And whereas said Shri Si'lvester Fernandes, Work Super­visor who was to join his duties on 15-5-1998 after expiryof Earned Leave sanctioned to him did not report for dutiesand 'unauthorisedly remained absent from duty till this date.

And whereas the Assistant Engineer, of Sub-Div. IV,Works Division XIV, Irrigation Department, Quepem-Goa,issued letter No.ID/SDIV/WDXIV/F. 3/121/98-99, dt. 15-10­1998 and the Executive Engineer, Works Division XIV, Irri­gation Department, Margao issued Memos. No. ID/WDXIV/F./432/98-99, dt. 11/11/98, NO.ID/WDXIV/Adm./F.C.F./98­99/560. dt. 18/1/1999 and No.ID/WDXIV/Adm./F. /99-2000/1146. dt. 2-6-99 at his available address at Quepem directingI1l1n to report for duty immediately.

And whereas efforts were also made to get the memoran­c1llfl) dt. 9-1 2~ I 999 of this office served on said Shri SiLvesterFernandes, Works Supervisor, through Police Inspector,Police Station, Quepem, who informed that an'fnquiry wasc.onducted and Shri Silvester Fernandes could not be traced

at his given address and that the wife of Shrt SilvesterFernandes received the said memorandum stating that herhusband Shri Silvester .Fernandys,was sick and had goneto Mumbai last 8 months for medical treatment.

Lilia Ana MariaFernandes, wife of Shri Silvester Fernandes, WorkSupervisor, filed an affidavit dt. 24/12/1999 stating that herhusband had to suddenly leave abroad in May, 1998 in orderto attend'hi,s ailing brother, Shri Manuel Fernandes, but shedid not disclose the address either of her husband or of thebrother of Shri Silvester Fernandes, in spite of requesting herand granting time of one month upto 29-2-2000 by lettersdated 4-1-2000 and 24-1-2000;

And whereas this office received, letter dt. 17-2-2000 fromShri Silvester Fernandes, Work Supervisor giving his addresstherein as Division 14, ID, Gogal, Margao-Goa, and informingthat he is unable to join the work till May, 2000 because ofhis family problem.

And whereasitis relevant from the documents in the casefile that Shri Silvester Fernandes, Work Supervisorunauthorisedly remained absenf from duty since 15-5-1998till this date and proceeded abroad as confirmed by his wife,Smt. Lilia Ana Maria Fernandes in her affidavit dated24-12-99 referred above without prior permission of hisappointing authority and as such said Shri SilvesterFernandes, did not maintain absolute integrity and devotionto duty which is unbecoming of a Government Servant.

.Now Therefore, in pursuance of Sub-Rule (l) of Rule 5of the Central Civil Services (Temporary Service) Rules1965, I, Shri S. D. AWARD

In exercise of the powers conferred by clause (d) of sub­section (1) of section. LO of the Industrial Disputes Act, 1947(Central Ac:t 14 of 1947) the Government ofC1oa by orderdated 10-8-94 beai'ing No. 28/25/94-LAB ~eferred the follow­ing dispute for adjudication by this Tribunal.

"Whether the demand of the workmen employed inMis Cidade de Goa, VainguinimBeacp, Dona Paula, Goa, for20% bonus for the accounting year .1992"93 is legal andjustified?

If not, to what relief the workmen are entitled ?"

2. On receipt of the re'fence a case was registered underNo. IT/91/94 and registered AID notice was issued to theparties. In pursuance to the said notice the parties put in theirappearance. The workman-Party I (for short, "Union") filedits statement of claim at Exb.3.The facts of the case in briefas pleaded by the union are that it is the sole representativeunion of the workmen of the Employer-Party II (for short,"employer") and its registration is No. 21 f/84. That theemployer paid 8.33% bonus to the confirmed workmen underthe Payment of Bonus Act, 1965 for the accounting year1991-92 as demanded by the union vide its letter ofdemanddated 27th July, 1992. That thus the employer refused to paythe balance 11.67% + 10% ex-gratia payment to the workmenthough the employer had successful and encouraging financialresults and gross profits for the accounting year 1991-92. Thatthe union raised an industrial dispute before the Labour Com­missioner vide letter dated 12-12-92 demanding 20% max. annualbonus for the accounting year 1991-92 as well as 10% ex-aratiab

payment. That the 8.33% minimum bonus which the employerpaid to the workmen sometime in the 3rd week ofNovember 1992was accepted by the workmen under protest. That'in order todeprive the workmen of the said bonus and ex-gratia paymentthe employer showed in the balance sheet fictitious losses andexpenditures. The union relied upon the balance sheet and profitand loss account for the year 1991-92 of the employer as wellas the halance sheet and profit and loss accounts for theaccounting year 88-89,89-90 and 90-91. The union claimed thatthe employer should be directed to pay to the workmen-the bonus@ 20% and ex-gratia payment @ 10% for the accounting year91-92. .

