Smart Growth Ombudsman 2004-2005 Annual Report

Narrative Statement

Public Law 2004, Chapter 89, also known as the Smart Growth Law, established the position of Smart Growth Ombudsman. This law was enacted on July 9, 2004, and shortly thereafter, Governor James E. McGreevey appointed Susan Bass Levin, Commissioner of Community Affairs as the State’s first Smart Growth Ombudsman. On February 8, 2005, Acting Governor Richard J. Codey, appointed Patrick M. Gillespie to be the State’s second Smart Growth Ombudsman. This annual report details activities by both Commissioner Levin and Patrick Gillespie during the period following enactment, and ending July 1, 2005. Rule Review Process:

Public Law 2004, chapter 89 requires the Smart Growth Ombudsman to “review any new rules or regulations proposed by any State agency and determine whether the proposed rules or regulations, as they pertain to the smart growth areas, are consistent with the State Development and Redevelopment Plan (State Plan).” The law further states that “State agency” shall not include the Pinelands Commission, the Highlands Water Protection and Planning Council or the New Jersey Meadowlands Commission or any independent authority or commission. The law further precludes the Smart Growth Ombudsman from reviewing any rules or regulations that would pertain to the Highlands preservation area as defined by the Highlands Water Protection and Planning Act (N.J.S.A. 13:20-1 et seq.).

In addition to those restrictions, the Smart Growth Ombudsman has interpreted

the law to preclude the review of proposed rules that are; proposed re-adoptions of existing rules without amendment and notices of adoption of previously proposed rules. During the period of this annual report, the Office of Smart Growth Ombudsman received 364 rules for review from State Executive Branch Departments. Of these 364 rules, the Smart Growth Ombudsman determined that 53 were consistent with the goals and objectives of the State Plan. 289 rules were found not to have any impact on the achievement of smart growth as envisioned by the State Plan. There were 22 rules in which no determinations were made due to, the Department withdrawing them, or the rules were received in error. Appendix I provides a complete breakdown of the rules received and reviewed by the Smart Growth Ombudsman during this period.

Qualification/Registration of Professionals The Smart Growth Law, PL 2004, Chapter 89, requires the Smart Growth Ombudsman to report on the status of programs within the Department of Community Affairs (DCA), Department of Environmental Protection (DEP), and Department of Transportation (DOT), to qualify and register professionals who would then certify as complete expedited permits under the Smart Growth Ombudsman Law. On November 5, 2004, James E. McGreevey signed Executive Order 140, which established a rule making process for the Department of Community Affairs (DCA), the Department of Environmental Protection (DEP) and the Department of Transportation (DOT), to qualify and register professionals under terms of this order. Each affected Department published a rule pre-proposal in the New Jersey Register on December 20, 2004. Appendix II, includes a copy of Executive Order 140 and copies of the rule pre-proposals. The public comment period for these pre-proposals ended on March 21, 2005. Under the terms of Executive Order 140, the effective deadline for proposing rules to implement this portion of law is July 15, 2005. Permit Applications Executive Order 140 provided that “Until such time as the rules described in the preceding paragraph (Qualification/Registration of professionals) are adopted in accordance with the Administrative Procedures Act, no expedited permit, permit by rule, or general permit under Public Law 2004, Chapter 89 may be accepted for review by any division or department.” In accordance with this Executive Order, the Smart Growth Ombudsman has not accepted any permit applications in order to ensure compliance with the time frames set forth in Public Law 2004, Chapter 89. Streamlined Permit Process To date, given the extended rule-making calendar set forth in Executive Order 140, there have not been any permit mechanisms or permit processes streamlined for the Smart Growth areas, that would utilize a pre-qualification process for professionals. Efforts to identify other program areas suitable for streamlined permitting are ongoing.
