OWNERS OR OCCUPIERS IN THE SHIRE OF LAKE GRACE
This Notice is a legal document, issued under section 33 of the Bush Fire Act 1954, and the mitigation measures stipulated in the Notice are required by law.
You are required to prepare your property for the fire season. This includes installing and maintaining firebreaks and reducing fuel loads on your property. The specific requirements are contained in this Notice. Penalties of up to $5,000 may be issued if you do not take the necessary steps to prepare your property.

Notice to all Owners and Occupiers of Land in the Shire of Lake Grace.
Pursuant to the powers contained in section 33 of the above Act, you are hereby required on or before the first day of
November up to and including the 30th day of April the following year, to have a firebreak clear of all inflammable
material in accordance with the following: (i) Rural Land
1. a) Immediately inside all external boundaries of the propertyor as is practicable, firebreaks of not less than 3 metres
wide and; b) Where buildings, haystacks, fuel ramps, fuel tanks and
stored fuel drums are situated on land, firebreaks of not
less than 2.5 metres wide within 33.5 metres of the
perimeter of such buildings, haystacks, fuel ramps, fuel
tanks and stored fuel drums in such manner as to
completely encircle the buildings, haystacks, fuel ramps,
fuel tanks and stored fuel drums and;
2. Where land is in crop and adjoins the railway line reserve a
firebreak of not less than 3 metres wide encircling the crop and;
3. a) Immediately surrounding an aerial landing ground situated on
the land a firebreak of not less than 6 metres wide and;
b) Any aerial landing ground used as the motor start up,
refueling and maintenance area to be completely cleared of all
inflammable materials for a radius of 18 metres and;
4. Maintain clear of all inflammable materials all townsite blocksand;
5. Where bush or land has been bulldozed, chained or prepared in

any similar manner for clearing by burning (whether intended to
burn the bush or not), provide a firebreak of NOT LESS
THAN 13 METRES WIDE inside the external boundaries of
the land so prepared. If you become owner or occupier of
land after the first day of November, the requirements of this
notice are varied so as to require you to comply with the
terms of this notice within fourteen days of the date of your

this notice are to be maintained clear of inflammable
materials up to and including the 30th day of April.
6. A readily mobile operational firefighting unit containing a
minimum of 600 litres of water on standby and available for
inspection is required during the period 1 November to 30 April.
(ii) Townland
1. Where the area of the land is 0.202 hectares (half an acre) or
less all inflammable material on the land shall be removed

7. s46. Bush fire control Officer or forest officer may postpone lightingfire. (1A) Notwithstanding and other provision of this Act-
(a) subject to subsection (1b) a bush fire control officer, or thelocal government in which district the land is situated mayprohibit, or from time to time postpone the lighting of a fire,where in his opinion the fire, if lit, would be or become asource of danger by escaping from the land on which it isproposed to be lit;
(b) where a fire is burning on land and the bush fire control officeror the local government as the case may be is of the opinionthat the fire is in danger of escaping from that land, he or it maydirect that all reasonable steps be taken by the owner oroccupier of the land to extinguish the fire or to prevent the fire fromspreading.

A section 46 of the Bush Fires Act 1954 can be imposed any time of the year.
Dress to Protect
Minimum dress requirements when firefighting are a long sleeved cotton
shirt, long cotton trousers or cotton overalls, boots & leather gloves.
PLANTATIONS
The Shire of Lake Grace has adopted the Guidelines for Plantation
Fire Protection developed by the Department of Fire &
Emergency Services which establish the minimum fire break
and fire equipment standards, subject to the following
provisions:
Plantations: any area of planted trees for commercial
purposes exceeding 3 hectares within townsites or exceeding
10 hectares in rural area.
Boundary Fire Breaks (15 metres): a 15 metre firebreak is
required on all boundaries of plantations. 8 metres must be
clear of all inflammable material on the ground and will have an
8 metre vertical clearance. The remaining 7 metres must be
maintained in a low fuel condition (i.e. closely mown,
grazed or sprayed).
Compartment Fire Breaks: in accordance with Guideline
standards subject to fire break being clear of all inflammable
material.
Vehicle Access: all fire breaks to be maintained in a trafficable
condition strictly in accordance with the Guidelines.
Fire Equipment Standards: where no brigade firefighting
equipment or community based plantation fire equipment is
located in a brigade area, plantation growers are required to
provide the minimum equipment levels in accordance with the
Plantation Fire Protection Guidelines.
A copy of the Guidelines for Plantation Fire Protection can be
obtained by contacting the Department of Fire & Emergency
Services (DFES) or the Shire Office during normal office
hours.
PLANTATIONS
GENERAL INFORMATION
If it is considered to be impracticable for any reason to clear
firebreaks or to remove inflammable material from land or any
other provisions required by this notice you may apply to the
Council or its duly authorised officer no later than 31 October, for
permission to provide firebreaks in alternative positions or to take
alternative action to abate fire hazards on the land. If permission is
granted by Council or its duly authorised officer, you shall comply
with the requirements of this notice.
“Inflammable Material” is defined for the purpose of this Order to
include bush (as defined in the Bush Fires Act), timber, boxes,
cartons, paper and like inflammable materials, rubbish and also
any combustible matter, but does not include green standing trees
or growing bushes and plants in gardens, or lawns.
The penalty for failing to comply with this notice is a penalty of not
more than $5,000 or a fine of $250 may be incurred by issue of an
infringement notice, and a person in default is also liable, whether
prosecuted or not, to pay the cost of performing the work directed
in this notice if it is not carried out by the owner or occupier before
the date required by this notice. If the requirements of this notice are
carried out by burning, such burning must be in accordance with the
relevant provision of the Bush Fires Act. A permit to burn is
required during the restricted burning period from an authorised
officer. Permits are not valid on Public Holidays. Burning on
Sundays is permitted, with a valid permit, during the Restricted
Burning Time.
IMPORTANT DATES TO REMEMBER & GENERAL INFORMATION
2. PERMITTED ACTIVITIES
The following activities are permitted provided these comply with
specified conditions.
1) Water carting for stock and domestic purposes provided it is
accompanied by a mobile fire-fighting unit or, alternatively, the
water carting vehicle acts as the mobile fire-fighting unit and meets
minimum specifications (this also requires the retention of 400
litres of water at all times).
2) All necessary travel to and from and within piggeries, sheep or
cattle feed lots, provided this is undertaken with a mobile fire-
fighting unit in attendance.
3) All necessary carting of livestock, provided that such a
vehicle is accompanied by a mobile fire-fighting unit.
4) Activities which received specific exemptions from Council or Chief
Bush Fire Control Officer.
3. CHRISTMAS DAY
A Harvest Ban and a ban on the movement of all vehicles and
machines and the operation of internal and combustion engines is
imposed on Christmas Day each year.
All other activities or operations may only be undertaken during Total
Vehicle and Machinery Movement Bans and Bans on the Operation of
Internal Combustion Engines after approval has been granted by
Council. Approval has to be sought on an individual basis. Approval
may be subject to specified conditions. It should be noted that approval
may not be granted.
Total Fire Ban (TFB)
Total Fire Bans are imposed by DFES. Information line 1800 709 355 or

