Short title and commencement: . (I) This policy may b called "Small Hydro Power Polley, 2007" (Ii) This shall come into force on the date of its publication in the Official Gazette. 2. Definitions: Inthis poli cy, unless the context otherwise requires, CI) 'Policy' means the Smal l Hydro Power Policy, 2007, ( 2) 'SHP ' m ea ns S ma ll H yd ro P ro je ct s u p t o a n i ns ta ll ed c ap ac it y o f 25 M W. (3) 'MW' means MegaWatt. (4) 'Action Plan' means plan an method for small hydr o power generation in the st at e with the involve mentof variousstake holders of StateGovern ments/A gencies. ( 5) 'Capacity addition' means adding-u of further power generation through small hydro power projects. (6) 'Grid mode' means small hydro power projects injecting power into the grid. (7) 'Isolation mode' means the small hydro projects without grid connections. (8) 'Conventional hydro power projects' means hydro power projects above 25 MW. (9) 'Grid quality power' means power maintai ing reliability and stability of power supply as grid supply. (10) 'KW' means KiloWatt. (11) 'Hi gh Vol tage'meansvoltag e leve l as definedinAct/Rules. ( 12) 'Low Voltage' means the voltage at 415 volts and below. (13) 'Stand alo e' means small hydro projects without onnecting to main grid. (14) 'NGO' means Non-Government al Organizatiof'j. 27. MONITORING OFPROJECTS :

[ Part - I

The Government ofArunachal Pradesh shall have the righ t to monito r physica l and financ ial progressof the projects on monthly/quarterly/half yearly basis as felt necessary from time to time through aTechnica l Committee comprising of the Chief Eng ineer, Departmen t of Hydro Power Deve lopment

(DoHPD), the Chief Engineer, Department of Power (DOP), the Managing Director, Hydro PowerDevelopment of A runachal Pradesh Ltd. (HPDCAPL), the Director, APEDAand a member from theDistr ictAdministration ofthe concerned area and itwill be headed by the Secretary (Power and NCER),Government ofArunachal Pradesh.

28. GENERAL CONDITIONS:

(1) The developer sha ll be generally liable to pay all the statutory lev ies viz . royalty on forest products,river bed materials, dut ies and taxes unless specifically exempted under the incentives providedunder this policy.

(2) Allotment of a project to a developer does not automatica lly confe r him any te rrito rial rights onboth upstream and downstream sides of the project area.

(3) The developers shall facilitate using of tail race water for agriculturelhorticulturepurposewhereverit is found feasible and necessary. .

(4) The Sta te Government shall have thE: righ t to use the ta ilrace water for any other purpose inc ludingdevelopment of hydro projects on its own or allot to some other party.

(5) The developers shall make all necessary protective arrangements on upstream, downstreamand tail race areas of the projects site to avoid soil erosion and damage to properties.

(6) The developer shall pay an amount worked out at the rate of 1 (one) paise per unit of power soldduring every financial year to the State Government for raising local area development fund effectedby the project(s).

This Notification will take immediate effect.
