Recently I’ve dropped a few pounds. I’ll spare all of you the details about how I did it or even why I did it. I bring it up however for a simple fact. A fact that I’d like to expand on a bit. Before and during this process many friends, colleagues, and even patients would say something like “wait until you lose a few pounds, you have so much more energy” or “when you lose the weight, you’ll gain years onto your life.” Honestly I didn’t think much about it until recently when I noticed the exact phenomena happen. I do feel more energy, I do sleep better, I do feel more focused and dare I even say, more “alive.” I started to think about the concept of LOSING something in order to GAIN something. Maybe this was worth exploring further.

At my office, I began a “purge.” We began losing our old files (HIPPA compliant shredding of course) and gained valuable space. Closets have been emptied and it seems that things feel “lighter” in the clinic now. Old posters have come down in favor of newer ones or even non-chiropractic artwork (gasp!).

Perhaps now would be a good time to think about your practice, your office space, even your headspace, and see what things or ideas you could “lose” in order to “gain.” Maybe it’s time to lose Fridays to gain more time with those you love. Maybe not. Maybe it’s time to lose outdated paperwork or even paper in general to gain a shiny new electronic health record system. Maybe not (but you should do it soon). How about losing some old treatment methods or adjusting techniques to gain a fresh perspective in line with current research. Maybe not. Lose a few dollars to our PAC and gain more political capital in Annapolis? (YES! Do that one). Lose a day or two in Ocean City on October 9-11 and gain CE’s, camaraderie with your colleagues, and a great time. (YES! That one too).

Some of you reading this may feel very attached to the things I’ve suggested you lose (Fridays, paper, certain treatment techniques, money and time). I mentioned them for a specific reason; to remind you that NOTHING should be “off limits” when it comes to change. Question ALL of it. Maybe we as a state association and even the entire profession can do with losing a few things in order to gain many more. Maybe it’s time we re-think our involvement with insurance companies and third party payers. Or how we approach those in other professions. Maybe it’s time to shift to a different model of service to our patients. Maybe it’s time to engage the public in different ways. Maybe it’s time we lose the two national associations and gain one SUPER association that represents ALL of us. Wishful thinking perhaps, but definitely worth the thoughts.

What will you GAIN when you LOSE? Lose a minute or two with these thoughts and gain some new perspective.

What a great year for chiropractors in Maryland! This strong and dedicated association took charge of the opening legislative session of a new term of office facing a newly elected Governor plus 70 newly elected members of the House and Senate with a powerful legislative package – and succeeded!

HB 208: State Board of Chiropractic and Massage Therapy Examiners - Preapproval for Use Prior to our firm beginning a relationship with MCA, Marc Cohen, counsel to MCA, had initiated the research on this initiative to present to the legislature this year. Chiropractors are the only professionals to have this requirement in statute. The reason for repealing board approval of trade names is that this regulatory burden has proven to create unnecessary problems for both licensing boards and licensees without any benefit to the public.

Louis Crivelli, DC, Marc and Julia Pitcher Worcester testified in support of the bill in both the House and Senate which voted this legislation unanimously and awaits the Governor’s signature.

SB 580/HB 979: State Board of Chiropractic and Massage Therapy Examiners and State Board of Physical Therapy Examiners - Dry Needling - Registration RequirementsThis legislation was an attempt by the Maryland Acupuncture Society to prohibit licensed chiropractors and physical therapists in Maryland from performing trigger point myofascial stimulation (aka “dry needling”). Maryland’s Board of Chiropractic Examiners determined that a procedure known as “dry-needling” is permitted under a chiropractor’s physical therapy privileges, so long as the chiropractor is sufficiently trained and educated in the procedure.

Maryland’s Attorney General concluded that “The authority to use acupuncture needles for therapeutic purposes is not necessarily reserved exclusively to licensed acupuncturists or those specifically exempted from the licensing requirement for acupuncturists.” (95 Opinions of the Attorney General 138 (2010).

Dry needling is not exclusive to one profession. It is an intervention therapy performed by a number of health care providers including physicians, chiropractors, physical therapists, osteopaths, neurologists, nurses and occupational therapists. It is unreasonable restraint of trade for one profession to have exclusive domain over an intervention, a tool, or modality.

The bill, as presented, would have required that the regulations to be promulgated in conjunction with the Board of Acupuncture be as least as stringent as the requirements for physicians which are 200 hours. Physicians receive a full acupuncture license by following these requirements. With regard to dry needling chiropractors are only practicing a limited neuro-muscular therapy they have been using safely and effectively for years and should not be subject to the educational requirements for

acupuncturists and medical doctors who will practice the full scope of acupuncture.

MCA fought this legislation together with the Maryland Physical Therapy Association, the Maryland Board of Chiropractors, and the Board of Physical Therapists. In the end, there was never a vote on either bill and therefore neither advanced. Upon withdrawal of the legislation, the Boards are to convene the stakeholders during the interim to come up with a solution not requiring additional legislation in future years. MCA will be participating in all dialogue and discussion on behalf of Maryland chiropractors over the summer and fall months.

