Status of compliance of the terms and conditions given in the Environmental clearance letter No.J-11015/217/2007-IA.II (M) dt.02.08.2010 issued by MOEF, Govt. of India New Delhi for Khas Mahal Opencast Project (0.60 MTPA with a peak production of 1.5 MTPA in 318.71 ha project area) for the period from April’2014 to September’2014’ A.SPECIFIC CONDITONS:

(i) Mining shall be carried out as per statute from the streams/nallahs flowing within the lease and along the diverted nallah along the lease boundary. No OB/topsoil shall be dumped along the side of the river/nallah. Approval of the flood and irrigation dept shall also be taken for continuation of mining operations

Mining is presently being carried out at about 1000 m from Godo nallah which is more than the statutory norms. There is no diversion of nallah along the lease boundary. No OB/topsoil is being dumped along the side of the river/nallah.

(ii) No washery shall be established within the ML without prior environmental clearance from the Ministry.

No washery is proposed in the ML area of project.

(iii) Top soil shall be stacked properly with proper slope at earmarked site(s) and shall not be kept active and shall be used for reclamation and development of green belt.

The present bench of OB contains highly degraded (morrum) material. However it is spread over backfilled area for biological reclamation.

(iv) OB shall be stacked at earmarked one external OB dump site of 99.16 ha in Konar OCP ML area shall be a max height of 75m. A slope stability study shall be undertaken to increase the dump height and the report furnished to the ministry for increasing dump height beyond 75m. The ultimate slope of the dump shall not exceed 280. Monitoring and management of reclaimed existing dump site shall continue until the vegetation becomes self-sustaining. Compliance status shall be submitted to the Ministry of Environment & Forest and its Regional Office located at Bhubaneshwar on yearly basis.

Presently no overburden is dumped externally. All overburden is used for backfilling in the mine. Till date the total area of backfilled dump is 60 Ha. Out of 60 Ha of backfilled area 30.94 Ha has been afforested by State Forest Department.

(v) Catch drains and siltation ponds of appropriate size shall be constructed to arrest silt and sediment flows from soil, OB and mineral dumps. The water so collected shall be utilized for watering the mine area, roads, green belt development etc. The drain shall be regularly desilted and maintained properly.

All mine water is collected to the mine sump acting as siltation pond. The present volume of mine sump is 40000 cubic metre. The water is used for sprinkling on roads & mining areas.

Garland drains (size, gradient and length) and sump capacity shall be designed keeping 50% safety margin over and above the peak sudden rain fall and maximum discharge in the area adjoining the mine site. Sump capacity shall also provide adequate retention period to allow proper settling of silt material.

All mine water is collected to the mine sump acting as siltation pond. The present volume of mine sump is 40000 cubic metre. The water is used for sprinkling on roads & mining areas.

The sump capacity is designed as per peak rainfall and is sufficient for safe operation of mine.

(vii) Dimension of the retaining wall at the toe of the dumps and OB benches within the mine to check run-off and siltation shall be based on the rainfall data.

Toe wall of dimension 1000m X 0.5 m X 1.0m constructed.

(viii) Mineral transportation from mine by road shall use trucks of a minimum capacity of 20 T. All internal roads shall be metal topped. A 3-tier Green belt shall be developed on both sides of the roads.

Internal coal transportation is by dumpers from face to coal stock yard. From coal stockyard, coal is being transported by covered trucks to different consumers like DVC BTPS and railway siding. The road to siding and BTPS is black topped. Plantation along road has been done.

(ix) High efficiency water sprinkling system provided to check fugitive emissions at the transfer points, haulage roads etc. shall be provided for crushing/loading operations for dust control at the CHP.

02 numbers of mobile water sprinklers of capacity 28 kl and 12 kl is deployed in the mine.

(x) Drill shall be wet operated only. There are 02 nos of drills and these are fitted with wet drilling arrangement.

(xi) Controlled blasting shall be practiced with use of delay detonators. The mitigative measures for control of ground vibrations and to arrest the fly rocks and boulders shall be implemented.

