What is a Multiemployer Plan?• A plan of benefits created through collective bargaining

requiring contributions by one or more labor organizations and more than one employer to a trust fund (as few as 2, but as many as several thousand employers)

• Proliferated during and after WWII in response to wage and price controls

• Approximately 1350 multiemployer defined benefit plans, down from over 2200 in 1980 (attributable almost entirely to mergers)

• Cover approximately 10.4 million present and former employees and their surviving spouses in industries across the economy; an INCREASE from about 8.5 million in 1980

What is a Multiemployer Plan?• Traditionally provided modest but regular retirement

income to workers in industries characterized by highly mobile workforces who otherwise would never qualify under traditional rules

• Post-ERISA, plan funding rose gradually until plans reached full funding

• In 80s and 90s upward of 75% of all plans had to raise benefits in order to raise cost of plans to ensure contributions remained deductible to contributing employers due to overfunding

What is a Multiemployer Plan?• Subject to numerous federal employee labor and benefit laws:

– The Labor Management Relations Act of 1947 (Taft Hartley Act) requires plans to be operated by joint (labor-management) boards for the “sole and exclusive benefit” of plan participants

– Employee Retirement Income Security Act of 1974 imposed vesting and pre-funding requirements, created Pension Benefit Guaranty Corporation to act as the safety net for failed plans and codified common law fiduciary responsibility of trustees

– Multiemployer Pension Plans Amendments Act of 1980 created concept of withdrawal liability and implemented the PBGC multiemployer guaranty fund

– Pension Protection Act of 2006 – accelerated funding requirements in response to 2000 – 2002 recession; created certain status tests “zones” with specific rules for achieving funding targets

Shift from DB to DC• Trend over past 30 years• Dominant among Corporate plans as the Primary

Retirement vehicle– Driven by:

• Employers’ Desire to Shift Investment Risk• Vastly reduce administrative cost & complexity

• DC Typically supplemental for most multiemployer plans

• Since the objective of a DC plan is usually based on capital accumulation, not replacement income target – Complicates Retirement Planning– Eliminates Retirement altogether for most low to moderate

wage workers

Commission Process• 42 groups spanning the multiemployer community met

for approximately 18 months to arrive at a consensus on the course of action.

• Included labor and employer representatives, plan representatives, large employers and advocates from the building and construction, trucking, machinists, retail food, service, entertainment and mining industries

• All recommendations are voluntary and designed to provide additional tools to trustees to address their specific situations

• In concluding process the group unanimously agreed they had achieved consensus on its recommendations

In Case of Guaranty Fund Insolvency:• If depleted by a large insolvent fund:– Benefits paid by PBGC would be reduced to less than

10 percent of the guarantee level.– “In this scenario, a [35 year] retiree who once

received monthly benefit of $2,000 and whose benefit was reduced to $1,251 under the guarantee would see monthly income further reduced to less than $125, or less than $1,500 per year.”

authority, preservation of benefits– the backing of the PBGC by the “full faith and

credit” of the government–Neither bill received so much as a hearing in a

Democratically controlled Congress

Legislative Process and Status• Five Congressional hearings have been held to assess

the extent of the problem facing plans and the PBGC• Established likely insolvency of a small but significant

minority of plans and of the PBGC multiemployer fund itself in the foreseeable future (10 – 15 years)

• GAO and CBO reinforced the magnitude of the problem by citing projections that the failure of a major plan which depletes the guaranty fund’s assets will reduce benefits payable to available cash flow, taking maximum benefits from about $1,000 per month to less than $125 per month

continue to register their support with their elected Representatives and Senators

Protect Our Earned Pensions…Under a proposal being discussed in Congress, many retirees covered by these plans could see significant cuts to their benefits. The proposal, intended to save the distressed plans from insolvency, would change the law to allow severely underfunded plans to slash the benefits of people who are already retired and relying on their pensions. A pension earned by a lifetime of hard work would be reduced to an empty promise….

When It Comes to Pensions, Doing Nothing Is Not An OptionWe can help ourselves before it's too late if we are given the flexibility to find workable solutions tailored to each pension plan. Doing nothing will ensure future retirees will have nothing for retirement……Rather than categorically object to any proposal which challenges the status quo without offering a viable alternative proposal, our fellow AARP members would be better served by thoughtful consideration of a proposal which yields higher benefits for retirees than the current system will and does so without favoring one generation of pensioner at the expense of another.