3 .. The employer filed writen statement at Exb. 5. By wayof preliminary objection the employer contended that thedispute does not survive because the workmen have ac­cepted bonus. of 8.33% for the accounting year 91-92. Theemployer also contended that the payment for bonus is notespoused by the substantial number of workmen and there­fore there being no industrial dispute the reference is liableto be rejected. The employer stated that the union has noright to raise the dispute as it does not represent majorityof the workmen nor a substantial section. The employerdenied that the union is the sole representative union of allthe workmen employed with tlfe employer. The employerstated that all the workmen who were entitled to bonus underthe Payment of Bonus Act, 1965 were paid bonus @ 8.33%which was due and payable under the Act for the accountin a

year 91-92 and the workmen accepted the payment without

any reservation whatsoever and in full and 'final settlementof their claim for bonus for the accountinli. year ending91-92 and thus they have no dispute wh~tsoever. Th~employer stated that the demand of the union for 20% bonusdoes not have any support from the workmen of theemployer. The employer denied that they had highly success­ful and encouraging financial season and gross profit for theaccounting year 91-92. The employer stated that they madealoss of 7.8 lakhs as shown in the profit and loss account.T~e employer denied any .knowledge that by letter dated12-12-92 the union raised an industrial dispu'te before theLabour Commissioner or that the said letter dated 12-12-92was sent tp the conciliation officer. The employer denied thatthe employer has shown in the balance sheet fictitious lossesand expenditure as contended by the union. The employerdenied that false, non existent and unreasonable expendi­tures have been deducted from the gross profit as contendedby the union. The employer stated that the expenditure isjustified, fair and proper. The employer stated that they havestrictly complied with the methodology of calculation underthe Act and there being no allocable surplus whatsoever theemployer has rightly paid the statutory bonus of 8.33%. Theemployer stated that in view of the proper and legitimatecalculations no bonus whatsoever is due and payable overand above what has been statutarilly paid in the accountingyear 91-92 and therefore the reference deserves to berejected. The Union thereafter filed rejoinder at Exb. 6.

4. On the pleadings of the parties, following issues wereframed atExb.7.

I. Whether the Party I proves that it is the sole representativeunion of the workmen employed by Party II and hence it isauthorised to raise the Industrial Dispute?

2. Whether the Party I proves that the demand for 20%bonus is espoused by substantial number of workmen andhence the reference is maintainable?

3. Whetherthe Party I proves that its demand for 20% bonusfor the accounting year 1992-93 is legal and iustifi~d ?

REASONS

6. Issue Nos. 1 and 2: Both these issues are taken upl\)gether as they are interrelated since the union had con­tended that it is the sole. representative of the workmenl'l11ployedwith the employer and therefore it is authorisedtu raise the industrial dispute and since this contention ofthe union was denied by the employer, the burden was onthe union to prove its sole representing character. It was alsothe contention of the union that the demand for 20% bonusI, espoused by substantial number of workmen and thereforelhe reference is mail1tainable which contention was deniedh) the employer and therefore the burden was on the unionto prove this contention also. The union has examined itsGen. Secretary Shri John Rego and its President Shri Jaoquim(Jomes and their deposition is on record. E)(cept for making~l bare statement that about 240 employees are presently themembers of the union and at the time when the dispute wasraised about 180 employees of the employer were the mem­hers of the union, no documentary evidence in support ofits contention has been produced by the union. In the crossexamination of Shri John Rego the employer had denied the(ontention of the said witness that the employees of theemployer are the members of the said union. In the crossexamination of the witness Shri Joaquim Gomes also theemployer had denied that at the time when the demand wasmade 180 employees were the members of the said union. Inview of the stand taken by the employer as regards themembership of the union it was incumbent on the union toproduce some documentary evidence to prove that at the timewhen the demand was made 180 employees were the membersof the said union or that atleast a substantial number of theemployees of the employer were its members. The union alsohas not produced any documentary evidence to. show thatan extraordinary General Body Meeting was held on 7-11-92for demanding 20% bonus and ex-gratia payment. In theabsence of any evidence on the part of the union the issuenos. I and 2 cannot be answered in favour of the union. I,therefore hold that the union has failed to prove that it is.the sole representative union of the workmen emproyed bythe employer or that the demand for 20% bonus wasespoused by asubstantil number of workmen. I, thereforeanswer the issue nos. I and" 2 in the negative.