the delivery and removal of farm produce when harvest and vehicle
movement bans are imposed by the Shire of Lake Grace.
1. DEFINITIONS
The following definitions shall apply to the guidelines on the ban of
vehicle and machinery movement and the operation of internal
combustion engines under Regulation 38A and 38B of the Bush Fires
Act.
Laneway/Roadway (non gazetted)
A laneway/roadway is defined as having a trafficable surface, free of all
inflammable material, a minimum of four metres wide. Overhanging
vegetation has to be pruned back so as to not come into contact with
parts of a vehicle.
Mobile Fire Fighting Unit
A mobile fire fighting unit is defined as having a minimum water carrying
capacity of six hundred (600) litres, fitted with a minimum of twenty
(20) metres of nineteen (19) millimetre diameter fire fighting hose and
pump capable of delivering water through an adjustable nozzle in the
spray and jet configurations.
Harvest Ban
A ban on the operation of all grain harvesting machines within the Shire
or part of the Shire and during a time, as specified in a notice or
broadcast (Reg 38A).
A Ban on the Movement of all Vehicles and Machinery and the Operation of Internal Combustion Engines
A ban on the movement of all vehicles and machinery and the operation
of internal combustion engines within the Shire or part of the Shire and
during a time as specified in a notice or broadcast (Reg 38A & 38B)
with the exception of the movement of vehicles and machinery on
constructed and gazetted roads and laneways.

THAN 13 METRES WIDE inside the external boundaries ofthe land so prepared. If you become owner or occupier of
land after the first day of November, the requirements of thisnotice are varied so as to require you to comply with the
terms of this notice within fourteen days of the date of yourbecoming owner or occupier of such land, instead of on or
before the first day of November. The firebreaks required bythis notice are to be maintained clear of inflammable
materials up to and including the 30th day of April.6. A readily mobile operational firefighting unit containing a
minimum of 400 litres of water on standby and available forinspection is required during the period 1 November to 30 April.
(ii) Townland
1. Where the area of the land is 0.202 hectares (half an acre) or
less all inflammable material on the land shall be removed
from the whole of the land; and2. Where the land exceeds 0.202 hectares (half an acre) in
area, firebreaks at least 2 metres wide shall be cleared ofall inflammable material immediately inside all external
boundaries of the land and also immediately surrounding allbuildings situated on the land.

Notice to all Owners and Occupiers of Landin the Shire of Lake Grace.
Pursuant to the powers contained in section 33 of the aboveAct, you are hereby required on or before the first day of
November up to and including the 30th day of April thefollowing year, to have a firebreak clear of all inflammable
material in accordance with the following:(i) Rural Land
1. a) Immediately inside all external boundaries of the propertyor as is practicable, firebreaks of not less than 3 metres
wide and;b) Where buildings, haystacks, fuel ramps, fuel tanks and
stored fuel drums are situated on land, firebreaks of notless than 2.5 metres wide within 33.5 metres of the
perimeter of such buildings, haystacks, fuel ramps, fuel t
anks and stored fuel drums in such manner as tocompletely encircle the buildings, haystacks, fuel ramps,
fuel tanks and stored fuel drums and;2. Where land is in crop and adjoins the railway line reserve a
firebreak of not less than 3 metres wide encircling the crop and;3. a) Immediately surrounding an aerial landing ground situated on
the land a firebreak of not less than 6 metres wide and;b) Any aerial landing ground used as the motor start up,
refueling and maintenance area to be completely cleared of allinflammable materials for a radius of 18 metres and;
4. Maintain clear of all inflammable materials all townsite blocksand;
5. 5. Where bush or land has been bulldozed, chained or prepared inany similar manner for clearing by burning (whether intended to

OWNERS OR OCCUPIERS IN THE SHIRE OF LAKE GRACE
This Notice is a legal document, issued under section 33 of theBush Fire Act 1954, and the mitigation measures stipulated in theNotice are required by law.
You are required to prepare your property for the fire season. This includes installing and maintaining firebreaks and reducing fuelloads on your property. The specific requirements are contained in thisNotice. Penalties of up to $5,000 may be issued if you do not take the necessary steps to prepare your property.
