Happy New Year everyone! My apologies for the delay in publishing this month’s newsletter. The past several months have been very eventful for Southeast Texas, from Hurricane Harvey and the recovery efforts that continued through the Thanksgiving and Christmas holidays, to the record-breaking cold weather conditions that brought us snow not once but three times! I hope that each of you faired well through these bizarre past few months and are getting back on track to a normal routine. I know that I have only just begun to feel like I’m getting back into the groove of things, and completing this newsletter for you was part of that effort. Please remember that my door is always open and I would love to hear from you if you have any comments or suggestions (good or bad), that you think would make this newsletter better. Thank you for allowing me to continue to serve on SETAP’s board and I hope to see you the next speaker meeting on February 15th!

There is a feature in Microsoft Word 2010 and 2013 (may also be available in other versions) that will restrict editing by others to portions of a Word document. Just follow these simple steps:

3. Check the box in #2: “Allow only this type of editing in the document.”

4. Keep the default setting: “No changes (Read only)”

5. Select the text in your document that you want to ALLOW editing:

(The selected text will be grayed out.)

What area of law do you work in? Personal injury defense / DTPA defense / just a tad of

immigration

What do you enjoy about working

in that area?

I have been involved in such a variety of legal mat-

ters–from seizing ships to counting tires to genetics

testing for twins to defense of several persons with

major drug charges to dead cows. Definitely a life-

learning experience—you never know what type of

case will walk through the door.

If you could work in any other area

of law, what would it be? Immigration or probate

How or why did you first enter the

paralegal field?

My mom worked for the Hardin County clerk and tax

assessor off and on for 20 years and also worked for

a solo practitioner in Silsbee, so I was exposed to the

field from a young age. My first part-time job was

with an attorney while I was still at Lamar. I had a

couple other jobs after that, but just kept going back

to the legal field.

Did you have a different career

before becoming a paralegal? If

so, what was it?

Secretary in a paper mill production office and at an

electronics firm;

legal secretary for almost 20 years.

What do you love about the

paralegal profession?

This is pretty intangible – I think you either love the

legal field or you hate it.

What things about the profession

do you dislike? Deadlines, horsey attorneys (and staff).

How long have you been a mem-

ber of SETAP? Off and on since the late 1990s.

What tip would you offer someone

just entering the paralegal field?

1. Join the Paralegal Division of the State Bar of Texas

and SETAP (or any local paralegal organization) – the

networking is invaluable.

2. Acquaint yourself with local court rules (or at least

know where to find them).

3. Stay up to date on technology advances, but

know also “work arounds” for those days when tech-

nology fails you;

4. Attend as many CLE opportunities as possible,

even on topics other than your preferred field. You

never know when you’ll need to know just some little

something.

I have made a few of these mistakes myself. It's not the mistake, it is how you handle the mistake that gets noticed. 1. Relying on your memory - You may have a terrific memory but how is your recall? Writing things down helps you focus, regardless of your learning style. Making a list or writing notes helps reinforce your memory and your recall. Always have a pad to write on. Use flash cards when you’re memorizing. Highlighting is not the same as writing it down. If you simply highlight, you will ll be able to find the material, but you may not remember it. 2. Assuming you don’t “need” to belong to a professional association - Actually, you’re correct – you don’t “need” to belong to a professional association….unless you don’t think you need to network with other paralegals, keep up to date with the latest trends and systems, and know first-hand about changes in the law. The time you invest in a professional association (on the local, state and national level) will bring you immeasurable returns. 3. Missing a deadline - Deadlines are very important in the law and there are a few that come with almost every case. A common mistake made by new paralegals is to assume that if a deadline is approaching, the attorney will tell you about it. Many times, however, the attorney expects you to tell them about deadlines, or better yet, just take care it. Some paralegals put deadlines on the attorney’s calendar and others use their own calendar for deadlines, but however you choose to do it, one of the first things you should do when you start a paralegal job is come up with a system that works for you. When you make a mistake you should give yourself a few minutes to feel sorry for yourself and beat yourself up if that’s what you want to do. However, you should not dwell on it and after a short time you MUST spring into action.

1. Figure out why – Why did this mistake happen? Was it because you are understaffed? Sometimes when we get really busy and there are a lot of deadlines on our plates we tend to rush through our everyday work and mistakes usually happen. If you notice, most mistakes happen in the simplest tasks; making copies, counting days for a response, missing a deadline on discovery etc. Make sure you understand why you made the mistake. 2. Make a plan – come up with a plan to solve the mistake or at least correct it. Sometimes we get so caught up in the mistake and how badly we feel that we forget that the mistake still needs to be remedied. Don’t dwell on what’s been done. Think about going forward, and do whatever is needed to repair the damage. 3. Going forward – come up with a few ideas to implement that will ensure the mistake won’t happen again. Could you get another paralegal or secretary to look at your documents to make sure that all the copies are there and the Bate Stamp numbers are in order? Could you implement some check points to make sure the deadlines are not missed? Maybe recording the dates on two different calendars, one that you carry with you at all times. I use my smart phone and have a calendar dedicated to “work.” Could you set your email to send you reminders? 4. Report your mistake – this one, I have to admit, is the most difficult one. I don’t like letting people down and I really like my attorneys so when I make a mistake I feel I let them down. Of course this is not the right thinking, I am, after all human, and am bound to make mistakes. However, letting them know you made a mistake is the most important step.

