came for lunch, some for
dinner, some golfed 18 holes and some golfed 9
holes. No matter what they participated in, everyone
had a good time and it was wonderful to see that
many members gathered at one event!