7. Issue No.3: On this issue the union has examined itsPresident Shri J. Gomes and its General Secretary Shri JohnRego. It is the contention of the union that the workers ofthe employer are entitled to 20% bonus. As per the order Ofreference dated 10-8-84 the dispute which has been referredis as regards-the demand of the workmen for 20% bonus forthe accounting year 1992-93 and whether the said demandis legal and justified. In the statement of. claim filed by thebnJon, the union has made the pleadings 'on the legality andjustifiability of the demand for 20% bonus for the accountingyear 1991-92 and not for the accounting year 1992-93. Thewitnesses examined by the union also have deposed asregards their demand for 20% bonus for the accounting yearY1-92 and not for the accounting year 92-93. Therefore thepleadings made by the union as well as the evidence whichhas been led by the union are besides the order of referencei.e. to say that the dispu'te referred by the Government ison one issue whereas the pleadings and the evidence which

has been led by the union are on a different issue. Evenotherwise no evidence has been led by the union in supportof its claim for 20% bonus. In the light of what is discussedabove, I hold that the union has failed to prove that itsdemand for 20% bonus for the accounting year 92-93 is legaland justified. I, therefore, answer the issue no. 3 in thenegative.

8. Issue No.4: The employer had contended that the dis­pute does not survive in view {)f the acceptance of 8.330/<­bonus by the workmen of the employer for the accountingyear 1991-92. I have already mentioned earlierthat the employerhas not led any evidence in the matter. Even otherwise, inmy view giving the finding on this issue does not arisebecause the dispute as regards payment of bonus pertainsto the accounting year 1992-93' whereas the employ~r hasreferred to the payment of bonus of 8.33% for year 1991-92.Giving the finding on this issue will amount to travellingbeyond the scope of reference which is not permissible underthe law. I, therefore hold that giving finding whether thedispute does not survive because of the acceptance of 8.33 07(;

bonus by the workmen of the employer for the accountingyear 91-92 does not arise. Hemce, I answer. the issue noAaccordingly.

9. Issue No.5: Since it has been held by me that the unionhas failed to prove that its demand for 20% bonus for theaccounting year 92-93 is legal and justified the question ofgranting any reliefto the workmen does not arise. I, thereforehold that the workmen are not entitled to any relief.

In the circumstances I pass the following order.

It is hereby held that the demand of the workmen employedin MlsCidade de Goa, Vainguinim Beach, Dona Paula, Goafor 20% bonus for the accounting year 1992-93 is not legaland justified. It is hereby further held that the workmen arenot entitled to any relief.

dated 24/9/99 published on page - of Series II, No. 28 of the

Official Gazette dated 7-10-99 and in two newspapers (I)

Sunaparant dated 4-10-99 (2) Tarun Bharat dated 5-10-99. it

was notified under section 4 of the ,Land Acquisition Act.

1894 (hereinafter referred to as the "said Act") that the land

specified in the schedule appended to the said notification

(hereinafter referred to as the "said land") was needed for

public purpose viz for construction of road at Nerul, Bardez.

And whereas in the opinion of the appropriate Govern­

ment (hereinafter referred to as the "Government") the said

land is not Tequired for the aforesaid purpose.

Now, therefore, the Government is' pleased to declare

under sub-section (l) of section 48 of the said Act that it

has withdrawn from acquisition of the said land for the

aforesaid public purpose and that the aforesaid Government

notification shall be deemed to be cancelled so far as it relates

to the said land. Th~ persons interested in the said land,

may lodge to the Deputy Collector/SDO, Mapusa, within a

period of thirty days from the date of this notification claims

under sub-section ,(2) of section 48 of the said Act, for the

damages suffered by them in consequence of the notice or

of any proceedings thereunder and for costs reasonably

incurred by them in prosecution of the proceedings under

the said Act relating to the said land.