As of January 1, 2018, attorneys can now search on re:SearchTX for cases in which they are attorney of record. What is re:SearchTX? Managed by the Office of Court Administration (OCA) and hosted by Tyler Technologies, re:SearchTX is a secure web portal powered by the e-filing database that allows judges, attorneys, court clerks, and other registered users to access court records and documents across all state jurisdictions that support e-filing. This system might one day resemble the federal courts’ PACER system. The system was first launched for judges in June 2016. On February 21, 2017, the Texas Supreme Court approved recommendations from the Judicial Committee on Information Technology (JCIT) to grant access to clerks and attorneys. They had hoped to open up the site in late fall 2017, however, there were delays that caused the opening of the site to take longer than expected. Some court clerks across the State opposed re:SearchTX because they believed that counties should be able to decide whether to make court records available online. There were concerns about the additional requirements on clerks to manage the system, sensitive data that is contained in court documents, liability if a document is released in error, and the responsibility of manually redacting information or having to purchase redaction software. The Texas Legislature considered two bills last year aimed to defeat re:SearchTX. One of them, H.B. 1258, would give court clerks the authority to determine whether they will participate in re:SearchTX. The other, H.B. 1393, would give clerks the power to decide whether they would accept files electronically, or go back to accepting paper files. Neither one passed. A group of clerks volunteered to be pilot clerks to beta test the functionality of the system. That testing has been ongoing over the past several months. Today, re:SearchTX is currently in a gradual roll-out to clerks and attorneys across the state. Attorneys will be required to request access via the website and then click on the link sent to them in a confirmation email in order to activate their account. This is exciting news with more information to come regarding the latest developments of this long-awaited statewide database.

On November 9, 2017, SETAP President-Elect Danielle Williams and SETAP Public Relations Chair

Angie Laird were invited to Lamar State College in Port Arthur to speak to the paralegal students

pursuing their paralegal studies degree. Danielle and Angie gave an informal presentation about the paralegal profession, the various job opportunities available to them, and the real life experiences as a working paralegal. They also gave information regarding the different types of paralegal certifications that are available through the National Association of Legal Assistants (NALA), the National Federation of Paralegal Associations (NFPA), and the Texas Board of Legal Specialization (TBLS). They spoke about the importance of continuing education and networking, and how those opportunities are one of the many benefits as a member of SETAP. In addition, the students were encouraged to join the Paralegal Division of the State Bar of Texas (PD), and explained the many benefits of its membership. Several handouts were given to each student that included SETAP’s membership brochure and membership application, information on the NALA and TBLS certifications, the PD brochure on professional ethics, as well as other handouts. The presentation was very successful and it was an honor to be invited once again. The class instructor and director of the paralegal studies program, Doneane Beckcom has invited SETAP to come back each semester to speak to her students. We look forward to future visits. SETAP strives to continue its mission in establishing good fellowship among members of the legal community, encouraging a high order of ethical and professional attainment, and furthering education among members of the profession.

The Jefferson County Bar Association held it’s free legal advice

clinic for veterans and spouses of deceased veterans on December

2, 2017 at Rogers Park Community Center in Beaumont, Texas.

SETAP volunteers in attendance were Cheryl Bryan, Tara Hickey,

and Mary Beth Jones. As always, the clinic was a great success.

Thank you to the JCBA, attorneys, and paralegals for volunteering

your valuable time to help our area veterans.

Proclamation of the

Texas Day of Civility

April 20, 2018

In conjunction with the State Bar of Texas, we, the Supreme Court of Texas and the Court of Criminal

Appeals of Texas, proclaim April 20, 2018, as The Texas Day of Civility in the Law.

On that day, we urge all lawyers to participate in programs at bar associations around the State of

Texas that will commemorate and focus upon the spirit and aspirations set forth in the Texas Lawyer’s Creed.

Further, we urge all lawyers always to conduct themselves with the utmost courtesy and

professionalism toward judges, adversaries, peers, workplace colleagues and in performing their duties to

their clients, and with the highest degree of civility toward other counsel and their clients.

The Texas Lawyer’s Creed was adopted by the Supreme Court of Texas and the Court of Criminal

Appeals of Texas by order of November 7, 1989, reaffirmed on March 26, 2013, and amendments were

approved through February 1, 2016. In our Order adopting the Creed, we reminded lawyers of the importance

that they perform all their duties in an ethical, professional, and civil manner, when we said in part:

The conduct of a lawyer should be characterized at all times by honestly, candor, and fairness.

In fulfilling his or her primary duty to a client, a lawyer must be ever mindful of the profession's

broader duty to the legal system.

Civility is at the heart of the Texas Lawyer’s Creed and is the hallmark of a professional. That term

"civility" was adroitly described by Justice Anthony Kennedy of the United States Supreme Court in these

words:

[Civility . . .] is not some bumber-sticker slogan, "Have you hugged your adversary today?" Ci-

vility is the mark of an accomplished and superb professional, but it is even more than this. It is

an end to itself. Civility has deep roots in the idea of respect for that individual.

We urge all lawyers to act with civility to preserve our system of justice and to embrace the principles es-

poused by the Texas Lawyer’s Creed as they vigorously represent their clients.
