The L S operated computer databases tha t among other4 th ings t racked the loca t ion of i nma te s hou sed in the Los5 Angeles County J a i l s arid sh are d th e loca t ion of those inmates6 with law enforcement agencies , inc luding fede ra l law enforcement7 agencies the LASD computer databases ) 8 3. Federal grand ju r i es i n ve s ti g at ed a l leg a ti o n s of9 vio la t ions of federal cr iminal law in sec r e t proceedings .

    10 Federal grand jur ies i ssued grand jury subpoenas to o bta in11 documen ts and tes t imony from witnesses.12 4. The Federal Bureau of Inves t iga t ion FBI ) was a13 f edera l law enforcement agency t h a t inves t iga ted al legat ions of14 vio la t ions of f edera l cr iminal laws, inc luding those al leged ly15 committed by employees of loca l law enforcement agencies such as16 the LASD Some of these inves t iga t ions included al legat ions of:17 a) c i v i l r igh t s abuses, such as deput ies u sin g e xc ess iv e fo rc e18 on inmates in j a i l s ; and b) p ub lic c or ru p ti on o ff en se s such as19 deput i e s smuggling contraband in to j a i l s in exchange fo r br ibes .20 The FBI often conducted inves t iga t ions in a covert manner so21 t h a t th e subjects of the inves t iga t ions would be unaware of the22 ex i s t ence manner, and ex ten t of the invest igat ions.23 Addi t ional ly the FBI of ten acted as an arm of fede ra l grand24 jur ies by, among other t h ings serving grand ju ry subpoenas,25 obta in ing evidence to be presented to the grand j u ry and26 in terviewing witnesses to a lle ge d crimes being inves t iga ted by27 the grand j u ry .

Federal grand j u r i e s ob tain ed th e testim ony o f inmates2 held in lo ca l j a i l s through wri t s of Habeas Corpu s, whi ch were3 fe de ra l c ou rt orders s igned by federal d i s t r i c t cour t judges.4 6. The United Sta tes Marshals Service USMS ) was a5 federal law enforcement agency tha t among other dut i e s he lped6 federal grand j u r i e s obtain the testimony of inmates located a t7 l o ca l j a i l s The USMS served Writs of Habeas Corpus on en t i t i e s8 operat ing loca l j a i l s i nc lu d ing t he L SD and ar ranged fo r the9 t ranspor ta t ion of inmates scheduled to t e s t i f y before fede ra l

Defendant GREGORY THOMPSON THOMPSON ) was an L SD12 l i eu tenan t who oversaw i t s Operation Safe J a i l s Program an d i t s13 Ja i l Inves t iga t ions Unit, which was ta sk ed w ith conducting14 invest igat ions w ith in th e Los Angeles County Ja i l s15 8. Defendants GER RD SMITH ( SMITH ), MICKEY M NZO16 MANZO ), and J MES SEXTON SEXTON ) were L SD deput ies17 assigned to th e Operation Safe J a i l s Program.18 9. Defendant STEPHEN LEAVINS LEAVINS ) was an L SD19 l i eu tenan t within i t s In te rna l Criminal Invest igat ions Bureau,20 which was tasked with i n v es t ig a t in g a l le g a ti o n s of loca l crimes2i commi tte d by the LASD s personnel .22 10. Defendants SCOTT CR IG CRAIG ) and M RICELL LONG23 LONG ) were L SD s er ge a nt s w i th in the In te rna l Criminal24 Inves t iga t ions Bureau.25 11. Inmate B was an inmate in the custody of the L SD a t26 the MCJ who was a cooperat ing witness in the inves t iga t ion of27 a ll eg ed f ed e ra l c i v i l r igh t s an d publ ic corrupt ion violat ions28 commit ted and being committed by employees of the L SD working

The inves t iga t ion concerned2 the al leged use of excess ive force by L SD deput ies aga ins t3 inmates within the MCJ and TTCF and the al leged smuggling of4 contraband by L SD deput ies in to the MCJ and TTCF in exchange5 fo r b rib es (the Federal I nv es ti ga tio n . S p ec if ic al ly , Inmate6 B was ass i s t i ng in a c ov er t p ub li c c or ru p ti on inves t iga t ion of7 L SD Deputy Gi lbe r t Michel ( Deputy Michel )r who worked a t the8 MCJ Addi t ional ly , Inmate B was prov iding in fo rmat ion about9 a ll eg e d f ed e ra l c iv i l r igh t s offenses being committed by

    10 employees of the L SD working a t the MCJ who were al leged ly11 abu si ng i nma te s.12 12. Specia l Agent LM and Special Agent DL were Specia l13 Agents w ith the FBI. Specia l Agent LM and Specia l Agent DL were14 among the FBI agents par t i c ipa t ing in the Federal Invest igat ion.15 13. As pa r t of the Federal Inves t iga t ion , the FBI16 conducted an undercover operat ion to determine whether Deputy17 Miche l wou ld accept a br ibe to provide Inmate B with a ce l lu l a r18 phone. In o r about l a t e July 2011, Deputy Michel accepted a19 br ibe and provided Inmate B with a ce l lu l a r phone. On o r about20 August 8, 2011, the L SD discovered tha t Inmate B had in Inmate21 AB s possession the ce l lu l a r phone t h a t Deputy M ic he l had22 smuggled in to the MCJ in re tu rn fo r a br ibe.23 14. By no l a t e r than in or about August 2011, defendants24 THOMPSON LEAVINS SMITH M NZO SEXTON CRAIG and LONG were25 aware t h a t the FBI and a f edera l grand jury were conducting an26 inves t iga t ion of the LASD s employees within the Los Angeles27 County J a i l s and tha t Inmate B was an informant ass i s t ing in28 the Federal Inves t iga t ion .