Nonels of different sizes and CED are used for controlled blasting. All steps suggested for mitigative measures for control of ground vibrations and to arrest the fly rocks and boulders are being implemented.

The total area that shall be brought out under a forestation at the time of mining closure shall include reclaimed external OB dump (99.16 ha), back filled area (145.36 ha) along ML boundary, embankment, safety zone (25.18ha) and undisturbed area, along roads and infrastructure, green belt (58.39 ha) and in township outside the lease by planting native species from the 70 species found in the original ecosystem during pre-mining phase in consultation with the DFO/Agriculture Department. The density of the trees shall be around 2500 plants per ha.

Plantation is being done on regular basis. Year wise plantation is given below; 1) Old plantation 3 Hac. 5300 nos. 2) 2006-07 – 27.24 Hac. (60500 nos.) 3) 2012-13- 3.7 Hac Out of 65 Ha of backfilled area 30.94 Ha has been afforested by State Forest Department. The density of the trees is 2500 plants per Ha. The major species are Chakundi, Bamboo, Siris, Aonla,Shisham, Kaju, Khair, Bakain, Ber, Bel, Karanj, Jamun, Neem, etc.

(xiii) A progressive mine closure plan shall be implemented by reclamation of quarry area of 145.36 ha which shall be backfield and brought to 20m above ground level and afforested by planting native plant species in consultation with the local DFO/Agriculture Department. The density of the trees shall be around 2500 plants per ha.

A mine closure plan has been prepared and approved at a cost of Rs 2269 lakh. Out of 65 Ha of backfilled area 30.94 Ha has been afforested by State Forest Department.

(xiv) No ground water (bore well) shall be used for mining operations and any additional water requirement during mining operations shall be met from mine sump water. Rain water harvesting structures shall be erected within and around the ML including check dams for recharge of ground water in case the water table shows the declining trend.

No ground water (bore well) is used for mining operations. At present mine sump of 40000 cubic metre capacity is used for sprinkling on roads & mining areas.

(xv) Regular monitoring of ground water level and quality shall be carried out by establishing a network of existing wells and construction of new peizometers. The monitoring for quality shall be done four times in a year in pre-monsoon (May), monsoon (August), post-monsoon (November) and winter (January) seasons and for quality in May. Data thus collected shall be submitted to the Ministry of Environement & Forest and to the Central Pollution Control Board quarterly within one month of monitoring.

Regular monitoring of ground water quality will be started soon.

(xvi) The Project authority shall meet water requirement of nearby village(s) in case in the village wells go dry due to dewatering mine.

The mine water will be discharged to nearby villages if needed.

(xvii) Sewage treatment plant of adequate capacity shall be installed in the colony. ETP shall also be provided for workshop and CHP wastewater. Treated wastewater meeting prescribed norms only shall be permitted to be discharged into the natural water course.

New workshop is under construction in which ETP is proposed. Washing platform has been constructed in the new workshop. Sump / lagoon discharge quality report for quarter ending September 2014 attached.

(xviii) Besides carrying out regular periodical health checkup of their workers, 10% of the workers identified from workforce engaged in active mining operations shall be subjected to health check-up for occupational diseases and hearing impairment, if any, through an agency such as NIOH, Ahmedabad within a period of one year and the result reported to this Ministry and to DGMS.

Periodical Medical Examination is being done regularly at area regional hospital as per requirement of Mines Rules 1955. Year Target Achievement 2012: 148 152 2013 110 110 2014 123 144 No occupational diseases reported.

(xix) A detailed CSR plan shall also be prepared for and in consultation with local communities; CSR should be for a minimal Rs. 5/tone of coal produced annually which is to be adjusted for the depreciation in the value of rupee over the life of the project. The activities under taken for the specific villages adopted under CSR should be displayed on the company website and updated at least once a year.