PAC PUSHLast, we would be remiss if we didn’t stress the importance of a robust Political Action Committee (PAC) which assists by contributing to candidates during the interim and election years.

Each year our businesses and providers are affected by the actions of our political leaders. The votes that legislators cast occur every year and it is most certain that the MCA PAC efforts influence these votes and allow our collective voices to be heard loud and clear. We know that in the future we will face new and different issues that will affect our organization and members, if you agree that we need to fight this battle every year in Annapolis and this year in particular to elect provider friendly legislators, make a commitment now by writing a check to the MCA PAC.

The MCA PAC is looking for new members to get involved with the decisions regarding PAC, attend fundraisers during the summer and fall months, and provide input regarding candidates. MCA is also in need of replenishing the money spent in 2014 in order to have a successful four-year fundraising effort with the 69 new legislators elected to serve from 2015-2018 and a newly elected Governor. If every member of MCA gave $50 to the PAC – we could have enough in the war-chest to really make an impact!

The committee general communicates via email with the PAC Chair and lobbyists, meetings are seldom. Fundraisers for candidates are generally early week day mornings or evening receptions. We encourage committee members to attend at least one fundraiser during the nine month interim between legislative session.

Working together, we can expand our effectiveness and keep our collective voices heard loudly in Annapolis. ACA Statement on NCCIH’s New Report on Pain in the United StatesArlington, Va.- American Chiropractic Association (ACA) President Anthony Hamm, DC, has released the following statement on the National Center for Complementary and Integrative Health’s (NCCIH) new analysis of data from the 2012 National Health Interview Survey (NHIS), which found that most American adults have experienced some level of pain, from brief to more lasting pain, and from relatively minor to more severe pain:

“The American Chiropractic Association is encouraged that NCCIH’s research priorities include the study of complementary approaches to pain management, including chiropractic services. Integrated approaches can offer patients a higher degree of safety and help address opioid overuse and abuse in the United States by reducing the necessity for prescription pain medications. NCCIH’s analysis found that chiropractic services remain one of the most popular non-drug approaches, with more than 19 million patients having received spinal manipulation in the previous year for pain management. ACA is hopeful that as additional research demonstrates the effectiveness of conservative forms of care for pain management, more Americans will experience the benefits in the form of improved health and quality of life.”

NCCIH’s new report on pain comes on the heels of ACA’s recent announcement that National Chiropractic Health Month (NCHM) in October will work to bring attention to the public health crisis caused by pain, and in particular the overuse of prescription painkillers, with this year’s theme #PainFreeNation.

The campaign is part of the profession’s ongoing efforts to educate the public about the value of exhausting conservative forms of care for both acute and chronic pain before resorting to higher risk options, such as prescription painkillers and surgery.

Repeal of the Federal Anti-Trust Exemption for Insurance a Top ICA Legislative Priority

ICA’s Board of Directors has voted unanimously to adopt the repeal of the anti-trust provisions of the McCarran Ferguson Act as a top legislative goal and priority for the association. Legislation to accomplish this important goal overwhelmingly passed the U.S. House of Representatives in a previous Congressional session and was only defeated in the U.S. Senate by one vote. The McCarran–Ferguson Act, 15 U.S.C. §§ 1011-1015, also known as Public Law 15,[1] is a United States federal law that exempts the business of insurance from most federal regulation, including federal antitrust laws to a limited extent. The McCarran–Ferguson Act was passed by the 79th Congress in 1945 after the Supreme Court ruled in United States v. South-Eastern Underwriters Association that the federal government could regulate insurance companies under the authority of the Commerce Clause in the U.S. Constitution.

“The time has come to once again make this vitally important public policy correction a top priority,” said ICA President Dr. George B. Curry. “With no effective federal oversight and enforcement, private insurance will only continue their widespread policies of abuse and discrimination, policies that strike especially hard at chiropractors and chiropractic patients.”

Unprecedented New Congressional Bills Seek to Sharpen State Vaccination Mandates, Officially Deny Vaccination Risks or Injury Potential

ICA is alerting the profession and the public about three new congressional initiatives that demands on vaccination. These include provisions that require states to have stringent vaccination mandates in place or else they face denial of federal funds, and also include provisions to officially deny that any risk of injury exists in any vaccination process.

“These unprecedented initiatives represent a dramatic new level of potential federal enforcement of a national vaccination requirement and simply ignore an individual’s right to control over their health care; it should be “my body-my decision” saidICA President Dr. George B. Curry. “All citizens who value their personal freedom, and all health professionals who believe that questionable research that is subjected to pharmaceutical and financial influences is driving public policy on medication and vaccination have good reason to be gravely concerned. ICA believes it is vitally important to bring these issues to the attention of the profession and the public and to encourage a powerful response in opposition to these anti-personal freedom and dogmatic vaccination mandate enforcement efforts.”