    4. Defendants LEAVINS SMITH CRAIG and LONG wouldconduct in te rv iews of Inmate and var ious employees of theL SD to at tempt to determine the manner and ex ten t of theFedera l Inves t iga t ion .

    5. Defendants LEAVINS CRAIG and LONG would a t tempt toconvince poten t i a l witnesses an d informants not to cooperatewi th the Federa l Inves t iga t ion inc lud ing by:

    a. Informing and suggest ing t o i nd iv id u al sinc lud ing Deputy Michel t h a t the FBI was and would b e ly ing tothem manipula t ing them blackmai l ing them and threateningthem; and

    b. Suggest ing to Inmate t h a t th e FBI hadabandoned him by informing Inmate t h a t the FBI had no t comeback fo r him.

On o r about August 18, 2011/ defendant THOMPSON4 ins t ruc ted an employee of the LASD to prohibi t outside law5 enforcement from meeting with Inmate AB6 2. On o r about August 23 / 2011, a f t e r learning tha t the7 FBI had interviewed Inmate AB a t the MCJ and tha t the LASD had8 te rminated the interview defendant LEAVINS informed Inmate AB9 t ha t he would be moved to a di f fe rent locat ion.

    10 3. On or about August 23 , 2011/ defendant THOMPSON asked11 a deputy assigned to the MCJ s medical ward whether there was an12 open ce l l toward the back of the medical ward.13 4. On o r about August 23 , 2011, defendants SMITH and14 MANZO moved Inmate AB to a ce l l in the MCJ/s medical ward.15 5. On o r about August 23 , 2011, defendants SMITH and16 MANZO stood guard outs ide of Inmate AB/s ce l l in the medical17wa;r-d.18 6. On o r about August 24, 2011, defendants THOMPSON19 SMITH an d MANZO held a meeting with LASD deput ies who were to20 be assigned to s tand guard outs ide of Inmate AB s c e l l a t a l l21 t imes.22 7. On or about August 24, 2011, defendant THOMPSON23 di rec ted LASD Deputy A to obtain Inmate AB s records jacket24 8. On o r about August 25/ 2011, defendant THOMPSON sent25 an email to LASD employees s ta tin g th at the FBI would need26 approval be fo r e i n te rvi ewing an y inmate in LASD custody.27 9. On o r about August 25/ 2011/ defendant THOMPSON caused28 LASD employees to use i n tim id a ti o n t o convince the LASD s

    10 had refused to provide h is s oc ia l se cu rity number and11 f i nge rp r in t s12 11. On o r about August 25 2011 defendants THOMPSON 13 LEAVINS SMITH and M NZO caused Inmate B to be moved from the14 MCJ to the LASD s San Dimas s ta t ion1516171819202122

    12. On or about August 26 2011 defendant THOMPSON causeda h ig h r an ki ng employee of the LASD s MCJ to i n s t ruc t MCJl i eu t enan t s and sergeants tha t :

    1 15. On o r about August 26 , 2011, defendant SEXTON stood2 guard outs ide of Inmate AB s c e l l a t the LASD s San Dimas3 s t a t ion4 16. In o r about la te August 2011, defendant SMITH to ld5 LASD Deputy A t ha t the FBI was on i t s way to take custody of6 Inmate AB and directed LASD Deputy A t o p hy si ca ll y stop the FBI7 from taking c us to dy o f Inmate AB8 17. On or about Augu st 30, 2011, defendants LEAVINS and9 CRAIG informed Deputy Michel tha t the FBI was manipulat ing,

    10 blackmailing, and threatening him in an attempt to convince11 Michel to be a witness in the Federal Inves t iga t ion12 18. On or about Sep tember 2 , 2011, defendants CRAIG and13 LONG caused the LASD to conduct survei l lance of Deputy Miche l to14 determine whether the FBI was following him.15 19. On o r about September 2, 2011, defendants THOMPSON16 SMITH and MANZO caused Inmate AB to be booked in the LASD17 computer databases under the name Chris Johnson and with18 f i c t i t i ous i nfo rma ti on , i ncl udi ng fa l se statements asser t ing19 t ha t Inmate AB refused to provide h is so cia l secur i ty number and2 f ingerpr in t s21 20. On o r about September 8, 2011, defendant CRAIG22 presented a proposed c ou rt o rd er to a aliforniaSuperior Court23 judge in Los Angeles County in an attempt to compel the FBI to24 disclose information re la ted to the Federal Invest igat ion25 21 .