CSR details uploaded in company’s website. Budget for CSR activities has been allocated for B&K Area (administrative area) is approximately Rs. 2.00 Crore for financial year 2014-15. About Rs. 3.00 Crore expenditure has been incurred on CSR activities by B&K area during last three financial years

(xx) For monitoring land use pattern and for post mining land use, a time series of land use maps based on satellite imagery (on a scale of 1:5000) of the core zone and buffer zone from the start be prepared once in 3 years (for any one particulars season which is consistent on the time series) and the report submitted to MOEF and its Regional Office at Bhubaneswar.

The remote sensing study was carried out in the year 2011.

(xxi) A final mine closure plan along with details of Corpus Fund shall be submitted to the Ministry of Environment & Forest 5 years in advance of final mine closure for approval.

Agreed. A mine closure plan has been prepared and approved at a cost of Rs 2269 lakh.

(xxii) A minimum Rs.206.38 lakhs earmarked for capital costs shall be utilized for environmental pollution control measures and an annual recurring budget for environmental measures shall be provided till end of mine life and the details of expenditure thereon shall be furnished as part of the monitoring report submitted to MOEF RO, Bhubaneswar. The details shall also be uploaded on the company website.

The revenue expenditure for 2013-14 1. Rs.75000.00 (statutory fee) 2. Rs. 5.07 Lacs (approx) for water sprinkling / dust control. 3. Rs 2.17 lakh for Environmental monitoring.

B.GENERAL CONDTIONS:

(i) No change in technology and scope of working shall be made without prior approval of the Ministry of Environment & Forests.

(iii) Four ambient air quality monitoring station shall be established in the core zone as well as in the buffer zone for monitoring PM10, PM 2.5, SO2, NOx. Location of the stations shall be decided based on the meteorological date, topographical features and environmentally and ecologically sensitive targets in consultation with the State Pollution Control Board. Monitoring of heavy metal such as Hg, As, Ni,

Cd, Cr, in particulates shall be carried out at-least once in six months.

Air quality monitoring station has been established at Rest House, PO office, Barwabera Village and Lodhar Bera village for monitoring SPM, RPM, SO2, NOx. The results of monitoring report are given below;

(iv) Data on ambient air quality (PM10, PM 2.5, SO2 and NOx and heavy metal such as Hg, As, Ni, Cr, etc.) and other monitoring data shall be regularly submitted to the Ministry including its Regional Office at Bhubaneswar and to the State Pollution Control Board and the Central Pollution Control Board once in six months. Random verification of samples through analysis from independent laboratories recognized under the EP Rules, 1986 shall be furnished as part of the compliance report.

Quarterly monitoring reports are regularly submitted on annual basis at JSPCB, Ranchi along with Environment Statement. These reports are also submitted along with half yearly compliance report.

(v) Adequate measures shall be taken for control of noise levels below 85 dBA in the work environment. Workers engaged in blasting and drilling operation, operation of HEMM etc. shall be provided with the plugs/muffs.

Adequate measures are being taken. Noise levels are regularly monitored and kept below 85 dBA . The results are appended below.

(vi) Industrial waste water (workshop and wastewater from the mine) shall be properly collected, and treated so as to confirm to the standards including for heavy metals before discharge prescribed under GSR 422(E) dated 19th May 1993 and 31st December 1993 or as amended from time to time. Oil and grease trap shall be installed before discharge of workshop effluents.

Workshop is under construction. Washing ramp constructed. Oil and grease trap shall be installed shortly. Mine water is collected in sump of 40000 cubic metre capacity and treated water is used by nearby village and industrial use. The water quality monitoring report for the period from Sept 2014 is attached , main parameters are summarized below,

(vii) Vehicular emissions shall be kept under control and regularly monitored. Vehicles used for transportation of mineral shall be covered with tarpaulins and optimally loaded.

(viii) Monitoring of Environmental quality parameters shall be carried out through establishment of adequate number and type of pollution monitoring and analysis equipment in consultation with the State Pollution Control Board and data got analyzed through a laboratory recognized under EP rules, 1986.