The first of these new bills - HR 2232, the vaccinate all children mandate: This bill seeks to amend the Public Health Service Act to prohibit the Department of Health and Human Services from awarding grants to public entities of a state for preventive health service programs unless the state requires each student in public elementary or secondary school to be vaccinated in accordance with the recommendations of the Advisory Committee on Immunization Practices. The bill provides an exception only for students whose health would be endangered by vaccination in the opinion of a physician conforming to the “accepted standard of medical care.”

The next bill in this new wave of proposed legislation - HR 933, the Head Start on Vaccinations Act: This bill would amend the Head Start Act to prohibit the enrollment of a child in a Head Start or Early Head Start program unless the child’s parent or guardian: (1) provides the program with information establishing that the child is vaccinated in accordance with the pediatric vaccine list; or (2) submits a signed agreement to provide such information and consents to the provision, by a program employee or other health care provider, of any vaccines on the Pediatric Vaccine List that the child has not yet received. It would also require any child who is not in compliance with such requirements to be removed. The bill would authorize the director of a Head Start or Early Head Start agency to use program funds to: (1) administer the required vaccines to children, at the request of the parent or guardian; or (2) assist the parent or guardian in gaining access to the required vaccines.

Perhaps the most alarming of all of the new initiatives - House Resolution 117, officially titled Recognizing the importance of vaccinations and immunizations in the United States: This Sense of Congress Resolution seeks to officially affirm that vaccines “save lives and are essential to public health, and economic and national security.” The most significant sections of this resolution state that the lack of vaccination can cause a public health crisis, that “…the scientific and medical communities are in overwhelming consensus that vaccines are both effective and safe, and the dissemination of unfounded, and debunked, theories about the dangers of vaccinations pose a great risk to public health,” and that there is no credible evidence to show that vaccines cause life-threatening or disabling diseases in healthy children or adults. It also encourages a continued commitment to research to improve vaccines and develop new vaccines. No reference to investigating vaccination safety or injury risks or informed consent is even mentioned.

The Government and YouBy Dr. Ray Foxworth, president of ChiroHealthUSAPresident Obama and his administration celebrated the 5th anniversary of the Affordable Care Act (aka Obamacare) in late March. Whether you believe it’s been a good thing or a bad thing, it remains a current fact of our professional lives, unless Republicans overturn it, as they continue to threaten. Good or bad, one thing you can be sure of; when the government steps up its presence in healthcare, the prosperity and even survival of your practice can depend on making sure you’re following all the rules. And oh, my goodness, there are so many, many rules! Most DCs I know are overwhelmed by trying to keep up. What could and should you be doing to protect yourself and your practice?

Medicare - I sure hope you know by now that opting out of Medicare isn’t an option. You can, however, choose to participate (par) or not (non-par). Make sure you’ve made a conscious choice here and that you understand your status and what it entails. Medicare is related to Obamacare for the simple reason that Medicare, historically, leads all third-party payers and thus our country’s universal health care model. If you’re out of step with Medicare’s requirements, you’re likely in hot water elsewhere and may not even know it.

Compliance - HIPAA Omnibus hit the street just as we began seeing significant surges in the number of federal audits. And private insurers quickly followed suit. The OIG has issued various statements over the past five years putting documentation error rates at anything from 80 to 94%. But even if we go with the lower of the two figures, that still represents way, way too

many practices who are at risk. If you don’t have OIG and HIPAA Compliance manuals implemented in your practice and procedures in place to actually use them, you’re vulnerable. It doesn’t matter whether you make mistakes out of ignorance or malice. The recoupments can be brutal either way.

ICD-10 - Although not directly related to Obamacare, your preparation, or lack of it, is another area that puts you at potential risk with the federal government and other auditors. Unlike 2014, it’s clear by now that we’re not going to get a reprieve. ICD-10 is coming, and at this point, it’s coming more or less like a freight train. It takes awareness, commitment, and effort to get your practice fully prepared, but the good news is, it’s probably not as hard as you think. This doesn’t mean, however, that you should procrastinate. At this point, you should already know which codes will be the ones you’ll most commonly use, your vendors’ changes to accommodate these longer, more specific codes, and have an ICD-10 “cheat sheet” of sorts in place with the codes you’ll use most.

Join the MCA ListservThis is a reminder for you to take advantage of a member benefit; the MCA ListServ. The ListServ is a convenient membership tool to find advice from your peers concerning business operations, insurance, equipment, record keeping, etc. Have you ever wanted to refer a patient who is moving to another part of the state? Us-ing the listserv you can send out a request for referral and find a like-minded doctor to continue treating your patient. The listserv is also a great resource if you have a problematic clinical case and want to ask questions or have suggestions about different treatment options.