Monitoring of Environmental quality is done by CMPDI having recognized laboratory.

(ix) Personnel working in dusty areas shall wear protective respiratory devices and they shall also be provided with adequate training and information on safety and health aspects. Occupational health surveillance programme of the workers shall be undertaken periodically to observe any contractors due to exposure of dust and to take corrective measures, if needed.

(x) A separate environmental management cell with suitable qualified personnel shall be set up under the control of a senior Executive, who will report directly to the Head of the Company.

An Environment Management cell has been established in this project, headed by Project Officer, KMP OCP who is assisted by a team of following personnel. 1. Colliery Manager, KMP. 2. Project Engr(Excv),KMP. 3. Sr.Manager(M),KMP. 4. Area Env.Engr.(B&K).

(xi) The funds earmarked for environmental protection measures shall be kept in separate account and shall not be diverted for other purpose. Year-wise expenditure shall be reported to this Ministry and its Regional Office at Bhubaneswar.

(xii) The Project authority shall advertise at least in two local newspapers widely circulated around the project, one of which shall be in the vernacular language of the locally concerned within seven days of the clearance letter informing that the project has been accorded environment clearance and a copy of the clearance letter is available with the State Pollution Control Board and may also be seen at the website of the Ministry of Environment & Forests at http://envfor.nic.in.

Advertisement has been made in following newspapers. 1. Hindustan , dated 09/10/2010 (Dhanbad Edition).. 2. Prabhat Khabar, dated 09/10/2010. (Dhanbad Edition). A copy of EC has been sent to member Secretary, JSPCB . It is posted on company website.

(xiii) A copy of the Environmental clearance letter shall be marked to concerned Panchayat/Zila Parishad, Municipal corporation or Urban Local Body and Local NGO, if any, from whom any suggestion/representation has been received while processing the proposal. A copy of the clearance letter shall also be displayed at company’s website.

(xiv) A copy of clearance letter shall be displayed on the website of the concerned state pollution control board. The EC letter shall also be displayed at the Regional Office, District Industry centre and collector’s office/Tehsildar’s office for 30 days.

Copy of EC has been sent to JSPCB for further needful at their end.

(xv) The clearance letter shall be uploaded on the company’s website. The compliance status of the stipulated EC conditions shall also be uploaded by the project authorities in their website and updated at least once every six months so as to

(xvi) The project proponent shall submit six monthly reports on the status of compliance of the stipulated environmental clearance conditions (both in hard copy and in e mail) to the respective Regional Office of the MOEF, the respective Zonal offices of CPCB and the SPCB.

(xvii) The Regional office of this Ministry located at Bhubaneswar shall monitor compliance of the stipulated conditions. The project authorities shall extend full cooperation to the respective Regional Office by furnishing the requisite data/information/monitoring reports.

The Project authorities will extend full cooperation to Regional Office, MoEF.

(xviii) The environmental statement for each financial year ending 31st March in Form-V is mandated to be submitted by the project proponent to the concerned State Pollution Control Board as prescribed under the Environment (Protection) Rules, 1986, as amended subsequently, shall also be uploaded on the company’s website along with the status of compliance of EC conditions and shall be sent to the respective Regional Offices of the MOEF by e-mail.

The Environmental Statement for the Financial year 2013-2014 is submitted to Regional office of JSPCB. It is uploaded on company’s website.

3. The ministry or any other competent authority may stipulate any further condition for Environmental protection.

4. Failure to comply any of the conditions above may result win withdrawal of the clearance and attract the provisions of the Environment (protection) Act, 1986.

The above conditions will be enforced inter-alia, under the provisions of the water (prevention & control of pollution) Act, 1974, the Air (Prevention & control of pollution) Act, 1981, the Environment (protection) Act, 1986 and the public liability Insurance Act, 1991 along with their amendments and Rules. The proponent shall ensure to provide for the costs incurred for taking up remedial measures in cased of soil contamination, contamination of ground water and surface water, and occupational and other diseases due to the mining operations.
